COMMITTEE OF THE WHOLE
AUGUST 13, 1991
The meeting was called to order at 6:05 p.m. Present at the meeting were:
Mayor Gerald L Farley; Trustees Mark Busse, George Clowes, Timothy Corcoran
and Paul Hoefert. Absent from the meeting were: Trustees Leo Floros'and
Irvana Wilks. Also present at the meeting were: Acting Village Manager David
Jepson and Village Attorney Everette Hill.
There was a Motion to go into Executive Session at 6:02 p.m. The Executive
Session adjourned at 7:25 p.m.
At 7:35 p.m., the regular Committee of the Whole Agenda was addressed. Also
present for this portion of the meeting were: Director of Public Works Herbert
Weeks, Public Works Street Superintendent Melvyn Both, Director of Planning
and Zoning David Clements, Director of Inspection Services Chuck Bencic and
Mount Prospect Park District Superintendent Walter Cook; approximately 15
persons in the audience and three persons from the print media.
II. MINUTES
The Committee of the Whole Minutes of July 23, 1991 were accepted and filed.
There were no citizens present who wished to be heard.

Director of Planning and Zoning David Clements provided an overview of the
issues relating to access from the Harvest Heights Subdivision to Maple Trails
Park. He stated that current tentative plans are to install an extension to an
existing sidewalk system on Harvest Lane, past the residential properties and then
make a turn into the Kensington Business Center office complex. This would
necessitate making an opening in the existing fence and then obtaining easements
from the Cummins -Allison business and from the office center at 411 Business
Center Drive. These easements would be needed so that the Mount Prospect
Park District could install a four -foot wide paved surface to connect to an existing
jogging/bike trail and to the Maple Trails Park area.
Walt Cook, of the Mount Prospect. Park District, stated that they had verbal
assurance from Cummins -Allison and the Property Manager that easements could
be granted pending legal descriptions and the location of the path on a Plat of
Survey. Mr. Cook stated that, once everything is in place, the construction work
could be completed within a week to ten days.
It was explained that the entire area within the Kensington. Business Park is served
by the River Trails Park District, The Harvest Heights Subdivision, however, is
in the Mount Prospect Park District. Through intergovernmental agreement, the
Mount Prospect Park District had agreed to develop a park on the land donated
by opus Corporation and maintenance of the park (once established) would be
assumed by the River Trails Park District. The Mount Prospect Park District has
stated that they will complete the bike/jogging path connection from the Harvest
Heights Subdivision entrance to the existing bike/jogging path.
Trustee Corcoran was concerned about the length of time that it would take to
install the walks. Planning and ;coning Director David Clements stated that the
property at 411 Business Center Drive is owned by a syndicate based in
Minneapolis. In his opinion, it may take time to obtain the easement from this
organization. Mayor Parley stated that the Village's first option was to extend.
the jogging path due north from an existing walkway immediately accessing the
Kensington Business Park area. Although this would have eliminated the need to
secure an easement form the owner of 411 Business Center Drive, the homeowner
on Harvest Drive (where we would need an easement) was unwilling to provide
same to the Village.
There was a discussion on installing a gate, approximately four feet wide, in the
existing fence surrounding the Kensington Business Center property. Mount
Prospect Park District Superintendent Walt Cook stated that, if a gate were not
required, they would install a single post in the center of the four -foot opening
to deter use by motorized vehicles.
Several Harvest Heights residents commented that they would like the Village to
intercede on their behalf and have the barbed wire removed from the top of the
existing fence. Trustee Corcoran commented that the Cummins -Allison existing
parking lot is currently being used by park patrons; As part of the agreement to
provide an easement for the jogging path, they are requesting Mount Prospect
Police assistance in monitoring use of their parking lot including the possible
installation of No Parking signs.
Trustee Corcoran also suggested that parking be allowed on Feehanville Drive
adjacent to the park. Initial discussion centered around parking on both sides
of Peehanville Drive, but this was modified to one side at the present time, with
the possibility of parking on both sides at a later date.
On behalf of the administration, Acting Manager Jepson will be submitting a
report back to the Mayor and Board of Trustees on a total Village cost and
feasibility of the project as discussed.

The resident at 1215 Wildwood (which is near the dead-end of Westgate Road)
told the Board that there are holes in the existing fence, which are being used to
gain access to the park. He also stated that there is another hole at Marcella and
Gregory that is being used for accessing the business park. He felt that these
access points should also be included in a formal walkway system intersecting with
the existing jogging path.
Another resident of the Harvest Heights Subdivision stated that the newly
constructed Aldi Food Store created considerable problems with traffic at Business
Center Drive. He felt that the access point as recommended earlier should be
accepted. He also stated that he is concerned about the barbed wire on the
existing fence and he would prefer to have the fence removed from the
westernmost part of the Harvest Heights Subdivision where it abuts to the 411
Business Center Drive property. He felt that grass and weeds growing into this
fence make it very unattractive as an entrance to their Subdivision. He also
suggested extending the walk adjacent to Harvest Lane all the way to Business
Center Drive.
There were other residents speaking on behalf of the project they feel that access
to the jogging/bike path would be extremely desirable and would offer all citizens
of the community the opportunity to enjoy the amenities in the business park.
Trustee Corcoran also stated that he would like staff to review the possibility of
additional pathways connecting the subdivisions to the south of the park where
openings are already present. He further suggested that access points be made
for the subdivision north of Kensington. The access points could be marked
crossings on, Kensington Road as well as a paved surface walkway connecting to
the existing walkways throughout the park.
Trustee Hoefert commented that access to the park from the residences north of
Kensington was also requested at a recent meeting by the residents.

In order to bring the item forward for discussion, it would be
necessary for one of the Trustees on the prevailing side (which
would include the two Trustees voting against the motion or either
Trustee who was absent) to make a motion to "Reconsider the action
taken relative to accepting the proposal submitted by RJN
Environmental to perform the construction engineering services for
Phase I of the storm sewer improvements". Any Trustee may second
the motion.

SUBJECT: Construction Engineering Services
For Phase I Storm Sewer Improvements

on August 14, 1991, a memo was submitted to your office which
included a recommendation to award the construction engineering
services contract to R.J.N. Environmental for our phase I storm
sewer project (Clearwater Park overflow). That memo highlighted
my reasons for the recommendation. The following further high-
lights those reasons.
As stated previously, R.J.N., up to this point, has not
approached the Village for additional fees for completion
of a contract. On the other hand, Donohue & Associates
have, on at least four separate occasions (recently) been
given extra payment for services they had performed. Exam-
ples:
March 1990, additional fees for expanded scope of services
on commuter parking lot rehabilitation contract.
June 1990, additional fee for engineering services relative
to the Melas Park storm sewer project.
June 1990, additional fees for Lincoln Street/Weller Creek
bridge decking.
December 1990, increased fees for Prospect Meadows sanitary
sewer rehabilitation project due to extended construction
time.
Also, R.J.N.'s schedule of hourly fees and charges for
professional services on a consulting basis reflects the
lowest overall cost. As stated, the request for proposal
called for a not -to -exceed figure, but reverted back to
actual payment being made on a time -and -material basis. It
is quite conceivable that the project could come in under
the not -to -exceed figure for R.J.N., thus their total over-
all cost would be substantially less.
Continuity of engineering services on this project is an
important consideration, as is the accountability of the
engineering company. It would be in the best interests of
the Village if design engineer for the project is also
the construction inspection consultant. Then, in the event
of errors on their design, they would have to be held ac-
countable for those errors. If a second -party engineering
firm were to do the inspection, that firm would not be held
accountable for design flaws, modifications, or altera-
tions. With second -party inspection, construction could be
delayed while waiting for redesign in case of error. With
the design engineer also the construction inspection engi-
neer, field changes could be made quickly and expeditiously
to insure that the project is completed according to sched-
ule.
Finally, although I urge you to award the contract to
R.J.N. Environmental, I would not want to delay an award
past the meeting scheduled for August 27, 1991. Szabo
Construction has been awarded the construction contract.
Initial paper work, including insurance forms, documents,
notice to proceed, etc, have already been issued to the
contractor. He also, I assume, will be ordering pipe based
upon the plans and specifications of the bid.
The one thing I cannot do at this point is schedule a
preconstruction meeting with the contractor, the Village and the
construction inspection engineer. I would need to have the
construction inspection engineer selected and in attendance at
that meeting.
Attached, for your review, is additional data which should be
considered before contract award.

Project Scope
Donohue understands the scope of the proposed work as follows:
1. Conduct a pre -construction conference prior to construction with the
Village, contractor, Public Utilities, and other concerned parties.
2. Provide project management and coordination with the Village and the
Contractor on the project.
3. Provide elevation and alignment reference checks throughout
construction of the project.
4. Review shop drawings to verify that they conform with the plans and
specifications.
5. Provide construction inspection services.
6. Review contractor's pay requests.
T. Review, provide recommendations to the Village as to acceptance of and
process change orders.
B. Prepare a certificate of substai,tial completion and provide a
corresponding punchlist based on the substantial completion inspection.
9. Perform final completion inspection and provide project close-out
documentation.
10. Provide "as -built" record drawings.
11. Attend coordination meetings with Village staff as necessary and
participate in two Village Board meetings.
Proiect Management
During construction of the storm sewer, sanitary sewer and watermain, both
technical and administrative expertise will be called upon. At Donohue, our
project management philosophy is that our Project Manager and Resident
Inspector be involved in the project from inception to completion. This
ensures an individual's familiarity with the ongoing concerns Of Mount
Prospect, both technically and politically.
Proiect Observation
Full-time field observation by Donohue staff will help verify the Contractor's
conformance with the project's plans and specifications. As Donohue will work
as an agent of the Village of Mount Prospect, the interests of the Village
will be upheld throughout the duration of the project. Communication between
will be upheld throughout the duration of the project. Communication between
field and office based staff will be a high priority in order to keep the
Village staff informed about project details on a day to day basis. Periodic
coordination meetings and. regular progress reporting will occur to further
enhance communication during the project.
Project Documentation
As with all projects, Donohue is committed to establishing and maintaining
proper, adequate and timely documentation. We at Donohue understand the
importance of construction documentation. Our staff is well trained in all
aspects of field and administrative documentation. Periodic audits of
documentation status will be carried out throughout the project to facilitate
proper and timely documentation.
Resident Concerns
During any construction effort, disruption of the normal day-to-day patterns
of the residents can occur. Donohue recognizes the problems and difficulties
associated with disruption of residents daily lives. During construction, the
Project Manager and Resident Inspector will maintain a sensitivity towards the
residents concerns. Residents affected by the proposed construction would be
notified in advance of both short term and long term construction schedules.
A "hotline" would be established at the Donohue office to field any residents
concerns or questions. Care would be exercised to keep the residents informed
on a day-to-day basis and to keep open access to their residence and services
throughout the project.
Interaction with the Village Staff
Donohue will act as an agent of the Village throughout construction. The
project will be run consistent with the Village's goals and objectives. In
order to achieve this, communication between a specific Village representative
and the Project Manager will be established and maintained. Donohue's goal is
to keep the Village informed on an as required basis to ensure that there are
no surprises during the construction phase. Written progress reports and
summaries of the week's issues will be presented on a weekly basis to provide
the Village with a formalized project reporting system.
Schedule
The following schedule depicts the major milestones for the project. Although
the start dates are assumed, the schedule shows the logical progression of
work. It is assumed that final clean-up and restoration would occur during
the Spring of 1992,
Project Management
RJN Environmental will provide necessary project
management and coordinate activities between the Village,
Contractor, and other concerned parties as required. Project
management work tasks to be provided include:
Review of Shop Drawings and construction materials
proposed to be incorporated into the work by the
Contractor for compliance with the plans and
specifications. Recommendations will be made to the
Village to accept or reject Shop Drawings submitted
by the Contractor and materials to be incorporated
into the work.
2. Review of pay requests submitted by the Contractor.
Work included in the pay requests submitted by the
Contractor will be verified for completeness and
compliance with the Contract Documents.
Discrepancies in pay items and quantities will be
resolved prior to recommending acceptance of a pay
request to the Village. Unauthorized work not
included in the project scope will not be recommended
for payment.
Proposal and issuance of change orders as required
throughout the project. RJN Environmental will also
review all change orders proposed or submitted by the
Contractor. Change orders submitted by the
Contractor for unauthorized work or for time
extensions resulting from conditions that were not
beyond his control will not be recommended for
acceptance by the Village.

4. Preparation of construction punch lists and statements
of substantial completion. Punch lists will be prepared
throughout the duration of the project as the
Contractor completes sections of the work. The
Contract Documents will be enforced to expedite the
Contractor's completion of punch list items.
5. Final construction review. Final construction review
will not be performed until all punch list items have
been completed in accordance with the Contract
Documents. A recommendation for acceptance of the
project will be made to the Village upon satisfactory
completion of all punch list items based on the final
construction review.
6. Assistance to the Village with the monitoring of
warranties and final waive of liens. RJN
Environmental will provide a computerized schedule
showing ending dates of material and labor warranties.
7. Meeting with the Village staff and other concerned
parties as necessary throughout the course of the
project. RJN Environmental personnel will also
participate in two meetings with the Village Board
during the course of the project to keep them
informed of the status of the project and respond to
any question or concerns.
On -Site Construction Observation
RJN Environmental will provide construction observation for
conformance to plans and specifications. Full-time coverage
will be provided throughout the duration of the construction.
Part-time coverage will be provided after substantial
completion of the storm sewer improvements to inspect
"punch -list" items. For the purpose of this proposal, it was
assumed that 50 days of full-time coverage and 10 days of
part-time coverage totaling 480 manhours (60 days) will be
provided.

A general listing 'of individual work tasks for on-site
construction observation is as follows:
1. Coordinating with the Contractor to maintain project
schedules during the project. The progress of the
project will be monitored on a daily basis.
Recommendations will be made to the Contractor to
keep the project on schedule and expedite it's
completion.
2. Inspection of materials to be used in the construction
of or as part of the Phase I Storm Sewer
Improvements infrastructure to ensure the quality of
the project. Materials observed to be defective or not
in accordance with the Contract Documents will be
rejected.
3. Observation of work for conformance with the plans
and specifications. Work not in conformance with the
plans and specifications will not be recommended for
acceptance.
4. Providing construction reference checks for elevations
and alignments throughout construction of the project.
Reference check elevations and alignments will be
recorded and made available for Village review. Work
not constructed at the elevations and alignments shown
on the plans will not be recommended for acceptance
if it compromises the intent of the project or has not
been authorized by the Village.
5. Observation of all tests performed at the project site
as specified in the Contract Documents. Results of
each test will be recorded. Work failing to pass a
specified test will be rejected. Work will not be
recommended for acceptance until it has been
observed to pass all specified tests.

6. Enforcement of all applicable regulations by federal,
state, and county agencies, and monitoring of
excavations around all utility lines to minimize
accidental disruption of service at all times during
construction.

RE: Public Hearing for Cable TV Performance Evaluation
As you are aware, there will be a public hearing at the Tuesday,
August 27 Committee of the Whole meeting to solicit citizen input
as a part of the evaluation process in the performance of the cable
television provider, Telenois, Inc. This hearing is only one
portion of the information needed to complete the ten year
evaluation process. A letter was sent to Kelvin Fee, .'ysten.
Manager of Telenois, asking for relative data and information to
complete the evaluation (enclosed) . This letter also requested
technical data which I will have a cable television consulting
engineer review, and a request for financial information which I
will have our auditor review. This information is due in my office
by the end of the business day on August 26. Once this information
is received and evaluated, I will issue a report on the findings
and the Village Board can make any determinations necessary.
I would like to emphasize that the public hearing is only to
solicit public comments to aid in the evaluation of the cable
company's performance. I will also have copies of any written
comments I receive from residents who have sent them in. Notices
were sent to all residents who have filed complaints or inquiries
to my office in the last 3 years (see attached).

Dear Mr. Fee:
As outlined in Section 6.404.A. of the Cable Communications Code,
a performance evaluation of Telenois is required during this tenth
year of the cable television franchise. As a part of the
evaluation process, the Village of Mount prospect will hold a
public hearing on Tuesday, August 27 during the regularly scheduled
Committee of the Whole meeting for the purpose of soliciting
citizen input on the performance of the cable television operation.
The meeting will take place at 50 S. Emerson and will begin at 7:30
p.m. A copy of the notice issued by the Village is enclosed.
Notice of the need for the performance evaluation is required from
the franchise holder sixty (60) days prior to such evaluation. The
anniversary date of the franchise is August 1, which would require
that your notice be received by June 1. The notice was received
on July 10, some 40 days in violation of the ordinance, Telenois
is also required by Section 6,404.C. to announce meetings or
hearings on the highest use origination channel no less than three
times between the hours of 7:00 p.m. and 9:00 p.m. for five
consecutive days immediately preceding each meeting. Please advise
which channel this announcement will run on and at what times.
As outlined in Sections 6.605.C. and 6.606.A. and D. of the Cable
Communications Code, all system tests, FCC filings, etc• are to
have copies filed with the Village. This has not been complied
with, with the exception of last year's request for such records
for the special performance evaluation. Telenois is hereby
notified that compliance with these requirements is expected and
should be cured immediately.

In order to adequately evaluate the performance of the franchisee,
it is necessary for the following items to be addressed or
information provided on them. Please send your full responses to
these inquiries within thirty (30) days, or by the end of the
business day on August 26, 1991.

TEN YEAR CABLE TV PE"ORMANCE EVALUATION
TO BE HELD
The Mount Prospect Village Board will conduct a public hearing as
part of a 10 year performance evaluation of the cable television
provider, Telenois/TCI, on Tuesday, August 27 during the scheduled
Committee of the Whole meeting. The meeting is scheduled to begin
at 7:30 p.m. at the Senior Center at 50 S. Emerson.
Those citizens wishing to make comment about the performance of
Telenois/TCI are encouraged to attend this hearing and provide
their comments at this time. For those unable to attend, written
comments may be submitted no later than 5:00 p.m., August 26.
Please mark such written comments as "Comments for Cable Rearing"'
on the letter and envelope.
Telenois/TCI will also be given the opportunity to comment on their
performance. This hearing will be cablecast as part of the regular
meeting on Channel 63, Mount Prospect's government access channel.
