B. 1st reading of AN ORDINANCE AMENDING CHAPTER 4, (APPOINTIVE VILLAGE OFFICERS) ARTICLES VIII AND IX AND CHAPTER 5 (BOARDS AND COMMISSIONS) ARTICLE III OF THE VILLAGE OF MOUNT PROSPECT VILLAGE CODE A review of the BOFPC Charter has resulted in a number of recommended changes to its current composition, operation and authority. An accompanying review of the Village Code Section creating and establishing the general operational parameters for both the Police and Fire Departments resulted in a number of changes and clarifications in the wording of these Code Sections. (Exhibit A) C. 1st reading of AN ORDINANCE AMENDING CHAPTER 13 (ALCOHOLIC LIQUORS) This ordinance deletes one (1) Class "S", (Restaurant with Lounge), liquor license issued to Applelllinois, LLC, d/b/a Applebee's Neighborhood Grill & Bar, 999 North Elmhurst Road. Applebee's Neighborhood Grill & Bar at this location has permanently closed. (Exhibit B) D. APPOINTMENTS VIII. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD IX. CONSENT AGENDA * All items listed with an asterisk are considered routine by the Village Board and will be enacted by one motion. There will be no separate discussion of those items unless a Board member, or resident from the audience so requests, in which event the item will be removed from the Consent Agenda and considered in its normal sequence on the agenda. X. OLD BUSINESS A. PZ-31-06, 1700 East Euclid Avenue, 1303 Wolf Road and ComEd ROW, Gendell Partners 1. 2nd reading of AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE VILLAGE OF MOUNT PROSPECT FOR PROPERTY LOCATED AT 1700 EAST EUCLID AVENUE, 1303 WOLF ROAD AND COMED ROW The Planning and Zoning Commission has recommended approval by a vote of 6-0. (Village Board approved Petitioner's request for deferral to February 19, 2008 meeting by a vote of 5-0 and 1 abstention. Staff is requesting further deferral.) B. 2. 2nd reading of AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT AND VARIATIONS FOR PROPERTY LOCATED AT 1700 EAST EUCLID AVENUE, 1303 WOLF ROAD AND COMED ROW The Planning and Zoning Commission has recommended approval by a vote of 6-0. (Village Board approved Petitioner's request for deferral to February 19, 2008 meeting by a vote of 5-0 and 1 abstention. Staff is requesting further deferral.) 2nd reading of AN ORDINANCE AMENDING CHAPTER 18 (TRAFFIC) OF THE VILLAGE CODE OF MOUNT PROSPECT This ordinance prohibits parking at all times along the on north side of Milburn Avenue and limits parking to two (2) hours along the south side of Milburn Avenue. The Safety Commission has recommended approval by a vote of 8-0. (Village Board approved deferral to February 19, 2008 by a vote of 4-3.) (Exhibit C) XI. NEW BUSINESS A. PZ-05-08, 1750 Azalea Place (Exhibit D) 1st reading of AN ORDINANCE GRANTING A VARIATION (SECOND DRIVEWAY) FOR PROPERTY LOCATED AT 1750 AZALEA PLACE The Planning and Zoning Commission recommended approval of the Conditional Use permit by a vote of 4-0. B. PZ-02-08, 2020 Camp McDonald Road (Exhibit E) 1st reading of AN ORDINANCE GRANTING A CONDITIONAL USE TO OPERATE A DAY CARE FACILITY AT 2020 CAMP MCDONALD ROAD The Planning and Zoning Commission recommended approval of the Conditional Use permit by a vote of 4-0. C. PZ-01-08, 3401 South Busse Road, Arrow Road Construction (Exhibit F) 1 st reading of AN ORDINANCE TO AMEND THE CONDITIONAL USE (PLANNED UNIT DEVELOPMENT) FOR PROPERTY LOCATED AT 3401 SOUTH BUSSE ROAD The Planning and Zoning Commission recommended approval of the Conditional Use permit by a vote of 4-0. D. PZ-03-08, 1040 West Northwest Highway, Victor Dziekiewicz, 1. 1st reading of AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP (Exhibit G) OF THE VILLAGE OF MOUNT PROSPECT FOR PROPERTY LOCATED AT 1040 WEST NORTHWEST HIGHWAY This ordinance rezones the subject property from B1 Business Office to R2 Attached Single Family to allow a 14-unit townhome Planned Unit Development. The Planning and Zoning Commission has recommended approval by a vote of 3-1. 2. 1st reading of AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT (Exhibit H) AND VARIATION FOR PROPERTY LOCATED AT 1040 WEST NORTHWEST HIGHWAY. This ordinance grants a Conditional Use permit to construct a town home planned unit development and variation. The Planning and Zoning Commission has recommended approval by a vote of 3-1. E. A RESOLUTION AUTHORIZING THE EXECUTION OF THE AMENDED (Exhibit I) LEASE AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND THE MOUNT PROSPECT HISTORICAL SOCIETY In accordance with Illinois State Statute, notice of the proposed amendment to the lease agreement was published in the Daily Herald on January 24, 2008. F. A RESOLUTION AUTHORIZING THE EXECUTION OF A TECHNICAL (Exhibit J) SERVICES (TSA) AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND THE REGIONAL TRANSIT AUTHORITY (RTA). As a RTAP grant recipient the Village of Mount Prospect is required to enter a technical services agreement with the Regional Transportation Authority to complete the public transportation system study. The RT AP will provide technical and financial support to the Village for transit planning projects. G. A RESOLUTION AUTHORIZING THE EXECUTION OF A PROFESSIONAL (Exhibit K) AND CONSULTING SERVICES AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND TRAN SYSTEMS RT AP grant recipients are required to enter a professional and consulting services agreement to complete the public transportation system study. Staff recommend the Village Board approve the contract with Tran Systems in an amount not to exceed $124,794.47. H. 1st reading of AN ORDINANCE TO AMEND CHAPTER 19, (HEALTH REGULATIONS) ARTICLE VIII, ENTITLED "CLEAN AIR REGULATIONS," OF THE VILLAGE OF MOUNT PROSPECT VILLAGE CODE. This ordinance regulates smoking shelters and prohibits smoking on certain public usage property. (Exhibit L) XII. VILLAGE MANAGER'S REPORT A. Request Village Board approval to accept bid for shade tree furnishing and planting in an amount not to exceed $218,084. B. * Request Village Board approval to accept bid for the 2008/2009 brick paver sealing contract in an amount not to exceed $30,000. C. *Request Village Board approval to accept bid for window cleaning contract in an amount not to exceed $6,872. D. *Request to waive bid and hire SRBL Architects for Fire Station 14, Emergency Operations Center and Public Works expansion project in an amount not to exceed $5,000. E. Status XIII.
