The petitioner has requested -that this matter be
continued to the Village Board meeting Sept. 21, 1983

B. A RESOLUTION EXPRESSING THE INTENT OF THE VILLAGE OF
MOUNT PROSPECT TO ADOPT AN INDEPENDENT SELF-INSURANCE
PROGRAM FOR PROPERTY AND CASUALTY EXPOSURES
The Village of Mount Prospect is currently a member
of IRMA, which was established for a five year period.
The five years will end December 31, 1983, and it
has been determined that the Village would benefit
by"providing self-insurance for property and casualty
coverage. This Resolution serves as notification that
the Village will withdraw from IRMA December 31, 1983.
C. Proposed Agreement with Gallagher -Bassett for
administering the self-insurance program

PAYMENT BOND" TO ARTICLE V, CHAPTER 8, OF THE
VILLAGE CODE
This Ordinance establishes the procedures for
posting a Letter of Credit for all public works
projects being conducted under contracts with the

COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD ON 'FOR THE
Joe Clancy requested the Village to approve the necessary MONEY - M.P.
steps involved with conducting the 2nd Annual 'Run for STATE BANK
the Money' sponsored by the Mount Prospect State Bank.
The run will benefit Mount Prospect United Way and will
be held on September 25, 1983.

THOMAS PEKRAS MAYOR'S REPORT - APPOINTMENTS
The name of Thomas Pekras, 2924 Briarwood Drive West,
Arlington Heights, Il 60005, 439-1454, was submitted
by Mayor Krause to fill the vacancy on the Finance
Commission caused by the resignation of Jan Coventry.
Leo Floros, seconded by Trustee Wattenberg, moved to
appoint Thomas Pekras, term to expire April, 1985.

OLD BUSINESS
ZBA 21-V-83 ZBA 21-V-83, Old Carriage House Restaurant
This case deals with requests for variations from the off -
20 WEST street parking requirement and for a reduced yard area.
NORTHWEST HWY
An nrdinance was Dresented for first reading that would
grant variations for certain property commonly known as
the Old Carriage Restaurant at 20 West Northwest Highway,
in the Village of Mount Prospect, Illinois
Robert Meersmen, owner of the property at 16 West
Northwest Highway spoke in opposition to the proposal
based on location of refuse, lack of easement to refuse
container and Mr. Meersmen stated that there is indeed
a parking problem in that general location. Phyllis
Stark, owner of property adjacent to the restaurant,
19 West Busse voiced her opinion in agreement with Mr.
Meersmen.
This Ordinance will be presented.for second reading August
2, 1983.
ZBA-22-A-83 ZBA 22-A-83, Schimming Oil, 302 E. Northwest Highway
An ordinance was presented for first reading that
would ammend Chapter 14 entitled "Zoning" of the Village
Code of Mount Prospect, Illinois regarding the addition
of an ambulance service as a special use in the B-3
business retail and service district. This ordinance
amends the text of the B-3 district classification
to specify 'Ambulance Service' permitted as a special use.
Trustee Van Geem, seconded by Trustee -Wattenberg moved
to waive the rule requiring two readings of an, ordinance
in order to' z take action on the subject ordinance.

on certain property commonly known as the Schimming Oil Co
Inc,, located in the. Village of Mount Prospect, Illinois.
This ordinance grants a special ,;use to„,the ,subject property
for the operation of an ambulance service in the B-3 district,
Trustee Floros, seconded by Trustee Arthur moved to waive
the rule requiring two readings, of an ordinance in order

minutes.

SUBJECT: LIQUOR LICENSE REQUEST -.EDWARDO'S PIZZA
The Village has received a Liquor License application from
Prospect Edwardo's, Inc., d/b/a Edwardo's, at 19042 South
Elmhurst Road, Mount Prospect, Illinois, formerly Maloney's
Ice Cream Parlor which held a Class W Liquor License. The
Acting Village Manager interviewed the principals in the
corporation, Jeffrey Himmel, of 3920 Lake Shore Drive,
Chicago, and Edward J. Gibson, of 5445 North Sheridan Road,
Chicago, on Thursday, July 28. They are seeking a Class R
Liquor License, restaurant -consumption at dining tables
only.
The principals indicated that there are presently three
existing Edwardo's Restaurants, all in the City of Chicago,
operating under the name of Edwardo's Pizza. The most,
recently completed facility is located at 1212 North Dearborn
Street, at the intersection of Division and Dearborn and
members of the Board are encouraged to visit that location.
The corporation will be purchasing the property and providing
for significant renovation both interior and exterior.
Future seating capacity is planned at 158 persons which is
less than the previous seating capacity of Maloney's. They
hope to open the business by the end of 1983.
Edwardo's reputation for pizza is very good and, in fact,
they have received numerous awards in the area of food
service. Mr. Jacobson is the founder of Edwardo's Restaurants
and will be responsible for the food service operation of
the facility and Mr. Himmel is Vice President and Secretary
of Himmel Real Estate Investors. This is the first of three
proposed joint ventures for this corporation.
The Liquor License application and other pertinent documents
appear to be in order and upon completion of our interview
yesterday, there appears to be no cause to recommend denial
of this License. Upon preliminary review of the Site Plan
and proposed modifications, there appear to be no necessary
Zoning changes required, however, additional review will
take place upon receipt of final drawings,

WHEREAS, Petitioner seeks the following variations from
the provisions of the Zoning Ordinance, to -wit:

SECTION ONE: The Recitals-set-forth--berei.nabove are
incorporated herein as findings of fact by the President and
Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Boa7rd of Trustees of
the Village of Mount Prospect do hereby grant to the property
hereinabove described variations requested with resnect to
Sections 14.2002C, 14.2005A3, 14.2005B1 and 14.2602h subject
to the following conditions:
A. Applicant shall make a cash contribution in the
total amount of $14,400.00 to the Village, in
lieu of a requirement for eight (8) parking
spaces upon applicant's premises; said payment
to be made pursuant to a schedule established
by the Village Manager.
B. Applicant shall provide delivery access across
the private alley adjoining the applicant's
separate property at 15 West Busse Street for
the purpose of deliveries to the premises in
question.
C. Applicant to provide adequate area to the rear
of his nearby and separately owned property at

garbage disposal.
D. Applicant shall carry out landscaping necessitated
as a result of the building addition proposed
to applicant's premises, pursuant to a land-
scaping plan satisfactory to the Community
Development Department of the Village.
SECTION -THREE: In the event that the Applicant sells,
transfers or leases the Subject Property or the restaurant
business thereon, then adequate provision for the storage
of refuse and garbage shall be provided or the variations
granted herein shall immediately cease and terminate.
SECTION FOUR: Except for the variations granted herein,
all other applicable Village of Mount Prospect Ordinances
and Regulations shall remain in full force and effect as to
the Subject Property.

In this regard Section 11-12-8 of Chapter 24 of the Ill.
Rev. Stat. provides municipalities with the specific power
to.permitthe depositing of cash or "other security" accep-
table to the municipality in order to complete required
subdivision improvements, in lieu of a bond. The Village
has enacted such procedure as an optional procedure in
Section 16.311C of the Village Code which incorporates the
Development Code as Chapter 16 thereof. Such security
requirements are in the nature of a performance bond rather

The second bonding category deals with the combined
performance and materials and labor payment bond require-
ments placed on contractors entering into contracts for
public work of any kind, as provided in Sections 15 and 16
of Chapter 29 of the Ill. Rev. Stat. This 1931 law provides
protection for subcontractors furnishing labor and materials
on public works projects and is in the nature of a payments
bond. A specific procedure is established whereby a sub-
contractor may file a notice of claim and thereafter sue
to recover upon the bond.
In addition to, bond protection subcontractors on a
public works contract also have the right to make a claim
against funds owing by the municipality to the contractor
pursuant to the provisions of Section 23 of Chapter 82 of
the Ill. Rev. Stat pertaining to liens against public
funds. This provision also establishes a specific procedure
whereby a subcontractor can file a notice of claim and
thereafter proceed in court for an accounting and payment
out of funds retained by a municipality.
While Mr. Wiley's letter has properly mentioned the
subdivision bond and contractor's performance and payment
bond requirements involved in municipal contracts, his
letter is in error in suggesting that the contractor bond
requirements cannot be altered. Such provisions would not
prevent a home rule municipality from establishing, by
ordinance, a letter of credit in lieu of bond requirement
on public works contracts, provided, in my judgment, that
a procedure is established by ordinance for subcontractor
claims to be made to the municipality which, if not satisfied
by the contractor within a certain date, could lead to a
disbursement of letter of credit funds.
The Village of Mount Prospect presently has not adopted,
by ordinance, a letter of credit provision in lieu of a
construction payment bond. In the absence of establishing
such requirement by ordinance, the Village must comply with
Sections 15 and 16 of Chapter 29, and if the Village failed
to obtain such a payments bond on a public works contract,
it could find itself liable to an injured subcontractor in
the event that the contractor defaults in his payments.
The Village, at this juncture, could establish a
letter of credit procedure to guarantee contractor perfor-
mance while at the same time retaining the statutory bond
requirements for labor and material payments. Such a dual
procedure right well be overly expensive to the contractor
as, it is my understanding, that most contractors are able

to obtain a material and labor Payments bond with combined
performance protection in the same bond at little or no
extra cost.
The Village could alternatively adopt an ordinance to
establish a letter of credit procedure for both performance
as well as labor and material payment requirements. By so
doing the Village would have to include elaborate provisions
whereby subcontractors could pursue payment claims directly
with the Village which would process them and, if proper,
make payment to the subcontractors out of funds on hand
for payment under the contract or out'of funds drawn under
the letter of credit. As suggested by your letter, the
Village could provide, by ordinance, for direct payment of
subcontractors on municipal contracts. By so doing, this
would prevent similar payments made to the contractor from
being misapplied by him and not passed on to his subcontrac-
tors.
There are two factors to be considered with respect to
the implementation of a letter of credit procedure in lieu
of construction bonds. one factor is the cost involved to
a contractor in obtaining a letter of credit. In this re-
gard I have no idea what these costs may involve, and how
much more substantial they may be than the premium costs of
a bonding company for the performance and payments bond. I
also do not know whether or nof some smaller contractor ,
firms would have difficulty in obtaining a letter of credit
from a bank, and thus be able to submit a bid on a public
works contract. I am assuming, of course, that most construc-
tion contractors have sufficient financial capacity to obtain
a letter of credit.
The second factor deals with the additional administrative
burdens, and perhpas costs, of processing subcontractor claims.
It is my belief that the administrative procedures would be
rather minimal, and, of course, the biggest benefit to the
Village of a letter of credit procedure is that such security
is irrevocable in form and allows the Village to obtain imme-
diate possession of funds, where in the past, the Village has
had to litigate similar claims against the bonding company
in order to obtain the proper funds.
In keeping with your instructions to me, I shall prepare
and forward to you a proposed ordinance which establishes use
of the letter of credit in lieu of bonds on public works
contracts.

Should the Mayor and Village Board accept this recommendation, the Village
would have to complete the following steps in order to implement this
program
- enter into a fnmal agreement with an administrator for
these services:
• Claims handling, ~
^ Preparation of monthly reports containing status '
all claims,
* Risk Management program for Village personnel.
- Appoint a law firm to represent the Village for claims settlement.
This firm would have to have the approval of the excess carriers,
- Purchase insurance for excess coverage such as that mentioned in
Arthur J. Gallagher's proposal which has previously been distributed,

Follow up to be sure Mt. Prospect's self -insurers bond remains in
effect. The current bond was received on July l, 1983,
- Although not required, notify IRMA officials that membership would
not be renewed on January l, 1984,
The above steps are relatively simple but must be completed in order to get a
new program off the ground.
He also want to mention that at the July 27, 1983 Finance Commission meeting,
we were asked to obtain quotations for aggregate stop loss amounts (deductibles)
of $300"000, $350"000 and $400,000. Arthur J. Gallagher's proposal is based on
$250,000 for an annual premium of approximately $85,000- The Commissioners
wanted to be in a position of knowing how much the premium would be reduced
by accepting these higher risks. Gallagher has been contacted and their
information will be distributed when it becomes available.

A RESOLUTION EXPRESSING THE INTENT OF THE VILLAGE OF
MOUNT PROSPECT TO ADOPT AN INDEPENDENT SELF-INSURANCE
FOR PROPERTY AND CASUALTY EXPOSURES
WHEREAS, the Village of Mount Prospect is currently a
member of the Intergovernmental Risk Management Agency
(IRMA), which Agency was established for a five (5) year
period, ending December 31, 1983; and
WHEREAS, the corporate authorities of the Village of
Mount Prospect believe that the citizens of the Village of
Mount Prospect would benefit by initiating an independent
self-insurance program, both in terms of financial savings
and in terms of increasing the control of the municipality
over the management and prevention of risks.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS:
SECTION ONE: The Mayor and Board of Trustees have determined
that in the best interest of the Village of Mount Prospect,
said Village does hereby express the intent of the Village to
assume a self-insurance program, effective 12:01 AM

SUBJECT: 1983 Real Estate Tax Levy
Attached is a copy of theposed noticeregarding ~
the public hearing for
the 1983 Tax Levy. The Truth in Taxation Act requires a public hearing
for any increase in taxation greater than 5% of the prior year's extension,
exclusive of election costs. You can note from the attached that the total
levy including Library services shows an increase of 2.9% when comparing
1983's proposed levy to 1982's extension.
We are also including on the attached notice data pertaining to Special
Service Area No. 5 (Lake Michigan Water) and want to point out that this
separate levy indicates 204.9% increase. As you know this large increase
comes about because 1882's levy covered only debt service on the 9,900,000
General Obligation Bonds issued in December of 1982.
The Truth in Taxation Act requires -public hearing to be held not less than
20 days prior to the adoption of the levy and that notice of this public
hearing be published not more than 14 days nor less than 7 days prior to the
public hearing. The Act also requires the notice be at least 7/8 page in size
in a newspaper of general circulation and must not appear in the classified
section. Based on the assumption that the Mayor and Board will adopt the
tax levy at their September @, 1983 meeting, l suggest that the public hearing
take place at their August 16 Board Meeting and that the notice of the public
bearing be published on or about August 5, 1983.
Please provide our department with direction on this matter.

SUBJECT: Busse Avenue/Wille Street Concrete Repair Work'
Last Spring, a determination was made that the appearance of
the curbing on the north side of Busse between Main Street and
Wille Street was not satisfactory.. As you may recall, efforts
were made to have the original contractor redo the work to
our satisfaction. We were unable to make contact with the
contractor, C & F Concrete Co., so with your intervention
we were able to transfer the $11,500 from his letter of credit
to the village to insure necessary repairs could be made.
Our consulting engineer from Baxter and Woodman and I have
been researching and reviewing products for a solution to the
problem. We both agree that the removal and replacement of
the curbing would be the most efficient way to correct the
appearance. However, the existing curbing is structurally
sound and to remove and replace it would cost in excess of
our available funds. Also, the disruption to the local
businesses would be quite excessive. We then looked at other
methods of improving the appearance of the concrete and have
agreed on a refinishing process manufactured by Sika Corporation.
The Sika Corporation prefers to work only with those contractors
whom they have trained which enables them to achieve better
quality control of their product. By inspection of the work
completed by this process, we are of the opinion that Dura -Bond
Concrete Restoration Co. does work of this nature with a very
good result. Their price for our work would be $5,355.00 and
would carry a two year warranty. A necessity in this re-
finishing process is to sandblast clean all the areas to be
treated. As this would be difficult to do during a weekday
the contractor has agreed to work on two consecutive Sundays
to complete the work with minimal disruption of business.
I request a waiver of the bidding process and recommend award
of a contract to Dura -Bond Concrete Restoration Inc. in the
amount of $5,355.00 for refinishing the concrete curbing on
the north side of Busse Avenue from Main Street to Wille Street.

twenty (20) days prior to the adoption of the tax levy, and is
further required to hold a public hearing regarding the proposed
tax levy, pursuant to the publication of a proper notice of
hearing; and
WHEREAS, on the -19th day of _Apjil , 1983 the Village of
Mount Prospect adopted Resolution 18-83 approving the Annual
Budget for the fiscal year from May 1, 1983 to April 30, 1984,
covering the cost, expenses and liabilities of all general corporate
and special municipal purposes and activities to be undertaken
during the said fiscal year; and
WHEREAS, pursuant to said Budget, the Village of Mount Proa-
pect anticipates and determines that it shall require an
aggregate tax levy of $5,638,114.00 upon all the taxable property
within the Village, which proposed tax levy is an increase over the
tax levy for the preceding fiscal year as extended of $160,988.00;
and
WHEREAS, it is further determined that an aggregate tax levy
of $950,332.00 shall be required upon all taxable property located
within Special Service Area No. 5 of the Village; an increase of
$638,653.00 over the preceding fiscal year levy; and
WHEREAS, such proposed Village wide tax levy for the year
beginning may 1, 1983 and ending April 30, 1984 constitutes a
tax increase of approximately 2.9%, and such proposed Special
Service Area tax levy constitutes a tax increase of 204.9%,
and it is deemed to be in the public interest that a public
hearing be held with respect to the various aggregate tax
levy amounts, as hereinafter set forth.
NOW, THEREFORE., BE IT RESOLVED BY THE MAYOR AND BOA -RD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1: This Board does hereby determine that the aggre-
gate amount of money to be levied (exclusive of any amounts levied
for election cost purposes) as necessary to be raised by taxation
upon all the taxable property within this Village for the year
commencing May 1, 1983 and ending April 30, 1984, for general
corporate and special municipal purposes, is estimated to be
$5,638,114.00. An additional levy for special purposes within
Special Service Area No. 5 is estimated to be $950,332.00; to be
levied upon all taxable property within said Special Service
Area.
SECTION 2: The amounts herein above determined to he the
aggregate tax levy for the year commencing May 1, 1983 and end-
ing April 30, 1984 constitute a proposed tax levy of approximately
102.9% of the property taxes extended upon the tax levy for the
preceding year ending April 30, 1983; an aggregate tax levy
increase of approximately 2.9%.
SECTION 3: A public hearing with respect to the intent
of the President and Board of Trustees of this Village to adopt
a tax levy ordinance to establish and levy the amounts determined
herein to be raised by "taxation, shall be held in the Board Room
in the'P , ublic Safety Building, 112 E..Northwest Highway, Mount
Prospect, Illinois at 8:00 p.m. o'clock C.D.T. on Tuesday,
August 16, 1983.
SECTION 4: The Village Clerk is herein authorized and
directed to publish a notice of said public hearing in the
Mount Er9ct Herald newspaper by no sooner than August 2,

1983 nor later than August 9, 1983, which notice shall be sub-
stantially set forth in the attached Exhibit A, and shall state
in plain and simple language (1) the amount of property taxes,
exclusive of election costs, extended or estimated to be extended
on behalf of the Village for the preceding Year ending April 30,
1983; (2) the amount of the proposed levy, exclusive of election
costs, for the current year beginning May 1, 1983; (3) the
percentage increase or decrease in the amount of taxes to be
levied; and (4) the date, time and place of the public hearing
concerning the proposed tax levy. The form of notice shall be no
less than 1/8th page in size and the smallest type used shall be
twelve point and shall be enclosed in a black border no less than
1/4th inch wide. The notice shall not be placed in that portion
of the newspaper where legal notices and classified advertisements
appear.
SECTION 5: This Resolution shall be in full force and effect
upon its passage and approval in accordance with law.

AN ORDINANCE TO ADD A NEW SECTION 8.515
ENTITLED "LETTER OF CREDIT IN LIEU OF
PERFORMANCE AND PAYMENT BONDS" TO ARTICLE
V, CHAPTER 8 OF THE VILLAGE CODE OF MOUNT
PROSPECT, ILLINOIS
WHEREAS, the Village of Mount Prospect is a home rule
municipality exercising the powers pertaining to its govern-
ment and affairs which are given home rule communities
by the Constitution of the State of Illinois; and
WHEREAS, the Village deems it to be necessary with
respect to its government and affairs to establish a
requirement that contractors executing contracts with the
Village for any public works provide an irrevocable letter
of credit in lieu of a performance bond and a labor and
materials Payment bond; and
WHEREAS, such requirement will tend to reduce
administrative costs and alleviate the expenses of liti-
gating contract performance or payment claims with a
bonding company.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK
COUNTY, ILLINOIS:
SECTION ONE: Article V entitled "Other Regulations"
of Chapter 8 of the Village Code of Mount Prospect,
Illinois (1981) as amended, is hereby further amended by
adding thereto a new Section 8.515 to be entitled "Letter
of Credit in Lieu of Performance and Payment Bonds" and
to read as follows:
"Sec. 8.515 Letter of Credit in Lieu of Performance
and Payment Bonds.
A. Except when a materials and labor payment bond is
required for any contract for public work wherein
the State of Illinois or the Federal Government
is an administering or funding party, the Village
of Mount*Prospect is hereby authorized to require
than an irrevocable, commercial letter of credit
with a State or National banking association in
a form acceptable to the Village Attorney be
established in the name of and for the benefit
of the Village in not less than the full contract
amount by every contractor entering into a con-
tract with thea,,village for the construction or
installation Cany public work of any kind.
B. Such letter of credit shall provide, as a minimum,
that in the event that all of the described
work is not completed to the satisfaction of the
Village on or before a specific date and in
accordance with the terms, plans, specifications
and conditions of the contract entered into
betwun the contractor and the Village, or in the
event the contractor fails to pay all persons,
firms and corporations the amounts due to them
for performing labor or furnishing materials to
the contractor, as subcontractor or otherwise,
with respect to the performance of the contract
for which this letter of credit is given, and
such payment claims are not satisfied out of the
contract price of the contract, then the Village
will have the right to draw on said credit by
ght draft, accompanied by a resolution ad, 2d
y the corporate authorities of,the Village in-
dicating that the contractor has failed to satis-
factorily complete the work or has failed to
make payment to persons, firms or corporations
performing labor or furnishing materials to
the contractor in performance of said contract,
for such amounts as are necessary to complete
the work to the satisfaction of the Village or
to pay all just claims for labor performed or
materials furnished with respect to said work.
C. On all contracts wherein a letter of credit is
required in lieu of a performance bond and a
labor and materials payment bond, the Village
shall make payment to the contractor and to
all other persons, firms br corporations for
work performed, (including labor and materials
furnished) on said contract upon the receipt
by the Village of a sworn contractor statement
designating the persons and amounts to be paid
proper lien waivers and a certificate by the
Village Engineer that such work, including labor
and materials furnished thereon, has been properly
completed; provided that the Village shall with-
hold from each said payment made to the contractor
an amount equal to ten percent (10%) thereof
until the entire work has been completed.
D. Every person furnishing material or performing
labor, either as an individual or as a sub-
contractor for any contractor having a contract
for public work with the Village shall have a
right to file a claim for payment with the Vil-
lage provided a verified notice of such claim
for payment is filed with the Village within
ninety (90) days after the date of the last
item of work or the furnishing of the last item
of materials by the claimant, with a copy of
such verified notice of claim to be submitted to
the contractor within ten (10) days of the filing
thereof with the Village. Such claims shall be
verified and shall contain the name and address
of the claimant, the name of the contractor,
the name of the person, firm of corporation by
whom the claimant was employed or to whom he
or it furnished materials, the amount of the pay-
ment claim, and a brief description of the public
,improvement sufficient for identification. All
such payment claims shall be immediately referred
by the Village to the Village,Engineer with a copy
thereof forwarded to the contractor by certified
mail (return receipt requested). If the village
Engineer certifies that said payment is proper,
the contractor ,shall have thirty (30) days from
the 'date said claim notice is received by him to
file with the Village a sworn statement and the
necessary lien waivers to enable the Village to pay
the claims out of funds on hand. If the contractor
fails to supply the Village with the proper sworn
statement and lien waivers during the thirty (30)
day period provided therefor, or in the event that
there are insufficient funds on hand with which to
make payment to the claimant under the contract,
then the Village shall adopt the proper resolution
and obtain the necessary funds from the credit
amount established by the contractor through an

of this Section."
SECTION TWO: This Ordinance shall be in full force and
effect upon its passage, approval and publication in pamphlet
form in accordance with law.

Minutes
Assistant Village Manager Hedges explained that Mayor Krause would
be unable to attend the meeting.
The meeting began at 7:30 PM.
Present were�Commissioners Bachhuber,Brandei,s, Davies, Holderried,
Holloway, Pekras and Smilanic.
Also present was Assistant Village Manager Hedges and 'Director of
Management Services Hedstrom.
A general discussion' took place regarding the Village's Property and.
Casualty Insurance progras beginning January '1, 1984 and covered
(1) remaininga member of''the Intergovernmental Risk Management Agency,
(2) assuming "a self-insured program and (3) using conventional insurance.
After discussion, Commissioner Holloway made the motion, seconded by
Commissioner Bachhuber, to recommend to the Mayor and Village'Board
that the Village assume a self -insured -program effective-January'l, 1984.

Commissioner Holloway then Dade the motion, seconded by Commissioner
Davies that Village staff attempt to secure insurance premium quotations
for aggregate stop loss amounts of $300,000, $350,000 and $400,000.

COMMITTEE OF THE WHOLE
JULY 12, 1983
I. ROLL CALL
The meeting was called to order at 7:35 p.m. by Mayor
Krause.r Present at the meeting were: Mayor Carolyn
Krause, Trustees Ralph Arthur, Gerald Farley, Leo Floros,
Norma Murauskis, George Van Geem and Theodore Wattenberg.
Also present at the meeting were Assistant Village Manager
Jay Hedges, Chief of Police Ronald Pavlock, Director of
Public Works Herbert Weeks, Village Engineer Charles Bencic,
Project Engineer Fred Tennyson, Engineering Assistant Drew
Johanson and.approximately ten individuals in the audience.
II. MINUTES
The Minutes of the Committee of the Whole meeting of
June 28, 1983 were reviewed and filed.
III. CITIZENS TO BE HEARD
There being no citizens present at the meeting desiring
to make any presentation before the Committee of the Whole,
the Mayor moved on to the next item of business.
IV. AWARD PRESENTATIONS
Mayor Krause introduced Robert Taylor, Director of the
Northeast Metropolitan Enforcement Group, who presented
Policy Board Awards to Mount Prospect Police Officers
Robert Barone and Phil Herman, Jr., for their diligence
and cooperation exhibited while working',with the N.E.M.E.G.
Investigative Unit. This was the first time these awards
were presented to Officers not specifically assigned to
the MEG Unit. In addition, Mayor Krause presented Officer
Phil Herman with the Officer of the Quarter award and his
service bar. This award represents outstanding performance
on the job as described by Chief Pavlock.
V. TRAFFIC 14ARRANTS
Mayor Krause indicated that a memorandum from staff had
been distributed with the Committee of the Whole packets
indicating a recommendation that the Board adopt by
reference the State of Illinois Manual on Uniform Traffic
Control Devices for Streets and Highways.
VII. MANAGER'S REPORT
1. Parental Responsibility Legislation. Assistant Village
Manager Jay Hedgessummarized for the Committee of the
Whole Senate Bill 437 which was passed by the State
Legislature on July 1 and is currently awaiting Governor
Thompson's signature before becoming law. This Bill would
create_a petty offense for any adult over the age of 21
who allows minors to become intoxicated on lois premises.
For the, purposes of this legislation] a minor is described
as someone 'under the ,age of 18. In addition, the 'Bill
requires that the adult have knowledge of the age and of
the possession of alcohol of the minor and that he leaves
them unsupervised in an intoxicated state. The gathering
must include two or more people; one or more of which must
be under the age of 18. When a copy of this Bill is
available, it will be forwarded to the 'Village Board along
with examples of local Ordinances for further discussion
and consideration:
2. Landlord/Tenant Update. The Committee of the Whole
received a memorandum indicating that approximately $27,000
has been received in license fees 'for 'the "Landlord/Tenant
Program=. Of the remaining $13,000 anticipated, properties
owned or operated by the DiMucci family which is currently
involved in litigation amount to approximately $7,000.
Cooperation in general has been very ,good with the landlords
and further notices will be sent during the next two weeks
to those who have: ;not paid their fees. Some development is
anticipated' with regard to the suit on behalf of Oak Park
Trust and Savings challenging the Landlord/Tenant Ordinance
within the next two weeks
3. S -Curve Speed Limit. Mr. Hedges presented a letter from
the Illinois Department of Transportation indicating their
rationale for increasing the speed limit on the s -curve on
Illinois Route 83. Trustee Farley expressed his displeasure
with the method used in which speed limits are determined
by the prevailing speed of traffic.
4.' Wheeling Road 'Petition/Private Road Alley Repairs.
Mr. Weeks distributed drawings of the area indicating the
locations of the needed repairs. Costs for these repairs
are estimated at $18,000. The Committee of the Whole directed
that staff work with the individual property` owners and,
in particular, Mr. Brantmann who owns approximately 35 of
the 48 units involved in an attempt to have the owners
work collectively to have these repairs carried out. The
Committee of the Whole re-emphasized its position that this
is a private alley and, therefore; it is the responsibility
of the surrounding property owners to maintain its repair.
