This Ordinance grants a variation to permit a
circular driveway for a single family home
presently under construction. The Zoning Board
of Appeals recommended 5-0 to grant request.

This Ordinance grants a variation from the side
yard requirements in order to permit construction
of a new garage. The Zoning Board of Appeals
recommended approval by a vote of 5-0.

This Ordinance grants a request for variation from
the side yard requirements in order to permit. the
construction of a loading dock. The Zoning Board
of Appeals recommended 5-0 to approve request.

D. 2nd reading of AN ORDINANCE REPEALING ORDINANCE
NOS. 3060, 3218 AND 3220 OF THE VILLAGE
The Ordinances being repealed deal with Commerical
Rehabilitation Loans and placing the funds
allocated for this program into the Facade Program.

E. 2nd reading of AN ORDINANCE AUTHORIZING A CANOPY OF
A BUILDING AT 2 EAST NORTHWEST HIGHWAY TO ENCROACH
OVER A SIDEWALK
This Ordinance authorizes an encroachment as well
as execution of a Hold Harmless Agreement.

F. 2nd reading of AN ORDINANCE AUTHORIZING A CANOPY
OF A BUILDING AT 15 WEST BUSSE AVENUE TO ENCROACH
OVER A SIDEWALK
This Ordinance also authorizes the encroachment of
a canopy of public right-of-way sidewalk and
execution of a Hold Harmless Agreement. (Exhibit F)
G. 2nd reading of AN ORDINANCE AMENDING CHAPTER 21
ENTITLED "BUILDING CODE" OF THE VILLAGE CODE OF
MOUNT PROSPECT
This Ordinance amends Chapter 21, Building Code,
in its entirety, incorporating the many changes
recommended by the Division Of Code Enforcement. (Exhibit G)

A. A RESOLUTION AUTHORIZING THE EXECUTION OF AN

AND SAVE -A -PET, INC.
This Agreement authorizes Save -A -Pet to accept
dogs and cats that are deemed strays, homeless, etc.
with the Village agreeing to pay $35.00 per animal
for the services. (Exhibit H)
B. A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT
BETWEEN THE VILLAGE OF MOUNT PROSPECT AND ILLINOIS
PRAIRIE GIRL SCOUT COUNCIL, INC.
This Resolution authorizes Community Development'
Block Grant Funds to be utilized for special summer
programs for children within the Boxwood area of
the Village, and administered by the Girl Scouts. (Exhibit J)
C. A RESOLUTION AUTHORIZING THE EXECUTION OF AN
AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND
NORTHWEST COMMUNITY SERVICES, INC.
As required,the Resolution authorizes an Agreement
for utilization of funds for transporting handicapped
persons under the Para -Transit program. (Exhibit K)
XI. ANY OTHER BUSINESS
A. Kensington Center Plat of Subdivision No. XV
This Subdivision divides the Village owned lot
into two lots of record.
B. Kensington Center Plat of Subdivision XIV
This Plat places property within the Kensington
Center for Business into a lot of record in order
to begin construction of another building.
C. Plat of Dedication - Park District Golf Course
The plat establishes an easement for water mains
across the Mount Prospect Park District Golf Course.

RESTAURANT El Sombrero Restaurant to assume the existing
Class "S" liquor issued -to, that restaurant at
1100 S. 1.100 South E.lrdhurst Road. Mr. Rick Russo, President
ELMHURST RD of Russo Brothers, Inc., stated that lie was still
LIQUOR LICENSE waiting for a copy of the land trust. and lease from

It was the opi.n.ion of the Village Board that when
all the necessary documents have been subTnitted to
the V-illage Manager, that the Class "S" license can

PUBLIC HEARING
Mayor Krause called the Public Hearing to order at 8:20 P.M.

The purpose of this public hearing, pursuant to proper

Legal notice published in the Mount Prospect Herald on
June 5, 1.984, was for the purpose of considering the
issuance of Industrial. Revenue Bonds in an amount not to
exceed $2,000,000 for the financing in whole or in part
the cost of acquiring land located within Kensington Cente.-
for Business (Lot 303) and constructing and equipping
industrial. and commerical buildings by TOKO America,Inc„
an Illinois Corporation.
Mr. Keitch Groebe, representing TOKO America, Inc., stated
that the company was incorporated in 1965, with the
desire to move the corporation to Mount Prospect some time
in 1985. It was proposed that there would be 30 to 45
employees. Mr. Groebe also stated that the projected sales
for 1983-84 would be $21,400,000.
There being no questions from the audience or Village
Board, Mayor Krause declared the Public Hearing closed
at 8:23 P.M.
An -)�dinance will be presented July 17th for first reading
that would authorize the issuance of the Industrial Revenue
Bonds as requested.
SALE OF
An Ordinance was presented for first reading that would VILLAGE
authorize the sale of Village owned property located OWNED
within the Kensington Center for Business. The proposed PROPERTY
purchaser is A T & T. This Ordinance and Plat of (AT & T)
Re -Subdivision will be presented July 3rd for second
readi.ng.

Mr. Bob Weirbeim, representing Bob Evans, stated that
although this intersection is a heavily traveled area
with difficult traffic patterns, it, was their opinion
that in order to have a successful business, the
traffic pattern for egress and. ingress as submitted
would be the most convenient for customers. Following
the presentation, which included traffic pattern charts
submitted by staff, it was the opinion of the Village
Board that while they appreciated the efforts and
concerns of staff, they would. accept the original
proposal. submitted by Mr. Weirheim.

to accept the site plan and traffic pattern as presented
by Bob Evans Restaurant for the proposed development
on Rand Road.

SAFETY
The Safety Commission's recommendations were presented

A request was received from a resident for a STOP or

YIELD sign at Evergreen & Pine Streets. The Safety

Commission recommended a YIELD sign for north and
southbound traffic on Pine Street at Evergreen.
Mr. Toni McGovern, living on the southwest corner of
Evergreen and Pine, stated that be saw no benefit for
such a traffic control sign.

to concur with the recommendation of the Safety Commission
to have a YIELD sign.

A request to prohibit left turns from westbound
Wa Pella
Central Road onto southbound Wa Pella was considered
by the Safety Corrunission. It was their recommendation
that a letter be sent to TDOT to request the stated
prohibition.

to deny the recommendation of the Safety Commission as
it applies to left turn from Central Road onto Wa Pella.

An ordinance was presented that would repeal those COMMERCIAL - I
ordinances governing the commercial rehabilitation REHAB PROGRAM
program. Due to the many complexities of this
program, no local businesses were able to take FACADE PROGRAM
advantage of the program. It was the recommendation
of staff that these funds be applied to the facade
program, which has received favorable response from
the local, businesses.
Mark Edwards, 113 S. Main Street, stated that he and
his wife had applied for the commercial rehab program
but were not granted a loan by the local banks.
There was discussion on the part of the Village Board
that perhaps this program could be re -organized and
possibly have the funds and administration of the
program placed with banks outside the community.
This matter will be considered and presented for second
reading on July 3rd.

Mayor Krause announced that the Citizens Utilities
rate :increase case will be ;heard soon and. the Tillage is
continuing its efforts in this area.
The Freedom of Information Act will. take effect on
July 1, 1984 and the Village has taken the steles
necessary to comply with this Act.
Trustee Wattenberg encouraged the Village and elected
officials to relay -their support for reform in the
judicial, system. Mayor ]Krause stated she will be
in touch with the Northwest Bar Association relaying
that message.
The Mayor and Board of Trustees eXpres ed their lest
wishes to John Bowman on his marriage June 22, 1984

AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 1922 BURR OAK DRIVE,
IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS

WHEREAS, Mr. and Mrs. Edward Beyer, have filed an application
for a variation with respect to certain residence property owned
by them and commonly known as 1922 Burr Oak Drive in the Village
of Mount Prospect, Illinois (the "Subject Property"); and
WHEREAS, the Subject Property is described as
follows:
Lot 12 in Tree Farm Estate, being a subdivision of
part of the South half of the Northeast quarter of
Section 25, Township 42 North, Range 11, East of
the Third Principal Meridian, in Cook County,
Illinois; and
WHEREAS, Petitioners seek a variation from the provisions
of Section 14.116.A of Article I, Chapter 14 of the Village
Code of Mount Prospect, Illinois, to provide an additional (sec-
ond) curb cut in order to allow the establishment of a circular
driveway on the Subject Property, both of which curb cuts will
be located on Lama Lane; and
WHEREAS, a public hearing was held on the variation re-
quest (designated as case No. ZBA-17-V-84) before the Zoning
.Board of Appeals of the Village of Mount Prospect on the
7th day of June, 1984, pursuant to due and proper notice thereof
published in the MountProsect herald erald on the 16th day of May,
1984; and _
WHEREAS, the Zoning Board of Appeals has submitted its
findings and recommendation to the President and Board of
Trustees of the Village of Mount Prospect to grant the subject
variation request, and the President and Board of Trustees of
said Village have given further consideration to the request and
have determined that the same satisfies the standards set forth
in Section 14.605 of Article VI of Chapter 14 of the Village
Code, provided the open area adjoining said Driveway is land-
scaped, including use of shrubs or low evergreen plantings,
and further find that it would be in the best interest of the
Village to grant the requested variation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS
AS FOLLOWS:
SECTION 1: The recitals set forth hereinabove are incor-
porated herein as findings of fact by the President and Board of
Trustees of the Village of mount Prospect.
SECTION 2: The President and Board of Trustees of the
Village of mount Prospect hereby grant to the Subject Property
the variation requested with respect to Section 14.116.A of
Article I of Chapter 14 of the Village of Mount Prospect, Illinois
to allow the installation of an additional (second) curb cut on
Lama Lane for the purpose of serving a circular driveway, provided
that applicants shall landscape the adjacent and surrounding open
area, including use of shrubs or low evergreen plantings, pursuant
to a landscape plan approved by the Community Development Depart-
ment of the Village.

SECTION 3: Except for the variation granted herein all other
applicable Village of Mount Prospect ordinances and regulations
shall remain in full force and effect as to the Subject Property.
SECTION 4: This Ordinance shall be in full force and effect
from and after its passage, approval, and publication in pamphlet
form in the manner provided by law.

Mr. Edward Beyer, petitioner, stated that he and his wife are
building a home on the northwest corner of Lama Lane and Burr Oak
and that the foundation has been poured. It is their desire to
have a circular driveway, however, the Village Code states that
there can only be one curb cut per dwelling therefore prohibiting
circular drives. The house faces Lama Lane and the proposed
drive would be on Lama Lane.
Mr. Beyer stated that a safety hazard would exist in his opinion
Without A'circular driveway since Lama Court, a cul de sac, is
located east of the property. It was also stated that had they
known of this type of restriction, the Beyer's could have
chAngedthe placement of thebouse on the lot.
,The staff report, recommending denial of this variation, was read.
It Was the position,of the staff that no such safety hazard
existed and that the driveway would occupy the entire,side yard
(being the front of the house).
It was noted by members of the Zoning Board of Appeals that the
structure would indeed cover most of the lot, however, it was
the feeling of the Board that since the petitioner would live in
this house it wasn't likely they would build a home that would
not be an asset to the neighborhood..,. It was also noted that no
neighbors were present to object to the proposed circular driveway.
Mr. Petrucelli, seconded by Mrs. Brothers, moved to recommend
granting the variation requested in ZBA Case No. 17-V-84.

AN ORDINANCE GRANTING A VARIATION FOR CERTAIN
PROPERTY COMMONLY KNOWN AS 1750 WEST CENTRAL
ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, Mr. Lloyd Shin, President of Hinz Lithographing
Company has filed an application for a variation with respect
to the Company's property commonly known as 1750 West Central
Road, in the Village of Mount Prospect, Illinois (the "Subject
Property"); and
WHEREAS the Subject Property is described as
follows:
Lot 1, in Hinz Subdivision, being a subdivision in
Section 33, Township 42 North, Range 11, East of the
Third Principal Meridian, in Cook County, Illinois; and
WHEREAS, Petitioner seeks a variation from the provisions
of Section 14.2202 of Article XXII of Chapter 14 of the Village
Code of Mount Prospect, Illinois which requires a 30 foot side
yard in I-1 Industrial Districts to permit instead a 5 foot
side yard for a truck loading dock on the Subject Property; and
WHEREAS, a public hearing was held on the variation request
(designated as Case No. ZBA-19-V-84) before the Zoning Board of
Appeals of the Village of Mount Prospect on the 7th day of June,
1984, pursuant to due and proper notice thereof published in the
Mount KE2spe(:�t Herald on the 16th day of May, 1984; and
WHEREAS, the Zoning Board of Appeals has submitted its find-
ings and recommendation to the President and Board of Trustees
of the Village of Mount Prospect to allow the variation request,
and the President and Board of Trustees of said Village have
given further consideration to the variation request and have
determined that the same satisfies the standards set forth in
Section 14.605 of Article Vi of Chapter 14 of the Village Code,
provided that said variation shall be conditioned upon completion,
by the applicant of the conditions set forth in Village Ordinance
3322 adopted April 19, 1983 with respect to other variation re-
quests covering the Subject Property, and this Board further
finds that it would be in the best interest of the Village to
grant the requested variation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS, AS FOLLOWS:
SECTION 1: The recitals set forth
hereinabove are incor-
porated herein as findings of fact by the President and Board of
Trustees of the Village of mount Prospect.
SECTION 2: The President and Board
of Trustees of the Village
of Mount Prospect hereby grant to the Subject Property the varia-
tion requested with respect to section 14.2202 of Article XXII
of Chapter 14 of the Village Code of Mount Prospect, Illinois to
allow location of a truck loading area to within 5 feet of the
side yard of the Easterly property line of the Subject Property,
provided that said variation is conditioned upon applicant's com-
pliance with the conditions of Ordinance No. 3322 regarding the
granting of additional variations to the Subject Property.
SECTION 3: As a condition to granting of the variation re-
quest -herein, the applicant shall deposit wi h the Community Development
Department of this Village the sum of $ which amount
shall serve,as an escrow deposit to cover'completion of land-
scaping and all other conditions established for the Subject
Property under Village Ordinance No. 3322.
SECTION 4: Except for the variation granted he -rein' -i all

OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Village of Mount Prospect is in its
seventh year as an entitlement community under the
Federal Community Development Block Grant Program; and
WHEREAS, in fiscal years 1980 and 1981 the Village
allocated funds under the Community Development Block
Grant Program for implementation of a Commercial
Rehabilitation Loan Program; and
WHEREAS, The Village adopted the Commercial
Rehabilitation Loan Program with Ordinance No. 3060, as
amended by Ordinance No. 3218 and 3320; and
WHEREAS, it has been determined that the Facade
Improvement Program is more economically feasible and
will present a more positive impact on the use of the
funds than the previously authorized Commercial
Rehabilitation Loan Program; and
WHEREAS, the Mayor and Board of Trustees have
determined that the funds originally allocated,
currently on hand, for the Commercial Rehabilitation
Loan Program will be more beneficial to the Village and
to the intent and priorities of the Federal guidelines
by use in the Facade Improvement Program:
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND
BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK
COUNTY, ILLINOIS:
SECTION 1. The Mayor and Board of Trustees of the
Village of Mount Prospect hereby authorize the

by ordinance exceptions to the prohibition on encroachments
contained in said Section may be allowed; and
WHEREAS, Gertrude M. Francek (hereinafter referred to
as "Owner"), the owner of a parcel of property commonly known
as 2 East Northwest Highway in the Village of Mount Prospect
(hereinafter referred to as the "Subject Property") has asked
the President and Board of Trustees of the Village of Mount
Prospect to allow a fixed canopy to be constructed on the
premises of
f the Subject Property, which fixed canopy will
encroach upon the sidewalks and side walkway by approximately
20 inches; and
WHEREAS, the President and Board of Trustees of the Village
of Mount Prospect have considered said request by Gertrude M.
Francek and have determined that it is appropriate to grant

executes the Indemnification and Hold Harmless Agreement
attached hereto as Exhibit A and incorporated herein by this
reference.

otherwise abandoned according to City ordinances in effect on
the date of capture.
2. To the extent the City can give good title, all
animals accepted from the City by Save -A -Pet, Inc. become the
property of Save -A -Pet, Inc•, subject to the various internal
operating procedures of said organization and all claims on
such animals, after acceptance by Save -A -Pet, Inc. become null
and void.
3. Save -A -Pet, Inc. shall undertake during the term
hereof to provide the following services:
A. Accepting, caring for, and finding new homes
for the City's stray, homeless, unwanted, and
injured dogs and cats which are delivered to
it by the City's Animal Warden or their
designate.
B. In accordance with the Illinois Animal
Control Act 183-740, Save -A -Pet, Inc. will not
release any dog or cat unless the animal
has been surgically rendered incapable of
reproduction by spaying or neutering, or the
person wishing to adopt an animal prior to
the surgical procedures having been performed
shall have executed a written agreement
promising to have such service performed
within a specified period of time.
C. Save -A -Pet, Inc. will provide the necessary
distemper and parvo inoculations, and feline
leukemia tests, as well as any other medical
treatment necessary for such animals in its
custody.
4. Save -A -Pet, Inc. shall provide the equipment and
labor necessary for the activities herein to be performed by it.
5. Save -A -Pet, Inc. shall be solely and absolutely
liable and responsible for all the regulation and
administration of the animals in its custody including, but not
limited to all costs arising from administration, maintenance,
and operation.
6. The City shall pay Save -A -Pet, Inc. the sum of
$35.00 per animal for the services herein to be provided by said
Save -A -Pet, Inc., which amounts shall be payable monthly upon
receipt of an invoice from Save -A -Pet, Inc.
7. This agreement shall be in effect for a period of
two (2) years from and after September 30, 1984, but may be
cancelled at any time prior thereto by either party by giving
60 days prior written notice. The depositing of a notice in
the U.S. mail addressed as follows shall constitute sufficient
notice hereunder:

Amount of the Grant
The VILLAGE does hereby contract for services with the

abide by the provisions and regulations of the 1974 Housing and
Community Development Act, as amended under which said contract
is made, and to use said contract funds for the purposes set
forth in Section I hereof and as conditioned by the provisions of
Section III next®
The VILLAGE's contractual obligation as identified in
Section I shall be limited to the maximum amount specified, to
the actual amount invoiced by the COUNCIL, and only to the extent
such amount is received from HUD for such purposes.
SECTION III
Conditions of Contract
A. Indemnification. The COUNCIL agrees to indemnify and
save and VILLAGE and each and everyone of its
officers, agents, employees, servants, attorneys, insurers and
successors from any and all claims, demands, causes of action,
expenses, injuries, losses or damages of whatever kind, character

of description the VILLAGE may suffer as a result of any cause,
matter, act, or oinission arising out of the failure of the
COUN( ' "IL ' or,
those acting under it, to conform to the stu

ordinances or other regulations or requirements of any gov-
ernmental authority, in connection with the COUNCIL's per-
formance under this Agreement. The COUNCIL agrees to defend
against any claims brought or actions filed against the VILLAGE
with respect to the subject of the indemnity contained herein,
whether such claims or actions are rightfully or wrongfully -
brought or filed. In case of such. a claim brought or such an
action filed, the COUNCIL agrees that the VILLAGE may employ
attorneys of its own selection to appear and defend the claim or
action on behalf of the VILLAGE at the expense of the COUNCIL.
The VILLAGE, at its option, shall have the sole authority for the
direction of the defense, and shall be the sole judge of the
acceptability of any compromise or settlemeTlt of any claims or
actions against the VILLAGE.

or applicant or any member of the public, because of race, creed,
color, sex, age or national origiri. Such affirmative action
shall include, but riot be limited to the following: employment,
upgrading, demotion or, transfer, termination, recruitment or

other forms of compensation, selection for training, including
apprenticeship. NCS agrees to post in conspicuous places
available to employees and applicants for employment, notices
setting forth the provisions of this non-discriminatory clause.
This policy of non-discrimination and affirmative action shall be
applicable with regard to both NCS's internal personnel, practices
and its actions in the performance of this Agreement. NCS agrees
and authorizes the VILLAGE and HUD to conduct compliance reviews
or any other procedures to assure compliance with these
provisions.
C. Examination of Records. The COUNCIL will, at all

and the VILLAGE, through any authorized representative, access
to, and the right to examine all records, 'books, papers or
documents related to the contract, in accordance with state and

Submission To HUD
Subsequent to the execution of this Agreement, the VILLAGE
shall forthwith file all necessary documents with. HUD and shall
comply with all applicable rules and regulations necessary to
facilitate acquisition of funds approved for this program by HUD.
The COUNCIL shall not file any lawsuit against the VILLAGE or any
of its officers or employees as a result of this contract, except
that this Section shall not act as a. bar to any lawsuits arising
from the negligent acts of the VILLAGE or any of its officers or
employees.
