ORDINANCE NO. 4600
AN ORDINANCE AMENDING ORDINANCE NO. 4500 BY
EXTENDING THE EFFECTIVE DATE FOR A VARIATION GRANTED
TO PROPERTY LOCATED AT 811 SOUTH EDWARD STREET
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect did
adopt Ordinance No. 4500 on December 15, 1992, which Ordinance, entitled "An
Ordinance granting a variation for Property Located at 811 South Edward Street, Mount
Prospect, Illinois", was the subject of ZBA 73-V-92; and
WHEREAS, the property being the subject of Ordinance No. 4500 is legally described as
follows:
Lot 93 In Golfhurst, being a resubdivision of Lot 3 in Owners Subdivision of
Section 13, Township 41 North, Range 11, East of the Third Principal
Meridian in accordance to plat of said Golfhurst registered in the Office of
the Registrar of Titles of Cook County, Illinois on December 3, 1958 as
Document 183276;
and
WHEREAS, SECTION FOUR of Ordinance No. 4500 contains the provision that a
building permit must be issued and construction begun within one year from the date of
passage of said Ordinance; and
WHEREAS, Petitioner has requested the effective date for the variation being the subject
of Ordinance No. 4500 be extended for one additional year.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings
of fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect
hereby amend SECTION FOUR of Ordinance No. 4500 so that the effective date for the
variation being the subject of Ordinance No. 4500 shall be December 15, 1994.
SECTION FIVE: This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.

ORDINANCE NO.
AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
LOCATED AT 811 SOUTH EDWARD STREET
W-~EREAS, Richard E. Urban (hereinafter referred to as Petitioner;
has filed an application for a variation from Chapter 14 of the
Village Code of Mount Prospect, Illinois, for property Commonly
known as 811 South Edward Street (hereinafter referred to as
Subject Property), legally described as:
Lot 93 In Golfhurst, being a resubdivision of Lot 3 in
Owners Subdivision of Section 13, Towhsip 41 North, Range
11, East of the Third Principal Meridian in accordance to
plat of said Golfhurst registered in the office of the
Registrar of Titles of Cook County, Illinois on December
3, 1958 as Document 183276;
and
WHEREAS, Petitioner seeks a variation from Section 14.1102.B.1 to
allow a reduced interior side yard setback of four feet six inches
(4' 6"), rather than the required 7.2 feet to allow a 4' x 9'
addition to the second story of the single family home; and
WHEREAS, a public hearing was held on the variations requested
being the subject of ZBA Case No. 73-V-92 before the Zoning Board
of Appeals of the Village of Mount Prospect on the 12th day of
November, 1992, pursuant to due and proper ="- ~ ..... ~
in the Mount Prospect Herald on the 27th day of October, 1992; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and
recommendation to the President and Board of Trustees of the
Village of Mount Prospect and the President and Board of Trustees
of the Village have given further consideration to the variation
being the subject of ZBA 73-V-92 and have determined that the best
interests of the Village of Mount Prospect would be served by
granting said variation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGEOFMOb~{TPROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of
Mount Prospect hereby grant to the subject Property a variation
from Section 14.1102.B.1 to allow a four foot six inch (4' 6")
interior side yard setback, rather thanthe required 7.2', in order
to construct a 4~ x 9' addition to the second of story of the
subject Property.
SECTION THREE: Except for the variation granted herein, allother
applic~ble.Villageof Moun= Prospect Ordinances and regulations
shall remain in full force and effect as to the Subject Property.
SECTION FOUR: In accordance with the provisions of Section 14.604
of Chapter 14 of the Village Code, the variations granted herein
shall be null and void unless permits are issued and construction

begins within one (1) year from the date of passage of this
Ordinance.
SECTION FIVE: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
