CALL TO ORDER Mayor Hoefert called the Regular Meeting of the Village Board to order at 7:18 p.m. in the Board Room at Village Hall, 50 S. Emerson St. 2. ROLL CALL: Members present upon roll call by the Village Clerk: Mayor Paul Hoefert, Trustee Agostino Filippone, Trustee Terri Gens, Trustee John Matuszak, Trustee Peggy Pissarreck, Trustee Colleen Saccotelli and Trustee Richard Rogers Absent: None a. Pledge of Allegiance — Led by Trustee Pissarreck b. Invocation - Trustee Gens provided the Invocation 3. APPROVAL OF MINUTES 3.1 Minutes of the Regular Village Board meeting of February 1, 2022 Trustee Matuszak noted that Trustee Filippone voted to abstain on agenda item 8.2 but did not declare his reasoning. In accordance with Chapter 2, Article II (2.201) of the Village Code, a vote to abstain must be accompanied by a declaration. Trustee Filippone did not state his reason at the time of the vote and hence, was not recorded in the meeting minutes. Trustee Filippone stated his reason to abstain was/is a conflict of interest relating to Golf Plaza II. Clerk's note: the meeting minutes of February 1, 2022 will be amended to contain a post -meeting note to reflect Trustee Filippone's declaration to abstain. MAYORS REPORT 4.1 1st reading of an ORDINANCE AMENDING CHAPTER 13 (ALCOHOLIC LIQUORS) OF THE VILLAGE CODE OF MOUNT PROSPECT. This Ordinance will increase the number of Class F -1-V licenses by (1) La Presa Restaurant Inc. d/b/a/ La Presa Restaurant and decrease the number of Class F-1 licenses by one (1) La Presa Restaurant 2 Inc. d/b/a/ La Presa Restaurant located at 401 E. Euclid Mount Prospect, IL La Presa owner Carlos Prado and manager Norma Zepada stated their restaurant is a seafood and taco restaurant offering alcoholic beverages. Mr. Prada is requesting approval to add video gaming to his establishment. 2 No further discussion. This ordinance appoints Mayor Paul Hoefert as Director and Trustee John Matuszak as Alternate Director. Motion by Richard Rogers, second by Colleen Saccotelli to waive the rule requiring two readings of an ordinance and adopt the ordinance as presented. Yea: Agostino Filippone, Terri Gens, Peggy Pissarreck, Colleen Saccotelli, Richard Rogers Abstain: John Matuszak* Final Resolution: Motion Passed Ordinance No. 6606 *As subject nominee, Trustee Matuszak chose to abstain 4.3 A RESOLUTION APPOINTING A DIRECTOR AND ALTERNATE DIRECTOR TO THE SOLID WASTE AGENCY OF NORTHERN COOK COUNTY. Mayor Hoefert presented a resolution appointing Mayor Paul Hoefert as the Village's Director and Trustee Terri Gens as the Village's Alternate Director on the Board of Directors of the Solid Waste Agency of Northern Cook County. Motion by Peggy Pissarreck, second by John Matuszak to approve the subject resolution Yea: Agostino Filippone, John Matuszak, Peggy Pissarreck, Colleen Saccotelli, Richard Rogers Abstain: Terri Gens* Final Resolution: Motion Passed Resolution No. 5-22 *As subject nominee, Trustee Gens chose to abstain 4.4 APPOINTMENT TO BOARDS AND COMMISSIONS Mayor Hoefert presented the following appointments to the Special Events Commission: Katie Cousino — Term to expire April 2022 (to fill the unexpired term of Vicki Busse) Chris Gordon — Term to expire July 2022 (to fill the unexpired term of Sandi DiCaro) Patti Galuski — Term to expire November 2024 (to fill the unexpired term of Maura Drew) 3 Mayor Hoefert stated he met with all prospective members and is confident each will serve the commission well. Motion by Peggy Pissarreck, second by Richard Rogers to ratify the subject appointments to the Special Events Commission. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD Steve Polit 601 N. Wilshire • In response to comments made during the January 25, 2022 Committee of the Whole discussion regarding the Community Engagement Committee, Mr. Polit read aloud an email (obtained via a Freedom of Information request) from Community Engagement Committee staff liaison Julie Kane to committee members, pausing the committee upon the suggestion by the committee co-chair and a majority of the members. Mr. Polit stated he hopes this clarifies confusion regarding the committee's status. Trustee Pissarreck responded, stating confusion arose from the member's understanding that the committee was placed on temporary pause versus statements suggesting the committee's status is permanently inactive. Ronak McFadden Mount Prospect resident • Appreciates virtual meetings in the interest of public safety • As a member of the Community Engagement committee, was not aware the committee was placed on permanent pause Carole Martz Berkshire Lane • Reason restaurants are not doing well is directly related to the pandemic; diners lack trust in restaurants; many are not following Cook County vaccination mandates. Mayor Hoefert responded, stating he has experienced many restaurants that are doing very well. Mayor Hoefert added the vaccination mandate is a County mandate and thus, it is the responsibility of the County to enforce it. 6. NEW BUSINESS 8.1 1st reading of AN ORDINANCE AMENDING CHAPTER 21 OF THE VILLAGE CODE OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS, ADOPTING THE 2021 INTERNATIONAL BUILDING CODE, 2021 INTERNATIONAL MECHANICAL CODE, 2021 INTERNATIONAL RESIDENTIAL CODE, 2020 NATIONAL ELECTRICAL CODE, 2021 INTERNATIONAL FUEL GAS CODE, 2021 INTERNATIONAL PROPERTY MAINTENANCE CODE, WITH MODIFICATIONS, AND OTHER CONSTRUCTION -RELATED PROVISIONS Director of Building and Inspections Bill Schroeder provided information regarding the proposed Building Code updates. Mr. Schroeder stated the review, update and adoption of the building code was identified as a goal for the Building and Inspections Services staff to complete as part of the Strategic Plan for the Village. As part of his presentation, Mr. Schroeder provided a background of services the department provides including the review and issuance of building permits, building inspections, code enforcement and restaurant inspections. With the implementation of permitting software, Mr. Schroeder noted many of these services are now done electronically, improving service and supporting sustainably efforts by reducing paper records. Mr. Schroeder stated the Village currently adherers to a set of standardized construction codes with local amendments based on the International Code Council (ICC) and National Fire Protection Association (NFPA). Building codes are established to protect the public as it relates to construction and property maintenance standards. The ICC and the NFPA codes are typically updated every three years. The Village of Mount Prospect usually updates codes every six years. Mr. Schroeder presented information on the following codes recommended for adoption: 2021 International Building Code (IBC) with local amendments - regulates commercial, industrial and multi-level/mixed use and multi -family dwellings 2021 International Residential Code (IRC) with local amendments - regulates attached and detached single-family homes • 2021 International Mechanical Code (IMC) - related to commercial codes 2021 International Fuel Gas Code (IFGC) - related to commercial codes 2021 International Property Maintenance Code (IPMC) with local amendments - code enforcement including tall grass/weeds, hoarding, deteriorated structures, etc. • 2020 National Electric Code with local amendments The Illinois State Plumbing code and the Illinois Energy Conservation Codes are mandated by state statutes and are not being amended with this update. Mr. Schroeder presented the proposed amended Code highlights: • Enhanced energy storage systems/batteries/solar systems codes 5 • Smoke control systems • Amusement buildings, puzzle rooms - enhanced egress standards • Types of construction - Heavy timber was subdivided to include additional timber classifications • Fire protection enhancements • Door widths, lock changes, stairway updates - adjustments and improvements to protect against severe weather events, changes etc. • Enhanced standards to wall bracings / emergency escape window public way access • Deck designs/guardrails/tributary loads - base reference for manufacturers Surge protection on electric panels - enhances safety and protection Mr. Schroeder indicated several benefits of codes and updates including standards for safe -housing, consistent codes for construction industry and insurance companies and standards for life and safety codes. Mr. Schroeder provided the following in response to questions from the Board: • Code updates do not have any significant impact on staffing levels, workload or training; department adjustments and training are on-going. The Board commended Mr. Schroeder and his staff for their outstanding service to the community. Public Comment Steve Polit 601 N. Wilshire • Asked if the Village assists homeowners with dead tree removals Mr. Schroeder responded, stating tree removal is the cost of home -ownership; the Village does not offer any subsidies to relieve this cost; staff works with residents as much as possible There was no further discussion. Motion by Peggy Pissarreck, second by Richard Rogers to waive the rule requiring two readings of an ordinance Yea: Agostino Filippone, Terri Gens, John Matuszak, Peggy Pissarreck, Colleen Saccotelli, Richard Rogers Nay: None Resolution: Motion Passed Motion by Richard Rogers, second by Colleen Saccotelli to approve the subject ordinance Yea: Agostino Filippone, Terri Gens, John Matuszak, Peggy Pissarreck, Colleen Saccotelli, Richard Rogers Nay: None Final Resolution: Motion Passed Ordinance No. 6607 8.2 1st reading of AN ORDINANCE AMENDING CHAPTER 24 OF THE VILLAGE CODE OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS, ADOPTING THE 2021 INTERNATIONAL FIRE CODE, WITH MODIFICATIONS, AND OTHER FIRE -PREVENTION -RELATED PROVISIONS Assistant Fire Chief of Administration Bryan Loomis presented amendments to Chapter 24 of the Village Code that adopts the 2021 International Fire Code (fire prevention) and the 2015 Life Safety Code (life -safety issues). Assistant Chief Loomis stated the proposed updates include the removal of code sections in the Village Code that are no longer supported by the National Fire Protection Association and the International Fire Code. Other proposed amendments include moving Fireworks permit and Usage from Chapter 23 to Chapter 24, updated requirements for Fluorine Free Foam for Petroleum Storage Facilities (Fluorine foam use to be eliminated by 2024) and clarifications to fire pit and fire ring definition updates to include gas fire pits and ring location requirements. Assistant Chief Loomis reported additional updates to Chapter 24 including_ • Fire sprinkler cost saving measures for single-family homes by reducing the number of sprinkler heads located in garages from two (2) to one (1) for 13D systems and allows inspectors to locate the bells within the house and cost saving measures for NFPA 13 Commercial Fire sprinkler systems • Fire alarm monitoring updates and reporting responsibilities • Fire alarm requirements for Business and Mercantile occupancies resulting in cost savings for small businesses Assistant Chief Loomis recognized and thanked his staff for assisting with the proposed code updates. Assistant Chief Loomis provided the following in response to questions from the Board: • Fire department staff is in the process of being trained on the updates; staff is expected to be fully trained by the end of the year • Enforcement of actions relating to fireworks will be remain in Chapter 23 • Cost-saving amendments will provide the same level of safety for residents and occupants • Staff will produce public service announcements and videos to relay information regarding updates and changes to the code and well as an informative video explaining what to expect during a fire inspection. Business Center Drive to 2060 Carboy Road. Play Ball, USA also operates a player development academy at 604 W. Central Road which will remain in operation. The new location will offer similar elements to the existing location. Mr. Cooney stated the proposal meets the Village parking requirements with the exception of handicap stalls. The property owner will install one additional handicap stall to meet Village requirements. VA Mr. Cooney stated the Planning and Zoning Commission recommended approval of the request by a vote of 5-0. Petitioner and owner of Playball USA Ross Wolfson was present to answer questions. Mr. Wolfson stated Playball USA teaches baseball and softball skills for kids ages 8-18 while focusing on team comradery. Mr. Wolfson stated Playball USA is staffed with students from Mount Prospect. The Board expressed support of the petitioner's request and thanked Mr. Wolfson for choosing to keep his business in Mount Prospect. There was no further discussion. Yea: Agostino Filippone, Terri Gens, John Matuszak, Peggy Pissarreck, Colleen Saccotelli, Richard Rogers Nay: None Final Resolution: Motion Passed Ordinance No. 6609 9 VILLAGE MANAGER'S REPORT 9.1 Motion to accept joint purchasing bid results (Sourcewell contract #080818 -VCM) and authorize the purchase two (2) 8 yard dump bodies, two (2) 1 ton dump bodies, two (2) F -550 hydraulic systems, one (1) salt spreader, and associated components from the Lindco Equipment Division of Viking-Cives Group, Merrillville, Indiana, at a cost not to exceed $90,512.00 Director of Public Works Sean Dorsey presented a proposal to purchase two (2) 8 yard dump bodies, two (2) 1 ton dump bodies, two (2) F-550 hydraulic systems, one (1) salt spreader and ap§ociated components to build -out four new dump trucks purchased earlier this year. Delivery time for these previously approved vehicles is approximately 18 months. Mr. Dorsey stated all components will be purchased from one vendor, Lindco Equipment. The Village has purchased similar items from Lindco in the past. Lindco offers quality products and the proposed components will be consistent with existing equipment. Mr. Dorsey stated the components are available through a Sourcewell joint purchasing contract with Lindco. Because the Village is a member of Sourcewell, the contract satisfies the Village's public bidding requirements. In response to a question from the Board, Mr. Dorsey stated the components will be delivered to Public Works and vehicle maintenance staff will install all equipment. Mr. Dorsey stated these components will likely be delivered before the chassis and cabs. No further discussion. Motion by Colleen Saccotelli, second by Richard Rogers to approve as presented.
