AN ORDINANCE GRANTING A CONDITIONAL USE FOR PROPERTY
COMMONLY KNOWN AS 1814 BONITA AVENUF
WHEREAS, Alan and Ester Provenzale (hereinafter referred to as Petitioners) have filed
an application for a Conditional Use as provided in Chapter 14 of the Village Code of
Mount Prospect, Illinois, for property commonly known as 1814 Bonita Avenue
(hereinafter referred to as Subject Property), legally described as:
Lot 8, that part of Lot 9 lying northeasterly of a line drawn from a point 16.0
feet Southwesterly (as measured along the curved property line) of the
Southeast corner of Lot 9 to a point on the North line of Lot 9 which is 20.0
feet west of the Northeast corner of Lot 9 in Block 2 in Hatlen Heights Unit
No. One, a Subdivision in the South 1/2 of the Northeast 1/4 of Section 10,
Township 41 North, Range 11', East of the Third Principal Meridian, according
to the plat thereof registered in the Office of the Registrar of Titles of Cook
County, Illinois on August 17, 1955 as Document No. 1614665
and
WHEREAS, Petitioners seek a Conditional Use as required in Section 14.903.A.8 to allow
an addition to an existing detached garage and to allow a garage designed to house more
than two motor vehicles, instead of the maximum allowed 600 square feet; and
WHEREAS, a public hearing was held on the Conditional Use requested, being the
subject of ZBA Case No. 2-CU-94, before the Zoning Board of Appeals of the Village of
Mount Prospect on the 27th day of January, 1994, and 24th day of March, 1994,
pursuant to due and proper notice thereof published in the Mount Prospect Herald on the
11th of January, 1994; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation
to the President and Board of Trustees of the Village of Mount Prospect and the
President and Board of Trustees of the Village have given further consideration to the
Conditional Use being the subject of ZBA 2-CU-94 and have determined that the best
interests of the Village of Mount Prospect would be served by granting said Conditional
Use.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings
of fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TVVO: The President and Board of Trustees of the Village of Mount Prospect
hereby grant to the Subject Property a Conditional Use, as provided by Section
14.903.A.8, to allow a detached garage 968 square feet in size. Said Conditional Use
is granted with the following conditions:
1. The garage be constructed of similar materials so that the new addition matches
the existing garage.
2. The Petitioner or future property owner(s) shall not allow the garage to be used in
conjunction with a home occupation.

3. The Petitioner shall remove the antenna dish from the garage structure and
relocate it within the Village standards.
SECTION THREE: Except for the Conditional Use granted herein, all other applicable
Village of Mount Prospect Ordinances and regulations shall remain in full force and effect
as to the Subject Property.
SECTION FOUR: That a certified copy of this Ordinance shall be recorded with the
Cook County Recorder of Deeds so that all future owners of this property shall be aware
of the conditions contained herein.
SECTION FIVE: This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.
