AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
COMMONLY KNOWN AS 1745 VERDE DRIVE
WHEREAS, Joseph and Catherine Schubkegel (hereinafter referred to as Petitioners)
have filed an application for a variation from Chapter 14 of the Village Code of Mount
Prospect, Illinois, for property commonly known as 1745 Verde Drive (hereinafter referred
to as Subject Property), legally described as:
Lot 9 in Block 3 in Hatlen Heights Unit #1, a Subdivision in the South 1/2 of
the Northeast 1/4 of Section 10, Township 41 North, Range 11, East of the
Third Principal Meridian, according to the plat thereof registered in the Office
of the Registrar of Titles of Cook County, Illinois on August 17, 1955 as
Document No. 1614665
and
WHEREAS, Petitioners seek a variation from Section 14.102.B.4 to allow a 775 square
foot garage, instead of the maximum allowed 600 square feet, in order to allow a storage
room addition to the existing garage; and
WHEREAS, a public hearing was held on the variation requested, being the subject of
ZBA Case No. 69-V-93, before the Zoning Board of Appeals of the Village of Mount
Prospect on the 9th day of September, 1993 pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the 24th of August, 1993; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation
to the President and Board of Trustees of the Village of Mount Prospect and the
President and Board of Trustees of the Village have given further consideration to the
variation being the subject of ZBA 69-V-93 and have determined that the best interests
of the Village of Mount Prospect would be served by granting said variation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings
of fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect
hereby grant to the Subject Property a variation from Section 14.102.B.4 to permit a
garage 775 square feet in size. Said variation is granted with the condition that the
Petitioner or futura property owner shall not allow the shed to be used in conjunction with
a home occupation.
SECTION THREE: Except for the variation granted herein, all other applicable Village
of Mount Prospect Ordinances and regulations shall remain in full force and effect as to
the Subject Property.
SECTION FOUR: In accordance with the provisions of Section 14.604 of Chapter 14 of
the Village Code, the variations granted herein shall be null and void unless permits are
issued and construction begins within one (1) year from the date of passage of this
Ordinance.

SECTION FIVE: This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.
