The proposed interconnection will be constructed on Elmhurst Avenue between Kensington Road and Highland Street. A NWC transmission main in the Kensington Road right-of-way will be tapped and connected to existing NSMJAWA transmission mains located in the Elmhurst Avenue and Highland Street rights-of- way. Exhibit A presents this concept in greater detail. By operating valves installed along the interconnection piping, NWC can deliver up to 7 million gallons of water per day (MGD) to the Village, and NSMJAWA can deliver a like amount to NWC should the need arise. This rate of delivery will 1 satisfy the Village's maximum day requirements and provide approximately one- third of NWC's average daily demand. Due to substantial differences in operating pressures, NWC cannot deliver water to the NSMJAWA system. Therefore, NSMJAWA will not be participating in the cost of the interconnection. Although they receive no benefit from the interconnection, they are party to the agreement because they are allowing existing NSMJAWA infrastructure to be utilized for the improvements and they have agreed to provide NWC with an emergency source of water should their normal connection to the City of Evanston fail. The distribution of costs is delineated in Exhibit E. The total estimated cost to construct the interconnection is $5,791,567.04. This estimate includes construction engineering and a contingency allowance. The Village will be responsible for $4,081,533.52 and NWC will be responsible for $1,710,033.52. Both entities will share equally in the construction costs except for the booster pumping station and pipes utilized exclusively for delivery of water from NWC to the Village. The Village will be the sole payer for the booster pumping station improvements because the increased pumping capacity is necessary to effectively convey water throughout the Village -owned water distribution system. NWC realizes no benefit from the pumping improvements. Staff proposes to fund the Village's share of proposed improvements utilizing American Rescue Plan Act of 2021 (ARPA) funds allocated for this purpose. Presently, $5.5 million of ARPA grant proceeds have been escrowed to pay for this project. The NSMJAWA Executive Committee, comprised of member village managers, has already approved this IGA. The NSMJAWA Board of Directors, comprised of member mayors and elected officials, considered and approved this agreement on August 24, 2022. The NWC plans to discuss and vote on this IGA at their regularly scheduled October 12, 2022 Executive Board meeting. Attached is a resolution that authorizes the Village Manager to sign the IGA on the Village's behalf once it has reached final form, provided it substantially resembles the transmitted document. Although staff from each participating agency have recommended execution of the IGA in its current iteration, minor modifications to form and function are anticipated since the document must be approved by governing boards of three (3) distinct organizations. For this reason, staff recommends that the Village Manager be granted some leeway to sanction minor changes as the document moves through the disparate approval processes. 2 Once fully executed, staff anticipates that final design engineering will be completed this fall, bids will be let in the winter, construction will start next spring, and final completion expected in late summer 2023. Alternatives 1. Approve a resolution authorizing the Village Manager to sign an intergovernmental agreement with the Northwest Water Commission and the Northwest Suburban Municipal Joint Action Water Agency for the construction and operation of an emergency water system interconnection. 2. Action at the discretion of the Village Board. Staff Recommendation Staff recommends that the Village Board approve a resolution authorizing the Village Manager to sign an intergovernmental agreement with the Northwest Water Commission and the Northwest Suburban Municipal Joint Action Water Agency for the construction and operation of emergency water system interconnection.
