Present at the meeting were: Mayor Carolyn Krause, Trustees Ralph Arthur, Gerald Farley, Leo Floros and Theodore Wattenberg. Absent from the meeting were Trustees Edward Miller. and Norma Murauskis. Also present at the meeting were: Village Manager Terrance Burghard, Assistant Village Manager Jay Hedges, Village Planner Steve Park, Director of Health Services Patrick Luehring and approximately two persons in the audience. II. MINUTES The Minutes of the Committee of the Whole meeting of July 27, 1982 were reviewed and filed. III. CITIZENS TO BE HEARD There were no citizens to be heard. IV. MULTI -FAMILY REFUSE PICK-UP Village Manager Burghard reviewed with the Committee of the Whole discussion which had taken place at an earlier` Committee of the Whole meeting with regard to refuse pick-up at multi -family residences. This question. was raised by a representative of Inland Real Estate who had indicated that Inland was not receiving any free service from the Vill-age of Mount Prospect. Patrick Luehring, Director of Health Services, was present and presented a memorandum indicating the provisions of the contract with Browning-Ferris Industries with regard to multi -family pick-ups. The Village provides for one pick-up per unit per week at a -cost to the Village of $2.70 per month. All multi -unit dwellings are required to have a minimum of two pick-ups per week, the second pick-up costing the owner $2.90 per month per unit. Additional optional pick-ups are priced as follows: Three times per week $3.40 Four times per week $3.60 Five times per week $3,80 Six times per week $4.00 Mr. Luehring informed the Board that Inland does, in fact, receive the pick-up provided by the Village and in addition pays $3.40 per unit per month for three times per week pick-up. The Committee of the Whole discussed Inland's request to have the Village portion contributed to a different contractor and the consensus was that this would not be allowed. V. RECOMMENDED CHANGES TO THE COMPREHENSIVE PLAN Mr. Park, of Community Development, was available and reviewed the proposed changes with the Committee of the Whole. After general discussion, Mr. Burghard indicated that these changes would now be codified and inserted into the text of the Comprehensive Plan which would then be retyped. The recommendations would be brought back to the Board in Ordinance form sometime in September or October, VI. FIRE AND POLICE COMMISSION MEMBERSHIP The Committee of the Whole members present agreed that the size of the Fire and Police Commission should be increased from three to five members. It was pointed out that with only two members required for a quorum input on a particular subject or issue could be somewhat limited. In addition, with Just two members absent at present, a quorum cannot be reached. Because of the mobility of many residents in the Village, it is believed that increasing the size of the Commission would make it somewhat easier to reach a quorum, Trustee Wattenberg expressed concern about the availability of additional. qualified people, and it was emphasized that qualified people are available in the COMInunity and should be sought out in particular for this Commission. It was pointed out by staff that individuals should be selected for this Commission on the basis of their experience and knowledge on personnel procedures related to recruitment and selection. Mr. Warner, Chairman of the Board of Fire and Police Commissioners, had called Mr. Burghard earlier in the day and indicated general support for the concept of increasing the size of the Board although. he did not feel it was absolutely necessary. lie emphasized the fact that new members should be appointed on the basis of their time availability and qualifications, and did not foresee separating the Committee into sub -committees as he felt all Commissioners should interview all candidates. It should be noted that Mr. Friederichs, also a member of the Board of Fire and Police Commissioners, arrived shortly after the discussion concluded on this item, but indicated support for the concept of increasing the Commission's size. The consensus of the Committee of the Whole members present was reached and staff was directed to prepare the appropriate Ordinance increasing the size of the Board of Fire and Police Commissioners from three to five. -2- VII. MANAGER'S REPORT Assistant Village Manager Jay Hedges indicated that G. T, BUBBLE GUM was now in compliance with the Village's zoning and building requirements with regard to the operation at the Eagle Shopping Center on Golf Road in Mount Prospect. Although there are minor changes recommended by the Health Department, there is no evidence of any violation requiring action at this time. Village Manager Terrance Burghard updated the Committee of the Whole on the WELLER CREEK PROJECT and indicated that the SPECIAL SERVICE AREA was proceeding as scheduled and that initial action by the Village Board is anticipated on September 7, 1982. Mr. Allen, owner of the properties at the northeast DEDICATION: corner of Meier Road and Lonnquist Blvd., following LONNQUIST BLVD & discussions with staff, has consented to dedicate MEIER ROAD that portion of his property necessary to make Lonnquist Blvd and Meier Road fully dedicated rights-of-way. That dedication is conditioned on the following`: 1. The, Village would prepare., at its expense, the necessary plats and dedication, survey, and documents. 2. The Village would be willing to accept; this dedication as a gift and place a value on it commensurate, with existing market prices for the Trust's tax 'purposes. 3. Mr. Allen's property would be allowed to tie-in to the Village water line and the normal tap -on fees waived. 4. The Village would facilitate and provide, at no expense to Mr. ;Allen, the actual connection. 5.: The Village would agree, in writing, that Mr. Allen's properties would not be ;special assessed in any way for the sidewalk improvements subsequently installed.. It was also stated `that `the Village, would install sidewalks along Lonnquist Blvd. and Meier 'Road to make a complete sidewalk for pedestrian traffic, which installation would take place this year. in line with this dedication and installation of sidewalks, it was the opinion of the Village .Board that the pedestrian sidewalk, previously required by the Village, between lots in the Semar's Subdivision would not be necessary, and that requirement should be removed from the engineering plans pending with the administration. Xytel Corporation XYTEL CORP. It was stated that Resolution No. 28-81, authorizing INDUSTRIAL REVENUE the issuance of $2,000,000 in industrial revenue BONDS bonds for the Xytel Corporation, provided for a date of September 10,, 1982, as the time period for issuance. Mr. Duboe, representing °Xytel 'Corporation, requested the Village Board to consider a request for time extension .for the issuance of such bonds to January 18, 1983. This ordinance will be placed on the agenda for 2nd reading August 17th. TAX LEVY: A Resolution was presented that set forth the proposed TRUTH IN tax levy as well as providina for a public hearing. TAXATION It was noted that althought State Statutes require a 'Truth in Taxation' hearing when tax levy's exceed 5% increases, the proposed levy for Mount Prospect does not reflect such an increase, the public hearing would be held as a source of information for the public. The hearing is scheduled for the August 17th Village Board meeting. Trustee Arthur, seconded by Trustee Floros, moved RES. INTEROFFICE MEMORANDUM TO: MAYOR CAROLYN H. KRAUSE AND BOARD OF TRUSTEES FROM: VILLAGE MANAGER DATE: AUGUST 13, 1982 SUBJECT: FOOD AND BEVERAGE SALES TAX Enclosed is a memo from Mr. Hedstrom outlining the procedures to.be followed in collecting the Food and Beverage Sales Tax, our estimated administrative costs, and some sample forms. The Ordinance distributed with the Agenda has had some changes from that which the Board reviewed at the first reading. I have directed the staff to change the effective date of the imposition of the Tax to January 1, 1983. 1 believe that this waiting period is necessary for us to have the forms properly printed, procedures instituted, and the business community properly notified as to the procedures of filing the Tax and its specific coverage. Section 5 on page 3 has been changed somewhat to take into account any business who may not be required to file monthly with the State Department of Revenue. Our collection period will be tied specifically to the State collection period for ease of administration to the business community and as a means to authenticate the municipal return. The Ordinance, as drafted, has not established a rate for late penalty payment (Section 6) although it is my recommenda- tion that the rate be lk% per month as anything less than that may encourage tax evasion. There is no specific appeal provision written into the Ordinance as there is no specific appeal provision written in most of our Village Ordinances. Typically, when a complaint about the Ordinance develops, it is reviewed by the respective. Department Director and if a question cannot be answered at that level, it is passed on to the Village Manager who either consults with the Board or the Village attorney. If the matter cannot be resolved through that procedure, then it is an item to be reconciled by the courts. If a business license is to be terminated or suspended, there are specific provisions existing in the Municipal Code as to hearings and appeals at that stage. A question raised at a recent meeting dealt with the applicabili- ty of the Tax to vending machines. While the Ordinance, as presently constructed, addresses tax of food and beverages, it does so only at retail food and liquor facilities,(seedefinitions #6 and #7). If a vending machine is located within a retail food facility or a retail package liquor facility, then its receipts are taxable. This is consistent with State law because the receipts from those machines are sales and, thus, are taxable If a particular outlet or vending machine company has �een excluding those sales, they are in violation of State law. That the Board is faced with a difficult series of decisions is well recognized by the staff. It is never pleasant to increase taxes, create new taxes, or deal with an organized interest group opposing a contemplated action. It is my opinion that we have covered some of the ground work previously in demonstrating that our existing expenditure pattern is lean and that the Board has two basic alternatives: Increasing taxes or decreasing services. Close scrutiny of budgets over the past several years, together with freezes on new positions and a cautious approach to absorbing new services, has provided very moderate expenditure patterns. This has been substantiated by the recent State Financial Study and further supported by comparisons to other communities in studies developed by Park Ridge, Des Plaines and our own staff. There can be no question that we are providing more services at fewer dollar expenditures than the vast bulk of our neighboring communities. Some of these same studies demonstrate that our level of taxation is again favorable when compared to the sub -region. Earlier this year, the Village Board recognized that the $8.8 million General Fund cash position needed improvement, that the current budget was balanced in part by one-time revenues, and that given the changing environment in Springfield and Washington, together with the national economy, made it mandatory that we seek additional revenue sources. Near the end of the first three months of this fiscal year,iwe spent some $350,000 more than we received and a deficit cash position was averted only because of the receipts of $187,000 in the first week of July from the Real Estate Tax Levy. In my twelve years of local government experience, this is the first time ever that such receipts have been received before August, usually they arrive in September. Additionally, the recent issuance of Industrial Revenue Bonds to Cummins Allison produced a $40,000 issuance revenue to the General Fund that while contemplated in the budget was not estimated to be received during this fiscal quarter. The Villa e cannot continue to run its $17.6 million business by 'hoping" for the continuation of such windfalls. MAN The Village Board determined previously that we would develop additional revenue sources amounting to $500,000 annually. The Food and Beverage Sales Tax will produce some $200,000 in revenue. I will further be proposing to the Mayor and the Board that our vehicle license fees be increased from the present rate of $10.00 to $20.00 which will produce an estimated additional $265,000. If the Board passes the Tax Levy Ordinance on August 17 and fails to adopt the Food and Beverage Sales Tax, then the $10.00 increase in the vehicle license fees will be insufficient to reach the earlier goal of the Mayor and the Board. Additionally, after the adoption of the Property Tax Levy, it cannot be increased again for another year. The basic finances of the municipality are extremely important as we enter the period when we will be acquiring Lake Michigan water. While it will be the responsibility of the Joint Action Water Agency to issue bonds and notes sufficient to pay the cost of construction, the ultimate security for those issues will rest with the individual communities. That means that the Bond Rating Agencies in New York will carefully review the finances of the member communities in establishing the "risk" factor for this first issue by the Agency. As with any business, the financial community is willing to loan money at reasonable rates where they see that the debtor has kept its own financial house in order. That means the avoidance of deficit spending, adequate cash flows to meet day to day operations and the community leadership to face such measures squarely and responsibly. TLB/rcw TERRANCE L. AN ORDINANCE TO ESTABLISH A PRIVILEGE 'PAX ON THE PURCHASE OF FOOD AND BEVERAGE AND ALCOHOL LIQUOR IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: DEFINITIONS For the purposes of this Ordinance, unless the context otherwise requires, the following words or terms shall have the meanings respectively applied to them: 1. "Alcoholic Liquor" means any alcohol, spirits, wine or beer as defined under Sec. 13.101, Article I, Chapter 13 of the Village Code of Mount Prospect and which is sold at retail either for consumption on the premises while sold or in its original package. 2. "Food and Beverage" means and includes any and all prepared material or commodities, whether solid, semi-solid, or liquid (including both alcoholic and non-alcoholic liquid) used or intended to be used for human consumption, for emjoyment or nourishment of the human body, and which is sold by a retail food facility for consumption or may be consumed within or upon the premises where the transaction of sale occurs. 3. "Person" means any individual., firm or corporation. 4. "Purchase at Retail" means to obtain food, beverages and alcoholic liquor for use or consumption in exchange for a consideration, whether in the form of money, credits, barter or any other nature, and not for resale. 5. "Retailer" means a person who sells or offers for sale food, beverages and alcoholic liquor for use or consumption and not for resale. 6. "Retail Food Facility" means any inn, restaurant, eating place, drive-in restaurant, buffet, cafeteria, cafe, lunch counter, fast food outlet, catering service, coffee shop, diner, sandwich shop, soda fountain, tavern, bar, cocktail lounge, soft drink parlor, ice cream parlor, tea room, delicatessen operation, movie theater, mobile food or beverage or ice cream vehicle, hotel, motel, club, or other facility where prepared food or beverage is sold at retail in the Village and whether or not situated in connection with some other endeavor or enterprise but does not include public, or private schools, boarding houses, grocery stores, convenience stores, hospitals, nursing homes or similar residential care facilities, or programs for the central preparation of meals to be delivered and consumed at private residences of invalids or the elderly, or churches other than those frequently and regularly selling food at retail. 7. "Retail Package Liquor Facility" means any grocery store, convenience store, liquor store, tavern or other establishments licensed under the provisions of Article I, Chapter 13 of the Village Code of Mount Prospect to sell. alcoholic liquor in its original package and not for consumption on the premises where sold. Commencing on the lst day of January, 1983 a tax, in addition to any and all other taxes, is hereby levied and imposed upon the privilege of purchasing alcoholic liquor at retail at any retail package liquor facility within the Village, and upon the privilege or purchasing prepared food or beverages at retail at any retail food facility within the Village, at the rate of one percent (1%) of the purchase price of such alcoholic liquor, food or beverage, the ultimate incidence of and liability for payment of which shall be borne by the purchaser thereof. The owner and the operator of each retail food facility and each retail package liquor facility and each premises licensed for the sale at retail of alcoholic liquors within the Village shall jointly and severally, have the duty to collect and account for said tax from each purchaser at the time that the consideration for such purchase is paid. - 2 - SECTION FOUR: BOOKS AND RECORDS Said retailer shall cause complete an(.J. accurate books, records and accounts, showing the gross roccipts for sales of food and. beverage and alcoholic liquor and the taxes collected each day, which shall- be made available in the Village for examination and for audit by the Village upon reasonable notice and during customary business hours. SECTION FIVE: TRANSMITTAI., OF TAX COLLECTION A sworn return shall be fi.led with tfie Village Collector for each such retail faci.lity and for each such licensed premi I -ses located in the Village. Said return shall. be prepared and submitted on form prescribed by the Village. Said return shall be filed with -the Village by the filing date and at the same -time interval -s Or frequencies as the Retailers Occupational Tax Return, form RR -I. -A, is due to be filed w.ith the Illinois Department of Revenue.Said return shall also be accompanied by payment to the Village of all -taxes due and owing for the period covered by sa.i.d return. Said return shall also be accompanied with a copy of the return filed with the Illinois Department of Revenue covering the same reporting period. SECTION SIX: LATE PAYMENT PENALTY If for any reason any tax is not paid when due, a Late, payment penalty at the rate of one and one-half percent (1.5%) of the amount due per thirty day period, or portion thereof, from the day of delinquency shall be ad( ed ttaereto and paid. SECTION SEVEN: TRANSMITTAL OF EXCESS TAX COLLECTIONS If any retailer collects an amount upon a sale not. subject to the tax imposed hereby but which amount. is purported to be -the collection of said -tax, or if a retailer collects an amount upon a sale greater than the amount of the tax SO imposed herein and does not for any reason refund the same to the purchaser who paid the same before filing the return for the period in which. such occurred, said retailer shall account for and pay over those: amounts to the Village along with the Lax properly collected. A variation from Section 14.2602829 of Article XXVI of the Zoning Ordinance, which requires off-street parking spaces of 10' x 20', to permit the development of the Subject Property with off-street parking spaces of 9' x 201. 4. A variation from Section 14.2205E of Article XXII of the Zoning Ordinance, which specifies the number of such off-street truck parking and loading spaces required for any portion of a building utilized for office purposes, so that one off-street truck parking and loading space shall be required for each 100,000, square feet or fraction thereof of floor area of such portion of a building utilized for office purposes. 5. A variation from Section 14.101F of Article I of the Zoning Ordinance to allow occupancy of any building on any lot into which the Subject Property is divided by more than one main use. WHEREAS, a public hearing was held on the Petitioner's request for the aforesaid variations, which request is known as ZBA 7-V-80 before the Zoning Board of Appeals of the Village of Mount Prospect on February 1 28, 1980, pursuant to proper notice published in the Mount Prospect Herald on February 11, 1980; and WHEREAS, the Zoning Board of Appeals has recommended to the Building Committee of the Board of Trustees of the Village of Mount Prospect that Petitioner's request for the aforesaid variations, ZBA 7-V-80, be granted; and WHEREAS, the President and Board of Trustees have considered the Petitioner's request and reviewed the recommendations of the Village of Mount Prospect Zoning Board of Appeals in ZBA 7-V-80; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that with respect to the A.at,io,n 3 of 4 Petitioner's requested variations, that Petitioner has satisfied the standards for the grant of a variation set forth in Section 14.605 of Article vi of the Zoning Ordinance and find that it would be in the best interest of the Village of Mount Prospect to grant Petitioner the requested variations provided that the Petitioner provides one parking space for each 1,500 square feet used for warehouse purposes. Present at the meeting were: Mayor Carolyn Krause, Trustees Ralph Arthur, Gerald Farley, Leo Floros, Edward Miller, Norma Murauskis and Theodore Wattenberg, Also present at the meeting were: Village Manager Terrance Burghard, Assistant Village Manager Jay Hedges, Director of Code Enforcement Les Wuollett and approximately ten persons in the audience. II. MINUTES The Minutes of the Committee of the Whole meeting of July 13, 1982 were reviewed and filed. III. LANDLORD/TENANT ORDINANCE Mayor Krause reviewed for the Committee of the Whole steps previously taken on the part of the Board to direct the staff to develop an Ordinance to provide service to the approximately 6,000 multi -family rental units in the Village in the areas of dispute resolution, dwelling unit responsibilities and licensing. The Mayor reiterated that the Village has a growing concern about the declining building standards in the multi -family areas, various lease disputes and disputes about security deposits, building repairs and seizures of personal property by landlords. Assistant Manager Hedges reviewed the staff activities to date in developing the first draft of such an Ordinance. After receiving the initial direction on the part of the Committee of the Whole, the staff visited Oak Park and Evanston to determine the practical consequences of their landlord/tenant ordinances currently in force. The draft Ordinance presented to the Committee of the Whole was an initial draft still needing further refinement by the staff, the Village attorney and input from the elected officials as well as landlords and tenants. Previous to developing the first draft, the staff invited representatives from landlord and tenant interests to assist in its development. Mr. Hedges indicated that if the first draft is approved, in principle, by the Board and after language refinements on the part of the attorney, a second meeting will be conducted with landlord/tenant interests and a second draft will be brought back to the Board sometime in September or October. If approved in principle by the Board at that time, the Village Manager's Office would then initiate the necessary recruitment and training of staff to implement the Ordinance on or about January 1, 1983. It is anticipated at that time that one full-time inspector would be hired and one part-time mediator would be employed with their salaries and benefits payable from licensing revenues assessed at the rate of $7.00 per dwelling unit. The Committee of the Whole then raised questions regarding certain sections of the Ordinance including the absence of a specific mediation step, the experience and costs of other cities, the reasonableness and justification for the fines proposed and application to senior citizens' housing sites in the Village. Members of the audience representing tenants and various management companies provided comments in support and against the proposal with specific questions raised about the following: A. How will the Village handle tenants that change locks on their units and, thus, prohibit reasonable access by the landlord or the Village? B. The Ordinance, as presently structured, would eliminate standard leases and if the language of the Ordinance is changed, the same objectives can be achieved without unduly burdening the real estate industry, C. The cumulative limit on initial rent and security deposit of one and one-half months is unsatisfactory in those circumstances where people do not move in on the first of the month. D. The provision to return security deposits within, 21 days is contrary to State Statute which requires 45 days. E., The Village Ordinance would require apart- ment management to be responsible for carpet cleaning when, in fact, many of their policies and leases make that the responsibility of the tenant. -2- F. In health-related matters, particularly the control of insects, the Ordinance is insufficiently clear as to whether this is a tenant responsibility or a landlord responsibility, G. The Ordinance's ten-day notice for failure to pay rent is contrary to State Statute which permits a five-day notice. H. Section 'VIII, 4, waives the rights of landlords in favor of tenant's to the disadvantage of the real estate industry, I. The language under the self-help section is insufficient in defining material non-compliance with landlord. maintenance, J. The: language under the self-help section regarding notice and reasonable cost needs further specificity, K. The penalty section is unclear as to whether it includes tenants as well as landlords. L. The tenant's right to terminate a lease after a fire with three -days notice is insufficient and a longer period may be necessary to cover occurrences on weekends. Three tenants in the audience indicated their support of such an Ordinance claiming in some instances they have been harassed by the landlord, not given copies of leases, been .forced to occupy units substantially different in cleanliness and maintenance standards than the models shown and not familiar with their rights and recourses lander the law. Mr. George Klews, 604 South Elm, claiming that he was neither a landlord nor a tenant,'expressed his opinion on philosophical grounds that the Village should not be a party of ,private contracts, that the Ordinance is heavily biased .against landlords and that the Ordinance is a serious threat to individual rights by allowing the local government the authority to inspect private dwelling units. After some further general. discussion, the staff was instructed to proceed in its refinement of the Ordinance, making necessary corrections for clarity in language and conformance to applicable State Statutes. The staff was also instructed to invite all interested parties to its subsequent meeting in completing the next draft of the Ordinance. IV. SPECIAL SERVICE DISTRICT Assistant Village Manager Hedges reviewed the Village attorney's letter on the procedures necessary to formally decide the question about the utilization of a Special Service District to pay the capital costs associated with the acquisition of Lake Michigan water. Mayor Krause reviewed the direction previously given to the staff to begin work on a Special Service District where- by approximately 50"/ of the cost of the acquisition of Lake water would be raised through a Special Service District and the remaining 50% placed on the water bills, This division approximates the breakdown between capital costs and operating costs, Mr. Hedges explained that in order to proceed, we would need a rather lengthy and accurate legal description of that part of the Village to be included in the Special Service District so that there is no taxation for the propertiesserved by Citizens' Utilities Company, The staff is seeking approval. in principle to spend up to $10,000 to have the necessary work completed by outside agents. The Committee of the Whole agreed and authorized the staff to proceed. V. MANAGER'S REPORT The Village Manager reported that the WELLER CREEK project should be completed within two weeks exclusive of the planting of trees which will be held off until this fall, The Manager briefly reviewed the legal opinion secured by the Village in 1180 demonstrating that there is NO RESIDENCY REQUIREMENT for managers of liquor licenses when such licenses are issued to corporations VI, ANY OTHER BUSINESS Mayor Krause recommended that the Village Board authorize the expenditure of up to $500 to join with the Northwest Municipal Conference in opposing an intervening in the proposed Commonwealth Edison rate increase. If the rate increase, as proposed by Commonwealth Edison and the ICC staff is approved, the Village can expect increases of $100,000-$130,000. The Village currently spends approximately $500,000 per year for such service and these increases amount to 20-2514 annually. The Committee of the Whole concurred and authorized the staff to notify the Conference of the Village's ''willingness 'to participate. VII. ADJOURNMENT The meeting was adjourned at 10:23 p,m.
