REQUEST FOR NEW "CLASS S" LIQUOR LICENSE
On July 25, 2007 and again on Wednesday October 24, 2007 the Village Manager met with Mr.
Krzysztof Miscierewicz and his daughter Agniezka Wheeler to discuss their application for a
"Class S" liquor license in conjunction with the new restaurant operation proposed at the above
address. The "Class S" designation provides for a restaurant with lounge involving full service
alcohol. Mr. Miscierewicz purchased the building at 139-143 W. Prospect Avenue in 2005. He is
planning to open a European style cafe in the portion of the building that formerly housed
Adam's Upholstery Shop. Mr. Miscierewicz is an immigrant of Poland where he operated a
restaurant. Since being in the United Stated he has operated a construction company with the
goal of raising enough money to open a restaurant here. His daughter will help manage the
establishment on a day to day basis.
The applicant has submitted plans for the interior build out of the premises. A demolition permit
has been issued. The cafe will have approximately twelve to fifteen tables and a small bar area.
Due to the lack of on-site parking, Mr. Miscierewicz sought to enter into an agreement with the
Village of Mount Prospect for an off-site parking lease. Under the agreement Mr. Miscierewicz
would lease fifteen spaces in the Village's Wille Street lot at an annual rent of $1350.00. By
code, the Planning and Zoning Commission is final on the approval of parking agreements. On
September 27, 2007 the Planning and Zoning Commission approved the lease agreement with
the following conditions:
A. Lessee shall use said Premises for the parking of motor vehicles for Lessee's
patrons and/or employees in connection with Lessee's cafe business at 143
Prospect in Mount Prospect, Illinois.
B. Between the hours of 5:00 p.m. and 10:00 p.m., Lessee shall use valet attendant(s),
and utilize placard signage in order to direct patrons arriving via motor vehicles
toward the valet attendant(s), to use Lessee's best efforts to facilitate said patrons
parking in the subject parking spaces (the leased Premises) in either the Pine Street
and/or the Wille Street parking lots.
C. Lessee shall not stay open for business to patrons later than 10:00 p.m.
D. Lessee's employees shall park in the Wille Street parking lot.
Beyond the conditions listed, patron parking is available along Prospect Avenue within the
existing time restrictions.

A number of residents along Wille Street appeared at the Planning and Zoning meeting to
express concerns about patron and employee parking in the adjoining residential neighborhood.
The conditions imposed in the lease were designed to address those concerns.
It is my recommendation to the Liquor Commissioner that the conditions contained within the
lease agreement be made conditions of the liquor license. That way, if there are any violations
or other concerns regarding parking associated with this establishment the Liquor
Commissioner can act in a more timely fashion than would be required by way of a hearing
before the Planning and Zoning Commission.
The Village Manager discussed with the applicants the requirements of the Village's Liquor
Code including the need to be mindful of sales to minors as well as obviously intoxicated
persons. The requirements of the Village's Fight Ordinance were also discussed. The Village
Manager also emphasized the need for appropriate controls to be in place to insure that
restaurant employees do not inadvertently violate code requirements. Mr. Miscierewicz
indicated they understood their obligations in this regard.
Both Mr. Miscierewicz and his daughter submitted proof that they have successfully completed
a certified liquor server's course. They also provided proof of legal alien status. A completed
application along with all fees and paperwork are on file with the Village Manager's office. Both
applicants have submitted to fingerprinting and background checks. Should the Village Board
consider this application favorably the adoption of an Ordinance creating a "Class S" liquor
license with the above referenced conditions would be in order.

AN ORDINANCE AMENDING CHAPTER 13 OF THE
VILLAGE CODE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT
PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS:
SECTION ONE: That in accordance with Subsection A of Section 13.108 of Chapter 13 of the Village Code of
Mount Prospect, as amended, the Corporate Authorities shall determine the number of Liquor Licenses
available in each Classification and shall establish a list specifying the number of Liquor Licenses authorized.
Said list is hereby amended by increasing the number of Class liS" Liquor Licenses by One (1) (Cafe
Boulevard at 143 W. Prospect Avenue) Said list is as follows:
