VIII. OLD BUSINESS
A. 2nd reading of AN ORDINANCE ADDING A NEW ARTICLE XVIII
ENTITLED "RESIDENTIAL LANDLORD AND TENANT REGULATIONS"
TO CHAPTER 23 OF THE VILLAGE CODE
This Ordinance establishes regulations for both tenants
and landlords , providing for the Village to mediate
specified areas between landlords and tenants.
B. ZBA 46-Z-82, M North Wolf Road
lst reading of AN ORDINANCE AMENDING THE OFFICIAL
ZONING MAP OF THE VILLAGE
This Ordinance grants B-2 zoning, from R -X, with
specific covenants running with the land.

X. NEW BUSINESS
A. The following recommendations were made by the
Safety Commission at their December 6th meeting:
1. Four -Way STOP at School Street and Council
Trail. The Safety Commission recommends
denial of request.
2. Four -Way STOP at Fairview Avenue and
Isabella Street. The recommendation was
to deny the request.
3. NO PARKING ANYTIME on one side of Wille Street,
between Central Road and Henry (the first block
north of Central Road). The Safety Commission
recommends denial of request.
4. Four-way STOP at Wille Street and Evergreen.
It was the recommendation of the Safety
Commission to deny the request.
5. one -Way traffic on Beechwood, north or south-
bound, between Palm & Willow. The Safety
Commission recommends the request be denied.
B. ZBA 51-V-82, 1-901-1919 West Golf Road
This request is for a variation to allow more than
one main building on a lot. This case was the
subject of a Planned Unit Development, granted in
1981, however, the one year allowed in order to obtain
a building permit has passed, requiring re-application.
The Zoning Board of Appeals recommends approval
of this request.
C. ZBA 56-V-82, 1423 South Robert Drive
This case deals with a request to allow an off-street
parking pad on a residential lot for the purpose of
parking a commercial -use pickup truck. The Zoning
Board of Appeals recommends approval of this request.
D. ZBA 57-Z-82, 650 East Rand Road
This request is to re -zone a lot just west of the
Mount Prospect Plaza from B-3 to B-4 to perriit a
drive-through restaurant facility (Taco Bell). The
Zoning Board of Appeals recommends this request be
granted.
XI. ANY OTHER BUSINESS
A. Kensington Center Plat of Re -Subdivision No. IX
This plat divides a large lot into two lots of record,
as required by the Development Code.

MAYOR'S REPORT
An Ordinance was presented for first reacting that would

amend the Class "G" liquor license classification for
the Mount Prospect Park District which would delete the

restriction of service of beery and wine between the
months of April and November and allow service the
entire year. This Ordinance will be presented
January 18th for 2nd. reading.

VILLAGE MANAGER'S REPORT 33-35 S. MAIN ST.
An Ordinance was presented for second reading ;that
would authorize the demolition of a Village owned
building at 33-35 S. Main Street, referred to as
V & G Building. There was a request at the last'
Board meeting to suggest a use for the building rather
than destroy it, however, Village Manager Terrance L.
Burghard stated that various options had been 'reviewed
and since the building was in need 'of,repairs ,`that would
cost approximately $9,500 and the fact that storage
would be unsupervised, it would not be a feasible use.
Mr. Burghard also stated that the Chamber of Commerce
had been contactedas to the possibility of their using the
building, but when the various utility costs were
reviewed, the Chamber stated they could not afford: such
a building:

NEW BUSINESS
A Resolution was presented authorizing execution of FOREST RIVER FIRE
an Agreement between the Village and the Forest River PROTECTION DISTRIC
Fire Protection District. This Agreement includes a AGREEMENT
small area of single family 'homes in the northeast
section of the Village, but not within the corporate
limits.

This case, dealing with 'a request to re -'zone the 322 N.Wolf Road
subject property from R -X to B-2, was heard by the
Zoning Board of Appeals, which recommended denial.
In line with this request, a Public Hearing was held
before the Planning Commission to amend the Official
Comprehensive, Land Use Plan. The Planning Commission
voted in favor of the proposed amendment. It was
stated that an architectural firm plans to purchase -
the existing single family home and convert it, with
modest external. remodeling, to an office.

which funds are to be paid from the Motor Fuel Tax
Fund.

AN ORDINANCE AMENDING ARTICLE I OF CHAPTER 13 OF
THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS,
REGARDING ISSUANCE OF A CLASS "G" LICENSE
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: Article I of Chapter 13 entitled "Alcoholic Liquor
Dealers" of the Village Code of Mount Prospect, Illinois (1981),
as amended, is hereby further amended as follows:
A. By amending Section 13.106.A,1 pertaining to the CLASS
"G" license to read as follows:
"CLASS 'G' license, for issuance to park districts
when operated as a function of that district and not
a concession to a third party, which shall authorize
the licensee to sell and offer for sale at retail in
the premises specified in such license application,
for beer and wine only, for consumption on the premises."
B. By amending Section 13.115.D to read as follows:
11D. It shall be unlawful for any licensee holding a
Class 'GI liquor license created under the terms of this
Chapter to sell or offer for sale any alcoholic liquor
at retail in the Village or to permit any person to
consume any alcoholic liquor in or on any premises
for which a license providing for consumption on the
premises has been issued pursuant to this Chapter 13
other than between the hours of eleven o'clock (11:00)
A.M. and ten o'clock (10:00) P.M. on Monday through
Friday, inclusive; between the hours of eleven o'clock
(11:00) A.M. on Saturday and three o'clock (3:00) A.M.
on the following Sunday; and between the hours of
twelve (12:00) noon and ten o'clock (10:00) P.M.
on Sunday."
SECTION TWO: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in pamphlet
form in the manner provided by law.

SUBJECT: CITIZENS UTILITIES INTERVENTION
Pursuant to discussions with Mayor Krause and Trustee Wattenberg,
the Village Manager spoke by telephone to the President of
the Water Consumers Association regarding the continuing
matters of Citizens Utilities Company of Illinois. The
Illinois Commerce Commission has initiated its own case
against Citizens Utilities Company requiring that Company to
demonstrate proof on the record of its actual or acquired
investment in capital facilities.
Apparently in the past, Citizens Utilities Company has
estimated its base investment; and, now the Illinois Commerce
Commission is requiring the Company to show proof of past
construction and acquisition. It is very important that
these base numbers be accurate and documented because rate
increases are based in part on the amount of capital investment
the Company has. As I understand it, the Illinois Commerce
Commission has requested this information in the past and is
now requiring it by formal action.
In speaking to Mr. Cather, the Water Consumers Association,
of which we are a member, is planning to formally intervene
as an interested party in the case and after discussing the
matter with Mayor Krause and Trustee Wattenberg, I pursued
the degree of financial involvement on the part of the
Village with the Water Consumers Association. By Mr. Cather's
estimate, the intervention case for the Association will
cost between $2,000 and $5,000.
This case is likely to be more significant thant'some of the
prior cases since it is brought initially by the Illinois
Commerce Commission and goes to the very base rates of
Citizens Utilities Company. The Board should consider
whether it desires to maintain its membership in the Water
Consumers Association. If we choose to do so, I would
recommend that we notify the Association that we will participate
in this case for 50% of the costs up to a maximum of $2,000.

SUBJECT: BUTCH McGUIRE'S LIQUOR LICENSE - NEW OWNERS
On Wednesday, January 12, the Village Manager interviewed
Mr. William Braun and Mr. David McNeil regarding their
reuqest for a Class A Liquor License at Butch McGuire's, at
300 East Rand Road. The Mc'Br-Al, Inc., group is seeking to
acquire ownership of the land, buildings and business from
the current owner of Butch McGuire's. The new corporation
is also entering into a license with a continued use of the
establishment's name. They estimate closing of the sale to
be on or about February 1 of this year.
The Manager of the establishment will be Mr. William Braun,
a principal of the corporation and. also a resident of the
Village. Neither Mr. Braun.nor Mr. McNeil have direct
experience in operating such an establishment, but the other.
principal, Mr. Vincent Alagna has such experience.
The current operation at Butch McGuire's does have a Class A
license which permits retail package and consumption on
premises. While there currently does not exist a package
operation, the new owners intend to do some remodeling of
one of the structures with the hope of selling bottles of
wine for off -premises consumption. That kind of operation
would be consistent with a. Class A operation. The Village
Manager's office is seeking a letter from the current owners
of Butch McGuire's indicating they do indeed intend to sell.
That document has not yet been received. Additionally, we
have not received a copy of the Land Trust Agreement, the
Trust number or a fully executed copy of the Dram Insurance.
If the Village Board agrees that these new owners are
eligible for a Liquor License, there would be no need to
change the existing Ordinances.

Sec. 23.1801. Purpose and Declaration of PoIicy. It is the
purpose of this Article and the policy of the Village, in order to
protect and promote the public health, safety and welfare of its
citizens, to establish rights and obligations of the landlord and
the tenant in the rental of dwelling units in the Village and to
encourage the landlord and the tenant to maintain and improve the
quality of rental housing within the community. This Article obaII
be liberally construed and applied to promote its purposes and
policies.
Geo. 23.I803. Scope.
A. Territorial Application: This Article applies to,
regulates and determines rights, obligations and remedies
under a rental agreement, wherever made, for a dwelling
unit, within a multi -family residence structure located
within the Village.
B. Exclusions: UoIeno created to avoid the application of
this Article, the following arrangements are not governed
herein:
I. Residence at a public or private medical, geriatric,
educational, religious nursin or retirement
institution; an 2
2. Occupancy under a contract of sale of e dwelling unit
if the occupant is the purchaser;
3. Residence in a residential care home as provided for
and approved by the village pursuant to the procedures
established in Chapter 14 of the Village Code.
4. Transient occupancy in a hotel or motel.
5. Rental of a single family residence.
Sec. 23.I803. Definitions. As used in this Article:
ACTION:
Includes recoupment, counter -claim, setoff, suit
in equity, and any other proceeding in which
-
rights are determined, including an action for
possession and an action for unpaid rent.
CODE:
Includes any ordinance or governmental regulation
oouoecuiog fitness for habitation, or the
~ onuotzuotlou, maintenance, operation, occupancy,
use or appearance of any premises or dwelling
unit.
COMMON AREA:
Includes any part or area of the premises not
within any dwelling unit.
CONDOMINIUM:
Shall mean any dwelling unit under individual
ownership in a multi -unit structure as provided
in the Condominium Property Act of the Revised
Statutes of the State of Illinois.
CONDOMINIUM ASSOCIATION:
Shall mean any organization oc.aonoolatioo which
governs the operation of common areas or services
DWELLING UNIT:
Consists of one or more rooms in a structure or
portion thereof arranged, designed and used as a
residence or living quarters by one or more
persons who maintain a household, and ouutaimlug
therein bathroom and kitchen facilities.
FAIR RENTAL VALUE;
Shall mean the prevailing value of comparable
rental units in the Village.
LANDLORD:
Includes the owner, lessor or sublessor of the
dwelling unit or the building of which it is a
part. An owner is one or more persons, jointly
or severally in whom is vested all or part of the
legal title to the premises, or all or part of
the beneficial ownership and a right to present
use and enjoyment of the premises, including a
mortgage holder in possession.
MULTI -FAMILY sU3WTaL STRUCTURE:
Shall mean a building which contains three or
more dwelling units, of which at least fifty
percent (50#) are rental units.
NOTICE:
Unless otherwise otated, all notices cenulced
herein shall be in writing and shall be served b
one party upon �td ma=i.
Includes an individual or a corporation,

government, governmental subdivision or
business trust, estate, trust, partnership or '
association or any other legal ot commercial=

PREMISES:

Shall mean all payments to be made to the
landlord under the rental agreement.
RENTAL AGREEMENT:
Shall mean all written agreements and valid rules
and regulations adopted under Section 23,I806B
hereof embodying the terms and conditions
concerning the use and occupancy of a dwelling
unit and premises.
RENTAL UNIT:
GbaII mean a dwelling unit in a multi -family
rental structure occupied or available for
occupancy by one or more gecoohe, other than the
owner of record, under a rental agreement.

Shall mean a person entitled under a rental
agreement to occupy a rental unit to the
exclusion of others.
TERM USAGE:
Whenever herein the term "person", "landlord" or
"tenant" is used in the masculine or sinjular
Eorm, said term shall o include and reter to
the feminine o �Jolur�al form.
Geo. 23.1804. Rental Agreements.
A. Terms and Conditions.
I. The landlord and tenant may include in a rental
agreement terms and conditions not prohibited by this
Article and other rules of law, including rent, term
of the agreement and other pcc~ioioua governing the
rights and obligations of the parties.
2. All rental agreements between landlords and tenants
omat be in writing, dated and signed by both parties
with signed copies provided to both at the time of
signing.
3. Rent is to be payable without demand or notice at the
time and place agreed oDoo by the parties. oolean
otherwise agreed, rent is payable at the IaodIozd`o
place of business at the beginning of any term of one
month or Ieos and otherwise in equal monthly
installments at the beginning of each month. OuIeas
otherwise agreed, rent obaII be uniformly

4. OoIesa the rental agreement fixes a definite term, the
tenancy shall be week -to -week in the case of a tenant
who pays weekly rent, and in all other cases
� B. Effect of Unsigned or Undelivered Agreemen't;
l. If the landlord does out sign and deliver a written -
rental agreement, signed and delivered to him by the
tenant, acceptance of rent without reservation by the
landlord gives the rental agreement the same effect as
if it had been signed and delivered by the landlord,
for the term set forth in the rental agreement.
^. If the tenant does not sign and deliver a written
rental agreement, signed and delivered to him by the
landlord, acceptance of possession and payment of cent
without reservation gives the rental agreement the
same effect as it it had been signed and delivered by
the tenant.
C. Prohibited Provisions.
l. Except as otherwise provided by this Article, no
rental agreement may provide that the tenant or the
landlord:
a~ Agrees to waive or to forego rights or remedies
under this Article.
b. &mtbncioes any 9ec000 to confess judgment on a
claim arising out of the rental agreement;
C , Agrees to the limitation of any liability of the
landlord or tenant arising under law or to
indemnify the landlord or tenant for that
liability or the costs connected therewith.
2. A provision prohibited by subparagraph l included in a
rental agreement is unenforceable. If a landlord
deliberately uses any provision in a rental agreement
known by him to be prohibited, the tenant may recover
an amount totalling not more than two (2) months rent
d suchd and fees
dete7m'ine and award.
3. If a court finds the rental agreement, or a settlement
in which a party waives or agrees to forego a claim or
right under this 8ctloIe or under the rental
agreement, to have been unconscionable when made" the
court may grant the following relief:
I. Nonenforcement; or
2. Nonenforcement of the unconscionable provision
only; or
3. Limit the application of any provision to avoid
an unconscionable result.
D. Notice of Non -Renewal of Rental Agreement.
I. If the rental agreement will not be renewed or if a
month-to-month tenancy will be terminated, the
landlord shall notify the tenant in writing not less
than thirty (30) days' prior to the termination date.
2. If the landlord fails to give the required written
notice, the tenant may remain in his rental unit for
thirty'(30) days commencing on the date that the
written notice is received by the tenant. During such
period, the terms and conditions of the tenancy shall
be the same as the terms and conditions during the
month of tenancy immediately preceding the notice.
E. Attachment of Article to Rental Agreement.'
Following the effective date of this Article a copy thereof
obaII be attached to each rental agreement delivered by or
on behalf of a landlord when any such agreement is
presented for signing to any tenant whether such agreement
is for a new rental or a renewal thereof.
Sec. Z3.1805. Tenant Obligations. The Tenant shall:
A. Comply with all obligations imposed opuo tenants by
provisions of the codes applicable to the rental unit:
B. Keep that part of the premises that be occupies and oeem as
safe as the condition of the premises permits;
C. Dispose from his rental unit all ashes, rubbish, garbage
and other waste in a clean and safe manner.
D. Keep all plumbing fixtures in the rental unit or used by
the tenant as clean as its condition permits;
D. Use in a reasonable manner all electrical, plumbing,
sanitary, beating, ventilating, air conditioning and other
facilities and appliances, including elevators, in the
premises;

F. Not deliberately or negligently destroy, deface, damage,
impair or remove any part of the premises or rental unit or
knowingly permit any person to do so;
G. Conduct himself and require other persons on the premises
and within his unit with his consent to conduct themselves
in a manner that will not disturb his neighbor's peaceful
enjoyment of the premises; and
B. Maintain his rental unit in a clean and sanitary condition
and provide for a general cleaning of the rental unit prior
to departure. As part of such cleaning the tenant will
broom sweep the floors, vacuum all rugs and carpeting,
clean appliances and plumbing fixtures and patch nail holes.
I. Not unreasonably withhold consent to the landlord and the
Village of Mount Prospect to enter the rental unit in order
to inspect the premises, make necessary or agreed repairs,
decorations, alterations or improvements, supply necessary
or agreed services or show the dwelling unit to prospective
or actual purchasers, mortgagees, tenants or workmen.

K. Unless otherwise aqreed to in writino bv the landlord. not
Seo. 23.1806. Landlord Obligations.
A. Security Deposits or Prepaid Rent:
I. A landlord who receives a security deposit or prepaid
rent from a tenant nmot comply in full with the
provisions of the Illinois State Statutes which
provide that landlords moot Day interest on security
deposits in developments with 25 or more rental units,
and within thirty (30) days after the end of each
twelve <I2> month rental period, pay to the tenant any
such interest by onab or credit to be applied to rent
due, except when the tenant is in default under the
terms of the rental agreement. '
_�- -- 2. Upon termination of the tenancy, property or money
held by the landlord as security or prepaid rent may
he applied to the payment of accrued rent and to the
payment of actual damages which the landlord has
suffered by reason of the tenant's noncompliance with
Section 23.1805, provided the landlord has, wltb10

thirty (30) days of the data that the tenant has
vacated the rental unit, given the tenant a written
notice mailed to the tenant at his last known address,
or delivered personally to him, which notice shall
include an intemlzed statement of the damage in
question together with copies of the actual paid

Rules and Regulations Regarding Rental Units.
_ l. The landlord from time to time, may adopt general
rules or regulations oouoecuiug the tenant's use and
occupancy of the premises. They are enforceable only

��- - a, Their purpose is to promote the convenience,
safety or welfare of the tenants in the premises,
preserve the landlord's property from abusive use
or make a fair distribution of services and
facilities among tenants;
b. They are reasonably related to the purpose for

which they are adopted;
C. They apply to all tenants in the premises in a
fair manner;
d. They are sufficiently explicit to fairly inform
the tenant of what be must or must not do to
comply;
e. They are not for the purpose of evading the
obligations of the landlord; and
f. They are attached to the rental agreement so that
the tenant has notice of them at the time be
enters into the rental agreement.

into the rental agreement that substantially modifies
his lease agreement is not enforceable uoIeoa the
tenant oouoeuto to it in writing or -unless a change in
local State or Federal legislation requires the
regulation change.

C. Disclosure.
I. The landlord or any person authorized to enter into a
rental agreement on his behalf obaII disclose to the
tenant in writing on or before the commencement of the
tenancy:
a. The name, address and telephone number of the
person authorized to manage the premises; and
b. The name and address of the owner of the premises
or the person authorized to ant on behalf of the
owner for the purpose of service of process and
for the purpose of receiving notices and demands.
2. A person who fails to comply with subparagraph l above
becomes an agent of each person who is a landlord for:
a. Service of gcooeoo and receiving of notices and
demands; and
b. Performing the obligations of the landlord under
this Article and under the rentalagreement and
expending or making available tor that purpose
all rent collected from the premises.
3. The information required to be furnished by
aohDacagragb l above shall be kept oucceot,
subparagraphs I and % above extend to and are
enforceable against any oocoeoaoc landlord or manager.
4. Before a tenant initially enters into or renews a
rental agreement for a rental unit, the landlord or
any person authorized to enter into a rental agreement
on his behalf shall disclose to the tenant in writing
any node violations vb1cb have been cited by the
Village for the rental unit on the pcemioea. If the

landlord fails to comply with this subparagraph 4,_the
tenant may pursue the remedies provided in Section
23.1808 of this Article.
D. Maintenance of Premises.
I. The landlord shall maintain the premises in
�
substantial compliance with the applicable codes of
-- the Village and shall promptly make any and all
repairs necessary to fulfill this obligation.
2. The landlord and tenant of any rental unit may agree
that the tenant is to perform specified repairs,
`
maintenance tasks, alterations or remodeling only if:
a. The agreement of the parties is entered into in
good faith and not for the purpose of evading the
obligations of the landlord or tenant and is set
forth in a separate writing signed by the parties
and supported by adequate consideration; and
b. The agreement does not diminish or affect the
obligation of the landlord to other tenants in
the premises.
E. Access to Rental Unit.
I- The landlord with consent of the tenant shall have the
right of access to the rental unit for the purposes
set forth in Section 23.1805 I.

2- The landlord shall not abuse the right of access to
the rental unit or use it to bacaoo the tenant.
Except in cases of emergency, the landlord sbzII give
the tenant at least notice of
his intent to enter eaoouable

3' The landlord may enter the rental unit without consent
of the tenant in onae of emergency. For purposes of
this provision the term "emergency" shall refer to a
situation wherein access to the rental unit is
necessary in order to prevent damage or destruction to
the unit, or to the fixtures, equipment, appliances,
furniture and other personal property contained
therein, or in order to protect any geznou from
injury, as a result of fire, explosion, nater leakage,
floods, intentional acts of damage or vandalism or
other casualty. Non-payment or delinquent payment of
rent shall not constitute an emergency.
F. Limitation of Liability.
I. Unless otherwise agreed, a landlord who sells the
premises is relieved of liability under the rental
agreement and this Article for events occurring
subsequent to written notice to the tenant that the
sale has ocoucced, However, be remains liable to the
tenant for any property and money to which the tenant
is entitled under Section I806A, of this Article and
all prepaid rent uoIeao the tenant receives written
notice that such property, money and prepaid rent have
been transferred to the buyer, and that the buyer has

accepted liability for such property, money and
prepaid rent.
3. Duleao otherwise agreed, the manager of the premises
is relieved of liability under the rental agreement
and this Article for events occurring after written

notice to the tenant of the termination of his
management.
_ G. Receipts.

Upon request of the tenant a landlord must provide a
written receipt for any payment mode (i.e., rent, security -
deposits, etc.). If payment is made by personal check, the
cancelled check shall be considered a ceoeipt.
Seo, 23.1807. Landlord Remedies.
A. B_reach of Rental Agreement.
l. If there is n material noncompliance by the tenant
with the rental agreement or with Section 23'1805, the
landlord may deliver =cicteu notice to the tenant
specifying the acts and omissions constituting the
breach and that the rental agreement will terminate
upon a date not less than after receipt
of the notice unless the breach is remedied by the
tenant within the l period.
2. If rent is unpaid when due, and the tenant fails to
pay the unpaid rent within five (5) days after written
notice by the landlord of his intention to terminate
the rental agreement if the rent is not so paid, the
landlord may terminate the rental agreement or he may
accept a payment made more than five (5) days after
such notice in which case he shall be entitled to
rental 2ayment,

3. Except as provided herein, the landlord may recover
damages and obtain injunctive relief for any material
noncompliance by the tenant with the rental agreement
or with Section 23.1805. If the tenant's noncompliance
is willful, the landlord may recover such additional
costs and fees as a Court mbaII determine to award.
4. If there is material noncompliance by the tenant with
Section 23.I805r hereof, and the tenant fails to
comply as promptly as conditions permit in case of
emergency or within ten (10) days of receipt of
written notice by the landlord specifying the breach
and requesting that the tenant remedy it within that
period of time, the landlord may enter the dwelling
unit and have the work done in a workmanlike manner
and submit a receipted bill from an appropriate
tradesman for the ouot thereof as rent on the next day
when rent is due, or if the rental agreement has
terminated, for immediate payment, provided that the
landlord has fulfilled his affirmative obligations
under Section 23.I806 C and D.
5. If the rental agreement is terminated, the landlord
shall have a claim for possession and for rent and
a separate claim for his actual damages for breach
of the rental agreement and his to and fees, an

B. Abandonment of Rental Unit - Sublease.
It the tenant abandons the rental unit, the landlord shall
make a good faith effort to rent it at the rent specified
in the tenant's cental agreement or at an amount equal to
the prevailing rent for similar units within the same
multi -family rental structure. This shall include the
acceptance of reasonable subleases. If the landlord
succeeds in renting the rental unit at a fair rental, the
tenant shall be liable for the amount by which the rent due

from the date of abandonment to the termination of the
initial rental agreement exceeds the fair rental
subsequently received by the landlord from the date of
abandonment to the termination of'the'loitial cental

agreement. If the landlord makes a good t%itb effort to
rent the rental unit at a fair rental and is unsuccessful,
the tenant shall he liable for the rent doe for the period

of the rental agreement. In either event, the tenant shall
be liable for the advertising euDeuoen and reasonable
redecoration costs incurred by the landlord in ceceoting
the rental unit.
C. qaiver of Right to Terminate.
Acceptance of rent with knowledge of a default by the
tenant, or acceptance of performance by the tenant that
varies from the terms of the rental agreement or rules or
regulations subsequently adopted by the landlord must be
confirmed in writing and signed by both parties and then
constitutes a waiver of the landlord's right to terminate
the rental agreement for that breach.
D. Disposition of Abandoned Property.

by the Village the tenant may notify the landlord
in writing of his intention to withhold from the
monthly rent an amount which reasonably reflects
the reduced value of the premises or the cost of
obtaining compliance, but not exceeding 75% of
the monthly rent and to deposit said amount, with
the Village of uut Prospect. If the landlord
fails to correct the condition within fourteen
(14) days atter being notified by the tenant in
writing, the tenant may, during the time such
failure continues, deduct from the rent the
stated amount and deposit it with the Village
ebiob will hold the same and use its best efforts
to resolve the situation at which time the amount
on deposit will be paid to the landlord.
2. A tenant may not withhold rent under this Section if
the condition was caused by the deliberate or
negligent act or omission of the tenant, a member of
his family or other gecaoo on the premises with his
consent.

�- 3. Where the noncompliance condition affects facilities
shared by more than one dwelling unit, the Village
abaII notify all other tenants sharing such facilities
- by regular mail, with respect to the implementation of
this subsection.
E. Counterclaim to Action for Possession or Rent.
1. ^ in an action for possession based upon nonpayment of
rent or in an action for rent where the tenant is in
possession, the tenant may counterclaim for any amount
which he may recover under the rental agreement or
this Article. In that event, the court may order the
tenant to Day into court all or part of the rent
accrued and thereafter accruing, and shall determine
the amount doe to each party. The Darty to whom a net
amount is owed shall be paid first from the money paid
into court, and the balance by the other party. It no
rent remains due after application of this Section,
judgment shall be entered for the tenant in the action
for pusaemoiou. It the defense or counterclaim by
tenant is without merit, the landlord may recover such
costs and fees as a Court shall determine and award.,
2. In an action for rent where the tenant is not in
possession, the tenant may counterclaim as provided in
subparagraph l, but the tenant is not required to pay
any cent into court.

F. Fire or Casualty Damage.
l. If the rental unit or premises are damaged or '
destroyed by fire or casualty to an extent that
enjoyment of the rental unit is substantially
impaired, the tenant may:
a. Immediately vacate the premises and notify the
landlord in writing within fourteen (I4) days
thereafter of his intention to terminate the
rental agreement, in which case the rental
agreement terminates as of the date of vacating;
or
b. If continued occupancy is lawful, vacate any part
of the rental unit rendered unusable by the fire
or casualty, in which case the tenant's liability
for rent is reduced in proportion to the diminu-
tion in the fair rental value of the rental unit;
or
C. Agree to accept alternate housing provided by the
landlord, if available.
%. If the rental agreement is terminated, the landlord
shall return all security recoverable under Section
23.I806 a, and all prepaid rent. Accounting for rent
in the event of termination or apportionment shall be
made as of the date of the fire or casualty.

the fire or casualty damage was caused by the
deliberate or negligent act or.omission of the tenant,
a member of his family, or a person on the premises

B. If the landlord acts in violation of Subsection A, the
tenant has a defense in any retaliatory actino against him
for possession and is entitled to terminate the rental
agreement and in either case,recover an amount equal to
not more than two (2) rent and such da.maq&�1,_.q9sLg
retaliation.
C. Notb*itbatandlog Subsection A and o" a landlord may bring
an action for possession if:
I. The violation of a code was caused primarily by lack
of care by the tenant, a member of his family or other
person on the premises with his consent; or
2~ The tenant is in default in rent, other than a
purported default under Section 23.18080.
Sec. 23,1810 Condominium Cooversioos,
Provisions of Article on/z of Chapter 23 of the Village
Code regulating condominium sales that contradict, modify,
expand or limit rights of landlords or tenants established
under this Article shall prevail over the pcovlol000 of
this Article for leases entered into or renewed subsequent
to the effective date of said Article ovz, and which are
subject to the provisions of Article XVI.
Seo. 23.I8II Breach of D000paooy Rights.
A. Unlawful Interruption of Tenant Occupancy by Landlord.
l. It is unlawful for any landlord or any person acting
at his direction to knowingly oust or dispossess or
attempt to oust or dioDomoeaa any tenant from a cental
unit without authority of law, by plugging, changing,
adding or removing any lmnb or latching device; or by
blocking any entrance into said unit; or by removing
any door or window from said unit; or by interfering

with the services to said unit, including, but not
limited to, electricity, gas, bot or cold water,
plumbing, heat, or telephone service; or by removing a
tenant's personal property from said unit; or by the
use of force or threat of violence, injury or force to
a tenant's gecoou or property; or by any other act
rendering a rental unit or any part thereof or any

personal property located therein inaccessible or
uninhabitable.
3. _ Exclusions. The provisions of this Section obaII not -

to forcibly evict a tenant or his personal

rent provided that within five (5) days of taking

shows evidence to the Village Manager that be has
filed an action with the Court to secure the
tenant's property in return for unpaid rent; or
C. A landlord acts pursuant to court order/ or
d. & landlord interferes temporarily with possession
only as necessary to make needed repairs or
inspection and only as provided by law; or
e. The tenants with a right to gonaeoaioo of the
rental unit have been absent therefrom for thirty
(30) consecutive days without advising the
landlord of such absence or their intent to
return, current rent is thirty (30) or more days
overdue, and after diligent inquiry the landlord

has reason to believe that the tenants have
abandoned the premises and do not intend to
return.
3, Civil Remedy by Tenant. If a tenant in a civil legal
proceeding against his landlord establishes that a
violation of this subsection a has occurred be obaII

If a landlord or any person acting at his direction
violates this section & the tenant ebaII have the
right to terminate the rental agreement by sending the
landlord written notice of his intention to terminate
within three -(3) days of the violation. If the cental
agreement is terminated, the landlord shall return all
security deposits, prepaid rent and interest to the
tenant in accordance with Section 23,1806A.
B. Holdover of Occupancy by Teoaut.
If the tenant remains in possession without the Landlord's
consent, after expiration of the term of the rental
agreement or its termination, the landlord may bring an

recurrence of the conduct, or terminate the rental
agreement. In either case, the tenant may recover an
amount equal to not more than two (2) months' rent and
such actual damages, costs and fees as a Court shall
dg.termine and award.
D. Fines for Violating Section.
Any Decomo found guilty of violating this Section shall be
fined not less than Two Hundred Dollars ($200,00) nor more
than Five Hundred Dollars ($500.00), and each day that such
violation shall uoouc or continue shall constitute a
separate and distinct offense for which a fine as herein
provided obaII be imposed.
Sec. 23.1812 Civil Action by Village to Enforce Compliance.
Whenever the Village Manager or his designee has reasonable
cause to believe that any landlord or tenant is engaged in
a pattern or practice of violating the provisions of this
Article, the Village, in addition to all other remedies
provided herein, may bring a civil action by filing a
complaint signed by the Village Manager, setting forth the
facts pertaining to such pattern or practice and requesting
such relief, including an application for a permanent or
temporary injunction, restraining order and damages as
hereinbefore provided against the landlord or tenant
responsible for such pattern or practice, as may be
necessary to eueoce compliance with the provisions of this
Article and the full enjoyment of the rights herein
established.
Sen. 23.1813 Inspections by Village.
A. The Village Manager or his designee shall be authorized to
conduct regular inspections of ceoteI units and common
areas of multi -family rental structures, which shall
include, but not be limited to: all hallways, stairways,
lobbies, utility rooms, laundry rooms, storage rooms,
recreation rooms, grounds, refuse areas, parking areas,
building extensions, signs and other areas designated as
common areas for the purpose of enforcing the provisions of
this Article and any other provision of the Village Code
aDgllnauIe or pertaining thereto.
B. The Village Manager or his designee shall be authorized to
conduct inspections of rental units or common areas of
multi -family rental structures upon receipt of complaint(s)
of violations of the provisions of this Article or of any
other provision of the Village Code pertaining thereto, to
ensure compliance.
C. The Village Manager or his designee shall conduct
inspections of.rental units or common areas of multi -family
rental structures pursuant to an application for s license
to operate a rental multiple dwelling structure and at
least annually prior to the ioououoe of any renewal license
to operate such a rental structure. "
Sec. 23.1014 License to Operate Multi -Family Rental Structures.

of one (l) year from its date of issuance unless
sooner revoked, and may be renewed for successive

application therefor on an application form provided
by the Village of Mount Prospect.
4. The Village Manager is hereby authorized upon
application therefor to investigate and to issue new
operating licenses,and renewals thereof, in the names

of applicant owners or operators of multiple family
dwellings. No such licenses shall be issued unless
the multiple dwelling and all rental units therein, in
connection with which the license in sought is found
after inspection by the Village Manager or his
designee to meet all requirements of the Village Code
and of applicable rules and regulations gmcomaot
thereto. Each applicant shall be notified by the
Village Manager in advance of the date and time of
such licensing inspection.
G- Condominium and townhouse associations are exempt from
the licensing provisions of this Article, however,
individual owners may not be exempt ebnold their
structure qualify as a multi -family rental otcootoce
as defined herein.
B. License Fee,
No operating license shall be issued or renewed unless the
completed application form is accompanied by payment of an
annual license fee.
The annual fee for operating licenses for multiple family
dwellings shall be: $7.00 per dwelling uoit.
C. Designation of agent.
No operating Iloeuee shall be issued or renewed for an
applicant unless such applicant has first designated an
agent for the receipt of service of complaints for
violations of the provisions of this Article or of the
Village Code and for service of process pursuant thereto
when said applicant is absent from Mount Prospect for

in writing, and shall accompany each application form. '
D. Renewal of License. a.
An application for renewal of an operating -license shall be

violations. Such notice shall state that unless the
violations cited are corrected within a reasonable
time of not less than five (5) days except for
emergency situations, the operating license may be
suspended.

A. In addition to any other remedy or penalty specified
for a violation of any particular provision of this
Article, any person violating any provision of this
Article shall, upon conviction be subject to a tine of
not more than one thousand dollars ($1,000.00) for
each offense; and a separate offense shall be deemed
committed on each day during or on which a violation

B. Before filing a complaint in Court with respect to a
violation of this Article the Village Manager shall
deliver or mail a violation notice to the landlord,
operating licensee or other party designated to
receive notices and service of process on behalf of
such landlord or licensee requesting compliance.
C. No person acting as managing agent or collector of
rents of any property involved in any proceeding
because of violations or alleged vlolaL1uuo of the
provisions of this Article shall be liable therefor if
such person shall within five (5) days after receipt
. of notice of any alleged violation have notified the
owner or owners of the property or the employer of
such person of the purported violation or violations
of any provision or provisions of this Article in
writing, by registered United States mail, or
otherwise, and shall have delivered to the Village
Manager a copy of such notice with proof of service

thereof on the owner, owners or employer.
_ -- Sec. 23.1816 Severability. .
If any provision or Dart thereof of this Article is
declared by a Court of competent jurisdiction to be invalid
and of no further force and effect, such invalidity shall
not affect the remaining provisions of this Article which
shall remain in full force and effect.
This Article shall apply to and govern everry lease or
renewal thereof for a rental unit, as defined herein, `

SUBJECT: RTA TAXI SUBSIDY GRANT
The Village has been notified by the Regional Transportation
Authority that we are eligible for a Grant in conjunction
with our Senior Taxi Cab Program in an amount not to exceed
$15,000. Fran Eisenman and Pat Luehring have been working
on this matter for some time and have secured an RTA staff
commitment that if we are willing to enter into the Grant,
it will be recommended for funding to the RTA Board.
Actually, the Grant language will reimburse the Village for
75% of its subsidy costs to a maximum of $15,000. We are
currently spending in the neighborhood of $22,000 a year of
local General Fund revenue.
This matter is being placed on the Agenda for Tuesday,
January 18. It would be appropriate to have a motion
authorizing the Mayor and the Clerk to sign an agreement
with the RTA after said agreement is reviewed by the Village
attorney.

ordinance in 1981. The petitioner is requesting the

The meeting was called to order at 8:17 p.m. Before proceeding
with ZBA-51, the October 28, November 4 and November 18 minutes
were presented for approval. Len Petrucelli moved, seconded by
George Van Geem to approve the minutes as presented. Motion
carried 5 to 0.
The case (ZBA-51-V-82) was called to order at 8:19 p.m.
The Secretary read the petitioners request:
"Petitioners are requesting a variation from Section 14.101F
limiting sites to one main building per lot so that three
buildings may be bult on one lot."
Notices were published and mailed on November 29, 1982.
Petitioner explained that the re -zoning granted in Village
Ordinance 3026 allowed 54 units. He stated that he still planned
54 (three buildings of 18 units each) but his variation for
multiple buildings had lapsed one year after it was granted.
Petitioner is, therefore, requesting another variation for the
same three -building plan.
Jim Viger questioned whether the 54 unit density was still
valid. He believed that the increased density that was allowed by
ordinance may have lapsed. The Board decided to hear the case on
hand, and instructed the Village staff to clarify the density issue
prior to Village Board action.
There were no objectors present.
The public hearing was closed at 8:42 p.m.

Thomas Fox of 1.425 S. Robert, Mt. Prospect, IL, testified
on behalf of the petitioners gloat the granting of the
variati.ons would permit the parking of vehicles and im-
prove the appearance of the neighborhood.
Landscaping was suggested by Ken Fritz and agreed to by
petitioners.
Objectors: Mr. and Mrs. Costa of 1,421 S. Robert, Mt.
Prospect, IL, testified regarding their ob-
jection to the parking of a 1/2 -ton truck
on the driveway.
Findings of Fact: The ZBA, after hearing all relevant evide rice and re-
ceiving the exhibits presented, voted to recommend the
granting of variations from Section 14.1.202.A., Sec-
tion 14.2602.8. and. Section 1.4.120.1.B.5. to permit the
widening of the ex-i.sting driveway by eight (8) feet. in
order to park a 1/2-ton'truck and vehicle on the drive-
way. The ZBA made the following findings with respect

TACO BELL, INC.
Location: 850 E. Rand Road
Taco Bell, Inc. is requesting a rezoning from B3 to B4
Business and a special -use permit to permit a drive -up
facility for a Class IV fast-food restaurant. The restaurant
would be located at the extreme NW edge of the vacant portion
of the Mount Propsect Plaza property, immediately south of
the,Thunderbird Bowling Alleyand Cinema Theatre complex.
This case was presented at the December 16, 1982 public
hearing of the Zoning Board of Appeals, and recommended for
approval by a vote of 5 to 0., In the initial staff report
to the Zoning Board, the staff recommended against approval
based upon the site plan submitted earlier. The site plan
.--was subsequently revised by the petitioner in time for the
public hearing and addressed the majority of those comments made
-,-.by staff. The major comments yet to be addressed include
the. access control.to and from Rand Road.
The Plan Commission, at its January 5, 1983 meeting, recom-
mended that the Village Board table Taco Bell, Inc.'s request
until they were able to present a unifed developAent plan for
all property under the ownership of the Mount Prospect Plaza.
The concern of the Plan Commission, endorsed by staff; are
f -or the piecemeal developments that could be potentially
detrimental to the balance of this large shopping center site.

Traffic on Rand Road is a major concern and a suitable
development of the few remaining vacant parcels along Rand
Road is crucial. It is not in the Village's interest to
have driveways exiting onto Rand Road every forty feet.
Ideally, the restaurant would only have access from the
Mount Prospect Plaza's internal circulation system. At
this point, Taco Bell has continued their request for two
access points along Rand Road for the single use.
Should the Board wish to pursue this question, it may be
desirable to remand this case to the Zoning Board of Appeals
in order to,consider the entire development of the Plaza
property. In this way, access to and from Rand Road can
be addressed for all the parcels that may ultimately con-
tain development on the Mount Prospect Plaza property. The
parcel proposed by Taco Bell, Inc. would require subdivision
of part of the Plaza property. As initially submitted, a
plat of subdivision did not adequately address the entire
property, but rather only the parcel that wottld be developed
for Taco Bell, Inc. Both the petitioner and Mount Prospect
Plaza's attorney have been notified of this situation.

COMMITTEE OF THE WHOLE
DECEMBER 14, 1982
I. ROLL CALL
Mayor Krause called the meeting to order at 7:30 p.m.,
in the Public Safety Building, 112 East Northwest
Highway. Present at the meeting were: Mayor Carolyn
Krause, Trustees Ralph Arthur, Gerald Farley, Leo Floros,
E. F. Richardson and Theodore Wattenberg. Absent from
the meeting was Trustee Norma Murauskis due to the
hospitalization of her husband. Also present at the
meeting were: Assistant Village Manager Jay Hedges,
Chief of Police Ronald Pavlock, Deputy Chief of Police
Robert Doran, Commander Ron Richardson and Police
Officer Dave Nicholson. There were approximately 75
persons in the audience.
II. MINUTES
The Minutes of the Committee of the Whole meeting of
November 9, 1982 were reviewed and accepted.
III. CITIZENS TO BE HEARD
There being no citizens_ present at the meeting desiring
to make any presentation before the Committee of the
Whole, the Mayor moved on to the next item of business.
IV. LANDLORD/TENANT ORDINANCE
Mayor Krause introduced the discussion by reviewing progress
to date on the Ordinance and indicating her support for
the proposed program. Mr. Hedges then explained that
staff had met with landlords and tenants on several
occasions and that the purpose of tonight's meeting was
to update the Board on changes which have been made in
the Ordinance since this was last discussed at Board level.
Mr. Hedges then indicated the following questions were
being reviewed by legal counsel. 1) Will this Ordinance
have affect on existing leases or only those entered into
after the effective date of the Ordinance? This provision
will also dictate whether or not landlords are required
to provide copies of the Ordinance to existing tenants.
2) Referring to page 7 of the Ordinance, Section VIII,
subsection 6, Disposition of Abandoned Property, legal
counsel is asked to incorporate existing State statutes
and case law on this matter into the new Ordinance. It
is the intent of staff to recommend that existing State
laws be simply restated, thereby adding local authority
for enforcement.
3.) Referring to page 8, Section IX, Tenant Remedies,
]egal`counsel has been instructed to draft language which
would permit tenants to withhold rent for failure of a
landlord to provide service requests and/or correct Code
violations. The procedure would permit tenants to with-
hold rent and instead deposit it with the Village of
Mount Prospect to be held in escrow along with a non-
refundable filing fee. The Village's mediator would then
attempt to resolve the situation and eventually pass the
withheld rent on to the landlord.
Mayor Krause then recognized questions and comments from
the audience at which time approximately 15 people spoke
to the Committee of the Whole raising some procedural
questions and some policy questions. Mr. Hedges indicated
that staff would be reviewing the suggestions and would
report back to the Board on the areas that would be modified.
The discussion centered around the need for the Village
to have additional legislation which would assist in the
enforcement of our Housing Maintenance Code in multi-
family dwellings and whether or not additional recourse for
tenants was, in fact, necessary. After nearly two hours
of discussion, the Mayor polled the Committee of the Whole
and all members agreed to move forward with the drafting
of the Ordinance as proposed. Additional discussions will
be held with landlords when a final draft is 'available and
it is anticipated that the Ordinance will be on the Board's
Agenda during the month. of January for first reading.
Implementation will be approximately 90 days after final
action on the Ordinance..

Chief Pavlock indicated'that'a committee process had
been used to review Departmental needs and develop bid
specifications involving both members'of'the Police
Department and the Public Works Department. The
significant conclusion of the"committee was that initial
purchase price`'is only one of many factors which should
be considered in analyzing bids.Fuel efficiency,
maintenance costs, resale value and officers' comfort
were also recognized as important factors.
Commander Richardson then reviewed an analysis of the
bids which 'indicated that a 'savings ,of between $10,000
and $25,000 would result' if the Malibu was purchased from
Bernard Chevrolet. Mr. Hedges explained that the
staff request was to purchase 16Chevy Malibu at a
cost of $8,`930.00 per unit. Five squad cars and the
Fire Department'administrative vehicle will be purchased
in the 1982-1983 budget' and the remaining' ten "squad
cars will be purchased from the 1983-1984 budget. Officer
Nicholson then 'ex'phained the process through which the
factors of" fuel-efficiency, vehicle maintenance` and
Departmental needs were reviewed.' Trustee Farley made
several comments regarding the accuracy of such information,
however, indicated support for the proposal.
The Mayor then polled the Committee of the Whole and there
was unanimous support for proceeding as recommended.
Staff was directed to prepare the necessary documents
for the December 21 Village Board meeting. Mr. Hedges
indicated that the order would be placed on December 20
in order to take full advantage of'the current'` Chevrolet
price. Several Committee of the Whole members complimented
the Police` Department for such a thorough analysis and
well-founded recommendation.
VI. CABLE TELEVISION
Mr. Hedges explained that the Northwest Municipal Conference
Cable Consortium has been inexistence for approximately
six months and that `the `Village of Mount Prospect has
contributed $2,402 toward its expenses for fiscal 1982-
1983. The Consortium has been responsible for the
monitoring of cable,sys.tem construction, and is now in
the process of developing"procedures for monitoring the
operation and programming of the system.

Subject: Kensington Center -Plat of Resubdivision No. 9
The Village staff has reviewed Kensington Center Resub-
division 1,7o. 9 and finds no objections to the resubdivision
which breaks the original Lot #301 into separate parcels.
This has been made necessary since opus found a tenant for
a build -to -suit building on what will become Lot #301-A.
This property is located on the north side of Business
Center Drive and abutts Kensington Road on the north. It
meets the requirements of the annexation agreement with
regards to setbacks and complies with, the development code.
The Plan Commission approved Resub No. 9 at their January 5,
1983 regular meeting, by a unanimous vote.
