HomeMy WebLinkAboutOrd 928 08/06/1963 ORDINANCE NO. 928 AN ORDINANCE ESTABLISHING A BOARD OF HEALTH AND THE OFFICES OF HEALTH OFFICER AND HEALTH INSPECTOR AND PRESCRIBING DUTIES AND FUNCTIONS OF SAME AND REPEALING CERTAIN PROVISIONS OF THE MOUNT PROSPECT CODE. NOW, THEREFORE, BE IT ORDAINED by the President and !Board of Trustees of the Village of Mount Prospect, Cook County, !Iliinois. SECTION 1. That Article I, Chapter 5 of the Mount Prospect ICode is hereby amended to read as follows: I ! ! "ARTICLE I. BOARD OF HEALTH ! i Section 5.101 Creation-ap~ointment. There is hereby Icreated the Board of Health of the illage. Said Board to be icomposed of five members, each of whom shall be appointed by the IIPresident with the consent of the Board of Trustees. The term of Isaid member shall be five years, except that the first person II appointed shall have a term of one year, the second person two ,!years, the third person three years, the fourth person four years. 'I Section 5.102 Compensation and Meetings. The members lof said board shall serve wIthout compensation and shall elect from lits membership a Chairman who shall serve as such for a term of one Iyear. The Health Inspector shall serve as the permanent secretary of said Board. The Board of Health shall meet regularily not less Ithan once every two months except for emergency meetings. Such Ilemergency meetings may be called by the Chairman or at the written II request of any two members fi led with the secretary. II Section 5.103 Iuorum. A maj ori ty of the members of !the Board of Health sha1 constitute a quorum. ! Section 5.104 Powers and Duties of the Board of Health. ! liThe Purpose of the Board of Health shall be to act in an advisory i \,capacity to the Board of Trustees in proposing rules and regulations Ito promote the general sanitary conditions and health of the peoplei liof the Village. The Board of Health shall have authority to propose Ilsuch reasonable rules, regulations, minimum standards and ordinance~, I! and recommend such sanitary inspections and investigations as it mar II from time to time deem necessary for the preservation and improve- i iment of the public health and for the suppression of disease. All! ilsuch rules, regulations, minimum standards and orders as approved 'iby the Village Board of Trustees shall be published in full and 'made available for public inspection and distribution. Section 5.105 Duties of the Secretar of the Board of !Health. It shall be the uty 0 t e ecretary to eep a wrItten , record of all meetings of the Board and of all ordinances proposed,! which shall be a public record and shall be kept on file in the 'office of the Board of Health available for public inspection." SECTION 2. That Chapter 4 of the Municipal Code of Mount Prospect be and is hereby amended by adding thereto the following: "ARTICLE XI. HEALTH OFFICER Section 4.1101 Creation ualifications Compensation. There is here y create t e 0 Ice 0 Hea t 0 ficer The Health Officer shall be a licensed physician and qualified to practice in the State of Illinois, who is a resident of or who practices in the Village. He shall be appointed by the President with the approval and consent of the Board of Trustees for a term of five years. The Health Officer shall serve as a technical advisor for the Board of Health and shall also serve as a member of the Board of Health. He shall supply information Ito the best of his ability on medical matters for the Board of Health or the Health Inspector. The Health Officer shall receive IsuCh compensation as m ay be allowed him from time to time by the President and Board of Trustees." II SECTION 3. That Chapter 4 of the Municipal Code of the IVillage of Mount Prospect is hereby amended by adding thereto qthe following: I "ARTICLE XII. HEALTH INSPECTOR Section 4.1201 Creation, Term, Compensation. The office of Health Inspector is hereby established. He shall be appointed by the President with the approval and consent of the Board of Trustees. His term of office shall be for an indefinite period of time. He shall be subject to the supervision and control of the Village Manager. He shall receive such compensa- tion as is approved by the President and Board of Trustees. Section 4.1202 Duties. It shall be the duty of the Health Inspector to enforce all rules, regulations and orders of the Illinois and Cook County Departments of Public Health and the Ordinances of the Village in relation to matters pertainin to the preservation of public health within the Village and he shall: a. Execute and enforce all ordinances of the Village relating to public health and sanitation. b. Issue such orders as may be necessary to carry out the rules proposed by the Board of Health and approved by the President and Board of Trustees. c. Execute and enforce all ordinances of the Village relating to the health standards maintained in every place of business in the Village where services of a personal nature are furnished to the public or where foods, food products, milk, milk products and beverages of every nature and description I, whatsoever are either handled, sold, given away, stored, manu- I factured or processed. , d. Investigate the existence of any contagious disease within the Village and report the same to the Village Board of Health and to the County Board of Health, and act without delay in carrying out such measures for controlling the progress of the same as the County Board of Health shall propose. e. Make all necessary sanitary and health I investigations and inspections and cause all nuisances, whether public or private, affecting the health of persons in private employment and the public generally, to be abated with reasonable i I I I I promptness. I f. Initiate plans for dealing with public health II problems not already included in the public health program. I I I I I g. Perform such other duties relating to health and sanitation as the Village Manager shall direct. - 2 - h. Request the Police Department of the Village ,and such other State or Municipal authorities for such assistance 'as he may deem necessary in the performance of the duties of his office and cause the arrest of offenders violating any of the Village Ordinances relating to public or private nuisances, i'public health and sanitation. :1 'Ii Section 4.1203 Reports. The Health Inspector shall Ifurnish the Board of Health and Village Manager a written report Iten days after the expiration of each month in which shall be Ii set forth his acti vi tes during the preceding month, the name and laddress of each location in which a health violation was discovered Ithe condition found, the correction required, and whether there has been compliance. II Section 4.1204 Penalty. Any person violating or I refusing to obey an order of the Health Inspector, or concealing any notice po~d by or under the authority of the Board of Health I shall be fined no less than $10.00 or more than $200.00." I SECTION 4. This ordinance shall be in full force and effec from and after its passage, approval and publication according to law.
