AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
LOCATED AT 523 WE GO TRAIL
WHEREAS, William Foreman (hereinafter referred to as Petitioner) has filed an
application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois,
for property commonly known as 523 We Go Trail (hereinafter referred to as Subject
Property), legally described as:
Lot 11 in Block 22 in Prospect Park Country Club Subdivision, being a
subdivision of the Southeast Quarter of Section 11, and the south 15 acres
of the East Half of the Northeast Quarter of Section 11, Township 41
North, Range 11, East of the Third Principal Meridian, in Cook County,
Illinois
and
WHEREAS, Petitioner seeks a variation from Section 14.306.E.4 to allow a servicewalk
seventy-two inches (72") in width to encroach into the required sideyard setback, rather
than the permitted 36"; and
WHEREAS, a public headng was held on the variation requested being the subject of
ZBA Case No. 78-V-93 before the Zoning Board of Appeals of the Village of Mount
Prospect on the 28th day of October, 1993, pursuant to due and proper notice thereof
published in the Mount Prospect Herald on the 12th day of October, 1993; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation
to the President and Board of Trustees of the Village of Mount Prospect and the
President and Board of Trustees of the Village have given further consideration to the
variation being the subject of ZBA 78-V-93 and have determined that the best interests
of the Village of Mount Prospect would be served by granting said variation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings
of fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect
hereby grant to the Subject Property a variation from Section 14.306.E.4 to allow a
seventy-two inch (72") wide service walk in the required sideyard, rather than the
permitted 36" service walk.
SECTION THREE: Except for the variation granted herein, all other applicable Village
of Mount Prospect Ordinances and regulations shall remain in full force and effect as to
the Subject Property.
SECTION FOUR: In accordance with the provisions of Section 14.604 of Chapter 14 of
the Village Code, the variations granted herein shall be null and void unless permits are
issued and construction begins within one (1) year from the date of passage of this
Ordinance.

SECTION FIVE: This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.
