AN ORDINANCE AMENDING ARTICLE XVl ENTITLED "UTILITY TAX"
CHAPTER 8 OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIR
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Section 8.1601 entitled 'q'ax Imposed" of Article XVl of Chapter 8 of
the Village Code, as amended, is hereby amended in its entirety; so that hereinafter said
Section 8.1601 shall be and read as follows:
" Sec. 8.1601. Tax Imposed.
A. Effective as of and commencing March 1, 1994, and continuing until further
order of the Board of Trustees, a tax of certain occupations and privileges as
authorized by Illinois Compiled Statutes (65 ILCS 5/8-11-2) at the rate
hereinafter specified is hereby established and levied by the Village of Mount
prospect on the following occupations or privileges:
1. Persons engaged in the business of distributing, supplying furnishing or
selling gas for use or consumption within the corporate limits of the
Village of Mount Prospect and not for resale, at a rate of Two percent
(2%) of the gross receipts therefrom.
2. Persons engaged in the business of distributing, supplying, furnishing
or selling electricity for use or consumption within the corporate limits of
the Village of Mount Prospect, and not for resale, at a rate of Two
percent (2%) of the gross receipts therefrom.
B. Effective for all bills issued on or after June 1, 1994, and continuing until further
order of the Board of Trustees, a tax of certain occupations and privileges as
authorized by Illinois Compiled Statutes (65 ILCS 5/8-11-2) at the rate
hereinafter specified is hereby established and levied by the Village of Mount
prospect on the following occupations or privileges:
1. Persons engaged in the business of distributing, supplying furnishing or
selling gas for use or consumption within the corporate limits of the
Village of Mount Prospect and not for resale, at a rate of One and Nine
Hundred Forty-Two One Thousandth percent (1.942%) of the gross
receipts therefrom.
2. Persons engaged in the business of distributing, supplying, furnishing
or selling electricity for use or consumption within the corporate limits of
the Village of Mount Prospect, and not for resale, at a rate of One and
Nine Hundred Forty-Two One Thousandth percent (1.942%) of the
gross receipts therefrom."
SECTION TVVO: That Section 8.1604 entitled "Definitions" of Chapter 8 of the Village Code,
as amended, is hereby amended by deleting the definition of "Gross Receipts" and
Utility Tax Amendment

substituting therefor the following; so that hereinafter the definition of "Gross Receipts" in
Section 8.1604 shall be and read as follows:
" Gross Receipts The consideration received for distributing, supplying, furnishing
or selling gas or electricity for use or consumption and not for
resale, and for all services rendered in connection therewith
valued in money, whether received in money or otherwise
including cash, credit, services, and property of every kind and
matedal and for all services rendered therewith; and shall be
determined without any deduction on account of the cost of the
service, product or commodity supplied, the cost of materials
used, labor or service cost, or any other expenses whatsoever.
The term 'gross receipts' shall not include any charges added to
customers' bills pursuant to the provisions of Sections 9-221 or
9-222 of the Illinois Public Utilities Act or any other separately
stated charge added to customers' bills in respect of any tax or
other governmental imposition."
SECTION THREE: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by laws.
