HomeMy WebLinkAboutOrd 962 03/03/1964 ORDINANCE NO.{f~ 2 AN ORDINANCE ANNEXING PROPERTY REFERRED TO AS "COLONIAL HEIGHTS" TO THE VILLAGE OF MOUNT PROSPECT. WHEREAS, a written petition has been filed with the Village Clerk of the Village of Mount Prospect by Colonial Heights, Inc., an Illinois corporation, being the sole owner of record of the hereinafter described land and territory (except the North 66 feet thereof which is the dedicated portion of Estates Drive) for annexation to the Village of Mount Prospect, and WHEREAS, said petition requests the annexation of the land therein described owned by Colonial Heights, Inc., together with Estates Drive, heretofore dedicated for street purposes as hereinafter set forth; and WHEREAS, all of said land and territory is not within the corporate limits of any municipality but is contiguous to the Village of Mount Prospect, is uninhabited and has no electors residing thereon; and WHEREAS, said petition is under oath and in all respects complies with the requirements of the statutes in such cases made and provided; and WHEREAS, the Village has and does seek to exercise authority under Section 7-1-10 of Chapter 24 of the Illinois Revised Statutes to annex roadways; the Village of Mount Prospect does hereby exercise said authority by annexing the property which was heretofore dedicated as Estates Drive, as per Plat of Dedication registered September 14, 1962 as Document No. 2055414 in the Torrens Office of Cook County, Illinois, in accordance with the provisions of said statutory authority; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have examined said petition, have considered the question of annexation of the territory described therein, and believe it to be to the best interests of the municipality that such territory be in fact annexed thereto; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: Section 1. That all of the lands and territories described in said petition, to wit: Estates Drive as per Plat of Dedication registered in the Torrens Office of Cook County, Illinois on September 14, 1962 as Document No. 2055414; -also- That part of lot 7 in Owner's Division, a subdi- vision of the southeast ~ (except the west ~ of the southwest ~ thereof) of Section 10, Townshio 41 North, Range 11 East of the 3rd. Principal Meridian, which lies southerly of the southerly line of Estates Drive as dedicated September 14th. A.D. 1962 as Document No. 2055414 and which lies westerly of the west- erly line of Crestwood Lane as per olat of Colonial Heights registered in the office of' the Registrar of Titles of Cook County, Illinois on May 27th, 1960 as Document No. 1923990 and which lies westerly of the westerly line of Crestwood Lane as per plat of Colonial Heights 1st. Addition as registered in the office of the Registrar of Titles of Cook County, Illinois on May 16. 1961 as Document No. 1977989 and which lies northerly and easterly of the following described lines; beginning at a point on a line drawn at right angles to the south line of said lot 7 from a point 630.0 feet east of the southwest corner of said lot 7 and 635.0 feet north of the south line of said lot 7 also being the southwest corner of said Colonial Heights 1st. Addition, Thence southwesterly along a line which forms an angle of 83r,degrees 09 minutes 26 seconds (measured from south to southwest) with the last described line to a point on the easterly line of property described in Document No. 1964453; said point being 617.0~feet north of the south line of said lot 7; Thence northerly along the easterly line of property described in Document No. 1964453 to the southerly line of said Estates Drive, in Cook County, Illinois; which territory is contiguous to the Village of Mount Prospect, is not within the limits of any municipality, contains no electors and is not presently in any incorporated municipality, be and the mme is hereby annexed to the Village of Mount Prospect so that hereafter said territory shall be included within the boundary lines and limits of said Village, as is by law in such case made and provided. Section 2. That the Village Clerk of the Village of Mount Prospect is hereby directed to record a certified copy of this ordinance together with an accurate plat of said territory with the Recorder of Deeds of Cook County, Illinois. Section 3. That this ordinance shall be in full force and effect from and after its passage and approval according to law.
