AN ORDINANCE AMENDING THE VILLAGE OF HOUNT PROSPECT
ZONING ORDINANCE RELATING TO PROPERTY PRONTING ON
ALGONQUIN ROAD AND DE?"lPSTEH STREE/I' 1,000 PBET EASrr
OF BDSSb; ROAD
WHEREAS, the Board of Appeals of the Village of Mount
Prospect, sitting as a Zoning~Commission at a public meeting duly
called find held according to law (Appeal No. 63-4 ),
considered the question of reclassifying the real estate herein-
after described from R-l to B-3
AND, WHEREAS, the President and Board of Trustees of the
village of Mount Prospect, having considered the recommendation of
said Zoning Board of Appeals, and having agreed with petitioner
herein that if the petitionerfs other requests for variation con-
cerning its right to enlarge by a butler building, its right to
permit storage and parking,. and its right to maintain a seven f00t
cyclone fence; as set forth in a letter addressed to the President
and Board of Trustees and signed by the Davey Wree Expert Company,
Inc. dated as received February 6, 1963, is not granted, that the
Pres ident and Board' will consent to a petition for disa.nn(3~ation;",
saidcoLlsGnt howeiVer shall ilbt extend beyond May 1, 1964,
find and believe that the highest and best use of said real estate
is that of B- 3
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Mount Prospect, Cook County,
Illinois:

Section 1. That an ordinance entitled "An ordinance
classifying, regulating and restricting the location of trades
and industries and the location of builQings designed for speci-
fied uses; regulating and limiting the height and bulk of build-
ings hereafter erected or altered, regulating and limiting the
intensity of the use of lot areas and regulating and determining
the area of yards, courts and other open spaces within. and sur-
rounding such bui.ldings; establishing the boundaries of districts
for the said purposes: and prescribing penalties for the violation
of its provisions," passed and approved December 4, 1923, and
amendments thereto, and known as Ordinance No. 52, as amended by
an ordinance known and~ited as the Zoning ordinance of Mount
Prospect, passed and approved May 2, 1944, and as subsequently
amended to date hereof, be amended by reclassifying the following
described real estate from R-l to B-3
(The legal description of said real estate is
attached hereto and incorporated herein by
reference as if here fully set out.)
Section 2. That said real estate as reclassified shall
be subject to all the limitations and conditions placed upon prop-
erties in the B-3 district ,
as defined in the ordinances aforementioned.
Section 3. That any person, firm or corporation who
violates, disobeys, omits, neglects or refuses to comply with or
who resists the enforcement of any of the provisions of this or-
dinance shall be fined not more than One Hundred ($lOO) Dollars
for each offense, and each day that a violation is permitted to
exist shall constitute a separate offense.
Section 4. That this ordinance shall be in full force
and effect from and after its passage, approval and publication,
according to law.

That part of the Southeast quarter of the Southeast quarter of
Section 15 and that part of the Northeast quarter of the North-
east quarter of Section 22, all in rrownship 41 North, Range 11
East of the Third Principal Meridian, lying South of the center
line of Old Algonquin Road and North of the South 5 acres of said
Northeast quarter of the Northeast quarter and East of a line 210
feet East of (measured at right angles to) and parallel with the
West line of said quarter-quarter Section lines and West of a line
395.14 feet East of (measured at right angles to) and parallel
with the West line of said quarter-quarter Section lines, Cook
county, Illinois.
