AN ORDINANCE ANNEXING PROPERTY TO THE VILLAGE OF
MOUNT PROSPECT, WHICH PROPERTY IS ON THE WEST SIDE
OF BUSSE ROAD, NORTH OF ALGONQUIN ROAD, JUST NORTH
OF ANDADJACENT TO THE COMMONWEALTH EDISON RIGHT-
OF-WAY.

WHEREAS, a written petition has been filed with the Village Clerk
of the Village of Mount Prospect by the LaSalle National Bank, as Trustee
under Trust No. 31766, being the sole owner of record of the hereinafter
described land and territory, for annexation to the Village of Mount Prospect;
and
WHEREAS, said land and territory is not within the corporate limits
of any municipality but is contiguous to the Village of Mount Prospect; and
WHEREAS, there are no electors residing on said property; and
WHEREAS, said petition is under oath and in all respects complies
with the requirements of the Statutes in such cases made and provided; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect, Cook County, Illinois, have examined said petition and
believes it to be to the best interest of said Village that said land and
territory be annexed thereto:
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Mount Prospect, Cook County, Illinois:
to wit:
Section 1. That all land and territory described in said petition
The East 582 feet as measured at right angles to the East
line thereof of that part of Lot 2, in Edward Busse's
Division of part of the Southeast Quarter (1/4) of Section
15, and the Northeast Quarter (1/4) of Section 32, Town-
ship 41 North, Range 11, East of the Third Principal
Meridian, as per plat recorded in the Recorder's Office of
Cook County, Illinois, December 17, 1919, as Document
Number 6696216, lying South of the North 759.54 feet
thereof, as measured on the East and West lines of said
Lot 2, and lying Northerly of a line drawn from a point on
the West line of the East half (1/2) of the Southeast
Quarter (SE 1/4) of said Section 15, 335.56 feet North of
the Southwest corner of said East Half (E 1/2) of the
Southeast Quarter (SE 1/4) to a point on the East line of
said Lot 2, 539.80 feet North of the South line of said
Section 15 (as measured along the East line of said Lot 2).
which territory is contiguous to the Village of Mount Prospect, is not
within the limits of any municipality, contains no electors and is not
presently in any incorporated municipality, be and the same is hereby an-
nexed to the Village of Mount Prospect, so that hereafter said territory
shall be included within the boundary lines and limits of said Village, as
is by law in such case made and provided.

PETITION FOR ANNEXATION TO THE VILLAGE OF MOUNT PROSPECT
The undersigned, being the sole owner of record of the
following described real estate, does hereby request that the
following described real estate be annexed to and become a part
of the Village of Mount Prospect.
Petitioner states that the said real estate is not within
the corporate limits of any municipality, and that said real
estate is contiguous to the Village of Mount Prospect.
Said real estate is legally described as follows:
The East 582 feet as measured at right angles to the
East line thereof of that part of Lot 2, in Edward

ANNEXATION AGREEMENT
THIS AGREEMENT, made and entered into this 11th
day of September, 1964, by and between CHICAGO TITLE AND TRUST
COMPANY, not individually but solely as Trustee under the pro-
visions of a Trust Agreement dated the 24th day of June 1964,

a Municipal corporation (hereinafter referred to as I1Vi11age"),
WITNESSETH:
WHEREAS, the Owner is the successor in title of the
real estate hereinafter described from La Salle National Bank
as Trustee under Trust No.
31766 , and is the present title
holder of the following described real estate:
The East 582 feet as measured at right angles to the

WHEREAS said La Salle National Bank as Tr~stee, as
aforesaid, is the petitioner in the petitions for rezoning in
and annexation to the Village, which petitions h2\/2 been granted
and which ordinances pertaining thereto were passed by the Vi~lage

Board of Trustees of the Village on September 1, 1964, as
Ordinance Nos. 996 and 995, respectively, and
WHEREAS, the Village desires that as a condition to
the signing and approval of said ordinances by the Village President,
that the Owner covenant and agree in writing that said property
will not be developed with more than 168 dwelling units, and then
substantially in compliance with the final building plans now on
file with the Village Building Department.
NOW, THEREFORE, in consideration of the premises and
the mutual covenants herein contained, the sufficiency of which
is hereby acknowledged, it is hereby mutually agreed by and
between the parties hereto, as follows:
1. Chicago Title and Trust Company, as Trustee under
Trust No. 47021
, on behalf of ~tse1f, its grantees, successors
and assigns, hereby covenants and agrees that the real estate
hereinabove described shall not be developed with more than 168
dwelling units, all of which units shall be constructed substantially
in accordance with the final bui16in: )lans dated June 22, 1964
now on file with the Building Department of the Village of Mt.
Prospect, which plans have met all the requirements of the Building
Code of the Village of Mt. Prospect and which plans are acceptable
to it. It is understood and agreed that all construction on the
subject premises shall be in complete accordance with all building
regulations and requirements of the Village of Mt. Prospect.
2.
It is understood and 2 :eed that upon the execution

of this Agreement by the Owner and the approval thereof by the Village
Attorney, the Village President of Mt. Prospect shall sign and approve
zoning and annexation ordinances aforesaid, and that publication
thereof shall be made by the Village in the usual form.
3. It is understood and agreed by the parties
that the Village of Mount Prospect shall not be under an
obligation to issue a building permit until and unless:
A - The owners of the property described herein
provide said Village with a sanitary district
permit issued by the Metropolitan Sanitary
District of Greater Chicago.
B - An executed copy of an agreement between the
Utility Sewer and Water Company and the owner
agreeing to supply water service to the
property herein described.
4. It is understood and agreed that this Agree-
ment may be recorded in the office of the Registrar of
Titles of Cook County, Illinois.
