WHEREAS, a public hearing was held on the request for Special Use, being the subject of ZBA Case No. 66-SU-93, before the Zoning Board of Appeals of the Village of Mount Prospect on the 26th day of August, 1993, pursuant to proper legal notice having been published in the Mount Prospect Herald on the 10th day of August, 1993; and WHEREAS, the Zoning Board of Appeals has submitted its findings on the request to the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect will be served by the granting the request being the BA 66-SU-93 Page 2 of 2 subject of ZBA 66-SU-93. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TVVO: That Ordinance No. 4142 passed and approved February 6, 1990 is hereby amended in order to delete the self-storage facility as shown on the approved Site Plan, and to allow an enclosed outside storage area for building materials as an accessory use of a Menard's Home Improvement Center, a use permitted in the existing B-3 Retail Service Zoning District. The amended Site Plan is dated 7/1/93, by Menard's Inc. SECTION THREE: That the amendment being the subject of this Ordinance is subject to the following conditions: 1. The fence/wall system abutting the Harvest Heights Subdivision shall be limited to a ten foot (10') height and setback seven feet (7') from the property line of the Subject Property. Menard's shall be responsible for removing the existing fence in this area, and for extending existing perimeter fences of abutting single family lots to meet the fenced wall system. Such fencing shall be of the same style as the existing fences. 2. Menard'$ Inc. shall landscape the exterior side of the fence/wall system abutting the Harvest Heights Subdivision. Such landscape treatment shall be installed as approved in writing by the Harvest Heights Homeowner's Association prior to final occupancy of the building. Abutting homeowners shall be responsible for maintenance of this landscaping after initial planting by Menard's. 3. Menard's Inc. shall accept all responsibility for maintenance of utilities located in existing easements that are encroached upon by the fence/wall system. 4. Menard's Inc. shall provide security lighting on the exterior of the fence/wall system along the south property line. All other lighting shall be inside the fence/wall and shall not reflect upon any abutting properties. All lighting shall be extinguished between 11:00 PM and 7:00 AM, except for reasonable security lighting. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
