CLEAN AIR REGULATIONS On January 1, 2008, the Smoke Free Illinois Act effectively replaced the Village's "Clean Air Regulations" because it is generally considered as or more restrictive than the Village's ordinance. However, the Act failed to expressly regulate smoking shelters and other public usage property, such as train station platforms, bus shelters, and municipal parking garages. Accordingly, staff recommends amending the "Clean Air Regulations" with a revised version that primarily regulates the placement, installation, and use of smoking shelters, as well as prohibits smoking on public usage property. Appropriate staff will be present to answer questions and facilitate discussion. V. BOARD OF FIRE AND POLICE COMMISSION. POLICE AND FIRE ORGANIZATION REGULATIONS The Board of Fire and Police Commission (BOFPC) is the Village's duly constituted body empowered to oversee the hiring, promotion and disciplining processes for non-exempt, sworn Police Officers and Fire-Fighters. The historical rationale behind the need for BOFPCs was the desire to remove politics, patronage and nepotism from Police and Fire Department operations. While that desire remains valid today, the advent of more professional forms of government, specifically the Council-Manager form, have largely removed politics and other questionable practices from the day to day operations of modern local government. And, while BOFPCs remain a common fixture in Illinois, they are not as prevalent in other states. They remain today largely due to the over-arching philosophy that there should be some level of direct citizen oversight of these two core services charged with protecting the health, safety and welfare of the citizenry. In Mount Prospect, the BOFPC derives its powers from the Village Board's Home Rule authority. As with other Village Boards and Commissions, the Mayor and Trustees, from time to time, review the enabling Charter of all of these bodies to ensure that their composition, operation and scope of authority are in keeping with modern government practices. A review of the BOFPC Charter has resulted in a number of recommended changes to its current composition, operation and authority. Those recommended changes are outlined in the attached memorandum from the Village Attorney. An accompanying review of the Village Code Sections creating and establishing the general operational parameters for both the Police and Fire Departments was also undertaken. Again, a number of changes and clarifications in the wording of these Code Sections are recommended. They are also outlined in the Village's Attorneys memorandum. The Village Attorney, appropriate staff and members of the BOFPC will be present to answer questions and facilitate discussion. VI. RED LIGHT CAMERAS In May of 2006, Governor Blagojevich signed into House Bill 4835 authorizing the use of photo Red Light Enforcement Technology in Illinois, outside of the city of Chicago. The new law (6251LCS 5/11- 208.6) has several requirements. The decision to install automated Red Light Enforcement Systems represents a significant policy decision for the Village Board. A review of the current State of Illinois Law, Cook County Ordinances and I.D.O.T regulations relative to the installation of automated Red Light Enforcement Systems will be provided to the Village Board members by Chief of Police John Dahlberg and Mr. Mike Liebert of Red Speed Illinois. Appropriate staff will be present to answer questions and facilitate discussion. VII. NOISE REGULATIONS Over the past several years' residents have increasingly approached both staff and elected officials about noise that is disturbing enough to garner a complaint. Staff review of these complaints revealed that much of the noise is being generated through the delivery of goods in commercial areas and the delivery of goods in commercial areas adjacent to residential areas. Staff undertook a survey through the Northwest Municipal Conference (NWMC) to determine comparable regulations. Less than one half of the responding communities regulated delivery times; however, based on the increasing frequency of complaints a standard delivery time regulation may be worth considering. Staff is also requesting a modification in the nighttime construction ordinance so that early start times no longer have to be requested of the Village Manager and establish a start time consistent with all other surrounding communities as indicated by a NWMC survey. Staff is further requesting Village Board input into consolidating noise regulations into a single Code section for ease of enforcement. Appropriate staff will be present to answer questions and facilitate discussion. VIII. GREENEST REGION COMPACT The Metropolitan Mayors Caucus has developed an environmental initiative, known as the Greenest Region Compact, to address the region's impact on its natural resources. The Compact requires each member community to adopt at least seven of several outlined strategies, including three priority strategies. Many potential actions identified under the outlined strategies are already conducted by the Village. Staff recommends the Village adopt the Greenest Region Compact and utilize its workbook as a guide to identify Village environmental strategies and implement actions. Notably, as a member of the Compact prior to February 15, 2008, the Village can obtain free compact fluorescent light bulbs (CFL) to distribute in any manner they see fit. Appropriate staff will be present to answer questions and facilitate discussion. NEW BUSINESS A. A RESOLUTION ENDORSING THE METROPOLITAN MAYORS CAUSCUS' GREENEST REGION COMPACT This resolution endorses the Greenest Region Compact created by the Metropolitan Mayors Caucus. The Village agrees to join the effort to address environmental issues and improve the metropolitan Chicago region's environment. (Exhibit A) IV. A RESOLUTION ENDORSING THE METROPOLITAN MAYORS CAUCUS' GREENEST REGION COMPACT WHEREAS, the Metropolitan Mayors Caucus provides a forum for the chief elected officials of the Chicago region to develop consensus and act on common public policy issues and multi- jurisdictional challenges; and WHEREAS, the Metropolitan Mayors Caucus' participating Mayors and their communities have a history of improving the environment, from promoting environmental practices through waste management, green purchasing, and participation in Clean Air Counts; and WHEREAS, it is important for Mayors and local governments throughout the United States to take leadership roles by adopting environmental programs that provide economic and quality of life benefits such as reduced energy bills, green space preservation, air quality improvements, and improved transportation choices; and WHEREAS, the Metropolitan Mayors Caucus created the Greenest Region Compact to address environmental issues of global importance at the local level; and WHEREAS, the Compact outlines a number of cost-effective environmental sustainability measures that enhance health and safety, reduce the consumption of energy and fossil fuels, conserve water, and reduce hazardous and solid waste, and air pollution emissions. NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The President and Board of Trustees endorse the Greenest Region Compact proposed by the Metropolitan Mayors Caucus and agree to join this effort to improve the metropolitan Chicago region's environment. SECTION TWO: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law.
