COMMITTEE OF THE WHOLE
JUNE 26, 1984
I. ROLL CALL
The meeting was called to order at 7:30 p.m. Present
at the meeting were: Mayor Carolyn Krause, Trustees '
Ralph Arthur, Gerald Farley, Leo Floros, Norma Murauskis,
George Van Geem and Theodore Wattenberg. Also present
at the meeting were: Village Manager Terrance Burghard,
Director of Public Works Herbert Weeks, Public Works
Superintendent Mel Both and Public Works Superintendent
Sandy Forgacs. There were approximately seven persons
in the audience.
II. MINUTES
The Minutes of the Committee of the Whole meeting of
June 12, 1984 were accepted and filed.

The Village Manager's office receives approximately
two inquiries a month from residents who have either
received tickets under the Ordinance for non-compliance
or are seeking ways other than temporary suspensions
to be allowed to park on the streets.
The Committee of the Whole reviewed the memo prepared
by Administrative Intern Sam Savides which included
a survey of seven surrounding communities. Six of the
seven communities have Ordinances very similar to the
Village of Mount Prospect and similar enforcement
patterns. The primary purpose for the overnight parking

VI. TREE AND S_ iBBERY OBSTRUCTIONS
Prompted by a recent judgment against the City of
Aurora, the Executive Safety Committee has recommended
strict enforcement of existing Village Ordinances which
require the trimming of trees and shrubs which overhang
the public right-of-way or obstruct traffic sight
distances. The Committee of the Whole reviewed a letter
from Village Attorney David Newman as well as a brief
memo from Polices Chief Pavloc , Also distributed at the
meeting were photographs takenat various locations -in
the Village showing obstructions both on private property
and public property.
The Village Manager explained that the Village in the
past, has sought to gain compliance with the Ordinance
in those situations where there was a clear and significant
public hazard and danger. However, the administration
has in the past exercised a fair degree ,of discretion as
it relates to private property and very mature shrubbery°'
that only technically violated the Ordinace. However,
based upon the case in the City of Aurora and a_case a
few yearsago that Found a city liable for alack of
enforcement of its fire prevention codes, it is the
recommendation of the administration that,the Village
pursue a more aggressive enforcement policy.
