AN ORDINANCE GRANTING MODIFICATIONS FROM THE CHAPTER 16
(DEVELOPMENT CODE) OF THE VILLAGE FOR PROPERTY
GENERALLY KNOWN AS M & M PARK SUBDIVISION
WHEREAS, Mariusz and Margaret Hauer (hereinafter referred to as Petitioners) have
requested modifications from the Development Code (Chapter 16) of the Village of Mount
to delay the installation of public improvements until such time as the Village deems
appropriate and necessary; and
WHEREAS, the Plan Commission of the Village of Mount Prospect did consider the
proposed modifications from the Development Code (Chapter 16) for property commonly
known as 1022 Linneman Road, and legally described as follows:
Lots I and 2 in the M & M Park Subdivision being a subdivision of part of
the West Half of the Northeast Quarter of Section 14, Township 41 North,
Range 11, East of the Third Principal Meridian, Cook County, Illinois
and
WHEREAS, the Plan Commission has forwarded its recommendation relative to the
modifications requested herein to the President and Board of Trustees of the Village of
Mount Prospect, and the President and Board of Trustees have determined that the best
interests of the Village would be served in granting the modifications requested herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the recitals set forth hereinabove are incorporate herein as
findings of fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: That modifications from the Development Code (Chapter 16) are
hereby granted to the Subject Property to permit delay the installation of sidewalks, curb
and gutter, street lighting, street paving and storm sewer, until such time as the Village
determines said public improvements are necessary, subject to the Petitioner enters into
a Restrictive Covenant guaranteeing the installation of said public improvements as stated
herein.
SECTION THREE: The modifications granted herein is subject to construction of two
single family homes on the Subject Property, in accordance with the plans submitted and
as approved by the Village.
SECTION FOUR: Except for the modifications from the Development Code granted
herein, all other requirements of said Development Code shall apply to the Subject
Property.
SECTION FIVE: This Ordinance shall be in full force and effect from and after its
