ORDINANCE NO. 4640
AN ORDINANCE GRANTING A SPECIAL USE FOR THE PROPER'FY
GENERALLY LOCATED AT THE NORTHEAST CORNER
OF EUCLID AVENUE AND RAND ROAD
WHEREAS, Pontarelli Builders, Inc. (hereinafter referred to as Petitioner), has filed an
application for a Special Use in the Nature of a Planned Unit Development for property
generally located at the northeast corner of Euclid Avenue and Rand Road (hereinafter
referred to as Subject Property), legally described on Exhibit "A" attached hereto and
hereby made a part hereof; and
WHEREAS, public headngs were held on the request for the Special Use, being the
subject of ZBA Case No. 72-SU-93, before the Zoning Board of Appeals of the Village
of Mount Prospect on the 9th day of September, 1993 and the 11th day of November,
1993, pursuant to due and proper notice thereof having been published in the Mount
Prospect Herald on the 24th day of August, 1993; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation
to the President and Board of Trustees of the Village of Mount Prospect; and
WHEREAS, Petitioner seeks a Special Use in the nature of a Planned Unit Development
to allow development of 200 residential condominium units located within four, 5-story
buildings; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
considered the request being the subject of ZBA 72-SU-93 and have determined that the
best interests of the Village of Mount Prospect would be served by granting said request.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the recitals set forth hereinabove are incorporated herein as
findings of fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect
hereby grant to the Subject Property a Special Use in the nature of a Planned Unit
Development; said Special Use to be developed in substantial conformity with exhibits as
specified in the amendment to the Consent Decree governing the property being the
subject of this Ordinance and other Exhibits submitted by the Petitioner, copies of which
are attached hereto and hereby made a part hereof. The Special Use granted herein
shall be in accordance with the following conditions:
1. The Petitioner shall install a right-turn lan~ on westbound Euclid Avenue and pay
all costs associated with the installation.
2. The Petitioner shall install a deceleration lane at the project's Rand Road entrance.
3. The $choenbeck Road access ddve shall be designed to all°w full movements in
and out of the project.
4. The Petitioner shall submit detailed site plans, landscape plans, building
elevations, engineering plans, floor plans, and signage elevations prior to approval
of the Consent Decree. Said submission shall be subject to the approval of the
appropriate Village officials. In addition, the Petitioner shall submit building
material samples for staff review.

5. The Petitioner shall comply with all current Village Codes, policies and regulations.
6. The Petitioner shall modify the Schoenbeck Road/Rand Road intersection to allow
dual left-turn lanes onto Rand Road.
SECTION THREE: VVith the exception of the Special Use granted here, the Subject
Property shall comply with all other applicable Village of Mount Prospect Ordinances and
Regulations pertaining thereto.
SECTION FOUR: This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.
