on a three year projection) and the genuine possibility that commuter service on Metra's North
Central line, which travels over CN's Wisconsin Central tracks, will expand and improve.
We acknowledge that in order to remain a major transportation hub for the nation, the Chicago
metropolitan area must embrace and support regional transportation initiatives such as these.
CN's proposed acquisition, which would divert a significant amount of freight traffic from the
Chicago metropolitan's core rail infrastructure and onto underutilized rail capacity around the
perimeter of the Chicago area, should reduce freight congestion and travel times, pollution from
idling trains, and costs resulting from shipping delays.
Admittedly, the proposed acquisition may negatively affect some of our neighboring
communities along the EJ&E line with increased freight traffic and commuter line disruptions.
We suggest that a portion of the proposed $100 million now dedicated to EJ&E infrastructure
improvements be used to permit enhanced train operations, including safer speed increases and
rerouting.
Furthermore, as proposed, there are no restrictions on CN's future ability to incrementally
increase freight or other rail traffic on the EJ&E or the CN Wisconsin Central tracks that serve
Metra's North Central line. We suggest that the STB establish line capacity restrictions to ensure

that the proposed acquisition's initial benefits to the region are not diluted in the future by
increased freight or other non-commuter rail traffic.
Finally, we hope the Surface Transportation Board's ("STB") Environmental Impact Study will
address the concerns of all communities affected by the proposed acquisition and provide
reasonable solutions. Moreover, we expect Canadian National to adequately respond to all the
issues and concerns raised and meet the requirements set forth by the STB study.
Since it is in the best interests of our community and the region in general, the Village of Mount
Prospect respectfully requests that the Surface Transportation Board approve the proposed
acquisition of the Elgin, Joliet & Eastern Railway Company by Canadian National, currently filed
as STB Finance Docket No. 35087. Please enter these comments into the official record of these
proceedings.

RESOLUTION
SUPPORTING THE PROPOSED ACQUISITION OF THE ELGIN, JOLIET & EASTERN
RAILWAY COMPANY BY THE CANADIAN NATIONAL RAILWAY COMPANY
WHEREAS, the President and the Board of Trustees of the Village of Mount Prospect desire to
express the Village's support for the proposed acquisition of the Elgin, Joliet & Eastern Railway
Company ("EJ&E") by the Canadian National Railway Company ("CN"); and
WHEREAS, the proposed acquisition would permit freight train traffic to be diverted away from
the Chicago metropolitan's core infrastructure and onto underutilized rail capacity around the
perimeter of the Chicago area, thereby improving the surface transportation system for the
entire region, including reducing freight travel times, pollution from idling trains and costs
resulting from shipping delays,
WHEREAS, the proposed acquisition would permit for better utilization of the CN Wisconsin
Central rail line, upon which Metra operates its North Central Service commuter line, thus
creating an opportunity for improved and expanded Metra service to address unmet weekday
service demand and commencement of weekend service, thereby improving the quality of life in
the region, enhancing the viability of the North Central Service and adding value to the past
investments made in capital improvements to the line.
NOW THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the President and Board of Trustees of the Village of Mount Prospect
request the Surface Transportation Board approve the proposed acquisition of the Elgin, Joliet &
Eastern Railway Company by the Canadian National Railway Company, currently filed as STB
Finance Docket No. 35087.
SECTION TWO: That this Resolution shall be in full force and effect from and after its passage,
approval in the manner provided by law.

As requested in the Grant of a License for holding a car show on the parking lots located
at Union Pacific Railroad Property located both east and west of Main Street, here
attached is a revenue and expense statement as budgeted for 2008.
A Certificate of Insurance naming the Village and Union Pacific Railroad as additional
insured has already been submitted per Aback & Associates our insurance agent.
We thank the Village for their support of this popular event that will bring many residents
and families to our Downtown.

TO CONDUCT WEEKLY CAR SHOWS
WHEREAS, the Village of Mount Prospect supports the summer "Blues Mobile Cruise Night" car shows
held in the commuter parking lots; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have determined that
the best interests of the Village would be served by entering into a Grant of License between the Village
and the Downtown Mount Prospect Merchants Association in order to conduct the annual Car Shows
from May 17, 2008 through September 27,2008.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:

Exhibit "A"
GRANT OF LICENSE
The Village of Mount Prospect hereby grants a license to the DOWNTOWN MOUNT PROSPECT
MERCHANTS ASSOCIATION (licensee) for the purpose of operating a Car Show on the parking
lots located at the Union Pacific Railroad property located both east and west of Main
Street/Elmhurst Road, which property is currently leased by the Village of Mount Prospect from the
Union Pacific Railroad Company. This License is subject to the following conditions:
1. The term of the License shall be from May 17, 2008 through September 27,2008.
2. Each vendor selling food at the Car Show shall utilize a food cart licensed by the Village of
Mount Prospect Environmental Health Division and in compliance with all health and
sanitation regulations of the Village and the State of Illinois.
3. This License shall be revocable at any time by the corporate authorities of the Village of
Mount Prospect if the licensee or any vendor is in violation of state or local laws or this Grant
of License.
4. Within ten (10) days of the execution of this Grant of License, the licensee shall submit to
the Village Manager a pro forma revenue and expense statement setting forth certification
fees and estimated revenues, expenses, management fees, if any, and the proposed
disposition of potential net revenues.
5. Prior to November 30, 2008, the licensee shall issue a written report to the Village Manager
outlining the financial aspects of running the Car Show, problems encountered in the year
2007 season, along with proposed solutions, proposals for improving the Car Show and the
outlook for the future of the Car Show.
6. The licensee shall possess a Certificate of Insurance for public liability insurance in an
amount of not less that $1,000,000 per occurrence naming both the Village of Mount
Prospect and the Union Pacific Railroad Company as additional insured.
7. The licensee/grantee shall not discriminate against any employee, applicant, volunteer,
authorized vendor or event participant because of race, color; religion, sex, sexual
orientation, marital status, national origin or ancestry, citizenship status, age, physical or
mental handicap unrelated to ability, military status or an unfavorable discharge from military
service.

HOLD HARMLESS
WHEREAS, DOWNTOWN MOUNT PROSPECT MERCHANTS ASSOCIATION ("GRANTEE") has
requested permission of the corporate authorities of the Village of Mount Prospect, ("GRANTOR")
to operate a Car Show within the parking lots located on the Union Pacific Railroad property, located
both east and west of Main Street/Elmhurst Road; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect did adopt
Resolution No. on April , 2008, entitled "A Resolution Authorizing Execution
of a License to the Downtown Mount Prospect Merchants Association to Conduct the Annual Car
Show in the Village".
NOW, THEREFORE, upon the mutual covenants and agreements hereinafter set forth and other
good and valuable consideration, the receipt of sufficiency of which are hereby acknowledged, the
GRANTOR has granted a Grant of License to GRANTEE to operate a Car Show within the parking
lots located on the Union Pacific Railroad property, located on both the east and west sides of Main
Street/Elmhurst Road, which license is conveyed, however, subject to the following terms,
covenants and conditions:
1. The GRANTOR may at any future time after the date hereof revoke the License referenced
herein and without notice to the GRANTEE and without cost to either the GRANTOR or
his/her successors or assigns.
2. Upon such revocation of said License by the GRANTOR, and with written notice of said
revocation to the GRANTEE, the GRANTEE shall cease operation of said Car Show.
3. GRANTEE shall at all times, and under all circumstances, indemnify, protect, and save
harmless the GRANTOR, its grantees, licensees, agents, lessees and invitees, from and
against any and all damages, losses, claims, demands, actions, and causes of action
whatsoever (including any reasonable costs, expenses, and attorneys' fees which may be
incurred in connection therewith) whether or not the claim, demand or other action asserted
by meritorious, and which results from or is alleged to arise as a result of the activity being
the subject of this Agreement.
4. GRANTOR shall not be liable to GRANTEE, her grantees, licensees, agents, lessees, or
invitees for any damages or injuries (including death) to any person thereof except to the
extent that injuries or damages are caused by the negligent, willful, or malicious misconduct
of GRANTOR.

SUBJECT:
The Development Code requires the Applicant to improve the right-of-way as part of the redevelopment
of the Subject Property. However, the existing streetlight system does not exist in this immediate area;
therefore installing streetlights at this time would not be practical.
The Village Code has provisions for instances where this type situation arises and allows for the
installation of the required improvement at a later date. Attached please find a copy of the Restrictive
Covenant where the Applicant agrees to pay for the installation of the required streetlights when the
Village requires such improvement.
Please forward this memorandum and attachments to the Village Board for their review and
consideration at their April 15, 2008 meeting. Staff will be present to answer any questions related to
this matter.

AND PAUL SHERIDAN, HAMILTON PARTNERS REGARDING
COMPLETION OF REQUIRED PUBLIC IMPROVEMENTS
PERTAINING TO THE DEVELOPMENT OF

WHEREAS. pursuant to the provisions of Chapter 16 entitled Construction Standards Site Improvement
Procedures of the Village Code of Mount Prospect certain public improvements are required to be
constructed and installed by owners and developers of property within the Village. as part of the approval
for the development of such property; and
WHEREAS, in certain instances the installation of public improvements. including but not limited to street
lights. are not feasible at the time of development. however the developer is required to provide those
improvements as such time as the Village of Mount Prospect deems appropriate; and
WHEREAS. the President and Board of Trustees have determined that the best interests of the Village
would be served by having the owner-developer. Paul Sheridan, Hamilton Partners. enter into a
Restrictive Covenant, a copy of which is attached and made a part of as Exhibit "A". guaranteeing the
installation of specified improvements at such a time as deemed reasonable and proper.

property commonly known as 199 West Rand Road which Restrictive Covenant guarantees the
installation of public improvements along Rand and Kensington Roads at such time deemed necessary.
SECTION TWO: That the Village Clerk is hereby directed to record with the Recorder of Deeds a fully
executed copy of the Agreement being the subject of this Resolution.

ILLINOIS AND THE OWNER-DEVELOPER OF CERTAIN PROPERTY WITHIN SAID VILLAGE
REGARDING INSTALLATION OF REQUIRED STREETLIGHTS PERTAINING TO THE
DEVELOPMENT OF SAID PROPERTY 199 W. RAND ROAD, MOUNT PROSPECT, ILLINOIS
WHEREAS, pursuant to the provisions of Chapter 15 entitled "Development" of the Village Code of Mount
Prospect, Illinois streetlights along the public right of way adjacent to the project site are required to be constructed
and installed by owners and developers of property within the Village, as part ofthe approval for the development of
such property; and
WHEREAS, the schedule for accomplishing the construction and installation of such streetlights by the owner-
developer of the property under development is often in conflict with other public improvement projects adjacent to,
or in the vicinity of the property so as to render such street light installation by the owner-developer to be practically
or economically unfeasible, until the installation can be combined with or scheduled so as to conform with other
public improvements affecting the subject property under development; and
WHEREAS, such other public improvement projects are administered by the Village, County or State officials,
over which the owner-developer has no control, and in some instances the streetlight installation to be accomplished
by the owner-developer with respect to the property under development cannot be completed until other
improvements under Village, County or State control have been completed; and
WHEREAS, under such circumstances, it is deemed to be inequitable to delay development ofthe property under
development or to require the owner-developer to establish a cash escrow, letter of credit or improvement bond for the
purpose of guaranteeing the completion of required streetlight installation due to the delay caused by the intervening
or subsequent accomplishment of other public improvement projects under administration and control ofthe Village,
County or State; and
WHEREAS, Section l5.502.BA of the Village Code of Mount Prospect, Illinois provides that in lieu of a cash
escrow, letter of credit or development bond, the owner-developer may execute a restrictive covenant to be recorded
and to run with the land as a guarantee that the required streetlight installation shall be completed with respect to the
property under development.
WHEREAS, the Village finds that it is in the best interest of the Village to accept a covenant to install
streetlights in the future.
NOW, THEREFORE, in accordance with the provisions of Section lS.S02.BA of the Village Code of Mount
Prospect, Illinois, the Undersigned Owner does hereby covenant with the Village of Mount Prospect, an Illinois

delay, until the improvements are completed in a satisfactory manner and in accordance with Village, County, and
State plans and specifications. In lieu of requiring the applicant to install the streetlights, the Village may elect to
have the applicant pay for the installation.
4. This Covenant to complete streetlight installation shall run with the subject property for twenty (20) years.
Nothing in the Covenant shall in any way prevent the alienation or sale of all or a portion of the subject property,
except that the sale shall be subject to the provisions of this Restrictive Covenant and to the plan of development
pertaining to the property. The new owner shall be both benefited and bound by the conditions and restrictions herein
expressed of this Restrictive Covenant.

5. This Covenant shall be binding upon and shall inure to the benefit of the parties and their successors and
assigns in title and interest. The provisions shall be enforceable in a proceeding at law or in equity against the person
or persons seeking to violate it including an action for injunctive relief, specific perfonnance or to recover damages or
other fines and penalties as may be established in such violation. In the event that the owner-developer of the subject
property fails to complete the required improvements or pay a proportionate share of the required improvements by
other contractors within the specified time periods, the value of such improvements shall be entered as a lien against
the property due and payable within sixty (60) days after notification to proceed with the improvements.

The petitioner received zoning approval in 2007 to construct two industrial buildings on the subject prope . As
part of the zoning approval, the petitioner was required to vacate the bulb of the Wall Street cul-de-sac and
consolidate the portion of the site being developed to create a two-lot subdivision. In order to comply with these
requirements, the Petitioner prepared a Plat of Vacation and a Plat of Resubdivision that creates two lots of
record.
Both Plats require Village Board review and approval. During their March 27, 2008, meeting, the Planning and
Zoning Commission voted 4-0 to recommend that the Village Board approve the proposed Plat of Resubdivision.
Please forward this memorandum and attachments to the Village Board for their review and consideration at their
April 15, 2008 meeting. Staff will be present to answer any questions related to this matter.

Chairman Richard Rogers called the meeting to order at 7:30 p.m. After roll call, Chairman Rogers stated that
they have the minimum amount of Planning and Zoning Commission Members for a quorum. In order for a case
to receive a positive recommendation, a unanimous vote must occur. The voting for the minutes from the January
24,2008 meeting were held over until the next meeting since only two members were present from that meeting.
After hearing one previous case, Chairman Rogers introduced case number PZ-14-07, a request to approve a Plat
of Vacation and the Lake Center Plaza Resubdivision No.3 at 1630-1780 Wall Street, at 8:10 p.m.
William Cooney, Director of Community Development, stated that this was a follow-up to a case that had
previously come up before the Planning and Zoning Commission. He said that this is a two lot subdivision with
the construction of two individual warehouses. Mr. Cooney showed an exhibit referencing six lots of record that
were subdivided in the 1970s. He stated that the Petitioner needed to consolidate the lots with the larger facilities
into two lots and also vacate a portion of the cul-de-sac on Wall St.
Mr. Cooney said that the Petitioner had submitted the necessary documents for review and Staff recommends
approval by the Planning and Zoning Commission.
Chairman Rogers asked if the two parcels would become part of the adjoining lot and stay with the small half
circles. Mr. Cooney confirmed with Chairman Rogers that the properties would be subdivided into two lots.
Chairman Rogers swore in Michael Ricamato, 1660 Wall St., Mount Prospect, IL. Mr. Ricamato stated that they
would be constructing two parcels on six lots that will be subdivided into two lots. He said that they would be
vacating the cul-de-sac on Wall St. based on the Village's recommendation.

Chairman Rogers asked if there would be a dead end road. Mr. Ricamato stated that the road tees off at
Montgomery St. and confirmed with Chairman Rogers that it is not a dead end street.

Marlys Haaland made a motion to approve case number PZ-14-07, a request to approve a Plat of Vacation and the
Lake Center Plaza Resubdivision No.3 at 1630-1780 Wall Street; Keith Youngquist seconded the motion.

BACKGROUND
A public hearing has been scheduled for the February 28, 2008 Planning & Zoning Commission meeting, and
continued to the March 27, 2008 meeting, to review the application by The Alter Group (the "Petitioner")
regarding the consolidation of several lots located on the west side of Wall Street between Montgomery St. and
Algonquin Road (the "Subject Property") in the Lake Center Plaza. The Petitioner is seeking approval of a Plat of
Vacation and the Lake Center Plaza Resubdivision No.3. Staff has posted the required Public Hearing signs on
the Subject Property.
PROPERTY DESCRIPTION
The Subject Property, commonly known as the Lake Center Plaza, is located on the north side of Algonquin
Road, between Elmhurst Road and Malmo Drive, and contains multiple lots of record. The Subject Property
received zoning approval in 2007 to construct two industrial buildings, and relief from zoning regulations for the
development. As part of the zoning approval, the Petitioner was required to vacate the bulb of the Wall Street
cul-de-sac and consolidate the portion of the site being developed to create a 2-10t subdivision.
SUMMARY OF PROPOSAL
The Petitioner has recently constructed two (2) warehouse buildings on the west side of Wall Street and is
seeking approval of the required plats. Lot 1 contains a 147,932 square foot industrial office/warehouse and Lot
2 contains a 108,732+/- square foot industrial office/warehouse. The office/warehouse structures cross multiple
lot lines and the Subject Property is being consolidated to comply with zoning requirements that prohibit
structures from crossing lot lines. Six (6) lots ofrecord are being consolidated, creating a 2-10t subdivision, with
the remainder of the industrial park still to be developed. Also, Wall Street is a public street and the cul-de-sac
needed to be vacated in order to construct the project as approved.
PLAT REVIEW
The Petitioner prepared a Plat of Vacation that vacates the bulb of the Wall Street cul-de-sac and a Plat of
Resubdivision that creates 2-lots of record. The required plats were addressed as part of the zoning case heard by
the P&Z in February 2007. The plats were prepared in response Staffs recommendations; Certificates of
Occupancy would be granted subject to completing and approval of the plats.

The proposed plats would: 1) vacate a portion of the Wall Street right-of-way (cul-de-sac bulb), and 2)
consolidate the six lots into two lots of record. Staff reviewed the plats and found that they were prepared in
accordance with the Village's Development Code requirements.
RECOMMENDATION
Based on the above analysis, Staff recommends that the Planning & Zoning Commission recommend the Village
Board approve the following motion:
"To approve a Plat of Vacation and a Plat of Resubdivision, titled Lake Center Plaza Resubdivision No.3, for
the Lake Center Plaza development, Case No. PZ-14-07":

RESOLUTION NO.
A RESOLUTION APPROVING A PLAT OF RESUBDIVISION
FOR PROPERTY LOCATED AT 1630-1780 WALL STREET
WHEREAS, the Petitioner, Michael Ricamato, Alter Group, has requested approval of a Final Plat
of Resubdivision for the purpose of resubdividing six (6) lots to create two (2) lots of record at
1630-1780 Wall Street as legally described in Exhibit "A"; and
WHEREAS, the Planning and Zoning Commission has recommended approval of the
Resubdivision.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the resubdivision of six (6) lots into two (2) lots of record is hereby granted
for the property at 1630-1780 Wall Street and the Final Plat of Resubdivision attached as Exhibit
"A" is hereby approved for appropriate execution and recording. Such Plat and its legal
description are incorporated into, and made a part of, this Resolution.
SECTION TWO: That the Village Clerk is hereby authorized and directed to record a certified
copy of this Resolution with the Recorder of Deeds of Cook County.
SECTION THREE: This Resolution shall be in full force and effect from and after its adoption,
approval and publication in pamphlet form as provided by law.

SUBJECT: EMPLOYEE CONTRIBUTIONS TO 401 (A) RETIREMENT PLAN
At the June 19, 2007 Village Board meeting, the Village Board authorized the establishment of a
401 (a) retirement plan through the ICMA-Retirement Corporation. The plan calls for mandatory
contributions from participants of the plan along with a matching employer contribution. The
amount of both the employee and employer matching contribution are based on the number of
years the employee has worked for the Village. The plan became effective on August 1, 2007.
It is desirable to have these employee contributions made on a pre-tax basis. In order for this to
occur, a resolution is required designating employee contributions to be "picked-up" by the Village.
This does not mean the Village will have assumed the employee portion of the required
contribution. Employee contributions will continue to be deducted from the wages of the employees
in question, but these contributions shall be treated as employer contributions in determining federal
and state income tax treatment.
The resolution makes no other changes to the plan and will not result in any additional cost for the
Village. I would recommend approval of the attached resolution authorizing the Village to pick up
contributions made by employees who participate in the 401 (a) retirement plan.

WHEREAS, the Village of Mount Prospect, Cook County, Illinois, is a
municipality and a home rule unit of government under Section 6 of Article VII of the
1970 Constitution of the State of Illinois; and
WHEREAS, Section 414(h)(2) of the federal Internal Revenue Code of 1986, as
amended, authorizes an employer, such as the Village of Mount Prospect, to pick up
contributions required to be made by employees who participate in a qualified Section
401(a) Plan of the employer; and
WHEREAS, the Village of Mount Prospect has heretofore adopted a qualified
Section 401(a) Plan, namely, the ICMA Retirement Plan (the "Plan"), that requires
contributions thereto to be made by the employees of the Village of Mount Prospect who
participate in the said Plan; and
WHEREAS, the Village of Mount Prospect and the employees who participate in
the said Plan desire that that the employee contributions to the said Plan shall be picked
up by the Village of Mount Prospect in accordance with Section 414(h)(2) of the Internal
Revenue Code of 1986, as amended, so that the employee contributions picked up by the
Village of Mount Prospect shall be made on a pre-tax basis and shall be treated as
employer contributions for tax purposes pursuant to the Internal Revenue Code Section
414(h) and Section 203 of the Illinois Income Tax Act;
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD
OF TRUSTEES OF THE VILLAGE MOUNT PROSPECT, COOK COUNTY,
ILLINOIS, as follows:
Section 1: That in accordance with Section 414(h)(2) of the Internal Revenue
Code of 1986, as amended, the Village of Mount Prospect will pick up employee
contributions paid to the said Plan.
Section 2: That the pick-up of contributions authorized pursuant to this
Resolution shall apply to all employees of the Village of Mount Prospect who are now
participating and who hereafter shall participate in the said Plan.
Section 3: That employee contributions to the said Plan, although designated as
employee contributions, shall continue to be deducted from the wages of the employees
in question, but the said employee contributions shall be treated as employer
contributions paid by the Village of Mount Prospect, in lieu of the required employee
contributions, in determining federal and Illinois income tax treatment under the Internal
Revenue Code of 1986, as amended and the Illinois Income Tax Act.
Section 4: That employees participating in the said Plan shall not have any cash
or deferred election right (that is, a right to elect to receive cash in lieu of the employee
contributions that are picked up pursuant to this Resolution), nor any right to opt-out of
the pick up of their contributions to the same Plan pursuant to this Resolution, nor any
right to receive the picked up amounts directly instead of having them paid into the said
Plan by the Village of Mount Prospect.
Section 5: That this Resolution shall be in full force and effect upon its adoption
and applies only prospectively.
Section 6: That all motions and resolutions or parts thereof in conflict with the
provisions of this Resolution are, to the extent of such conflict, hereby repealed.
Section 7: That if any section, paragraph, clause or provision of this Resolution
shall be held invalid, such invalidity shall not affect any of the other sections, paragraphs,
clauses or provisions of this Resolution.

The Engineering Division transmits their recommendation to
approve intersection traffic control and speed limit changes for Zones 11, 16 & 18 as
part ofthe Neighborhood Traffic Study.
The Residential Intersection Traffic Control Program and Residential Speed Limit Program are the two
primary traffic initiatives that are included in the current Neighborhood Traffic Study. The Residential
Intersection Traffic Control Program involves reviewing all neighborhood intersections to determine the
proper traffic control. The Residential Speed Limit Program involves reviewing all Village-owned streets
to determine the appropriate speed limit. Both programs are being implemented on a neighborhood by
neighborhood basis using today's engineering principles.
The Village has been divided into 18 neighborhoods or "traffic zones" for the purpose of implementing
the programs. With the assistance of a consultant, KLOA Inc., the Engineering Division has completed
the study of Zones 11, 16 and 18. The neighborhood of Zone 11 is bounded by Central Road to the north,
Busse Road to the east, Golf Road to the south, and the western Village limits. Zone 16 is bounded by
Golf Road to the north, Busse Road to the east, Algonquin Road to the south and the western Village
limits. Zone 18 is bounded by Dempster Street to the north, Elmhurst Road to the east, Oakton Street and
1-90 to the south, and the western Village limits.
SUMMARY
Residential Intersection Traffic Control Program
A total of 77 intersections were reviewed to determine the proper traffic control in Zone 11, 22
intersections were reviewed in Zone 16, and 6 intersections were reviewed in Zone 18. A summary of the
recommendations are indicated in the tables below and on the next page.

It is noted there is one change to the original plan. Because of resident reaction to the proposal to remove
Stop signs on Willow Lane at Tamarack Drive, the Engineering Division gathered additional vehicular
and pedestrian data at the intersection. Willow Lane is a collector street that carries approximately 1900
vehicles per day and is wider than a typical residential street. It is, therefore, recommended that the Stop
signs remain until such time that a traffic calming project can be considered that will focus on pedestrian
safety. Further evaluation of the intersection traffic control would then take place at that time.
Residential Speed Limit Program
In addition to reviewing the intersections, the street system was reviewed to determine the appropriate
speed limits in Zones 11, 16 and 18. The Engineering Division also evaluated the two schools within
Zone 11: Forest View Elementary School and Holmes Junior High School, and the one school within
Zone 16: John Jay Elementary School, to determine those streets that should be posted a school speed
limit zone. Along those streets there would be a 20 mph speed limit during school hours when children
are present. At other times, the speed limit would be 25 mph. Section 18.605 of the Village Code covers
school speed limit zones. Therefore, a separate ordinance is not required. A summary of the
recommendations are indicated in the tables below and on the next page.

Public Notification
Once the studies were completed, the first piece of information sent to each of the 1800 properties within
the three neighborhoods was a brochure. The brochure provided information about the traffic study and
invited them to an Open House to learn about the proposed changes. A web page that included a 12
minute video explaining the programs was created on the Village web-site as an additional avenue to get
information to the public.
The Open House for Zones 11, 16 and 18 was held on February 25th at Holmes Junior High School.
Residents could come anytime between 6:00pm & 7:30pm. The Open House included the video about
the programs and an area where residents could see the recommended changes on display boards and talk
with Staff. Residents could also fill out a Comment Card and provide Staff with feedback. All written
comments received via the Open House, e-mail or regular mail are attached. Approximately 20 residents
attended the Open House.
Based on the traffic study performed by KLOA Inc. and the Engineering Division, we are recommending
changes to Chapter 18 (Traffic) of the Village Code as detailed on the following pages. With the Village
Board of Trustees' approval, the Engineering Division will then work with the contractor currently under
contract to manufacture and install the necessary signs. The current schedule is to have the new signs
installed this summer.

SUPPLEMENT TO THE RECOMMENDATIONS FOR ZONES 11, 16 & 18
The proposal developed by the Engineering Division and KLOA Inc. for Zones 11, 16 and 18 has brought
both positive and negative reaction by residents from these affected neighborhoods. The Open House and
Village web-page have been the two main resources to view both the intersection traffic control and speed
limit recommendations. From the comments we received at the Open House as well as e-mails, letters
and phone calls, the Engineering Division identified five primary issues that have been raised by
concerned residents. We have taken a closer look at these five issues including gathering additional
vehicular and pedestrian data, and would like to briefly provide a response as they may be voiced by
residents at next Tuesday's Village Board Meeting.
1. Crestwood Lane & Martha Lane - Zone 11
Background
This T -intersection currently has Stop signs on Crestwood Lane (thru street) and no signs on Martha Lane
(terminating street). Crestwood Lane carries 600 vehicles per day and Martha Lane carries 100 vehicles
per day. Both streets have a 24' pavement width which is narrower than the standard 28' wide street.
There are painted crosswalks across all three legs of the intersection. A sidewalk exists between two
homes near the intersection that leads to the back of Forest View Elementary School.
Recommendation
The recommendation is to remove the Stop signs on Crestwood Lane and install a Stop sign on Martha
Lane. School crossing signs would be installed on Crestwood Lane at the intersection.
Concern
Removing the Stop signs on Crestwood Lane would cause motorists to speed and create an unsafe
situation for students crossing the street.
Observations
10 Staff hours were spent observing and recording vehicular and pedestrian traffic at this intersection
during the morning and afternoon peak periods. The pedestrian counts were much lower than typically
seen at primary school crossings. In addition, a majority of the pedestrian traffic were adults. With
respect to vehicular traffic, no more than six vehicles during any given hour were observed to enter the
intersection from Martha Lane. Little traffic on Martha Lane is probably the main reason why most
vehicles on Crestwood Lane did not come to a stop at the Stop signs.

Response
As we have said from the beginning, Stop signs are to be used to define the right-of-way and not as a
speed control device. Arbitrarily installing Stop signs can lead to a high disobedience rate and give less
credence to other Stop signs. And at the intersection of two low volume streets, it is typically necessary
to only stop one of the two intersecting streets. With aT-intersection, the terminating street should yield
the right-of-way. However, Stop signs in all directions can be considered with high vehicular traffic, high
pedestrian traffic or a combination of both. With both low vehicular and pedestrian traffic at this
intersection, there are sufficient gaps for the few pedestrians to safely cross the street. Further, removing
Stop signs at unwarranted locations in other parts of the Village have not shown to create a speeding
problem. Speeds tend to be more consistent over the length of the street. There are a number of T-
intersections near schools that have higher vehicular and pedestrian. traffic and safely operate with one
Stop sign on the terminating street only. This recommendation is consistent with previous studies.
2. Oakwood Drive & Palm Drive - Zone 16
Background
This intersection currently has Stop signs on both Oakwood Drive and Palm Drive. Oakwood Drive
carries 1300 vehicles per day north of the intersection and 200 vehicles per day south of the intersection.
Palm Drive carries 1000 vehicles per day east of the intersection and 600 vehicles per day west of the
intersection. Both streets have a 24' pavement width which is narrower than the standard 28' wide street.
The north and south legs of the intersection (Oakwood Drive) are slightly offset. There is sidewalk at the
intersection but no painted crosswalks.
Recommendation
The recommendation is to remove the Stop signs on Palm Drive and keep the Stop signs on Oakwood
Drive.
Concern
Removing the Stop signs on Palm Drive would cause motorists to speed and create an unsafe situation for
pedestrians crossing the street.
Observations

As mentioned in the previous response, in most situations the intersection of two local streets can operate
safely with Stop signs only on one street. Arbitrarily installing Stop signs can lead to a high disobedience
rate and result in the intersection operating inefficiently. At this intersection, there are sufficient gaps for
the few pedestrians to safely cross the street. And with many vehicles turning at this intersection, speeds
should remain low at the intersection and stable along Palm Drive. Stop signs were chosen to remain on
Oakwood Drive because of the offset condition. This recommendation is consistent with previous
studies.

Background
This T-intersection currently has Stop signs on both Willow Lane (thru street) and Tamarack Drive

Recommendation
The original recommendation was to remove the Stop signs on Willow Lane and keep the Stop sign on
Tamarack Drive. Based on Staffs observations, it is recommended that the Stop signs remain on both
streets at this time.

why many vehicles on Willow Lane did not come to a stop at the Stop signs.
Response
As mentioned in the recommendation memo, based on Staffs observations we are recommending all of
the Stop signs remain at this intersection at this time. Because it is a collector street, Willow Lane is
wider than a typical street and carries a higher than average amount of vehicular traffic. Being a wide
street, it takes pedestrians a longer time to cross the street. This intersection may be a good candidate for
a traffic calming project that would focus on pedestrian safety. It is, therefore, recommended that the Stop
signs remain until such time that a more in-depth traffic study can be performed by Staff. Further evaluation
of the intersection traffic control would then take place at that time.
4. Pheasant Trail & Laverene Drive - Zone 16
Background
This T -intersection currently has Stop signs on both Pheasant Trail (thru street) and Lavergne Drive
(terminating street). Pheasant Trail carries 600 vehicles per day and Lavergne Drive carries 300 vehicles
per day. Both streets have a 24' pavement width which is narrower than the standard 28' wide street.
There is a sidewalk system at the intersection but no sidewalk ramps leading across Pheasant Trail, only
Lavergne Drive. Also, there are no painted crosswalks at the intersection. It is approximately 0.2 miles
from John Jay Elementary School.
Recommendation
The recommendation is to remove the Stop signs on Pheasant Trail and keep the Stop sign on Lavergne
Drive.

Neighborhood Traffic Study

Concern
Removing the Stop signs on Pheasant Trail would cause motorists to speed and create an unsafe situation
for students crossing the street.
Observations
Six Staff hours over three days were spent observing and recording vehicular and pedestrian traffic at this
intersection during the morning and afternoon peak periods. The pedestrian counts were much lower than
typically seen at primary school crossings. During all three mornings traffic was observed, not one
pedestrian crossed either street at the intersection during the peak hour. During the afternoon peak hour,
an average of four pedestrians (all junior high age, high school age, or adults) crossed the street. With
respect to vehicular traffic, there was very little traffic on either street outside a 10-minute window right
before and after the elementary school day started and ended.
Response
Similar to the previous responses, Stop signs are to be used to define the right-of-way and not as a speed
control device. Arbitrarily installing Stop signs can lead to a high disobedience rate and give less
credence to other Stop signs. And at the intersection of two low volume streets, it is typically necessary
to only stop one of the two intersecting streets. With aT-intersection, the terminating street should yield
the right-of-way. However, Stop signs in all directions can be considered with high vehicular traffic, high
pedestrian traffic or a combination of both. With both low vehicular and pedestrian traffic at this
intersection, there are sufficient gaps for the few pedestrians to safely cross the street. Further, removing
Stop signs at unwarranted locations in other parts of the Village have not shown to create a speeding
problem. Speeds tend to be more consistent over the length of the street. There are a number of T-
intersections near schools that have higher vehicular and pedestrian traffic and safely operate with one
Stop sign on the terminating street only. This recommendation is consistent with previous studies.
5. Lake Briarwood Subdivision - Zone 18
Background
The subdivision was annexed into the Village in 1978. As is typical with any Annexation Agreement, the
intersection traffic control and speed limits as they existed were incorporated into the Village Code.
However, no evaluation of the traffic regulations was done at the time nor has one been done until now.
The streets are 26' wide which is slightly narrower than a standard residential street. There is no curb and
gutter and no sidewalk. The subdivision has four T -intersections with a variety of traffic control and a 20
mph speed limit.
Recommendation
The recommendations are to modify the intersection at the entrance to be all-way Stop controlled (add a
Stop sign), have Stop signs on the terminating street only at two other intersections, have the fourth
intersection be uncontrolled, and increase the speed limit to a consistent 25 mph on all the streets.
Concern
Amending the traffic regulations in the subdivision is a violation of the Annexation Agreement.
Observations
The intersection at the entrance to the subdivision currently has Stop signs on two of the three legs.
Because of the volume of traffic, landscaping near the corners, and a bend in the road near the
intersection, stopping all three legs would better regulate traffic into and out of the subdivision. The other
three intersections experience low traffic volumes and have good sight lines. It is Staff's opinion,
therefore, not necessary to stop both streets to safely and efficiently move traffic. With respect to
vehicular speeds, Staff reviewed the speed data and confirmed that a 25 mph speed limit is the appropriate

recommendation based on engineering practice. The recorded speeds along Briarwood Drive are similar
to speeds on most other residential streets in the Village.
Response
Staff has reviewed the Annexation Agreement for Lake Briarwood Subdivision and nowhere does it
prevent the Village from amending the traffic regulations. The recommendations are of sound
engineering judgment and were developed based on the same process used in all previous studies. Staff
contends that consistent traffic regulations throughout a neighborhood and throughout the Village will
enhance a motorist's expectations. This greater understanding will increase the obedience to the traffic
regulations in place which we expect, in turn, will improve safety. And post-studies in other
neighborhoods are showing that crash rates are lower.
I would like to make a few comments regarding the neighborhood petition (attached) as a couple of the
statements need clarification. It indicates that 96 signatures are on the petition. While this is true, it only
represents about 50% of the properties as in many cases there are multiple signatures from the same
address. Also, it says that I "... insisted that increasing the speed limit and removing stop signs will
improve safety." When the Association President, Mr. Bess, and I briefly spoke, I provided a perspective
of how a consistent set of traffic regulations in other neighborhoods has improved safety. And to
accomplish this, stop signs have been removed, stop signs have been added, speed limits have increased,
and speed limits have decreased. I also mentioned that it was reasonable for the Village to review the
traffic regulations within the subdivision to make sure they meet current standards just as we should with
other infrastructure assets such as water main, sewer and roads. While we did not discuss a specific
intersection or street within Lake Briarwood, we acknowledged that many Stop sign violators and
speeding vehicles in the neighborhood are the residents' themselves as this is a closed-loop subdivision
with only one access to a main street (Algonquin Road). With whatever decision is made by the Village
Board of Trustees, the Association Board can play an active role in addressing some of their concerns by
encouraging their neighbors to drive safely in the subdivision.
Representatives from the Engineering Division and KLOA Inc. will be in attendance at the April 15th
Village Board Meeting and would be happy to answer questions and further discuss these issues and any
other concerns that may be raised at the meeting.

We have reviewed the proposed changes to the speed limit and stop sign changes in our
development. (Zone 18) The stop signs and 20 MPH speed limit were part of our original
annexation agreement. (See ordinance # 2853 passed December 19, 1978) This letter is to
inform you that we as the Board of Directors of the Homeowners Association are unanimously
opposed to any changes. We circulated a petition Saturday AM and secured 96 signatures frOm
the 119 homes in our development also opposed to the changes. (See attached)
Mr. Lowery of Public Works has insisted that increasing the speed limit and removing stop signs
will improve safety. We strongly disagree.
I and most of the Board have prior commitments for April 15th at 7:00PM but we have notified all
homeowners and encouraged them to attend the Council meeting.
We would appreciate it if you would make no changes to the speed limit or stop signs. Thank

In keeping with past practice, the names and addresses are not included in the comments be/ow.

Zone 11
"I've lived at 1720 Martha corner of Martha and Crestwood for about 33 years and have seen much
regarding this intersection. I've looked at the recommendations for signage for Zone 11 and I have to
wonder why would anyone want to remove the North and South stop signs on Crestwood when this is a
school crossing.
We've been very fortunate that over the last 33 years that there have been no accidents, but I believe that
will change if the stop signs are removed. I realize there is nothing that can been done to prevent drivers
from blowing the stop signs. It just seems to me that if the signs are removed and a kid gets hurt that the
driver would have a stronger case of not be held liable. Could simply say the kid ran out in front of him.
We need something to slow the traffic.
Was there any consideration for installing speed bumps before the intersection like what is over by the
golf course? This will not make cars stop but it will surely slow them down. Lets give the kids a break, as
an adult does not always accompany them. I would also like to see the wing walks on the north side of
Martha and the wing walk directly west to be removed. This would force kids to cross on the south side of
Martha. Wing walks were installed when stop signs installed. Would think ifno stop signs then no wing
walks.
As far as changing the stop signs to read pedestrian crosswalk that to me is a waste. If cars are not going
to stop for a stop sign then a pedestrian crosswalk sign is meaningless.
In zone 11 the recommendation is to install 42 new stop signs and remove four stop signs. If the police
department can't control traffic with what is currently there now how can they possibly control traffic
with 42 new signs and that's just for Zone 11. Or maybe they just won't brother to issue tickets.
With no stop signs Meier, Crestwood, Hatlin, and Lincoln will be nothing more than a main street with
cars exceeding the speed limit. These streets will be used instead of Busse. It appears as though all the
east/west streets will have stops signs before entering a north/south street.
However, my main concern is Martha and Crestwood. I strongly urge you the Board and whoever else
please considers the installation of speed bumps. That will at the very least slow the traffic, which in my
opinion is the only effective way to slow the traffic to prevent a child from serious injury if not death."
"I'm sorry that I missed the meeting at Holmes Junior High last evening. I was late with the snow and by
the time I arrived at 8:05 I was told by a custodian it was over. I reviewed the recommendations and while
I agree that the speeds should be generally be consistent in the village, it will not take care of the cut-
through speeders that the residents of Hatlen Heights experience. Although the intersections of Central
and Cleveland! AudreyIHatlen are out of Mt. Prospects jurisdiction they are accident prone (even
death) and the source of the cut-through traffic that uses the Audrey/Meier corridor, and should be
investigated with the County's department and possibly with the village of Arlington Heights. This section
of Zone 11 really needs to be investigated deeper with a more direct solutions to the cut-through issue."
Zone 16
"Have just noticed-- the Zone 16 Traffic Study recommends the removal of the East-bound and west-
bound stop signs on Pheasant Trail, at Lavergne. I STRONGL Y object to this omission! Presently,
Pheasant Trail (and Willow) are frequently used as a bypass around the Dempster/Busse Rd!Algonquin
Rd intersection. Drivers speed-30-35 mph on Pheasant Trail- in a hurry. Eliminating the stop signs at
Lavergne only will result in a clearer high-speed "run" between Tamarak and Busse Rd. Living near
Tamarak (at 1822 Pheasant), I am less affected, but still adversely affected by speeders. Whoever made
the decision to eliminate these stop signs has not spent much time observing the traffic flow/speeds on
Pheasant Trail."
"Concerned about the removal of stop signs on the Willow & Tamarack intersection. This is a walking
route to John Jay School that should have a 4 way stop. It is further complicated by the offset streets.
Please reconsider."

trafficked stop fostered by the ACE Hardware strip mall. It is a walking path further complicated by the
off setting streets. Please reconsider."
"I am concerned about the removal of the stop signs at Willow and Tamarack Yz mile stretch of road with
no stops will increase the speed of motorist who use Willow as a cut through. People trying to cross the
street or cars exiting Tamarack will have a long wait!"
"Removal of stop signs at Oakwood and Palm can cause problems. Many people from the neighborhood
walk to the shopping center at Golf & Busse and it would be difficult crossing Palm with no signs - many
people use Palm Drive to get to the apartments."
"This email is in reference to the proposed removal of stop signs at the intersection of Willow and
Tamarack Roads in my neighborhood (Zone 16). I live on the west end of Thornwood Lane, two blocks
north of this intersection. I have two small children who attend John Jay School. When the weather
permits, we, along with other families in the neighborhood, walk to and from school. I feel the removal
of the stop signs on the Willow portion of this intersection will jeopardize the safety of my children as
well as the handful of others who cross at this intersection en route to/from school. To express our
concerns, my family and I attended the open house at Holmes where I talked to an engineer regarding this
matter. I was told that drivers aren't expecting a stop sign in the middle of the block so it is frequently
"rolled" or ignored. I am not comfortable with the thought that a stop sign should be removed because it
is routinely ignored. I feel there is a legitimate need to keep or enhance traffic awareness at this
intersection in the interest of pedestrian safety. Tamarack ends at the front door of John Jay School. I
feel keeping the stop sign as well as painting a crosswalk and perhaps putting up a School Crossing or
School Advance sign would be a better solution. This could reinforce the need for drivers to stop and
proceed with caution."
Zone 18
"The landscaping around Briarwood is out control and blocking the view of walkers. You can't stop
speeders but you can make the speeders see walkers easier by trimming or removing overgrown
evergreens. "
"Busse & Algonquin! If you are on Algonquin going East and wanting to make a right turn on red, you
can't see the traffic coming from the left on Busse if a truck is a the stop light in the inner lane. A change
to the line on the street would correct the problem. Paint the line at an angle so trucks can't block your
view."
"No parking between signs on the curve at the Briarwood entrance has been removed. This is a very
dangerous comer when cars park on the curve."
"Location Briarwood and Algonquin: People living on the north side of Algonquin and west Briarwood
pull into the left turn lane going east on Algonquin. When you try and make a left turn into Briarwood
from Algonquin the left turn laners pull out right in front of you."
"One reason there is a stop sign at the dam is that children frequently fish, catch frogs, explore esp, during
the summer. They cross back & forth on foot & with bicycles. There should be a second stop sign for the
other direction."

AN ORDINANCE
AMENDING THE CODE OF ORDINANCES
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
BE IT ORDAINED by the President and Board of Trustees of the Village of
Mount Prospect, Cook County, Illinois, acting in the exercise of their home rule powers
as follows:
SECTION 1: A new Section 1303.1 entitled "Prohibited Activities Within A
Residential Zoning District" shall be added to Article XIV "Nuisances" of Chapter 23,
entitled "Offences and Miscellaneous Regulations" of the Village Code of the Village of
Mount Prospect as follows:
23.1403.1: PROHIBITED ACTIVITIES WITHIN A RESIDENTIAL
ZONING DISTRICT.
It shall be unlawful between 7:00 p.m. and 7:00 a.m., within the RX,
R 1, R2, R2A, R3, R4 or R5 residential districts, to do any of the following
acts:
A. Drive a commercial vehicle (with the exception of residential
moving vans) to a specific address within the Village for the
purpose of loading or unloading such a vehicle at that address; or
B. Load or unload a commercial vehicle (with the exception of
residential moving vans) regardless of who is doing the loading or
unloading; or
C. Run the engine and/or refrigeration unit of a parked commercial
vehicle; or
D. Operate any percussion tools, power tools, power lawn tools or power
construction equipment.
For purposes of this Section 23.1403.1, "commercial vehicle" shall mean
any vehicle other than a school bus or a first division vehicle as defined by the
Illinois Vehicle Code. A person may, not more than twice in any twelve month

time period and upon not less than twelve hours' advance notification to the
Police Department, load or unload a second division vehicle at times otherwise
prohibited by this Section. The prohibitions in this section shall not apply to snow
removal or to municipal operations or to bona fide emergency home repairs.
SECTION 2: Section 11.2808 entitled "Loud Noises and Speaking Devices" of
Chapter 11 entitled "Merchants, Businesses, Occupations and Amusements" shall be
amended by deleting Section 11.2808 in its entirety and inserting the following new
Section 11.2808 to be and read as follows:
11.2808:
LOUD NOISES AND SPEAKING DEVICES:
No licensee under this Article shall shout, use any sound or amplifying device
upon any public way or place, or upon any private premises where the sound
may be heard upon any public place. The foregoing shall not apply to
entertainment provided to the general public as part of a Village approved event.
(Ord. 3403, 3-6-1984).
SECTION 3: Subparagraph 5 of Paragraph B entitled "Food Service" of Section
12.102 entitled "Food Service Regulations" of Chapter 12 entitled "Food Code" shall be
amended by deleting subparagraph 5 in its entirety and inserting the following new
subparagraph 5 to be and read as follows:
5. The noise prohibitions of Section 11.2808, the nuisance
declarations of Chapter 23, Article XV, the delivery prohibitions of
Section 9.309 and equipment requirements of Chapter 18, Article
XV shall apply to all food service vehicles.
SECTION 4: Section 13.121 entitled "Entertainment" of Chapter 13 entitled
"Alcoholic Liquors" shall be amended by adding the words "or her" to the last sentence
as follows:
... Further, the local liquor control commissioner, the village manager or his or
her designate or either, shall have the absolute right for cause and without the
necessity of a hearing, to order the immediate cessation of such live music.

SECTION 5: Subparagraph D of Section 14.307 entitled "Standards for Home
Occupations" of Chapter 14 entitled "Zoning" shall be amended by adding the words
"signal interference" twice in the first sentence as follows:
D. There shall be no noise, odor, dust, vibration, smoke, glare, television
signal interference or radio signal interference, electrical interference, fire
hazard or any other hazard emanating from the dwelling. ...
SECTION 6: Section 18.1528 entitled "Horns and Warning Devices" of Chapter
18 entitled "Subdivision, Development and Site Improvement Procedures" shall be
amended by adding a new paragraph D at the end of Section 18.1528 to be and read as
follows:
D. The restrictions or limitations of A and B above shall not apply to approved
and properly operating anti-theft devices.
SECTION 7: Section 23.704 entitled "Restrictions" of Chapter 23 entitled
"Offenses and Miscellaneous Regulations" shall be amended by deleting Section
23.704 in its entirety and inserting the following new Section 23.704 to be and read as
follows:

RESTRICTIONS:
No licensee shall use or operate or employ any such device within the village
limits on Sunday or between 8:00 P.M. and 8:00 A.M. of any other day. No
licensee shall use, operate or employ any such device within a radius of one
thousand six hundred feet (1,600') from any hospital, church while funeral
services are being held or within one thousand feet (1,000') from any property
used or zoned for any residential purpose under the village zoning ordinance.

SECTION 8: Section 23.1403 entitled "Enumeration of Nuisances" of Chapter
23 entitled "Offenses and Miscellaneous Regulations" shall be amended by adding the
following sentence at the end of paragraph H to be and read as follows:

SECTION 9: Section 25.102 entitled "Construction of Words" of Chapter 25
entitled "The Village Code" shall be amended by deleting Section 25.102 in its entirety
and inserting the following new Section 25.102 entitled "Construing this Code" to be and
read as follows:

CONSTRUING THIS CODE:
Whenever any word importing the plural number is used in describing or referring
to any matters, parties or persons, any single matter, part or person shall be
deemed to be included, although distributive words may not have been used.
When any subject matter, party or person is referred to in this code by words
importing the singular number only, or the masculine gender, several matters,
parties or persons and females as well as males and bodies corporate shall be
deemed to be included. If a requirement or prohibition is applied to a licensee or
permittee, then the requirement or prohibition shall also apply to any agent,
employee or person acting on behalf of the licensee or permittee. The word
"persons" or the words "person, firm or corporation" shall include an individual,
organization, entity, corporation, proprietorship, partnership, firm, association,
trade union, trust, estate or group as well as any parent or beneficiary of any of
the foregoing entities, whether or not operated for profit. Words in the present
shall include the future. The words "the ordinance" whenever used in this code,
shall be held and taken to mean the entire code, including each and every
section. The word "village" whenever used in this code shall be held and taken
to mean the village of Mount Prospect. The words "written" or "in writing" may
include printing. These rules of construction shall not be applied to any section
of this code which contains any express provisions excluding such construction

PURPOSE:
To present for the Village Board's consideration an ordinance that would reserve the
Village's 2008 private activity bond volume cap.
BACKGROUND:
The Internal Revenue Code allows state and local governments to issue tax-exempt
debt for the benefit of certain qualified private development projects. These projects
include the acquisition or construction of industrial facilities and apartments for low
and moderate-income families. The amount of such private activity debt issued in
2008 cannot exceed the equivalent of $85 per resident. The Village's private activity
bond volume cap is currently $4,601,900 (based on population of 54,140 estimated
by the U.S. Census Bureau at 12/27/07).
DISCUSSION:
According to the regulations, any volume cap not reserved or committed by a
municipality by April 30th is automatically transferred to the State of Illinois. If a
community does not have any specific projects that would qualify for the tax exempt
financing, it can cede, or transfer, the volume cap to another community.
Over the past several years, it has become common for municipalities to transfer
their unused volume cap to other municipalities in exchange for a fee. The fee is
actually paid by the ultimate beneficiary of the tax-exempt financing. The amount of
the fee paid depends upon the economy and the current interest rate environment.
The Village has typically received between 1-2% for the sale of its volume cap.
Most recently, the Village sold $1,000,000 worth of 2006 volume cap at 1 %, or
$10,000. The balance of the 2006 volume cap was transferred to benefit the
"Assist" first-time homebuyer program administered through the City of Aurora.
Mount Prospect volume cap for 2007 was reserved, but not ceded to another
community or used internally.

The Village has a total of $4,601,900 of private activity bond volume cap it must
reserve by April 30th or it will be transferred to the State of Illinois. The Village can
choose to hold onto the volume cap after it is reserved until a project is identified. It
may also be able to carry over the cap for up to three years depending on the type
of project being considered. There are currently no projects at this time placing a
request on the Village's volume cap.
RECOMMENDATION:
It is recommended the Village Board adopt the attached ordinance reserving the
Village's private activity bond volume cap for 2008.

AN ORDINANCE RESERVING VOLUME CAP IN CONNECTION WITH
PRIVATE ACTIVITY BOND ISSUES, AND RELATED MATTERS.
WHEREAS, the Village of Mount Prospect, Cook County, Illinois (the "Municipality"), is
a municipality and a home rule unit of government under Section 6 of Article VII of the 1970
Constitution of the State of Illinois; and
WHEREAS, Section 146 of the Internal Revenue Code of 1986, as amended (the "Code"),
provides that the Municipality has volume cap equal to $85.00 per resident of the Municipality in
each calendar year, which volume cap may be reserved and allocated to certain tax-exempt
private activity bonds; and
WHEREAS, the Illinois Private Activity Bond Allocation Act, 30 Illinois Compiled
Statutes 1998, 345/1 et seq., as supplemented and amended (the "Act''), provides that a home
rule unit of government may transfer its allocation of volume cap to any other home rule unit of
government, the State of Illinois or any agency thereof or any non-home rule unit of government;
and
WHEREAS, it is now deemed necessary and desirable by the Municipality to reserve all of
its volume cap allocation for calendar year 2008 to be applied toward the issuance of private
activity bonds (the "Bonds "), as provided in this Ordinance, or to be transferred, as permitted by
this Ordinance;
Now, THEREFORE, Be It Ordained by the President and the Board of Trustees of the
Village of Mount Prospect, Cook County, Illinois, as follows:
SECTION 1. That, pursuant to Section 146 of the Code and the Act, the entire volume
cap of the Municipality for calendar year 2008 is hereby reserved by the Municipality, which
shall issue the Bonds using such volume cap, or shall use or transfer such volume cap, without
any further action required on the part of the Municipality, and the adoption of this Ordinance
shall be deemed to be an allocation of such volume cap to the issuance of the Bonds or such
other bonds; provided, that any such transfer shall be evidenced by a written instrument executed
by the Mayor or any other proper officer or employee of the Municipality.
SECTION 2. That the Municipality shall maintain a written record of this Ordinance in
its records during the term that the Bonds or any other such bonds to which such volume cap is
allocated remain outstanding.
SECTION 3. That the President, the Village Clerk and all other proper officers, officials,
agents and employees of the Municipality are hereby authorized, empowered and directed to do
all such acts and things and to execute all such documents and certificates as may be necessary
to further the purposes and intent of this Ordinance.
SECTION 4. That the provisions of this Ordinance are hereby declared to be separable,
and if any section, phrase or provision of this Ordinance shall for any reason be declared to be
invalid, such declaration shall not affect the remainder of the sections, phrases and provisions of
this Ordinance.
, SECTION 5. That all ordinances, resolutions or orders, or parts thereof, in conflict
herewith are, to the extent of such conflict, hereby superseded; and that this Ordinance shall be
in full force and effect upon its adoption and approval.

COOPERATIVE (IPBC) FOR VILLAGE HEALTH INSURANCE
The Village became a member of the IPBC in 1997. Since that time, the Village has renewe
membership in this health insurance cooperative three times (1999, 2002 and 2005). There are
currently 43 member agencies included in the cooperative consisting of municipalities, park districts,
libraries, special service districts and sub-pools of smaller communities. This is up from 36 members
at the time of the last renewal in 2005. The cooperative is an attractive alternative for agencies
wanting to take advantage of the pooled aspects of insurance for shared claims experience and rate
stabilization.
The IPBC negotiates HMO and PPO insurance coverage pricing along with individual and aggregate
stop loss coverage, life insurance, prescription drug rates and claims administration. The cooperative
also negotiates dental coverage where applicable. Member agencies are then able to customize their
own health insurance plans based on individual need. This also allows flexibility when negotiating
coverage options with any employee groups.
Participation in the cooperative allows for the sharing or pooling of risk for major claims. While risk is
shared among member agencies, each participant's total exposure is limited to their own claims
experience and a pro-rata pooled share based on the number of covered lives as a percentage of the
total pool. Therefore, even if the pool experiences a poor claims year, the member agency can receive
some benefit by having favorable claims experience compared to the overall pool.
Pricing obtained through the cooperative compares favorably to the national trend. The table below
illustrates the annual rate increase of IPBC compared to the national trend for both the HMO and PPO
plans.

In additional to favorable pricing, there are numerous operational and other financial advantages for
maintaining membership in the IPSG. A data warehousing project was implemented allowing the
collection of claims data across the entire IPSG membership. This information can now be shared
among members and be used in preparing comparables. This information also allows the IPSG to
maximize the effectiveness of the health plans by directing efforts where problem areas appear and
keep future cost increases down.
An integrated wellness and disease management program ("Healthy Focus") was implemented in 2008
to provide employees covered by Village health insurance a partner, or "health coach" to assist in
maintaining a healthy lifestyle. This personal health coach will help with lifestyle programs or chronic
condition programs such as nutritional guidance, physical activity, tobacco cessation, diabetes and
high blood pressure.
Other operational changes made during the 2007-2008 plan year include a change in health care
providers for one of the PPO vendors and the establishment of a single prescription vendor. These
changes provided an additional strong option for membership to choose from for health coverage and
aim to help control costs for the expensive prescription drug benefit.
One final benefit of membership in the IPSG is the accumulation of an equity reserve that can be
utilized as a rate stabilizer during periods where claims experience is poor or to reduce the overall
premium for coverage during lean budget times. The reserve is built up over time when actual claims
experience is lower than the budgeted monthly premium. The current reserve balance is $738,697.
Staff would recommend Village Soard authorization to approve the attached resolution extending the
period of participation in the IPSG for a period of three additional years from July 1, 2008 through June

RESOLUTION NO.
A RESOLUTION EXTENDING THE PERIOD OF
PARTICIPATION IN THE INTERGOVERNMENTAL
PERSONNEL BENEFIT COOPERATIVE FOR A PERIOD
OF THREE ADDITIONAL YEARS.
WHEREAS, the Village of Mount Prospect, a municipal corporation is a Member
of the Intergovernmental Personnel Benefit Cooperative, ("IPBC"), which is an intergov-
ernmental entity providing employee benefits to the officers and employees of this
municipality; and
WHEREAS, through its membership in the IPBC, this municipal corporation
gains the ability to achieve economies of scale in the administration of the benefit claims
of its requisite Members and the other benefits of membership provided for in the
Contract and By-Laws of that Cooperative; and
WHEREAS, the Contract and By-Laws of the IPBC provide that the IPBC shall
operate in three (3) year cycles with the governing board of each Member, including the
governing board of municipal corporation Members, being required to pass an ordinance
or resolution agreeing to continue as a Member for the new three-year cycle; and
WHEREAS, failure to pass a timely ordinance or resolution agreeing to continue
as a Member, at least sixty (60) days before the commencement date of a new three-year
cycle shall constitute a withdrawal from the Cooperative; and
WHEREAS, the next three-year cycle of the Cooperative commences on July 1,
2008; and
WHEREAS, this municipal corporation desires to express, through the passage of
this Resolution, its desire to continue as a Member of the Cooperative for the three-year
cycle commencing on July 1, 2008, provided that an adequate number of other Members
of the Cooperative, as is set forth within the Contract and By-Laws document, also agree
to continue as Members for the next three-year cycle; and
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS:
SECTION 1: This municipal corporation shall continue as a member of the
Intergovernmental Personnel Benefit Cooperative for a three-year term commencing on
July 1, 2008, in accordance with the Contract and By-Laws of that entity as it currently
exists or as it may be validly amended in the future.
SECTION 2: The obligation of this municipal corporation to be a Member of the
Intergovernmental Personnel Benefit Cooperative shall obligate this municipal
corporation to make financial contributions to the Intergovernmental Personnel Benefit
Cooperative only to the extent required from time-to-time by the Contract and By-Laws
of the IPBC and authorized therewith by the Board of Directors or the Executive
Committee.
SECTION 3: This Ordinance shall take effect immediately upon its passage and
approval as provided by law.
