AN ORDINANCE GRANTING MODIFICATIONS FROM THE
DEVELOPMENT CODE (CHAPTER 16) OF THE
VILLAGE CODE OF MOUNT PROSPECT RELATIVE TO
PROPERTY COMMONLY KNOWN AS ELMHURST PLACE SUBDIVISION
(1000 NORTH ELMHURST ROAD)
VVHEREAS, Nauert Builders, Inc. (hereinafter referred to as Petitioner), has requested
modifications from the Development Code (Chapter 16) of the Village Code of Mount
Prospect for property generally located at 1000 - 1010 North Elmhurst Road (hereinafter
referred to as Subject Property), legally described as follows:
Lots 1, 2, 3, 4, 5, and 6 in Elmhurst Place Subdivision, being a
Resubdivision of Lots 1, 2, 3 and 4 in Block 6, Wedgewood Terrace in the
East 1/2 of the Southwest 1/4 of Section 27, Township 42 North, Range 11,
East of the Third Principal Meridian, as per plat thereof recorded as
Document No. 13732148, in the Office of the Recorder, Cook County,
Illinois; and
WHEREAS, Petitioner is requesting the following modifications from the Development
Code:
1. To waive the requirement for public improvements on Meadow Lane and Oxford
Place;
2. To allow a lot depth of 89.24 feet on Lot 5, rether than the required 120 feet, due
to the triangular shape of the lot;
3. To waive the required street lighting on Elmhurst Road, subject to a Restrictive
Covenant being executed guaranteeing installation of the required improvement
at a future date to be determined by the Village; and
4. To permit building on Lots 5 and 6 up to, but no closer than, twenty-five feet (25')
from the storm water detention facilities.
WHEREAS, the Plan Commission of the Village of Mount Prospect did consider the
proposed modifications from the Development Code for the Subject Property at their
regular meeting on November 17, 1993; and
WHEREAS, the Plan Commission has forwarded its recommendations to the President
and Board of Trustees of the Village of Mount Prospect.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the recitals set forth hereinabove are incorporated herein as
findings of fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TVVO: That the President and Board of Trustees of the Village of Mount
Prospect do hereby grant to the Subject Property the following modifications from the
Development Code (Chapter 16):
1. To waive the requirement for sidewalks and curb and gutters on Meadow Lane and
Oxford Place, subject to a Restrictive Covenant being executed guaranteeing
installation of the required improvements at a future date to be determined by the
Village; and

SECTION THREE This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.
