At the July 12, 2022 Committee of the Whole meeting, staff discussed the
challenges associated with rehabilitation of the Fairview Gardens sanitary sewer
pumping station. Notably, the Metropolitan Water Reclamation District of Greater
Chicago (MWRDGC) will not issue a permit for the work until excess clear water is
removed from the system. The source of the excess clear water appears to be
private sector plumbing.
The most economical and effective solution considered was to prevent clear -water
entry into the separate sanitary sewer system by correcting private sector
deficiencies such as direct footing the connections or improperly connected
exterior area drains (driveway drains, stairwell drains, etc.). Discussion ensued
regarding the idea of utilizing Village funds to facilitate this work.
As a next step in developing this solution, staff proposes a pilot project to
determine how effectively private sector improvements remove excess clear water
and to accurately define costs.
Attachment A depicts the proposed pilot project area. It includes 24 homes on
Lowden Lane west of the intersection with Stevenson Lane. The area includes 12
homes that have suspected direct footing tile connections and 12 homes that have

existing sump pumps with no apparent clear -water discharges to the separate
sanitary sewer.
Most importantly, staff has a history of sanitary sewer flow monitoring data for
this distinct area. Flows in this area traditionally behave as a microcosm of the
larger Fairview Gardens area. That is, there are dramatic volume peaks
immediately after rain events. Arguably, if private sector improvements alleviate
the excess clear water intrusion problem in this sub -basin, it seems likely that this
solution would the subdivision writ large.
Staff proposes to hire a plumbing contractor to perform the footing the
disconnection work. While this work progresses, Public Works staff will re -inspect
the remaining homes in the pilot project area to validate or debunk how clear
water is discharged.
An underlying assumption about a home with a sump pump is that all of the
footing tiles and exterior area drains are discharged at grade. Consequently, it has
been assumed that homes with sump pumps are not significant contributors of
clear water flow. Staff will utilize dye -water testing and closed circuit camera
inspections to determine as accurately as possible whether these properties
discharge clear water to the separate sanitary sewer.
Staff anticipates that pilot project work can be completed by early spring allowing
Public Works crews to perform post -improvement flow monitoring. Post
improvement flow monitoring should yield definitive information about the overall
effectiveness of this proposed solution. If excess clear water is substantially
reduced and costs are reasonable, the proposed solution may be viable to
implement throughout the remainder of the subdivision.
Staff prepared a detailed request for proposals (RFP) necessary to hire a plumbing
contractor for the footing the disconnection work. A copy of this RFP is enclosed.
Qualified plumbing contractors were invited to an interview with staff to discuss
the project and review the firm's qualifications for the work. In addition, each firm
was also asked to submit a separate cost proposal indicating proposed fees.
The basic scope of work includes removing direct footing the connections,
installing a sump pump pit with pump that discharges at grade, and installing a
sanitary ejector pump discharging to overhead sewers in each of the three (3)
model homes and all 12 homes with suspected direct footing tile connections in
the pilot project area.

The contractor will restore exterior excavations to grade. Public Works crews will
perform requisite landscape restoration and the Building Division will coordinate
any required interior restoration via a separate procurement process.
A total of 15 homes are included in this proposed project. This quantity includes
two (2) raised ranches, one (1) split-level, and twelve (12) assumed split-levels
with sub -basements. Staff has determined that all of the homes in the Fairview
Gardens subdivision can be classified as one of these styles. The contractor will be
compensated for all subsequent work completed in the pilot project area based on
the submitted fee for the style of the home.
Staff facilitated open house visits with a volunteer homeowner for each style of
home. The volunteer sites are referred to as "model" homes in Attachment A.
Contractors were asked to submit costs for each type of home.
In addition, contractors were also asked to submit pricing to restore exterior
excavations with clean trench backfill (alternate 1) and provide electrical
upgrades; such as an additional circuit for sump pump. (alternate 2).
RFPs were distributed to four (4) plumbing contractor firms with expertise and
experience removing direct footing the connections and installing overhead sewers
in the Village of Mount Prospect.

Four (4) plumbing contractors participated in interviews and three (3) submitted
cost proposals. Each interview was qualitatively evaluated by staff based on the
background of the firm, related project experience, proposed personnel, scope of
work, schedule, and overall approach. Each firm received a point ranking (total
points = 100) for each criterion. Table 1 below summarized this analysis:

The highest rated firm was Rick's Sewer & Drainage of Spring Grove, Illinois
(Rick's).
Since each contractor was invited to participate based on work experience known
to staff, each firm was found well qualified for the project and, therefore, the
qualitative scores are closely distributed.
Rick's received the highest qualitative score because the firm successfully
completed an almost identical project for the Village in 2010 by removing direct
footing tile connections and installing overhead sewers for 15 flood -prone homes
in separate sanitary sewer basin #14 (Cleven & Lancaster area). Rick's plans to
utilize the same personnel on this project.
Each firm was asked to submit a cost proposal as well. Table 2 below summarizes
staff's analysis of costs:

The lowest cost proposal was submitted by Rick's Sewer & Drainage. A copy of the
firm's cost proposal is enclosed.
Please note, during model home site visits with contractors, interior inspection
revealed that the ranch -style home is constructed on top of a crawl space with
gravel infill. The home does not have footing tiles. For this reason, staff has
omitted the ranch -style home from the basis of award.
Also, please be aware that Rick's and Intelligent Service submitted fees to
upgrade the electrical service (i.e. from a 60 amp service to a 100 amp service) of
their own volition. These costs are denoted for informational purposes but were
not included in the basis of award.
It is the opinion of staff that Rick's Sewer & Drainage understands the proposed
project, has extensive experience, requested a reasonable fee, and is well
qualified to perform the work.
Staff recommends awarding a contract to include base price, alternate 1, and

alternate 2 work at all 15 homes. The total cost to perform this work is $366,850.

In addition, staff recommends including a 10% contingency in the award for this
project in order to accommodate unforeseen circumstances encountered in private
homes. This contingency would increase the total project award to $403,535.

2. Action at the discretion of the Village Board.
Staff Recommendation
Staff recommends that the Village Board accept the proposal for the 2022
Fairview Gardens Footing Tile Disconnection Program Pilot Project as submitted by
Rick's Sewer & Drainage of Spring Grove, Illinois in an amount not to exceed
$403,535.

Fairview Gardens Footing Tile Disconnection Program
Pilot Project
Proposals due — October 7, 2022
The Village of Mount Prospect (Village) is seeking proposals from, qualified plumbing and sewer
contractors to disconnect footing tiles from sewer service lines and install overhead sewer
systems at selected private single-family homes tributary to the Village -owned separate sanitary
wastewater collection system.
The selected homes are delineated in Attachment A. Selected homes are categorized as Model
Homes and Pilot Project Homes. Model Homes must be fully completed prior to beginning work
on the Pilot Project Homes. The Village will issue a separate and distinct Notice to Proceed for
both the Model Homes and the Pilot Project Homes.

Project Scope
The contractor shall provide professional services and materials necessary to convert pre-existing
gravity, sanitary drain, waste, and vent system to a new overhead system at each specified
property (privately -owned home). At a minimum the Base Price at each home shall include:
1. All work to meet State of Illinois Plumbing Code and Village of Mount Prospect local
amendments.
2. Convert below floor gravity system waste line system to an overhead gravity system
that includes a clean-out. Include disconnection of any drain tile, below grade fixtures,
and connection to the drain and waste vent stacks.
3. Disconnected drain tile shall be reconfigured underground to drain to an approved
sump pit with sealed lid configuration and appropriate check valve. All sump discharge
shall flow to grade either at the front or rear of the property as approved by Director of
Public Works or authorized representative.
4. All below grade fixtures shall drain to an approved vented and sealed ejector pit that
collects all floor drains, laundry trays, bathrooms, and basement plumbing fixtures.
Include an appropriate check valve.
5. All plumbing piping shall be supported per code as necessary.
6. A 6" exterior clean-out is to be included with all necessary interior code cleanouts as
required at curves and/or bends.
7. Excavation, backfill with spoil, and rough, mounded grade restoration. No final grade,
seed, or sod is to be included in the Base Price.
8. It is the responsibility of the contractor to ensure that a State of Illinois licensed plumber
is on the jobsite at all times.
9. All sump pumps require a dedicated electrical outlet and circuit.

10. All proposals shall include the cost of an installed Sump Pro Model 75 (or equivalent)
fully automatic 115V auxiliary power source for the sump pump.
11. All ejector pumps require a dedicated electrical outlet and circuit.
12. A licensed electrician is required to perform all work associated with the installation or
modification of sump pumps and/or ejector pumps.
13. Any and all "incidental" or other costs associated with the provisions and requirements
of the "General Conditions" referenced herein.

SPECIAL PROVISIONS
Alternate #1: The Contractor shall provide a lump sum, not -to -exceed fee to backfill
non -pavement area excavations with clean sand mechanically compacted in 9 -inch lifts
and top -dressed with a minimum 4 inches of clean, pulverized topsoil at a finished grade.
Paved areas shall be backfilled in a similar manner utilizing CA -6 in lieu of sand. All
excavations shall be removed from the work site and lawfully disposed.
2. Alternate #2: The Contractor shall provide a lump sum, not -to -exceed fee to upgrade
the existing electrical panel and/or service to accept the load and circuit requirements
necessary to facilitate the Base Price scope of work referenced herein. Only electrical
upgrades directly correlated with this scope of work and expressly specified by the
Village should be included in this fee.
3. Some private homes participating in this project may have various and disparate existing
components of an overhead sanitary sewer system. Costs to replace and/or upgrade
these existing facilities (i.e. sump pumps, battery back-up systems, sump crocks, etc.)
should NOT be included in the Base Price unless the upgrades or replacements are an
intrinsic and essential part of the improvements.
For example, a homeowner may have constructed an addition to the primary structure.
This addition may be served by a footing tile and sump pump system while the original
structure still has direct footing tile connections to the sanitary sewer. As part of the
improvements, a new sump crock and pump will be installed to accept the footing tile
connections from the original structure. Unless (as part of this project) the footing tiles
from the original structure are brought to the sump crock installed with the addition, any
costs associated with upgrading the addition's sump crock, sump pump(s), battery back-
up system, or discharge piping should NOT be included.

GENERAL CONDITIONS
INSURANCE REQUIREMENTS (Incidental)
The Contractor shall provide Insurance of such types and in such amounts as may be
necessary to protect himself/herself and the interests of the Village against all hazards or
risks of loss as hereinafter specified. The Village shall be named as additional insured on
all of the Contractor's policies. The Village's endorsement on the certificate of insurance
shall specifically state that the Village of Mount Prospect is primary and non-contributory
additional insured. Satisfactory certificates of insurance shall be filed with the Village
prior to starting any work on the Contract. The certificates shall state that ten (10) days
advance written notice will be given to the Village before any policy covered thereby is
changed or canceled.
Satisfactory Workers Compensation and Employer's Liability insurance to satisfactorily
protect himself/herself against all claims under applicable state compensation laws. The
Contractor shall also be protected against claims for injury, disease, or death of
employees that, for any reason, may not fall within the provisions of a worker's law. This
policy shall include an "all states" endorsement. The liability limits shall not be less than:

The contractor shall not commence work until he has filed with the Village a certificate of
insurance showing complete coverage of all insurance required, signed by the insurance
companies or their authorized agents. Each certificate shall provide that coverage shall not be
terminated or reduced without 30 days advance notice to the Village. The contractor shall name
the Village as additional named insured on the comprehensive general liability and automobile
liability policies. No additional compensation will be made to the contractor for compliance with
the above requirements.
INDEMNIFICATIONS (Incidental)
The contractor shall indemnify and hold harmless the Village, its agents and employees from and
against all claims, damages, losses and expenses, including attorney's fees, arising out of or
resulting from the performance of the contractor's work. In any and all claims against the owner,
or any of the owner's agents or employees, by any employee of the contractor, or anyone directly
or indirectly employed by the contractor, or anyone for whose acts the contractor may be liable,
the indemnification obligation shall not be limited in any way by any limitation on the amount of
damages, compensation or benefits payable by or for the contractor under Worker's
Compensation acts, disability benefit acts or other employee benefit acts.
OBSERVANCE OF LAWS, ORDINANCES, AND REGULATIONS (Incidental)
1) The contractor shall, at all times during the life of this contract, observe and abide by all
federal, state and local laws which in any way affect the conduct of the work and with all

decrees and orders of courts of competent jurisdiction. Likewise, said contractor shall be
governed by all municipal ordinances and regulations which in any way affect the conduct
of the work. The contractor shall indemnify and save harmless the owner, its officers,
agents, and employees against any claim or liability arising from or based on his violation
of any law, ordinance, regulation, decree or order.
2) The contractor shall procure and display all necessary licenses and permits in connection
with the work of his contract. The Village agrees to waive its fees for building permits and
inspections.
PROPERTY PROTECTION (Incidental)
No vehicles of any kind shall be placed, parked or operated upon or over any sodded areas.
During performance of the work, Contractor shall protect all utilities and property from damage.
Contractor shall spot all utilities prior to any excavation work. Contractor shall call J.U.L.I.E. one
Call System (1-800-892-0123), and request utility locations as soon as possible for emergency
repairs and within forty-eight (48) hours for non -emergency work prior to excavation in strict
accordance with J.U.L.I.E. one Call System operation procedures.
TREE PROTECTION (Incidental)
REMOVAL PROHIBITED UNLESS AUTHORIZED: All trees shall be maintained, saved, and
protected from damage unless removal is approved by the Village.
CRITICAL ROOT ZONE: To prevent unnecessary damage to existing public trees during
construction, proper tree protection guidelines must be followed, particularly in the root zone
where major support roots securely hold the tree in the soil. This Critical Root Zone (CRZ) is
defined as the entire ground area within the vertical projection of the crown of a tree. This is also
commonly referred to as the area within the drip line of a tree.
Power equipment may not be used to excavate soil, change grades, or dig trenches in the Critical
Root Zone. All soil excavation done within the CRZ must be done by hand, except as authorized
in these specifications. Exceptions to the above shall be granted only with written permission
from the Director of Public Works.
FENCING: All unpaved ground on public property within the CRZ's of existing trees subject to
construction damage shall be fenced before any work is started. This Tree Protection Fencing
will be paid for as specified in these contract documents. Once assembled, no fencing shall be
removed without proper approval of the Engineer, and there shall be no construction activity or
material including storage, stockpiling, and equipment access within the enclosure. Fencing
material shall be orange polypropylene snow fence supported with metal posts.
CHANGES TO EXISTING GRADE: No changes to original grade shall be allowed inside the
CRZ.
ROOT PRUNING DURING CONSTRUCTION: All tree roots greater than one inch (1") in
diameter that are encountered in any construction process shall be cut cleanly with an
appropriate saw or pruning shear or other tool specifically designed for cutting wood. Axes or
other such chopping tools shall not be used. Shovels or other tools designed for digging shall not
be used.
ATTACHMENTS TO TREES: No signs, placards or other objects may be nailed or stapled to
trees.
BRANCH REMOVAL: Tree branches shall not be cut, pruned or trimmed by the Contractor.

PENALTIES FOR TREE DAMAGE: Where limbs, trunks or roots of trees not approved for
removal are damaged, the Village shall determine whether the tree can be repaired or must be
removed. Repairs may include, but are not strictly limited to, pruning of broken limbs, removal of
loose bark and proper shaping of wounds, thinning of the crown to compensate for root loss,
fertilization, straightening and staking.
Repairs shall be performed by the Village. The cost of such repairs shall be paid for by the
Contractor to the Village, using rates listed in the current edition of the Village's Equipment and
Labor Rate Charges.
If in the opinion of the Village, the amount of damage warrants removal of the tree due to safety
or aesthetic concerns, the Contractor shall remove the tree, along with its stump to a depth of 12
inches below grade. The Contractor shall pay the Village for replacement of the tree.
Replacement cost will be determined by multiplying the diameter of the damaged tree, as
measured 4-1/2" above the ground, by the rate of $150.00/inch.
DESCRIPTION: All unpaved ground on public property within the CRZ's of existing trees subject
to construction damage shall be fenced before any work is started. Once assembled, no fencing
shall be removed without prior approval of the Engineer, and there shall be no construction
activity or material including storage, stockpiling, and equipment access within the enclosure.
The fencing shall be installed in accordance with the details as shown on the drawings and as
directed by the Engineer.
The Contractor shall be responsible for being familiar with and complying with all aspects of the
Village of Mount Prospect Tree Protection ordinance as it relates to the various site locations.
Any questions regarding tree protection shall be directed to the Village Forestry Division and their
response or direction shall be considered as the final word/decision on tree protection issues.
Any costs for tree protection fencing, posts, labor or other associated labor or material shall be
incidental with the fixed cost per unit bid.
SCHEDULING (Incidental)
The contractor shall consult with the Public Works Director or his authorized representative
concerning the details and scheduling of the work contemplated herein, and shall be governed by
the decisions of said Public Works Director or his authorized representative.
PUBLIC CONVENIENCE AND SAFETY (Incidental)
The contractor shall notify the Director of Public Works at least three days in advance of the
starting of any construction work which might in any way inconvenience traffic, and the contractor
shall at all times conduct the work in such a manner as to insure the least obstruction to vehicular
and pedestrian traffic. Whenever possible, the contractor shall provide and maintain at his own
expense such temporary roads and approaches as may be necessary to provide access to
driveways, houses, buildings or other property abutting the improvements. In no case will the
contractor obstruct entrance ways into private property without first seeking Village and private
property owner's approval.
ACCIDENT PREVENTION (Incidental)
The contractor shall exercise every precaution at all times for the protection of persons and
properties. The safety provisions of all applicable laws and ordinances shall be strictly observed.
Any practice obviously hazardous, in the opinion of the Director of Public Works or his authorized
representative, shall be immediately discontinued by the contractor upon his receipt of
instructions from the Director of Public Works or his authorized representative to discontinue such
practice.

COOPERATION WITH UTILITIES (Incidental)
It is understood and agreed that the contractor has considered in his bid all of the permanent and
temporary utility appurtenances in their present or relocated positions that may be encountered
during construction and no additional compensation will be allowed for any delays,
inconvenience, or damage sustained by him due to any interference from the said utility
appurtenances either by the utility company or by him, or on account of any special construction
methods required in prosecuting his work due to the existence of said appurtenances either in
their present or relocated positions. The contractor shall insure that prompt repairs are, to the
approval of the inspector, made to any utility appurtenances damaged by him without
compensation from the Village.
CONSTRUCTION NOISE RESTRICTION (Incidental)
1) All construction activities or alteration operations within the Village shall be performed
only between the hours of 8:00 a.m. and 7:00 p.m. Variations from these time limitations
shall be allowed only in the case of maintenance of operation of safety and traffic control
devices such as barricades, signs and lighting, or to construction of an emergency
nature. More stringent requirements may be assessed for work in state highway or
railroad rights-of-way." Working hours outside these times must receive prior approval
from the Village.
2) The Contractor will be required to submit a separate letter to formally request a variation
in the prescribed working hours as outlined above.
BARRICADES AND WARNING SIGNS AND LIGHTS (Incidental
The contractor shall erect substantial barricades to protect his work at all points deemed
necessary by the Director of Public Works; said contractor shall place at such points the
necessary warning signs, amber lights, and other suitable devices to protect his work properly
and to provide for the convenience and safety of the public at all times. The contractor shall
maintain such barricades, signs, lights and protective devices until the need for them, in the
judgment of the Public Works Director of his authorized representative, has passed.
Contractor shall provide warning signs and barricades to safely mark any hazards or detours
caused by the work. All such warning signs and barricades for work in, or affecting Village of
Mount Prospect streets, access roads, and state highways shall meet all applicable requirements
as stipulated in the latest edition of the Manual for Uniform Traffic Control Devices published by
the U.S. Department of Transportation. All costs for barricades, signs including all labor and other
associated materials shall be incidental to the fixed unit price bid.
TRAFFIC CONTROL (Incidental)
Contractor shall maintain traffic flow(s) and accessibility to private property(s) as close to normal
condition as possible. Contractor shall notify residents, Village of Mount Prospect and
state/county officials, as appropriate, of any driveway or road closure.
The contractor shall abide with the Illinois Department of Transportations Standard Specifications
for Road and Bridge Construction, latest edition. The Contractor shall also abide with the Manual
on Uniform Traffic Control Devices, latest edition. Contractor shall also provide sufficient flag
persons to assist with traffic control during operation.
Traffic control is by per street per day and typically includes all work within the street from
intersection to intersection (i.e. there may be two manholes being raised on same section of
street). Traffic control will only be paid for consecutive days worked.

WORK IN STREET RIGHT-OF-WAY (Incidental
All of contractor's construction work in street right-of-ways shall be done in strict accordance with
the applicable controlling public agency's construction specifications, rules, and regulations.
Contractor shall coordinate with the proper public officials and receive approval from said officials
prior to any street closings or detouring required due to the work to be performed.
Contractor shall protect existing vegetation from removal or damage wherever possible.
Contractor shall confine construction work to specified construction limits as shown on the
drawings or defined in the specifications. Should Contractor damage or remove any vegetation
outside the construction limits, Contractor shall restore the affected area to its original state at no
expense to the Village.
DATA (Incidental)
Any reservations on the use of data contained in a proposal must be clearly stated in the proposal
itself. The village assumes that, unless stated otherwise, information submitted in response to
this request may be used within the Village on a proprietary basis.
COLLUSION
If at any time it shall be found that the person, firm, or corporation to whom the Contract has been
awarded has, in presenting any proposal or proposals, colluded with any other party or parties,
then the Contract so awarded shall be null and void and the Consultant and his sureties shall be
liable to the Village for all loss or damage which the Village may suffer thereby, and the Village
may advertise for new proposals for said work.
CLEAN —UP (Incidental)
After all work under each task phase of the work is completed, the Contractor shall remove all
loose debris and other materials not incorporated in the work from the site of the work. Any clean
up or restoration to private property will be the responsibility of the Contractor.
PUBLIC RELATIONS (Incidental)
The Contractor shall cooperate with the Village of Mount Prospect in maintaining a high degree of
sensitivity to the needs of property and business owners along the project route. Contractor to
distribute written public work notices to businesses and residences when required by the Village.
INSPECTION (Incidental)
1) All materials and each part or detail of the work shall be subject at all times to inspection
by the Village or its inspectors, and the contractor will be held strictly to the true intent of
the specifications in regard to quality of materials, workmanship and diligent execution of
the contract. The Village or its inspectors shall be allowed access to all parts of the work
and shall be furnished with such information and assistance by the contractor as is
required to make a complete and detailed inspection.
2) The contractor shall, if the Village requests remove or uncover such portions of the
finished work as the Village may direct before final acceptance of the same. After the
examination, the contractor shall restore said portion of the work to the standard required
by the specifications. If the work thus exposed or examined proves acceptable, the
expense of uncovering or removing and the replacing of the parts removed shall be paid
for as extra work; but if the work so exposed or examined is unacceptable, the expense
of uncovering or removing and replacing of the same shall be borne by the contractor.

REMOVAL OF DEFECTIVE AND UNAUTHORIZED WORK (Incidental
1) Work done without lines and grades being given, or beyond the lines shown on the plans
or as given, except as herein provided, or any extra work done without authority will be
considered as unauthorized and at the expense of the contractor, and will not be
measured or paid for. Work so done may be ordered removed or replaced at the
contractor's expense.
2) All work which has been rejected or condemned shall be remedied or removed and
replaced by the contractor in a manner approved by the Village at the contractor's
expense. Upon failure on the part of the contractor to comply promptly with any order of
the Village made under the provisions of this article, the Village shall, after giving written
notice to the contractor, have the authority to cause defective work to be remedied, or
removed and replaced, or to cause unauthorized work to be removed, and deduct the
cost thereof from any compensation due or to become due the contractor.
FINAL INSPECTION (Incidental
The Village shall make final inspection of all work included in the contract, as soon as practicable
after notification in writing by the contractor that the work is completed and ready for acceptance.
If the work is not acceptable to the Village at the time of such inspection, the Village shall inform
the contractor as to the particular defects to be remedied before final acceptance can be made.
BASIS FOR PAYMENT
Payment for work completed within the project scope at Model Homes shall be at the lump -sum,
not -to -exceed Base Price provided in the Cost Proposal.
Payment for work completed within the project scope at Pilot Project Homes shall be at the same
lump -sum, not -to -exceed Base Price for the corresponding type of home provided in the Cost
Proposal.
PAYMENT FOR EXTRA WORK
Payment for extra work shall be by lump sum price or at a unit price agreed upon by the
contractor and owner. Only extra work specifically and expressly authorized by the Village in
writing will be eligible for compensation.
PAYMENT FOR ITEMS OMITTED WHEN PARTIALLY COMPLETED
Should the Village cancel or alter any portion of the contract which results in the elimination or
non -completion of any portions of the work partially completed, the contractor will be allowed a
fair and equitable amount covering all items of work incurred prior to the date of cancellation,
alteration, or suspension of such work. When such elimination or non -completion involves a new
decrease in the amount of the contract of more than twenty-five percent (25%) of the original
contract price, a supplemental agreement between the contractor and the Village will be required.
PARTIAL PAYMENT
1) When requested, the contractor will make an approximate estimate, in writing, of the
materials in place completed, the amount of work performed, and the value thereof, at the
contract unit prices. From the amount so determined, there shall be deducted ten
percent (10%) to be retained until after completion of the entire work to the Village for

payment, except that no amount less than $500 will be so certified unless the total
amount of the contract is less than $500.
2) In addition, an estimate may, at the discretion of the Village and upon presentation of
receipted invoices and freight bills, be made for payment of the value of acceptable
materials delivered on the work or in acceptable storage places and not used at the time
of such estimate. Ten percent (10%) shall be retained from the value of such materials
until final payment. Such materials, when so paid for by the Village, shall become the
property of the Village, and in the event of default by the Village, shall become the
property of the Village, and in the event of default by the contractor, the Village may use
or cause to be used such materials in the construction of the work provided for in the
contract. The amount thus paid by the Village shall be deducted from estimates due the
contractor as the material is used in the work.
3) Partial payment for work or materials shall not be construed as an acceptance of the
work or any part of it, or as a waiver of any provisions of the contract. Partial payment will
only be granted if in the opinion of the Village sufficient labor and materials have been
expended to warrant it.
ACCEPTANCE AND FINAL PAYMENT
Whenever the improvement provided for by the contract shall have been completely performed
on the part of the contractor, and all parts of the work have been approved by the Village and
accepted by the Village, a final payment showing the value of the work will be prepared by the
contractor as soon as the necessary measurements and computations can be made, all prior
estimates upon which payments have been made being approximate only and subject to
correction in the final payment. The amount of this estimate, less any partial or semifinal
payments previously made and less any sums that have been deducted or retained under the
provisions of the contract, will be paid to the contractor as soon as practicable after the final
acceptance, provided the contractor has furnished to the Village satisfactory evidence that all
sums of money due for any labor, materials, apparatus, fixtures or machinery furnished for the
purpose of such improvements have been paid or that the person or persons to whom the same
may be due have consented to such final payment.
The acceptance by the contractor of the final payment shall constitute a release and waiver of
any and all rights and privileges under the terms of the contract; further, the acceptance by the
contractor of final payment shall relieve the Village from any and all claims or liabilities for
anything done or furnished relative to the work or for any act or neglect on the part of the Village
relating to or connected with the work.
FINAL POLICING OF THE SITES (Incidental)
Before the completed work will be ready for the Village's final inspection, the contractor shall have
removed from the project sites all surplus equipment, machinery, materials, debris, barricades,
and signs. The contractor shall leave said project sites in the best possible condition to the
complete satisfaction of the Village.
ALTERATIONS, CANCELLATIONS, EXTENSIONS AND DEDUCTIONS
The Village reserves the right to alter the plans, extend or shorten the improvement, add such
incidental work as may be necessary, and increase or decrease the quantities of work to be
performed to accord with such changes, including the deduction or cancellation of any one or
more of the unit price items. Such changes shall not be considered as a waiver of any condition
of the contract nor to invalidate any of the provisions thereof. A supplemental agreement
between the contractor and the Village will be required where such changes result in a net

increase or a net decrease in the amount of the contract by twenty-five percent (25%) of the
original contract price.
AUTHORITY OF THE DIRECTOR OF PUBLIC WORKS
All work shall be done under the supervision of the Director of Public Works, or his designated
representative. He shall decide all questions which arise as to the quality and acceptability of
materials furnished, work performed, manner of performance, rate of progress of the work,
interpretation of the plans and specifications, acceptable fulfillment of the contract, compensation
and disputes and mutual rights between contractors under the specifications.
In case of failure on the part of the contractor to execute work ordered by the Director, the
Director may, at the expiration of a period of forty-eight (48) hours after giving notice in writing to
the contractor, proceed to execute such work as may be deemed necessary, and the cost thereof
shall be deducted from compensation due, or which may become due the contractor under the
contract.
RIGHT OF THE VILLAGE TO TERMINATE THE CONTRACT
Should the contractor fail to meet the quality standards of the specifications or fail to perform any
provisions of the contract, or fail to proceed at a satisfactory rate of progress or within cost limits
satisfactory to the Village, the Village, after seven days written notice to the contractor, may,
without any prejudice to any other remedy, make good the deficiencies resulting from faulty
workmanship and may deduct the cost thereof from the payment then or thereafter due to the
contractor, and/or terminate the contract.
Notwithstanding any other provision hereof, the Village reserves the right to terminate the
Contract at any time upon thirty (30) days written notice to the Contractor. In the event that the
Contract is so terminated, the Contractor shall be paid for work actually performed and
reimbursable expenses actually incurred, if any, prior to termination, not exceeding the value of
the Work completed, which shall be determined on the basis of the rates set forth in the Proposal.
WARRANTY
The Contractor shall guarantee and warrant the Work against defects in workmanship and
materials for a period of twelve (12) months from the date of Final Acceptance. Upon Final
Acceptance, the Contractor shall furnish the Owner with all manufacturers' and suppliers' written
guarantees and warranties covering materials and equipment furnished under the Agreement.
Any defects that appear within this twelve (12) month period and arise out of defective or
improper materials or workmanship shall, upon direction of the Owner, be corrected by the
Contractor at its own expense within a reasonable period of time after receipt of notice from
Owner, but not longer than ninety (90) days from the date of receipt of the notice. The Village
reserves the right to re -inspect such Work
HAZARDOUS MATERIALS
In performing the Work, Contractor shall take the necessary steps to remediate affected
hazardous materials, including asbestos, lead-based paint hazards and surfaces, etc., as
required by state and federal law and the ordinances of Cook County and the Village. Such work
shall be performed in accordance with those laws and ordinances. The costs for such work are
included in the Contract Amount. Should the work fail to conform to those laws and ordinances,
Contractor will be responsible for any additional costs to ensure compliance, including additional
abatement work and the cost of clearance testing.

AWARD
The award of any Contract or Agreement may be made to the Contractor who submits the
proposal which is in the best interest of the Village as evaluated by Village staff, at their sole
discretion.
In addition, the Village reserves the right to accept or reject any and all proposals, to waive any
informality in any proposals, and to accept any proposals considered advantageous to the
Village.
