This Ordinance grants variations from the off-street
parking requirement and from the rear yard dimension
requirements. (Exhibit A)

lst reading of AN ORDINANCE TO AMEND CHAPTER 14 ENTITLED
"ZONING" OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS
REGARDING THE ADDITION OF AN AMBULANCE SERVICE AS A
SPECIAL USE IN THE B-3 BUSINESS RETAIL AND SERVICE
DISTRICT
This Ordinance amends the text of the B-3 District
classification to specify 'Ambulance Service' permitted
as a special use. (Exhibit B)

A. A RESOLUTION ADOPTING THE UNIFORM TRAFFIC CONTROL
DEVICE MANUAL
This Resolution adopts the subject manual as a guide-
line for determining traffic control regulations. (Exhibit D)
B. A RESOLUTION AFFIRMING THE SELECTION OF SEVERAL
PROJECTS FOR FUNDING UNDER THE FEDERAL AID TO
URBAN SYSTEMS PROGRAM (FAUS)
This Resolution adds Emerson Street and Seminole Lane
(Willow Road) to the list of local roadways previously
specified as a part of FAUS Program (Exhibit E)
C. ZBA 23 -SU -83, 1002 S. Busse Road
This case deals with a request for special use in
order to operate an automobile service station with
a canopy, which canopy intensifies the use of the
property. The Zoning Board of Appeals recommended
denial of the request for a canopy.
D. ZBA 25-V-83, 1816 Sitka Lane
This request for a variation to permit a 5 car attached
garage and a reduced side yard has been continued to
the August 16th Village Board meeting, at the request
of the petitioner.

COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD PETITION:
A petition was presented by Mr. Glen Lemons requesting PRIVATE
the Village to assume responsibility for repairing a ROADWAY,
private driveway/parking lot behind the townhouses WHEELING ROA:--
on Wheeling Road at Euclid Avenue (1200 - 1298 Wheeling)
Mayor Krause stated that inasmuch as the subject area
is private property, and under common ownership, it is
the responsibility of the owners to maintain the area.
It was also stated that the Village has a policy that
no roadway can be accepted as a dedication unless it
meets Village standards, or is brought up to standard.
Correspondence was presented from Mr. Arthur Brantman,
owner of the majority of the subject property, stating
tip -c he would pay his proportionate share of the
repair. Mr. Lemons stated that he would also pay
his share. It was concluded that staff would assist
these property owners in ascertaining the approximate
cost of the repairs and that the property owners
could share the cost of the necessary pavement repairs.
Trustee Floros arrived at this point, 8:14 P.M.
REQUEST TO Representatives from the Prospect High School PTA
requested the Village Board to consider legislation
AMEND CH.13 relative to parental responsibility in serving
ALCOHOL alcoholic beverages to minors. Mayor Krause stated
that the State Legislature hadJust passed such
legislation and it is either on the Governors' desk
for signature or possible already signed into law.
If the subject legislation has been adopted and
signed into the law, then an ordinance could be
presented to the Village Board adopting it into the
Village Code.,
MAYOR'S REPORT
AMEND CH.13 An Ordinance was presented for first reading that
would create a Class "W" liquor license for a
PROSPECT GYROS restaurant known as Prospect Gyros (formerly Wa Pa Ghetti's)
1520 NORTH 1520 North Elmhurst Road.

in order to take action on the subject ordinance.

& 20-A-83
An ordinance was presented for first reading that
AMEND CH.14
would amend various sections of Chapter 14, zoning
Ordinance, of the Village Code. The amendments deal
with establishing standards for accessory buildings in
all single family districts; location and width of
driveways in single family districts; modification to
permit more than one main use in all business and
industrial districts; 'Grandfathering' in single family
homes built prior to December 31, 1964 with respect to
setbacks, current standards and driveway locations.
Trustee Floros, seconded by Trustee Farley, moved to
waive the rule requiring two readings of an ordinance
in order to take action on the subject amendments.

MANAGER'S REPORT
Jay Hedges, Assistant Village Manager, presented the
Manager's Report, due to Mr. Burghard being out of town
on vacation.
Mr. Hedges presented a request to waive the bidding
procedures in order to add an item onto the paving contract
with J. A. Johnson Paving. It was stated that inasmuch as
the commuter lot, west of Main Street, is in need of re-
paving, it was recommended that the project be added to
the existing contract with J. A. Johnson, in an amount not
to exceed $17,000. By taking this action it was estimated
that the Village would save approximately $6,000.
Trustee Wattenberg, seconded by Trustee Murauskis, moved
to authorize an add-on to the existing contract with
J. A. Johnson_Paving Company in order to re -pave the
west commuter lot for an additional amount not to exceed
$17,000.

Assistant Manager Hedges then stated that the Chamber of FARMERS
Commerce had requested permission to hang banners MARKET
advertising the summer Farmers Markets across roadways, BANNERS
however, it has now been determined that the banners would
be best placed across the entrances to the commuter lots.
NEW BUSINESS
ZBA 21-V-83, Old Carriage House Restaurant ZBA 21-V-83
This case deals with requests for variations from the 20 WEST
off-street parking requirement and for a reduced yard NORTHWEST
area. The Zoning Board of Appeals had a 3-3 vote, therefore
a denial.
The Village Board discussed the requests, particularly
the area dealing with transporting the garage to a refuse
container located in a separate building approximately 50 feet
from the restaurant. At the present time the alley
behind the restaurant and adjacent properties is being used
to transport the refuse, however, that alley is a private
alley with ownership held by the various property owners.
It was stated that a permanent easement could not be
obtained from the other property owners, but arrangements
could be made to transport the refuse without using the
alley.
Also included in this case was a request to reduce the
number of required off-street parking stalls. The owner
of the restaurant, Peter Panagopoulos, stated that he would
be willing to deposit with the Village the sum of $1,800 per
parking. space that could not be provided, in this case the
requested variation consisted of a reduction of 8 spaces.
This 'cash in lieu of policy is presently being proposed
to be included in the Village Code, with monies collected
to be placed into an account for the purpose of acquiring
land at some future date for parking.

to grant the requested variations in ZBA 21-V-83, for
property commonly known as Old Carriage House Restaurant,

ZBA 22-A-83 ZBA 22-A-83, Text Amendment - 302 East Northwest Highway
302 EAST The subject case is a request to amend the text of the
NORTHWEST HWY Zoning Ordinance, Chapter 14, to permit the operation of
an ambulance service in a B-3 District as a Special Use.
AMEND CH.14
Also, the petitioner is requesting a special use to
allow the operation of an ambulance service, if a
favorable vote is considered by the Board on the text
amendment. The Zoning.Board recommended granting the
text amendment and special use for the subject property.
Trustee Farley, seconded by Trustee Wattenberg, moved
to concur with the recommendation of the Zoning Board of
Appeals and grant the requested text amendment in
ZBA 22-A-83.

Ordinances will be presented at the next Village Board
meeting.
Trustee Floros requested consideration be given to amend
the Zoning Ordinance as it pertains to the votes required
at the Village Board level to over -ride the Zoning Board
of Appeals recommendation. The necessary votes vary
depending on the subject, either a special use, variation,
etc. The administration will review the applicable
Statutes to determine if under home rule, the Village
could make the necessary votes consistent.
POLICE PENSION A Resolution was presented that would defer income tax
FUND on Police Pension contributions.

WHEREAS, Petitioner seeks the following variations from
the provisions of the Zoning Ordinance, to -wit:
1. A variation from Section 14.2002.0 to allow the
continuation of a .97 foot rear yard (formerly a side yard)
instead of the required 20 foot rear yard.
2. A variation from Section 14.2005.A.3 to provide for
twelve (12) instead of the required twenty (20),off-street

WHEREAS, a Public Hearing was held on Petitioner's
request for the aforesaid variations (designated as Case
No. ZBA 21-V-83) before the Zoning Board of Appeals of the
Village of Mount Prospect on the 9th day of June, 1983 pur-
suant to due and proper notice thereof published in the
Mount Prospect Herald on May 13, 1983; and
WHEREAS, the Zoning Board of Appeals returned the matter
to the President and Board of Trustees of the Village of
Mount Prospect without a favorable recom:-.iendation concerning
the aforesaid variations under ZBA 21 -V -S3; and
WHEREAS, the President and Board of Trustees of the
Village of Mount Prospect have determined that the Petitioner's
variation requests satisfy the standards set forth in Section
14.605 of Article VI of the Zoning Ordinance and further find
that it would be in the best interest of the Village to grant
the Petitioner the requested variations upon compliance with
the conditions hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK
COUNTY, ILLINOIS:
SECTION ONE: The Recitals -set -7 f oKth_berein above are
incorporated herein as findings of fact by the President and
Board of Trustees of the village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of
the Village of Mount Prospect do hereby grant to the property
hereinabove described variations requested with res-oect to
Sections 14.2002C, 14.2005A3, 14.2005Bi and 14.260fB subject
to the following conditions:
A. Applicant shall make a cash contribution in the
total amount of $14,400.00 to the Village, in
lieu of a requirement for eight (8) parking
spaces upon applicant's premises; said payment
to be made pursuant to a schedule established
by the Village Manager.
B. Applicant shall provide delivery access across
the private alley adjoining the applicant's
separate property at 15 West Busse Street for
the purpose of deliveries to the premises in
question.
C. Applicant to provide adequate area to the rear
of his nearby and separately owned property at
15 West Busse for the purpose of refuse and
garbage disposal.
D. Applicant: shall carry out landscaping necessitated
as a result of the building addition proposed
to applicant's premises, pursuant to a land-
scaping plan satisfactory to the Community
Development Department of the Village.
SECTION THREE: In the event that the Applicant sells,
transfers or leases the Subject Property or the restaurant
business thereon, then adequate provision for the storage
of refuse and garbage shall be provided or the variations
granted herein shall immediately cease and terminate.
SECTION FOUR: Except for the variations granted herein,
all other applicable Village of Mount Prospect Ordinances
and Regulations shall remain in full force and effect as to
the Subject Property.
SECTION FIVE: This ordinance shall be in full force and
effect from and after its passage, approval and publication
in pamphlet form in the manner provided by law.

has hereto filed an application seeking an amendment to Chapter

TRAFFIC CONTROL DEVICES
WHEREAS, traffic control guidelines are necessary to provide
for the safe and efficient traffic flow; and
WHEREAS, guidelines for traffic safety have been developed
by the State of Illinois Department of Transportation through
the -Mahaal on Uhiform Traf-fic Control Devices
WHEREAS, the Mayor and Board of Trustees have reviewed the
Illinois 'Department of Transportation Manual on -Uniform Traffic
Control DeviceG and have determined that to insure the health,
safety and welfare of the residents of the Village of
Mount Prospect said guidelines set forth within the subject
Manual be adopted.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,

A RESOLUTION AFFIRMING THE SELECTION OF SEVERAL PROJECTS
FOR FUNDING UNDER THE FEDERAL AID TO
URBAN SYSTEMS PROGRAM (FAUS)
WHEREAS, the Village of Mount Prospect has been informed by
the Northwest Municipal Conference that funding for
transportation projects is available; and
WHEREAS, the Village of Mount Prospect recognizes the need
for certain improvement projects with the Village; and .
WHEREAS, these projects conform to the specific constraints
set forth by the Chicago Area Transportation Study Northwest
Council (the Northwest municipal Conference); and
WHEREAS, it is necessary for the Village Board to affirm
the selection of the projects within the Village of
Mount Prospect to indicate their support for these projects;
and
WHEREAS, the Mayor and Board of Trustees did pass and approve
Resolution No. 28-83 affirming the selection of specified
roadways for funding under the Federal Aid to Urban Systems
Program; and
WHEREAS, it is necessary to add Emerson Street, entire
jurisdiction, and Seminole Lane (Willow Road), between
River and Wolf Roads to the Federal Aid to Urban System
Program.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS:
SECTION ONE: That the President and Board of Trustees of

the following additional projects for funding under the Federal

The petitioner seeks a special use for an autombile service
station in order to erect a freestanding canopy over the existing
pump islands on Golf Road thus constituting an intensification of
the use requiring approval of a special use permit. Village
Board action is required.
The Community Development staff considered the request by G B
Mini Mart, Inc. for a freestanding canopy and have no principal
objections to the use of the canopy over the pump islands.
However, at the Zoning Board of Appeals meeting it was noted that
the site plan submitted did not coincide with the plat of survey
measurements, and did not delineate parking, landscaped areas and
revised pump island locations. Therefore, the Zoning Board of
Appeals denied the request on the basis of incomplete information
by a vote of 1 aye, 4 nays, 2 absent. Since the Zoning Board of
Appeals action was to deny the request, four affirmative votes
would be required to pass by a two thirds majority vote of the
Trustees of the Village.
Community Development Department staff recommends that the
petition be remanded back to the Zoning Board of Appeals upon
proper documentation regarding the site plan layout coinciding
with the dimensions and legal description of the plat of survey.

and harmony with the majority of single family homes in the area.
Moreover, the petitioner, in protecting their private property
are creating their own hardship. They have the option of storing
the vehicles in another location more appropriate for the repair
and reconditioning of such vehicles. The tendency is for these
types of uses to become illegal home occupations.

I.
ROLL CALL
The meeting was called to order by Mayor Krause at
7:30 p.m. Present at the meeting were: Mayor Krause,
Trustees Ralph Arthur, Gerald Farley, Leo Floros,
Norma Murauskis, George Van Geem and Theodore Wattenberg.
Also present at the meeting were Village Manager
Terrance Burghard, Assistant Village,Manager Jay
Hedges,; Director of Community Development Kenneth Fritz,
Director of Management Services John Hedstrom, Director
of Public Works Herbert Weeks and .several other staff
members representing variousDepartments. There were
approximately 18 persons in the audience including members
of the Planning Commission and Zoning Board of, Appeals.
II.
MINUTES
The Minutes of the Committee,"of the Whole meeting of
June 14, 1983 were reviewed and filed.'
III.
CITIZENS TO BE HEARD
There being no citizens, present at the meeting desiring
to make any presentation before the Committee of the
Whole, the Mayor moved on to the next item of business.
IV.
ROUSE/RANDHURST PRESENTATION
Mr. Claude Lamontagne, with the Rouse Corporation,
introduced his staff from Randhurst. The Rause Corporation
owns and operates'58 shopping, centers throughout this
country. Then they 4dgUired andhurst approximately two
years, ago, it met their standards for acquisitions and
provided the -possibility of expansion,'a change in tenant
m.x; existed in an estalhlished market and provided the
potential profit for return on their investment.
The Rouse staff reviewed their market research data which
indicated that Randhurst could benefit in our market from,
the infusion of some additional stores aiming at a higher
quality and higher price market.
Mr. Hedstrom briefly reviewed his research on the matter
indicating for the last three and: one-half years', the
Villa e has incurred average losses in the neighborhood
of $1 1,0100. 'Since May; 9; Mr. Hedstrom had contacted
seven brokers and,/or self-insurance administrators inviting
proposals with a submission date of June 15„ 1983. As of
this meeting, the only response that we have received has
been from Arthur J. Gallagher and Company. A conventional
carrier is attempting to put together a conventional insurance
program but they have not submitted any data as of this
date.
Mr. James Gault, of Arthur J. Gallagher, was present in the
audience and briefly reviewed the basic format of the
program. The Village would -continue to self -insure for all
claims under general liability, auto coverage and workers`
compensation up to an annual stoploss of $250,000. The
remaining exposure would be covered by conventional umbrella
insurance secured through Arthur J. Gallagher and most likely
placed with Lloyd's of London. Arthur J. Gallagher would
administer our claims and their administration fee would
be approximately $25,000 per year. The fixed costs; i.e'.,
the purchase of the umbrella coverages and the administrative
fee would amount to $111,000:
The Committee of the Whole discussed the merits of the
proposa'l,"individual concerns from elected officials and
the mechanics for review. IRMA must have an Ordinance by
September 1 of 1983 indicating the Village's desire to
participate in the second phase of the program. Therefore,
the Village must make its final decision,by,the.second meeting
in August if it hopes to adopt the.Ordinance,at a regular
meeting and not a'special meeting.Because of this short
time -span, the Committee of the Whole recommended that the
matter be referred immediately to the Finance Commission
for their review and advice. The Committee of the Whole
felt generally that the matter ought to be explored but
reserved judgment ,for final decision until they receive
the recommendation of the Finance Commission and have more
time to study the proposal in detail. Elected officials
having specific questions are to direct them to the
administration and 'they ;will be addressed with the Finance

V1. MANAGER'S REPORT'
The Village Manager reported.that the WATER AGENCY pipeline
has now crossed Central Avenue from the north,, work has
begun on the line in\the commercial area in the vicinity
of Venture and Countryside Bank and that the augering pit
is being constructed on the MSIR property at the far south.

The Executive Session adjourned at 9:40 p.m. and the
Committee of the Whole was immediately reinstated.
Trustee Wattenberg reviewed for the Committee of the
Whole a recent incident that he had in municipal court
in observing the procedures. The court clerk announced
at the beginning of the session-that note taking was
prohibited. Mayor Krause suggested that these kinds of
matters be directed to the Bar Association and that
perhaps Trustee Wattenberg write a letter to the Chief
Judge. Trustee Wattenberg suggested that Mr. Pavlock,
Chief of Police, bring this matter up for discussion with
Judge Geocaris as it appears to be an affront to bur
Constitutional rights.
The Committee of the Whole meeting adjourned at 9:45 p.m.
