This Ordinance amends the Sign Code by creating
a Special Use category for off -premise signs

recommended approving this request by a vote
of 5-0.

B. 1st reading of AN ORDINANCE AMENDING CHAPTER 18
(TRAFFIC CODE) OF THE VILLAGE CODE
This Ordinance establishes the prohobition to
park on the north side of Prospect Avenue between
Maple Street and a point 335 feet east of Emerson
Street. The Safety Commission recommended granting
this amendment. (Exhibit C)

These cases have been withdrawn by the Petitioner.
B. ZBA 69 -SU -92, 1811 Sitka Lane
The Petitioner is requesting a Special Use
to allow a commercial vehicle, with a
licensed weight or more than the permitted
8,000 lbs., to be housed in a garage. The
Zoning Board of Appeals recommended granting
this request by a vote of 6-0.
C. ZBA 70-V-92, 214 S. Hi LuSi
The Petitioner is requesting a variation to
allow a 21 setback along the interior side
property line, instead of the required 5',
in order to replace an existing one car
detached garage with a new 2 -car garage.
The Zoning Board of Appeals recommended
granting this request by a vote of 6-0.

The Petitioner is requesting a variation to
allow a minimum interior sideyard setback of
5' instead of the required 7.5', to allow
construction of a 2 -car attached garage.

COMMUNICATIONS AND PETITIONS, CITIZENS TO BE HEARD
A representative of St. Emily's Church and School RED RIBBON
stated that a parade will be held Saturday, October 24 PARADE
starting from St. Emily's to bring attention to the
dangers of drugs.
Richard Hendricks, 1537 E. Emmerson Lane, once again SIGNS
stated that he did not agree with the interpretation
of David Clements, Director of Planning and zoning,
and Ken Fritz, Economic Development Coordinator,
relative to the size and placement of various signs
in the Village, specifically the signs on the NBD
Bank, located at Business Center Drive and Rand Road.
It was Mr. Hendricks' opinion that his interpretation
of the Code is correct and therefore the difference
in opinion constituted an error by staff; therefore
Mr. Hendricks stated that both David Clements
and Ken Fritz should submit letters of resignation.
Mayor Farley stated that staff's interpretation of
the Code is correct and a difference of opinion
does not mean Mr. Hendricks is correct.
Mayor Farley, members of the Board and Village
Manager Janonis expressed their support for
Mr. Clements and Mr. Fritz.

The Petitioner has filed an appeal from the decision 212 S. OWEN
of the Zoning Board of Appeals to deny this request
for a 6 foot high fence.
The Petitioners stated that their yard is surrounded
by shrubs which exceed 6 feet in height and this
fence, which is intended to keep a secure environment
for a Labrador dog, would not be obvious to anyone.
The Petitioner also noted that the neighbors did not
object to this fence.
A majority of the members of the Village Board stated
that they did not support 6 foot high fences.
Trustee Clowes, seconded by Trustee Floros, moved to
overrule the decision of the Zoning Board of Appeals
denying the request in ZBA 68-V-92 for a 6 foot high
fence.

A request was presented from residents in the general AMEND CH.18
area of St. Raymonds Church/School to reduce the SPEED LIMIT
speed limit on I -Oka between Sha Bonee Trail and I-OKA
Hi Lusi and on Milburn between Hi Lusi and Pine
Street from 30 MPH to 20 MPH. The Safety Commission
recommended granting these requ4sts.
Trustee Hoefert, seconded by Trustee Corcoran, moved
to concur with the recommendation of the Safety
Commission and reduce the speed limit from 30 MPH
to 20 MPH on I -Oka, between Sha Bones Trail and
Hi Lusi, and on Milburn, between Hi Lusi and Pine
Street.

IDA COURT PARKING
Staff presented a recommendation to the Safety
Commission relative to parking on Ida Court. It was
noted that ther�e are a couple of cul de sacs on Ida
Court and residents are parking diagonally on these
cul de sacs. Village regulations prohibit diagonal
parking on public rights-of-way.
Fred Tennyson, Traffic Engineer for the Village,
stated that this particular area consists of 3 and 4
flats and parking is limited and recommended diagonal
parking be permitted. The Safety Commission voted to
grant the recommendation of staff relative to diagonal
parking on Ida Court.
Trustee Wilks, seconded by Trustee Corcoran, moved to
authorize the Village Manager to direct the Chief of
Police to suspend enforcement of the law prohibiting
diagonal parking on Ida Court effective immediately.

DESIGN ENGINEER A proposal was presented from Greeley & Hansen to
HIGH SERVICE PUMP conduct the design engineering services for Phase 4 of
REPLACEMENT the high service ;pump replacement program.
PROGRAM: PHASE 4
It was noted that this is an on-going program and the
services of the, design engineer will include: design
preparation, contract documents, start-up testing,
inspections and follow-up. The proposal for
$24,500.00 was submitted by Greeley & Hansen.
This is a specialized field and Greeley & Hansen is
familiar with the Village operations and the entire
program.

accept the proposal submitted by Greeley & Hansen as
design engineer for Phase 4 of the high service pump
replacement program in the an amount of $24,500.00.

SEWER REHAB A recommendation was presented to authorize sewer
repairs using a ,specialized technique developed by
Insituform Midwest, Inc. This process allows a type
of liner to be 'inserted into damaged sewer lines
therefore eliminating the need to dig up areas or
remove landscaping. Based on the number of areas
needing repair, the proposed sewer rehabilitation
would cost $85,870.00.

waive the bidding procedure relative to a specialized
form of sewer rehabilitation.

Mr. Janonis also stated that he was working on items
to bring to the Board at a Committee of the Whole meeting,
however, he does not have all the information necessary,
therefore the Committee of the Whole meeting scheduled
for Tuesday, October 27 would be cancelled.
ANY OTHER BUSINESS
Trustee Floros noted that the Board had received a letter
from Rogers Industrial Park stating that the project is
complete and 100% leased. Representatives of the Rogers
Industrial Park also complimented staff for their
cooperation and professional manner of operation.
Trustee Corcoran informed the Board that membership on
the SWANCC Board would consist of 3 elected officials,
3 appointed officials and one appointed at large.

APPLEBEE'S NEIGHBORHOOD GRILL AND BAR

On Tuesday, October 13, the Village Manager met with Messrs. Douglas Neis and Jerry
Egner from Marcus Restaurants, Inc., regarding a request by Hasty Host, a division of
Marcus Restaurants, Inc., for the creation of a Class S Liquor License. The License will
be used in conjunction with the operation of Applebee's Neighborhood Grill and Bar.
The Class S liquor designation provides for the consumption of alcoholic beverages on
site in conjunction with a lounge.
Messrs. Neis and Egner stated that Marcus Restaurants, Inc., is the
Wisconsin/Chicagoland area franchisee for Applebee's Neighborhood Grill and Bar, a
national restaurant chain. The gentlemen indicated that Applebee Restaurants are
currently in operation in Schaumburg and Bloomingdale and that requests for additional
restaurants are pending in Deerfield and Mount Prospect. Mr. Neis indicated that
Marcus Restaurants, Inc., is a large, well-established corporation that also operates Marc's
Big Boy and KFC restaurants in the Wisconsin/Chicagoland area.
The proposed location of the restaurant is on the west side of Randhurst on the former
site of Kroch's and Brentano's bookstore. The facility will have a separate outside
entrance that will allow for hours of operation separate and apart from the operation of
the Mall. Plans for the restaurant space have been submitted to the Village and are
currently under review. An early 1993 opening is anticipated.
The Village Manager discussed with Messrs. Neis and Egner some of the particulars of
the Village's Liquor Ordinance and the general philosophy of the Village regarding the
sale and consumption of alcohol. The gentlemen indicated that Marcus Restaurants,
Inc., corporate philosophy was similar and that all managers and liquor servers receive
extensive training in this area.
The required Liquor License application, supporting documents and fees have been
submitted to the Village and are in order. Appropriate background checks are currently
being conducted.
A representative from Marcus Restaurants, Inc., will be present to answer any questions
that you may have.

AN ORDINANCE AMENDING CHAPTER 7 ENTITLED "SIGN REGULATIONS
OF THE VILLAGE CODE OF MOUNT PROSPECT
WHEREAS, Charles Vavrus (d/b/a as Charlie Club) , hereinafter
referred to as Petitioner, has filed a request to amend Chapter 7
(Sign Regulations) of the Village Code of Mount Prospect by
creating a category for "off -premise" signs; and
WHEREAS, the Sign Review Board did consider the request, being the
subject of Sign Review Case No. 24-92 followiong due and proper
notice having been published in the Mount Prospect Herald on April
10, 1992, at their regular meeting held on May 4, 1992, August 31,
1992 and September 14, 1992; and
WHEREAS, the Sign Review Board has forwarded their recommendation
to the President and Board of Trustees of the Village of Mount
Prospect; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect has considered the proposed amendment to Chapter 7
and have determined that the best interests of the Village would be
served by approving the proposed amendment.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the recitals set forth hereinabove are
incorporated as findings of fact by the 'President and Board of
Trustees of the Village of Mount Prospect.
SECTION TWO: That Section 7.330 of Article III entitled "General
Provisions" of Chapter 7 (Sign Regulations) of the Village Code of
Mount Prospect, as amended, is hereby further amended by adding
thereto paragraph E; so that hereinafter said Section 7.330 shall
include the following:
If E. Off -premise Business Identification Signs. The following
standards shall apply:
1. The sign must direct attention to a business on a
lot adjacent to the lot on which the sign is
located.
2. The sign must be located on a lot which is adjacent
to a major arterial street.
3. The number of free-standing signs permitted by this
Article shall not be increased by the placement of
the off -premise sign.
4. The lot on which the business to be benefitted by
the off -premise sign must not have any frontage on
an arterial street.
5. An easement or license must be granted allowing the
placement of the off -premise sign.
6. The sign may contain changeable copy as provided
for in Section 7.325.E of this Chapter.
SECTION THREE, That Section 7.701 of Article VII entitled
Chapter 7

"Appeals, Variations and Special Uses" of Chapter 7 (Sign
Regulations) of the Village Code of Mount Prospect, as amended, is
hereby further amended; so that hereinafter said Section 7.701
shall be and read as follows:
See, 7.701. Scope of Appeals, variations and Special Uses. An
appeal from a staff decision made in interpreting,
applying and/or enforcing the regulations contained in this Chapter
may be taken to the sign Review Board.
A variation may be requested from the height, area, and. minimum
distance requirements contained in this Chapter, provided that no
variation shall exceed the maximum height, sign area, and distance
requirements by more than twenty-five percent (25%).
A special use may be requested to permit an electronic message
center, development identification signs, non -conforming wall signs
and the equity option, and off -premise business identification
signs. 11
SECTION FOUR: That this ordinance shall be in full force and

Mr. George Savoy, petitioner in the above request, has contacted me and asked that this
rezoning and PUD request to allow 20 townhomes, be withdrawn.
As you know, on October 22, the Zoning Board of Appeals voted 6-0 to recommend that
the Village Board deny this request. This matter would have been scheduled for review by
the Village Board on November 4. At the Zoning Board meeting, Mr. Savoy indicated an
interest in working with single family builders on the property, and he has proceeded to
do so.
All residents who spoke at the public hearing have been advised that the application has
been withdrawn.

Chairman Basnik introduced ZBA-47-Z-92, ZBA-49-SU-92 being a continuation of a
rezoning and Special Use request to allow the construction of 22 townhomes on the west
side of Elmhurst Road, south of Oxford. fie stated that this public hearing had been
continued from the September 24 Zoning Board meeting date and that he would convene
the hearing and allow concluding testimony by the neighborhood association. He then
stated that other persons would be allowed five minutes each for their comments and he
asked that there by no repetition of earlier statements. He then stated that the petitioner
would be allowed a period for rebuttal of neighbor's comments and then the public hearing
would be closed for consideration by members of the Zoning Board of Appeals.
John Czerochowicz introduced himself to the Zoning Board and stated that the association
would try not to repeat items that were discussed at the last meeting, and Mr. Czerochowicz
passed out a booklet of information and facts that was prepared by the neighborhood
association. Mr. Czerochowicz briefly summarized the association's general opinions about
the proposed townhomes and stated their concern about flooding, traffic problems, lack of
property maintenance for the petitioner's property, and asked the Zoning Board to help
enforce private subdivision covenants in this area.
Mr. Bill Wilson then introduced himself and stated he resides at 1120 North Elmhurst. He
stated that his property fronts onto Elmhurst Road and he has lived here for 34 years and

has never felt the need for a buffer from Randhurst Shopping Center or Elmhurst Road,
and that the median strip has not presented a problem for access in and out of his driveway.
Jan Makaryk, 100 Stratford, objected to the request and stated that she was concerned about
a precedent for townhorne rezoning if this application was approved. She also gave a history
of Lot 8 in the subdivision.
Clarence Bobikewicz, 1114 Meadow, objected to the request and stated that he did not think
that the townhomes were compatible with Wedgewood Terrace, he objected to the proposed
privacy wall around the townhomes, and stated that there was no need for sidewalks in this
area.
Marie Reagen, 1009 Meadow, stated she bought her home in Wedgewood Terrace because
she was comfortable with the protective covenants in the area, and that many homes in this
neighborhood have been sold for upper bracket prices. She stated she is planning a major
addition to her home and is concerned about property values in this area, if the townhomes
were built.
Lucy Ding, 3 Oxford Place, stated since the September meeting she had been studying the
request and had visited other R-3 planned developments in the Village. She stated that
most R-3 townhomes do not abut single family areas, and that the market is not particularly
good for townhomes at this point. She pointed out that the single family homes in the,
Thomas More Subdivision are selling much better than townhomes in this area. Ms. Dinj
summarized the information in the brochure prepared by the association. She also stated
that the Par 4 Subdivision on Golf Road is a good "ample of single family homes being
built on a major street, and indicated she had told builder, Gene Nauert, to go and visit this
particular property; and he had indicated an interest in acquiring these lots. She also stated
that the Prospect Height Park District had submitted a letter objecting to the request.
Lastly she stated that the objector's petition had been revised to include 413 names.
Mr. Basnik asked if any members of the association had talked with attorneys about the
existence of these private covenants, and whether they can all be enforced.
Trudie Berndt, 3 West Euclid, stated she had talked with a federal judge concerning the
church and parking lot matter at 1 West Euclid, and indicated that this judge had stated she
should pursue private covenants.

Chairman Basnik stated that he did not believe this information was relevant to the public
hearing, and indicated that the Zoning Board of Appeals would not become involved in the
matter of Mr. Hendricks' discussion.
There being no further comments from the audience, Mr. Basnik asked the petitioner to
proceed with his rebuttal.
Mr. George Savoy stated that he and his team would be rebutting the comments made by
the residents and began by stating that most informed buyers would not buy a house on
Rand Road or Elmhurst Road, and stated that this is one of the main issues he has had to
deal with in owning this property for so long. He also confirmed that most inquiries by this
property had been for commercial development. He further stated that the private
covenants on the subdivision plat are discriminatory and that they call for only caucasians
to reside in the subdivision. Mr. Savoy stated he would also sell the lots to a single family
developer if one could be found.
Mr. John Melvan then continued the petitioner's rebuttal and stated that the site plan is
attempting to be considerate of the neighborhood in terms of a design and building
placement, and that the property had been owned by the petitioner for over 20 years, and
had been for sale many times in that period, and that the only inquiries had been for
commercial. With a mounted elevation and floor plan, Mr. Melvan described the townhome
units and stated that they would have first floor masonry construction. He stated that many
of the units would be larger than the homes in Wedgewood Terrace. Mr. Melvan stated
that Mr. Savoy is constructing a new subdivision called Medina Woods and that this consists
of 96 units. Sixty of those units are single family homes and 36 are townhomes. Mr. Melvan
used this example to point out that townhomes could be developed near single family
homes, and being an attractive, compatible use.
Mr. Melvan then gave a summary of the credentials of McMahan & Associates, the Land
Planner and Engineer, and Mr. John Sturgill began a rebuttal of some of the technical
points that had been previously raised. Mr. Sturgill said that two single family homes had
been built in Wedgewood Terrace on Elmhurst and Rand Road in the last five years and
that this was not necessarily a trend of development. He stated that this property is at the
edge of a zoning boundary, and that this gives the property characteristics of a fringe
development area, and townhomes have proved very successful in difficult development
sites such as this, in the past.
Mr. Sturgill pointed out that the site plan provides for a frontage road and that this is better
than direct access onto an arterial street. He further stated that increased guest parking
could not be provided near Buildings 1 and 11, and that the point of access from a private
road to Oxford Terrace could not be flipped, as this would result in a very severe turning
radius of the private road and would result in the loss of three units. He stated this would
also place the road too close to Ms. Ding's house. He also confirmed that the driveways
were a minimum of 20 feet to the back of the curb, and that sidewalks were not desirable
in this area considering the nature of the subdivision. He again stated that there is a
precedent for townhome development in transitional areas such as this, and that a
townhome plan on this site is much better than a commercial, and believes that the
neighborhood opposition should be less severe for townhomes rather than commercial.

Mr. Sturgill then began a response to the engineering considerations that were raised at the
last meeting and discussed civil engineering standards, soil investigations, I.D.O.T.
requirements for use of their storm sewer and summarized that the plan had been designed
to meet the Mount Prospect DevelopmentCode. Mr. Sturgill then provided a rebuttal to
further neighborhood comments from a prepared text dated October 22, 1992 by Randhurst
Townhomes. This four-page text and rebuttal by the petitioner is attached as Exhibit A to
these minutes.
Chairman Basnik then stated that the public hearing is closed and he asked for discussion
by members of the Zoning Board of Appeals. Mr. Saviano pointed out that the residents
had indicated a single family buyer might be interested in the property, and asked if it might
be wise to continue this request in order to allow the residents to have this buyer look at
the property, and to further study to see if it was adaptable to single family.
Ms. Ding responded that it is not their responsibility to bring a buyer to the petitioner and
Zoning Board members indicated they would like to close the hearing that night, if at all
possible.
Mr. Basnik pointed out that there are only two existing lots that require access to Route 83
and that these are the problem lots. He indicated that the other lots are necessary with this
request to help solve the problems of these two interior, lots. He asked if a frontage road
could be designed,. and the petitioner stated that there is not sufficient room for a frontage
road. Mr. Basnik stated that residents in this area have to keep corning out and objecting`
to rezonings in their neighborhood, and he believes that concessions should be made to the
residents. He asked if a compromise could be worked out and perhaps a rezoning to R-
1 could be studied. The petitioner' indicated that they would have to review R'-1 lots at this
location.
Mr. Brettrager stated he didn't feel like he knows enough about the townhomes proposed
for this location, other than the preliminary floor plans and elevations. He stated he
somewhat agrees with the concept of townhomes, but that more information is necessary.
Mr. Melvan stated that the townhomes were similar to other developments in Mount
Prospect, such as the Village Commons and Orchard Fields. However, those two
developments have smaller units.
Mr. Savoy stated that they would be willing to delete sidewalks and that they would use this
cost savings to increase landscaping around the townhome units.
Mr. Cassidy pointed out that the health, safety and welfare of the area residents was not
addressed, and he believes that the plan lacks usable amounts of open space.
Mr. Lannon stated that the proposed townhomes put pressure on adjoining single family
homes and that with this request, there would be a precedent for more townhome rezonings,
and that in some respects he believed that a rezoning for this development would be
rewarding the property owner for allowing existing houses on these lots to deteriorate. Mr.
Lannon stated that, in his opinion, some of the covenants could still be considered valid
even if some might appear to be discriminatory. He indicated that this project is not
significant to the entire community and it is not special enough to go against the wishes of
the neighborhood.

Mr. Saviano stated that the Zoning Board should be concerned with what is best for the
Village as a whole, and that everyone that appears before the Zoning Board has their own
special interests. He pointed out that these townhomes would generate $50,000 in real
estate taxes per year, plus construction jobs and sales taxes, but he did see that there were
problems with the development, concerns with the neighbors, and the impact of the
covenants.
Mrs. Skowron noted that it is important for the Zoning Board to listen to everyone to see
what the important issues are for everybody that is impacted by the request. She stated that
the developers are entitled to come in and request a development that represents what they
feel works best, and that she believes that in most instances townhomes are a reasonable
buffer, and that they should not adversely affect property values of abutting single families.
She stated that home owners have a right that development should be the best plan for
them in the area and not just an adequate plan, and she believes that it has not been
demonstrated that this is the only use for the property or the best answer for the
homeowners association.
Mr. Savoy again emphasized that in twenty years there has never been a request for single
family development
Mr. Basnik asked Mr. Savoy what his motive was to buy these lots many years ago, and Mr.
Savoy thought at one point that the lots had commercial potential. Mr. Savoy asked what.
the next step was in the public hearing process and Mr. Basnik stated that the request would -
go to the Village Board. Mr. Savoy briefly requested a continuance to work with staff on
a revised request, and Mr. Basnik suggested that the petitioner work with staff, but that he
would ask the Zoning Board to make a recommendation on the request and move this item
on to the Village Board.
Mr. Basnik then read the rezoning standards from the Zoning Ordinance, and it was
determined that the existing zoning. was appropriate for this property and that the R -X
classification had not diminished the value of these lots. The Zoning Board also determined
that the health, safety and welfare of neighboring residents would be adversely impacted by
this plan due to the higher density and resulting traffic. The Zoning Board determined that
the property was suitable for development with R -X zoning, and that other lots in the area
had been developed as evidence of this. The Zoning Board also examined the length of the
time the property had been vacant, and pointed out that the three interior lots with access
to Elmhurst Road are the vacant properties, and that two lots have existing homes. The
Zoning Board also noted that the site plan is in compliance with the Comprehensive Plan,
and that no real community need or benefit had been proven by the petitioner to help justify
the townhomes.
The Zoning Board of Appeals then summarized the Special Use standards. They again
noted that the development was not in harmony with the public health, safety and welfare
of area residents, and that the proposed development was not compatible with large lot
single family homes. The Board discussed whether the proposed Special Use would be
injurious to property values, -and Mr. Brettrager stated that he did not think that the
townhomes would reduce property values, but that there might be adverse impacts from
stormwater runoff from the project. The Zoning Board found that the utilities were
adequate for the townhomes and that the development would cause high level of congestion
in the area.

There being no further discussion, Chairman Basnik asked for a motion on the rezoning„
Mr. Lannon moved that the 'honing Board of Appeals recommend approval of a rezoning
from R -X to R-3. The motion was seconded by Mr. Brettrager.

Mr. Saviano stated that he voted against the rezoning because he did not know if this was
the most appropriate project for this area.
The Chairman then asked for a motion on the Special Use. Mr. Lannon moved that the
Special Use be approved. The motion was seconded by Mrs. Skowron.

Mr. Savoy and Mr. Bower -Ibe Developers" have acquired the subject property over the past 20 year
period and their ownership comprises of 7% of the property in Wedgewood Terrace. The Developers
come to the Board, not as outside interests, but as property owners just as those property owners who
belong to the Wedgewood Terrace Improvement AssociationAssociatiod'. They have the right, as
any property owner, to apply to the Board for consideration of their development within the current
guidelines prescribed by Mount Prospects Zoning Ordinance.
During the past 20 years the Association has countered all previous attempts to rezone parcels within the
subdivision. All the prior attempts have been for Commercial development. The Developers have had
the subject properties For Sale at various times over the past 20 years and all inquiries have been for
commercial uses. This would lead someone to believe that the highest and best use of the property would
be for commercial development However the Developers, in keeping with the desires of the Manning
Department, are requesting a less dense and less traffic bearing zoning of R-3. This zoning change would
not set any precedent since their are only 3 remaining vacant lots scattered lots throughout the subdivision.

The Association Conclusion I : Subject property's R -X status is not arrived at because it is undeveloped
land incorporated into the Village of Mount Prospect- R -X development is what the original covenant of
Wedgewood Terrace dictates as the only permissible land usage.
This area surrounding Randhurst is one of the most congested part of the Village. Wedgewood Terrace
is already almost a stone's throw from many of these townhomes of varying qualities and sizes. Changing
R -X zoning to higher density R-3 zoning will intensify problems created by congestion.
The Developers Rebuttal 1 : The proposed rezoning is consistent with the Village General Plan, is
a lessor density than the evidenced highest and best use of the property, and is not the only permissible
land usage since the covenants would be unenforceable.
The Association, by their own admission, have an extremely low traffic count since children play in the
streets, and so it seems, the residents quite frequently stroll and jog in the streets. Common sense would
dictate that the proposed residents of the development would be ingress and egress onto Elmhurst Rd. and
not through the subdivision unless visiting a neighbor.
The Association Conclusion 2: * F-,dsting zoning has Increased property value. * Re -zoning will Diminish
quality of life for existing residents.
The Developers Rebuttal 2: The zoning of the property has not increased the value of the property. The
value of the property has been increased by economic trends and by the fact that the surrounding areas
have developed thus making the location more desirable. The subject property's value would be greater
as commercial not R -X. The Association has not presented any documented evidence which shows that
the rezoning would Diminish the quality of life for the residents. The square footage of the proposed
townhomes meet or exceed over 70% of the single family residences within Wedgewood Terrace.
The Association Conclusion 3 "Friendliness" has always been a way of life for residents of Wedgewood

The Developers Rebuttal 3 : The. Developers are pleased to know that "Friendlincsst' is a way of life for
the residents of Wedgewood and are hopeful that they would respect the Develop"cr's as property owners
exercise their rights, just as the -Developers are respectful of the residents. The proposed development is -
designed in elegant style withinAbe, ordinances and codes of the village which are written to promote the
wpjfge�_of the village citizenry. No evidence presented to show that
general health, safety and d ence has been, p,re. en
the proposed development either encroaches or adversely impacts the surrounding area
The Association Conclusion 4: "The relative gain to the public as compared to the hardship imposed upon
the petitioner." * Please, petitioners, show us your hardship. * Please, petitioners, show us our gain.
The Developers Rebuttal 4: The Developers, as developers and property owners, have the right, to the
extent allowed, to realize as much gain from their property as any other resident or property owner. The
Developers feel, as do local realtors and appraisers, that a townhome development would enhance and
benefit the value of the surrounding area.
The Association Conclusion 5 : *The lots are only suitable for its original intent - one single family home
for each lot. This will only add one driveway with direct access to Route 83. One driveway is already in
existence. No parallel setback access drive will be necessary, thus eliminating expensive costs. Utilities
are already in place for developing one single family detached home per lot. The homes than can be built
with attractive setbacks from Elmhurst and will definitely be compatible with the rest of Wedgewood
Terrace.
*On the other hand, the proposed PUD is unsuitable for the many reasons mentioned under Standards
for consideration C.
The Developers Rebuttal 5 : As previously discussed by the Developers, independent appraiser, local
realtor and the village planning department, it is widely recognized that the subject property would not be
suitable for a single family detached development nor consistent with the Comprehensive plan.
The Association Conclusion 6 : The modus operandi of speculators of this area is to hold on to properties
for enormous profits. They have in the past, and at present, let their properties deteriorate and then claim
hardship of marketability as ground for rezoning.
' Georgen, after losing the lawsuit to rezone a parcel of land in our area, sold to individuals at a
reasonable rate for single family detached home development
' Fidelity Development also lost the battle to put in the shopping center and now the Thomas Moore
Subdivision of deluxe single-family detached homes are beening built. The Village Director of Planning
David Clements, testified at a prior hearing that the aforementioned area was only suitable for commercial
use. The Zoning Board, however, had the wisdom to vote against commercial use.
The Developers Rebuttal 6: By the Associations own admission, "All Wedgewood Terrace properties have
appreciated between 100% and 200% during this duration.", "Existing zoning has Increased property value.%
"residents indicated a number of concerns, but one of the more significant concerns was the impact on
existing property values". It seems the modus operandi of the residents, not withstanding the clutter of
superfluous unrelated issues that have been presented, is value and profitability. Quite frankly, tats their
right.
The Association Conclusion 7 The compatibility of existing zoning vis-a-vis the compatibility of the
proposed zoning with the existing comprehensive land use plan of the Village.
The Developers Rebuttal 7 :, The proposed development is compatible and conforms to the Village of
Mount Prospect Comprehensive Plan.

The Zoning Board of Appeals transmits for your consideration their recommendation for
a Special Use Permit as required in Section 14.1101.C.8 to allow a commercial vehicle with
a licensed weight of more than 8,000 lbs. to be housed in a garage.
The Zoning Board of Appeals considered the request at their meeting of October 22, 1992.
At the meeting, James Hoffmann indicated that he has been parking his vehicle at his home
for over twenty years. He indicated that he had an agreement with the Village Board which
allowed the parking of the vehicle at his home pending the amendment to the Ordinance.
He indicated that the truck was used as a personal vehicle and also for his part-time
masonry business. He stated that he now stores all equipment and supplies off-site.
Ray Forsythe, Planner, summarized the staff report. He indicated that earlier this year the
Zoning Board recommended, and Village Board approved an amendment to the Zoning
Ordinance which allows vehicles with a licensed weight greater than 8,000 lbs. in residential
areas, when housed in a garage, if a Special Use Permit is obtained. Mr. Forsythe indicated
that in staff's opinion, the intent of the Ordinance has been met.
Mr. Richard Ruchalski of 1816 Sitka Lane, indicated his opposition to the request. He
presented in chronological order a series of complaints he issued to the Village in regards
to the petitioner's home business.
The Zoning Board discussed the request. Gil Basnik indicated that there was a petition in
support of the request submitted which included 13 families adjacent to the subject property
and that many neighbors were at the meeting to show their support. By a vote of 6-0, the
Zoning Board of Appeals recommends approval of the Special Use Permit request to allow
a commercial vehicle with a licensed weight in excess of 8,000 lbs. to be parked in the
garage.

Mr. Jim Hoffmann introduced himself to the Zoning Board and stated that he was the
petitioner: in this request. Mr. Hoffmann indicated that he had been parking a truck in his
garage for approximately the last 20 years. Mr. Hoffmann stated that he understands that
there have been complaints concerning the truck at his residence, and he has talked with
the Village Board about this matter in the past in hopes of finding a way to have the truck
authorized to be parked in a garage. The last time Mr. Hoffmann presented this to the
Village Board, he indicated that the matter of truck parking would be looked at with the
revised Zoning Ordinance and Mr. Hoffmann believed that, with this statement from the
Village Board, his truck was non -conforming as to some respects.
Mr. Hoffmann then stated that an amendment to the Zoning Ordinance had been adopted
that sets up a Special Use category for truck parking in residential garages, and his request
was filed under this new amendment. He explained that his truck fits in the existing garage
at his home and that the garage is a typical two -car garage, and that his truck has not

required any modification to the structure. He described the truck as a small lift -bed dump
truck with a typical pick-up truck cab. Mr. Hoffmann explained that he is a driver education
teacher at Hersey High School, and that he uses the truck in spring, summer and fall for a
part-time masonry contractor's business.
Mr. Basnik asked Mr. Hoffmann if he also uses the truck for a personal vehicle, and asked
what the weight of the truck is. Mr. Hoffmann stated that he drives the truck on a daily
basis and uses it as his personal vehicle, including daily trips to his full-time job at Hersey
High School. He stated that in addition to the truck, his wife has an automobile and that
these are the two vehicles in the family. He then stated that the truck has a weight capacity
of over 8,000 lbs, fully loaded.

Sitka Lane, stated that he opposes the request and he has filed complaints with the Village
concerning this truck since 1986. He gave a,background of these complaints and stated that

deteriorating Village streets. He stated he is the only neighbor to complain, but stated he
believes there are others that are concerned with this vehicle.
Mrs. Skowron asked if Mr.'Ruchalski was objecting to the actual truck or to the part-time
masonry business, and Mr. Ruchalski stated he's objecting to the presence of the truck but
also believes that the masonry business was more than a part-time seasonal occupation for
Mr. Hoffmann.
Chairman Basnik matte reference to the petition that was submitted in support of the
request and read the petition into the public record. Chairman Basnik asked how many
persons in the audience had signed the petition and were in favor of the request, and
approximately 12 people raised their hands in support of the request. Mr. Basnik asked Mr.
Ruchalski what Mr. Hoffmann could do to satisfy Mr. Ruchalski's concerns, and Mr.
Ruchalski stated that he believed Mr. Hoffmann should remove the truck from the
residential area.

Mr. Cassidy asked Mr. Forsythe what the exact wording was in the recent amendment to
the Zoning Ordinance, and Mr. Forsythe summarized the new language in the Zoning
Ordinance and emphasized that the Special Use category is set up to allow trucks in typical
residential garages.
Mr. Basnik asked if Mr. Hoffmann can keep the truck in the garage at all times, and Mr.
Hoffmann stated that the truck is usually garaged except when he gets home from school
in the afternoon. Mr. Hoffmann acknowledged that there is a problem with the neighbor,
and that he tries to keep the truck in the garage at all times. Mr. Hoffmann continued and
stated that he has no employees for his masonry business and that a laborer lives in the
neighborhood and walks to his house for the masonry business. Mr. Hoffmann stated that
he had also kept masonry materials and contractor's equipment at his home prior to 1986,
and that's when the complaints first started, but since then he has found rental space for his
contractor's equipment in Wheeling and that the home occupation standards are not violated
with any garage storage.
Mr. Basnik stated that Mr. Hoffmann seems to have the support of his neighbors, but he
believed that the truck should be kept in the garage as much as possible inasmuch as there
is one neighbor that seems to be concerned.
Mr. Brettrager stated that this request seems to meet exactly the intent of the amendment
to the Zoning Ordinance, and it provides a way to house a truck in a garage and to
minimize any impact on the neighborhood, and stated he had no objection to the request.
There being no further discussion, Chairman Basnik asked for a motion. Mr. Brettrager
moved, seconded by Mrs. Skowron, that the Zoning Board of Appeals recommend approval
of a Special Use to allow a truck in excess of 8,000 lbs. to be parked in a residential garage
at 1811 Sitka Lane.

Summary of application: The petitioner is requesting permission to park his truck in the
garage of his single-family residence. The application indicates that he has been parking
his vehicle in the garage since 1974. The petitioner has submitted a petition with 22
signatures (13 households) which recommend approval of the Special Use Permit. As
additional background, Mr. Hoffmann has informed staff that, while his truck is used daily,
it is also utilized with a part-time job as a masonry contractor. The Home Occupation
provisions of the Zoning Ordinance prohibit employees and any garage storage of materials.
The petitioner should discuss the Home occupation standards with the Zoning Board to
demonstrate that all standards are met.
Impact on Surrounding Properties: On July 21, 1992, the Village Board amended the
Zoning Ordinance to allow vehicles with a licensed weight in excess of 8,000 pounds to be
parked in residential areas if housed in a garage. Staff has reviewed the petitioner's
application and believes the intent of the Ordinance has been met. The petition in favor
of the request has been signed by residents on all sides of the applicant as well as other
nearby neighbors.
There were no comments from the other departments on this request.
The petitioner has requested a Special Use Permit to allow his commercial vehicle to be
parked in his garage. Staff has reviewed the garage and it is a typical single family garage.
The neighbors have indicated their support and therefore, staff would recommend approval
of the request. Staff would like to remind the petitioner that the vehicle must be parked
in the garage at all times when at home, and that all home occupation standards are met.

The Zoning Board of Appeals transmits for your consideration their recommendation for
a variance application filed by Peter Orel. The applicant is requesting a variance to Section
14.102.13.2 to allow a 2 foot setback along the interior side property line instead of the
minimum 5 feet in order to replace an existing one -car garage with a two -car garage.
The Zoning Board of Appeals considered the request at their meeting of October 22, 1992.
At the meeting, Peter Orel explained that they wished to replace the existing garage with
a two -car garage and proposed to use, the same setback so that they can maintain a greater
amount of usable open space in the rear yard of his lot.
Ray Forsythe, Planner, then summarized the staff report and indicated that the Zoning
Ordinance requires a 5 foot setback, but that a 2 foot setback was requested for the new
garage in order to maximize open space in the rear yard. He stated that this is not an
unusual request with a 50 foot lot, and that there are other detached garages in the area
with reduced setbacks. Mr. Forsythe stated that the total lot coverage will be below the
maximum allowed.
The Zoning Board discussed the request. Mr. Basnik asked if gutters would be installed.
Peter Lannon indicated that he has a concern with the Inspection Services Department
requiring 5/8" Class X drywall on an accessory structure. He feels that this is an excessive
requirement.
By a vote of 6-0, the Zoning Board of Appeals recommends approval of the variance
request to allow a 2 foot setback for the proposed detached garage with the following
conditions:
1. Gutters being installed on the north side of the garage.
2. Five-eighths inch Class X drywall shall be added along the garage wall abutting the
property line.

Mr. Peter Orel introduced himself to the Zoning Board of Appeals and stated he would Eke

stated that he would be demolishing the existing one -car garage in hopes to construct a two -
car garage at the same location with a 2 foot setback. He noted that the Zoning Ordinance
requires a 5 foot setback for a detached structure. He stated that the variation request was
filed so that the garage would not project into the center of his lot. He explained he has
a 50 foot lot and that maintaining a 5 foot setback would reduce the amount of usable yard
space in his rear yard.
Mr. Forsythe then summarized the staff report for the Zoning Board and acknowledged that
this is a variation request to reduce the 5 foot setback for a detached garage to two feet,
and that the petitioner would like to maintain the same setback for a new two -car as exists
with a one -car detached garage. Mr. Forsythe stated that in an area with a 50 foot lot
width, it is not unusual to have property owners want to reduce the 5 foot setback to
maintain as much usable rear yard space as possible, and that there are other reduced side
yards in this area so that this request would not provide a structure that was out of character
with the neighborhood.

Mr. Lannon questioned why Inspection Services had recommended Class X drywall be
placed inside the garage, and Mr. Forsythe stated that this was important because a garage
could be constructed on the adjoining property that could be within a 10 foot separation of
the petitioner's garage, and that this is a fire safety consideration.
Mr. Basnik asked if the garage would have projecting eaves into the 2 foot setback, and if
there would be gutters on this side of the structure. Mr. Mike Cody, an architect with
Lineworks, introduced himself to the Zoning Board of Appeals and stated that they were
not planning gutters for this garage, and Mr. Clements stated that gutters could be made a
condition of the variation request if deemed important by the Zoning Board.
No one appeared to speak in favor or opposition to the request.
Mr. Basnik asked if the petitioner's neighbor was aware of the proposed two -car garage, and
Mr. Orel stated that he has a letter of approval from the adjoining property owner.
The Zoning Board generally discussed the request and it was determined that a reasonable
condition should be attached to the, variation to require gutters to be installed on the side
of the garage near the property fine, and the Class X drywall should be installed on the
interior as recommended by Inspection Services.
Chairman Basnik asked for a motion on the request. Mr. Cassidy moved, seconded by Mr.
Saviano, that the Zoning Board of Appeals recommend approval of'a 2 foot setback for a
new two -car garage at 214 South HiLusi, subject to a gutter being installed on the north
side of the garage and that Class X drywall be installed inside the garage.

The petitioner is seeking a variation to Section 14.102.B.2 to allow a 2 foot setback along
the interior side property line instead of the minimum 5 feet in order to replace an existing

Summary of application: The petitioners hope to replace an existing one -car garage which
is located 2 feet from the sideyard property line with a two -car garage, and would like to
maintain the same setback. Also indicated is a mature row of trees and the fact that the
lot is only 50 feet wide and they wish to maintain as much open space as possible in the rear
yard.
Impact on Surrounding Properties: The one -car garage is presently located with the same
interior sideyard setback as the proposed garage, and is approximately 16.25' x 22' in size.
The proposed garage is to be in the same location with a dimension of 22' x 22'. This is a
difference of 5.75 feet in width further into the petitioner's yard. The Zoning Board of
Appeals recommended and the Village Board approve an amendment to the Zoning
Ordinance earlier this year to allow existing non -conforming buildings or structures to be
enlarged, maintained, repaired or altered provided that no such enlargement, maintenance,
repair or alteration shall either create an additional non -conformity or increase the extent
of the existing non -conformity. The amendment also allows non -conforming structures to
extend up to 2 1/2 feet into a sideyard setback on 50 foot lots. Because the petitioners are
electing to remove the existing garage and replace it with a new structure, the amendment
does not apply. However, staff believes that the reduced lot width on a 50 foot lot is a
hardship and providing the required sideyard setbacks would limit the usable area in the
rear. Staff would also note that total lot coverage is well below the maximum allowed.
Inspection Services: Since a structure could be built within 5 feet of property line on an
adjoining lot, buildings may be only 7 feet apart. Recommend 5/8" Class X drywall be
placed inside the garage.
Engineering. No fill shall be placed around outer limits of the new garage so that existing
drainage patterns are not altered.
SU-MMARY/RECOMMENDATIO
The petitioners are requesting to construct a new two -car garage to within two feet of the
property line. There is presently a one -car garage which maintains this same setback. Staff
agrees that on narrow 50 foot lots, a 5 foot setback decreases the amount of usable open
space and would recommend approval of the request. The Zoning Ordinance would allow
the petitioners to add on to the existing structure without seeking a variation, and staff feels
by removing the existing structure and replacing with an all new garage, a more aesthetically
pleasing and architecturally sound garage will be constructed.

presently has a one -car attached garage, and that he would like to convert this existing one -
car garage into living space and construct a two -car attached garage on the side of his
house. Mr. Zidek stated to accomplish this he would need to reduce the 71/2 foot sideyard
to 5 feet. He pointed out that his property is 10 feet wider than most lots in this area, and
this is due to an alley that was vacated which provided additional land area to his lot.
Because of this, Mr. Zidek stated there would be no adverse impact on the neighborhood.
Mr. Ray Forsythe then summarized the request for the Zoning Board, and stated that the
Zoning Ordinance would require a 7 1/2 foot sideyard for any part of the principal
structure, and that the petitioner would like to construct a garage addition at a 5 foot
setback. Mr. Forsythe stated that the abutting house maintains a 16 1/2 foot setback and
that the proposed garage addition would not'then adversely be impacting the neighboring
property. He stated that staff believes the addition would not have any adverse impact on
the area, and that staff would support the variation request based on the reduced setback,
and the overall compliance with lot coverage and other regulations.

the affected lots are 10 foot wider than the average lot in this area. Presently there is a 10
ft. sideyard on the west side and a 24.41 ft. sideyard along the east. The Ordinance requires
a setback of 7.5 feet on each sideyard. The lots with a width of 60-65 feet in the area would
be allowed to extend up to 6'-6.5' from the property line. Staff feels that adding a one-
story garage which is 20' x 22' will not cause a negative impact on the neighbor's property.
The property to the north which would be more affected maintains a 16.65' setback and
there is a 5 foot fence dividing the properties.
Engineering: There is an existing 24" storm sewer in the easement along the east property
line. Garage footing should be kept out of the easement.
The petitioner is seeking to convert the existing one -car garage into living space and add an
attached two -car garage to the north of the existing single family dwelling. The lot is larger
than the average lot in the area due to a vacated alley. Staff believes the addition will be
in harmony with the neighborhood and would support the variation. Staff would also like
to remind the petitioner that a permit will be needed to convert the existing garage and the
existing driveway will need to be removed and replaced.

A RESOLUTION REGARDING THE RELEASE
OF EXECUTIVE SESSION MINUTES
WHEREAS, the Mayor and Board of Trustees of the Village of Mount
Prospect have met from time to time in executive session for
purposes authorized by the Illinois Open Meetings Act; and
WHEREAS, as required by the Act, the Village Board has kept written
minutes of all such executive sessions; and
WHEREAS, pursuant to the requirements of Public Act 85-1355, the
Mayor and Board of Trustees have met in closed session to review
all closed session minutes; and
WHEREAS, the Mayor and Board of Trustees have determined that a
need for confidentiality still exists as to the executive session
minutes for the meetings as set forth on Schedule A attached
hereto; and
WHEREAS, the Mayor and Board of Trustees have further determined
that the minutes of the meetings as noted on Schedule "All attached
hereto no longer require confidential treatment and should be made
available for public inspection.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES

SUBJECT: Scheduled Replacement of Vehicle #2713
We are requesting to replace vehicle #2713, a 1986 Chevrolet
four -door sedan. Our replacement schedule for automobiles is
six years, and this unit was purchased in early 1986 from dealer
stock at a cost of $11,000. It has in excess of 37,000 miles
and a current maintenance cost of $3095. The cost to operate
the vehicle has increased in the last year to a current cost of
$.193 per mile.
Having had Chevrolet cars in the Police Department fleet, we
have the advantage of being able to predict or estimate some
items that will have to be replaced or repaired within the next
year of operation. This is determined by mileage and the time
in service. We project that the following items will have to be
addressed in the next year of operation:

Replacement of front steering linkage at an estimated cost
of $290.
Replacement of shock absorbers at an estimated cost of $105.
Replacement/repair of the cooling system at an estimated
cost of $220.
Complete replacement of the brake linings and rebuilding of
the front calipers and master cylinder at an estimated cost
of $200.
The unit may also require major repairs to the transmission and
engine due to an overheating problem we experienced in June of
this year. At the time we repaired what caused the overheating,
we also had to change the fluids and filters in the engine and
transmission due to a breakdown of the fluids. We are currently
monitoring oil usage of the engine and the shifting characteris-
tics of the transmission.
If this unit were to be kept in the fleet for another year or so
(due to the low mileage), we would, in my opinion, incur substan-
tial costs for transmission/engine failures. I recommend this
unit be replaced with a 1993 Chevrolet sedan at a cost not to
exceed $13,914.61. 1 ask that bids for this proposed purchase
be waived, as the price given is based on a state bid contract
through Miles Chevrolet out of Decatur, IL. On page 187, ac-
count code 48-077-93-8462, there is $15,000 allocated for this
expenditure.

SUBJECT: Reroof Bid - Former Aldi/Wille Bldg.
Ever since the Village purchased the former Aldi/Wille Hardware
building, at the intersection of Northwest Highway and Wille
Street, we have received numerous complaints from the tenants on
leaky roofs. We have tried, unsuccessfully, to stop the leaks
with our forces and by contracting roofing companies. There are
only two tenants left from the original four, and they are still
plagued with leaky roofs. This building has had many additions
over the years and several layers of roofing materials have been
applied. We have been unable to pinpoint specific areas where
the leaks are originating, as the water travels between the
layers of roofing. Our only recourse is to remove portions of
the roof and add new drains, gutters, and downspouts.
Sealed bids were opened at 10 AM on October 27, 1992 for the
replacement of these roofs. The replacement roofs will have a
nominal five-year warranty and the bid is structured into four
segments. It would be possible to repair the roof over specific
areas without doing the entire building. Areas 1 and 3 cover
existing tenant space, while areas 2 and 4 would be done to
protect the building and waterproof it in the event additional
space is rented. Bid results are attached.
If this property is to continue being rented, I would recommend
repair/replacement of -all four areas. It would be my further
recommendation to accept the lowest bid of $36,324.00 as submit-
ted by A-1 Roofing Co.
Funds for this proposed work are on page 185 of the current
budget, account 51-077-81-6695, in the amount of $10,000.
