ORDINANCE NO. 4606
AN ORDINANCE VACATING CERTAIN PROPERTY (UNIMPROVED
WALKWAY) OWNED BY THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the corporate authorities of the Village of Mount Prospect did consider the
vacation of certain Village owned right-of-way, namely the unimproved public walkway
located between 1011 and 1013 South Lancaster Street, Mount Prospect, which
walkway is no longer useful or necessary to the Village; and
WHEREAS, a Public Hearing was held by the corporate authorities of the Village of
Mount Prospect on November 16, 1993, at which time the corporate authorities did
determine that it would be in the best interests of the Village to vacate the unimproved
public walkway being the subject of this Ordinance; and
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the corporate authorities of the Village of Mount Prospect did
hold a Public Hearing to consider vacating property shown on the Plat of Vacation
attached hereto and hereby made a part hereof as Exhibit "A".
SECTION TWO: That the corporate authorities of the Village of Mount Prospect have
determined that the best interests of the Village would be served by vacating the
unimproved public walkway, being the subject of this Ordinance, provided that a utility
easement for maintenance of storm and sanitray sewers be established to benefit the
Village.
SECTION THREE That upon the passage and approval of this Ordinance by a 2/3
vote of the corporate authorities, the Village Clerk is hereby authorized and directed to
file a certified copy of this Ordinance, together with an accurate map of the vacated
area, with the Cook County Recorder of Deeds.
SECTION FOUR: That this Ordinance shall be in full force and effect from and after
its passage, approval and publication in pamphlet form in the manner provided by
law.
