Mayor Farley noted that the total amount of the proposed budget was $45,321,300.00. There was discussion relative to the Governor's announcement that the surcharge tax allocated for local governmental bodies will probably be discontinued. This could present a financial hardship on many communities, however, Mount Prospect has developed a contingency plan if the surcharge tax is not received from the State. Frank Vlazny, 2103 Jody Court, asked the Village to limit the levy being requested by the Mount Prospect Public Library to the maximum amount approved by the voters in the last referendum. Mr. Vlazny-also expressed concern that the amount of sales tax received by the Village appears to be -lower than budgeted. Trustee Corcoran stated that while the original budget included $50,000 for 'new technology', which had been eliminated due to the possible loss of the surcharge tax, the Village Board would be able to authorize funds for this purpose if the need arises. Mr. Sindhu, who is coordinating the modeling efforts at the Holiday Inn has been and will continue to be a 49% ownership partner with Ampak Beverage. They are bringing in a new liquor manager, Mr. Bokhari, and he will be receiving 51% ownership of the Ampak Beverage Corporation. Because of the change in the major shareholder of the Corporation, this information is before you. Mr. Bokhari has been fingerprinted by the Police Department and has had some past experience as Food and Beverage Manager at this same Holiday Inn in 1988 and then went on to a Hampton Inn in Schiffer Park before coming back to this facility at the request of Mr. Sindhu. Mr. Bokhari has not had a Liquor License in his name in the past although he had been involved with purchasing of liquor for motel operations in the past. He has not personally been involved with a sale at a bar or any restaurant setting. He just oversaw those operations. They will change ownership effective June 30, 1992. ON JOHN FIJL,TODI JFD/rcc VILLAGE OF MOUNT PRQSPECT COOK COLM. Both of them have had experience as waitresses in Korean restaurants in the past and both of them have, in fact, worked at Shin Jung which is on Golf Road in Mount Prospect. They wish to open up a Korean barbecue restaurant where there will be seating for approximately 42 people and will have the cooking by barbecue at each of the tables. They anticipate being open from 10:30 a.m. to 11:00 p.m. each night. Ms. Yi has four years' experience and Ms. Chong has eight years of experience and they anticipate opening at the end of May or early June. Both of them have worked short periods of time behind a bar but have never had a Liquor License in their name before. I encouraged both of them to attend a mixology school which they have already indicated they were looking into and they anticipate having that completed prior to their opening. They are in the process of being fingerprinted and going through all of the State requirements before opening. The establishment will be primarily a restaurant with liquor to be incidental service. They will be present Tuesday evening to answer any questions the Board may have. DIXON, VE MANAGER FROM: DAVID M. CLEMENTS. IRECTOR OF PLANNING AND ZONING DATE: APRIL 29, 1992 SUBJECT: ZBA-17-V-92, BURTON V. DUBOE LOCATION: 1500-1522 NORTH ELMHURST ROAD The Zoning Board of Appeals transmits for your consideration their recommendation for a variance application filed by Burton V. DuBoe. The applicant is requesting a variation to Section 14.3012 to allow a reduction in the required parking spaces from 116 to 70 to allow a Class III restaurant to occupy the building. The Zoning Board of Appeals considered the request at their meeting of April 23, 1992. At the meeting, Burton DuBoe, explained the variation was necessary to allow a Lou Malnati Pizza take-out and delivery restaurant to occupy a space in the Center. He indicated that this space is available because of the reduction in space by a Chinese restaurant which is currently a tenant in the Center. He also indicated that several traffic counts were taken during various times of the day and sufficient parking appears available to justify the variation. Ray Forsythe, Planner, stated that if this Center was over 30,00 square feet, the parking requirement would be 77. However, with a smaller Center, such as this, the parking rate is calculated for each individual user. Including the proposed restaurant, 116 spaces are required for this property. He also indicated that there is a variety of users in the Center and many close between 5:00 and 7:00 p.m. The restaurant would generally cater to evening and weekend patrons and staff felt that there would be adequate parking available. The Zoning Board generally discussed the request. By a vote of 6-0, the Zoning Board recommends approval of the variance request. ir7 ! t€ u #. ZONING BOARD OF APPEALS ZBA CASE NO. 17-V-92 Hearing Date: April 23, 1992 PETITIONER: Burton V. DuBoe SUBJECT PROPERTY: 1500-1522 North Elmhurst Road PUBLICATION DATE: April 7, 1992 REQUEST: The petitioner is seeking a variation to Section 14.3012 of the Village of Mount Prospect Zoning Ordinance to allow a reduction in the required parking spaces from 116 to 70 to allow a Class III restaurant to occupy the building. ZBA MEMBERS PRESENT: Gilbert Basnik, Chairman Robert Brettrager Ronald Cassidy Peter Lannon Dennis Saviano Michaele Skowron ABSENT: Richard Pratt OBJECTORS/INTERESTED PARTIES: None Chairman Basnik introduced this agenda item as being a request for variation to allow the reduction of required parking spaces for a shopping center from 116 spaces to 70, to allow a Class III restaurant to occupy the shopping center. Mr. Burton DuBoe introduced himself to the Zoning Board and stated that he is one of the owners of the property at 1500 North Elmhurst Road, and that he is currently working on a lease for 1,000 square feet of vacant space for a Lou MaInati's Carry Out and Delivery Pizza business. Mr. DuBoe explained that this vacant space was formerly occupied by the Chinese restaurant who had reduced their total area, and demonstrated that this space had been used by a restaurant previously. Mr. DuBoe explained that, while the Class III restaurant has a higher parking requirement than the former sit-down Chinese restaurant, he believed that the nature of the carry -out business would create less of a parking demand at the shopping center. Mr. DuBoe explained that he had undertaken seven parking space inventories at the shopping center and that these parking counts indicated that the maximum number of cars at the property was 46. He explained that the total capacity of the lot is 70 and with this maximum count of 46, helped indicate that there was a sufficient surplus of parking available to accommodate the carry -out restaurant. ZBA-17-V-92 April 23, 1992 Page 2 Mr. Ray Forsythe then summarized the staff report for the Zoning Board of Appeals. Mr. Forsythe described the parking requirements for a carry -out restaurant and stated that this is at a rate of 15 spaces per 1,000 square feet. Mr. Forsythe stated that the Zoning Ordinance for a small shopping center such as this requires that parking be calculated as a total requirement for all the individual uses. Mr. Forsythe then explained that, including the carry -out pizza business, the total required spaces for the shopping center was 116, and that there are 70 spaces available. Mr. Forsythe explained that there are a number of restaurants and service and retailuses in the center and each with varying hours of operation. He believed that many of the uses closed between 5:00 and 7:00 p.m. and that there is a sufficient amount of parking available in the evening hours which would be the high demand time for the carry -out pizza business. He stated that staff believes that due to the current mix of uses in the center, there is adequate parking available at peak times to accommodate the proposed use. Chairman Basnik asked if there was any person in the audience to speak in reference to this request. There was no one to speak in favor or in opposition to the variation. Mr. Ron Cassidy asked if there would be any seating in the restaurant and Mr. DuBoe emphasized that this would be take-out and delivery pizza only. He stated that there was such a small space, there would be.no potential for seating. Mr. Cassidy had stated that he has observed that the parking lot can be congested, particularly in the summer, during the evening hours with Baskin and Robbins, but he could support the request if there was no seating in the restaurant. Mr. Mark Malnati introduced himself to the Zoning Board of Appeals and described his operation and the number of units that the company currently has. He explained that this facility would be carry -out only and that there would usually be three cars for delivery, but the delivery operation would be from the back of the store and the delivery cars would be parked behind the building. Mrs. Skowron questioned Mr. DuBoe on the days of the week and the timesof day for the seven parking counts. Mr. DuBoe explained that he had done his parking counts on Saturday afternoons and Friday evenings, Thursday afternoons and a Monday morning; and that from his experience, these would be peak times for the center. He again indicated that 46 spaces was the most cars ever at the property. Mr. DuBoe stated that he believed prime time for parking demand at this center is really lunch time considering the number of restaurants, and that in the evening hours some of the users are closed, which allows more parking availability for those restaurants that maintain evening hours. Mr. Saviano asked if the Magic Dragon provided a carry -out restaurant and Mr. DuBoe stated that it did Mrs. Skowron questioned the hours of the pizza operation and Mr. DuBoe and Mr. Malnati stated that the hours would be from 4:00 to 10:00 p.m. Monday through Thursday, and 11:00 to 11:00 Friday through Sunday. ZBA-17-V-92 April 23, 1992 Page 3 Chairman Basnik asked if there was any additional space vacant in the shopping center and Mr. DuBoe stated there is presently 1,000 square feet vacant and another lease that is due to expire soon. Mr. Basnik then asked Mr. Forsythe for the definition of a Class III restaurant and Mr. Forsythe responded by reading the definition from the Zoning Ordinance. The Zoning Board of Appeals generally discussed the request and there was consensus that the proposed carry -out restaurant would not contribute to a parking problem at this property during peak demand times. This consensus was based on the parking counts provided by the petitioner that demonstrated, that in several instances there were no more than 46 spaces occupied out of the 70 in the center; and that this type of space availability could easily absorb the type of operation and parking that a carry -out restaurant would require. There being no further discussion, Chairman Basnik asked for motion on the request. Mr. Saviano moved that the Zoning Board of Appeals recommend approval of the variation to reduce the required number of parking spaces at 1500 North Elmhurst Road from 116 to 70 to allow a Class III Restaurant. The motion was seconded by Mr. Brettrager. Upon Roll Call: AYES: Lannon, Saviano, Cassidy, Brettrager, Skowron and Basnik NAYS: None Motion carried by a vote of 6-0. This recommendation will be forwarded to the Village Board for their consideration. Respectfully Submitted, David M. Clements, Director of Planning VILLAGE OF MOUNT PROSPECT PLANNING AND ZONING DEPARTMENT Mount Prospect, Illinois TO: MOUNT PROSPECT ZONING BOARD OF APPEALS GIL BASNIK, CHAIRMAN FROM: DAVID M. CLEMENTS, DIRECTOR OF PLANNING AND ZONING DATE: APRIL 14, 1992 CASE NO.: ZBA-17-V-92 APPLICANT: BURTON V. DUBOE ADDRESS: 1500-1522 NORTH ELMHURST ROAD LOCATION MAP: IWITWL U, 911 PROPERTY DESCRIPTION: ZONING: LOT SIZE: % COVERAGE: F.A.R.: B-3 Business Retail & Service 60,885 sq. ft. 93.06% .26 Gil Basnik, Chairman Mount Prospect Zoning Board of Appeals Page 2 The petitioner is seeking a variation to Section 14.3012 of the Village of Mount Prospect Zoning Ordinance to allow a reduction in the required parking spaces from 116 to 70 to allow a Class III restaurant to occupy the building. Summary of application: The petitioners are seeking the variations to allow a Lou Malnati Carry -out Pizza to occupy the vacant 1,200 square foot space in the Center located at the southwest intersection of Elmhurst and Camp McDonald Roads. The variation is needed because of the amount of parking available at the site does not meet the requirements of a shopping center with a total of three restaurants. The applicant has indicated that presently there is no parking problem at the Center. Impact on Surrounding Properties: The subject property was included in the Consent Decree for the Old Orchard Country Club. The three remaining intersections of Elmhurst and Camp McDonald Roads are also commercially zoned areas in the Village of Prospect I-1-`ehts. To the west of the subject site is the Country Club and to the south is a Mount Prospect water tower. Staff would like to note that because the Center is under 30,000 square feet, each commercial use must be analyzed to determine the number of parking spaces required, while a larger center is calculated at 4.5 spaces per 1,000 square feet. If this formula was used for this 17,100 square foot Center, a total number of spaces needed would be 77. There are currently a variety of restaurants, services and retail uses in the Center, each with varying hours of operation. The hours range from 24 hours for the 7-11 Store to 9:00 - 11:00 a.m. Tuesday and Friday or by reservation for the "Fun Station." Many of the uses close between 5:00 p.m. and 7:00 p.m. Monday through Friday and 5:00 p.m. on Saturday, with the exception of the other restaurants which generally cater to their patrons in the evening hours. Staff believes that due to the current mix of users in this Center, there should be adequate parking available for the peak time of the carry -out pizza which would generally be during the evening hours and weekends. 1:1311141"31, ^ a' There were no objections or concerns raised by other departments. Staff has no objection to the proposed variation, however, would suggest to the petitioner that the he be prepared to discuss the proposed hours of the carry -out restaurant as well as the maximum number of employees on the largest shift. Staff also asked the petitioner to conduct a parking survey at peak demand times to demonstrate that there are sufficient vacant spaces for existing users to justify the variation. Also, because there is no street parking available or any off-site parking nearby, staff would encourage the petitioner to be careful in the future as to the type of tenant any fixture space is marketed to. Any user who requires a large amount of traffic could cause a problem with this Center. DMC:hg VILLAGE OF MOUNT PROSPECT PLANNING AND ZONING DEPARTMENT Mount Prospect, Illinois TO: JOHN F. DIXON, VILLAGE MANAGER FROM: DAVID M. CLEMENTS, DIRECTOR OF PLANNING AND ZONING DATE: APRIL 29, 1992 SUBJECT: ZBA-19-V-92, ZBA-20-SU-92, JAMES MALAPANES LOCATION: 1230 SOUTH PRAIRIE AVENUE The Zoning Board of Appeals transmits for your consideration their recommendation for a variance and Special Use Permit application filed by James Malapanes. The applicant is seeking a variation of Section 14.115.0 to allow driveways 31 feet wide and a Special Use Permit under Section 14.1101.C.8 to allow three -car garages on two lots. The Zoning Board of Appeals considered the request at their meeting of April 23, 1992. At the meeting James Malapanes, Jr., representing the petitioner, indicated that they purchased a large lot and are in the process of subdividing it into two lots. He indicated that his parents would be building one house and they were building the other house for sale. They would like to be able to offer three -car garages and the subsequent larger driveways. He noted that the site plan was a potential scenario and they would be constructing smaller homes. Ray Forsythe, Planner, indicated that this area of Mount Prospect is undergoing a change from "R -X" to "R-1" zoning and many new homes have been built. He also noted that three - car garages are a common request in new construction especially in expensive custom homes. The garages are proposed to face the interior of the lot to reduce the impact of the doors. The Zoning Board of Appeals generally discussed the request. By a vote of 6-0, the Zoning Board recommends approval of the variation and Special Use Permit, with the following conditions: - The driveways be 21 feet at the property line; and - The garages face the interior of the lots as indicated on the site plan. Gilbert Basnik, Chairman Robert Brettrager Ronald Cassidy Peter Lannon Dennis Saviano Michaele Skowron ABSENT: Richard Pratt OBJECTORS/INTERESTED PARTIES: None Chairman Basnik introduced the next agenda item as being a request for a variation to allow a 31 foot driveway instead of a maximum of 21 feet, and a special use permit to allow a garage designed to house more than two motor vehicles. Mr. James Malapanes introduced himself to the Zoning Board and stated that he and his father had recently purchased this property and it was their intent to subdivide the parcel to two lots and build two large semi -custom made homes. He explained that with upper bracket homes, as proposed, there was a demand for three -car garages and the special use request was filed to allow the construction of the three -car garages with these two homes. Mr. Malapanes noted that the 31 foot driveway width is necessary to provide access to the proposed garages. Mr. Forsythe then summarized the staff report for the Zoning Board of Appeals. Mr. Forsythe noted that this request for a subdivision is currently being processed by the Plan ZBA-19-V-92, ZBA-20-SU-92 April 23, 1992 Page 2 Commission and that the zoning request was filed to review the :matter of the three -car garages on the driveway variation. Mr. Forsythe described the proposed lot sizes as approximately 10,000 square feet with a zoning of an R-1 Single Family District. He stated that the petitioner would like to build two custom homes and offer three -car garages as an amenity to potential buyers, and that the driveway is necessary to serve the garage at the widest point. Mr. Forsythe stated that the petitioner had submitted a site plan that depicts a large home with a three -car garage and 31 foot driveway that could be constructed on these lots. Mr. Forsythe stated that staff had reviewed these proposed plans and that the plan demonstrates that three -car garage could be constructed on these lots and not result in the need for any additional variations. Mr. Forsythe concluded by saying that this is an area that is undergoing a change from large lots (R -X); to R-1 zoning and that many new homes in this area had been constructed with three -car garages, and that such a feature would not significantly impact surrounding properties. He also noted that the garages are proposed to face the interior of the lot and that the garages would not face the street, so this would reduce the impact of the three garage doors from the public streets. Mr. Cassidy stated he was reluctant to offer a blank approval without knowing a specific plan. Mr. Basnik made reference to the letter submitted by the petitioner stating that they would request no further variations with the proposed construction. Mrs. Skowron indicated some concerns with the site plan and stated that the site plan was designed to a maximum building size on the lot, and that this would leave no land available for such items as sheds or above -ground swimming pools should an owner desire those types of items. Mrs. Skowron stated she was concerned about the plan that it did not allow any flexibility for buyers of these homes. Mr. Malapanes explained that the site sketch was submitted only to depict that a typical large home with a three -car garage and related driveway can be constructed and that this was not meant to be a final plan. Mr. Clements stated that this request did not involve a specific site plan approval but only a special use for a three car garage and driveway variation. Mr. Clements stated that staff had requested that the site plan be submitted so the Zoning Board could see that the proposed construction could be accomplished on the specific lot size. Mr. Lannon stated that the Zoning Board had done other similar, approvals and that the approval for these two lots would not be contrary to other Zoning Board decisions or impact the neighborhood. He believed it was reasonable to allow the amenity of a three -car garage to be approved before a specific buyer was interested in the lot or the home. He suggested that there be a condition, however, that the garages be a side load garage and not directly face the street. Mr. Malapanes had no objection to this condition. ZBA-19-V-92, ZBA-20-SU-92 April 23, 1992 Page 3 There being no further discussion, Chairman Basnik asked for a motion on the variation request for a 31 foot driveway. Mr. Brettrager moved that the Zoning Board of Appeals recommend approval of a 31 foot driveway with a condition that the drive be tapered to 21 feet at the street. The motion was seconded by Mr. Lannon. Upon Roll Call: AYES: Lannon, Saviano, Cassidy, Brettrager, Skowron and Basnik NAYS: None Motion carried by a vote of 6-0. Also, the petitioner is seeking a Special Use Permit under Section 14.1101.C.8 to allow a garage designed to house more than 2 vehicles. Summary of application: The petitioner purchased a home on a lot which consists of 24,957.29 square feet. The petitioner demolished the existing structure and is now in the process of subdividing the property into two lots with approximately 9,986.39 square feet each. The property is zoned "R -l" Single Family Residence. The petitioner is proposing to build custom built homes on the two lots and would like to offer three -car garages to the potential buyers. The driveways to service the three -car garages are shown at 21 feet wide at the property line, and as the driveway turns to face the garages it expands to 31 feet at its widest point. The petitioner has indicated that the site plan is a possible scenario and not necessarily the exact dimensions of the structure that will be built. Staff has no objection to this and would note that this is a "worst case- scenario. The lot coverage and floor area ratio are at the maximums allowed and the petitioner has submitted a letter to indicate that they will not request additional variations to lot coverage or floor area ratio. Staff would remind the petitioner that should the homes be built as indicated, no further structures or lot coverage would be allowed. This also pertains to decks or patios for the homes. Impact on Surrounding Properties: This area of Mount Prospect is undergoing a change from "R -X" to "R -l" zoning and there have been many new homes constructed in the area. The proposed lots exceed the "R-1" single family standards, and the three -car garages Will not significantly impact the surrounding area. The garages are proposed to face the interior of the lot and not the street which will soften the impact of the large garage doors. No major objections or concerns have been raised by other staff members. Staff has no objections or concerns to this request. Three -car garages are a common request in new construction especially in expensive custom homes. Staff would also note that the applicant has indicated that the proposed site plan only indicates the idea of a three -car garage and wider driveway, and documentation has been submitted indicating no further variation will be requested. The applicant is seeking a Special Use Permit under Section 14.1101.C.8 to allow a tandem four -car garage. The Zoning Board of Appeals considered the request at their meeting of April 23, 1992. At the meeting Lennard Jendal explained that the garage is needed to store antique cars and parts. He explained that this was a hobby of his and no type of business was to be run out of the garage. He also explained that there is a large amount of mature landscaping to the rear and side of the property which will screen the garage from the neighbors. Ray Forsythe, Planner, stated that the garage was an extension of the existing garage. No additional overhead doors or driveway is to be added. He also indicated that the size of the lot and amount of landscaping around the site would be adequate to screen the neighbors. The Zoning Board of Appeals generally discussed the request. Mr. Lennard Jendal introduced himself to the Zoning Board of Appeals and explained that he would like to construct an addition to an existing two -car garage. He noted that he would like to add the equivalent of a two -car garage at the rear of the existing garage. The proposed garage would be of the same dimensions, it would have the same siding and roof as the existing structure, and there is existing mature landscaping to screen the garage from surrounding property owners. Mr. Jendal stated that he would like to construct the additional garage space in order to provide storage area for two antique automobiles. He stated that with this additional garage space, he could store his antique cars and provide garage parking for the family automobiles. Mr. Forsythe then summarized the request for the Zoning Board of Appeals and stated the petitioner is proposing to construct a tandem two -car garage being an addition to an existing garage. The proposed addition is 484 square feet and the total garage area will be 968 square feet. The garage would be behind the existing structure and the driveway would remain the same. There would be no changes in the driveway location to service the new garage addition. Mr. Forsythe also indicated that lot coverage was within Ordinance requirements. ZBA-21-SU-92 April 23, 1992 Page 2 Lastly, Mr. Forsythe pointed out that there is a significant amount of mature landscaping to the west and south that would screen the garage from adjoining properties, and this should contribute to the garage having no significant impact on neighboring properties. No one appeared to speak in favor of, or in opposition to the request. Chairman Basnik asked for comments on the application and Mr. Brettrager pointed out his only concern was that the potential of a home occupation or prohibited storage from being conducted in this large garage. Mr. Jendal stated that the restoration of the antique cars was his hobby and that sometimes there are related parts stored with those cars, but that in no way would he be operating an automobile repair business from the structure. The Zoning Board discussed this matter and it was determined that there are other home occupation provisions in the Zoning Ordinance that would regulate this type of activity. The Zoning Board of Appeals generally discussed the request and it was noted that the proposed overall garage size of 22' x 44' was extremely large but that the petitioner has a lot of over 10,000 square feet, and that the lot coverage was within Ordinance standard of only 33%. There being no further discussion, Chairman Basnik asked for a motion on the request. Mr. Lannon moved that the Zoning Board of Appeals recommend approval of a Special Use to allow a garage designed to house more than two motor vehicles at 102 Hatlen Avenue, with a condition that this be a tandem garage with the addition constructed directly behind the existing garage and that the addition be done with the same siding and roofing materials as the existing garage. The Zoning Board of Appeals considered the request at their meeting of April 23, 1992. At the meeting, James Handschiegel, the petitioner, explained that the driveway was needed to add additional parking as well as reduce the potential of accidents when backing out of their garage. Ray Forsythe, Planner, stated that staff was uncomfortable with such a large lot coverage request. He noted that Lama Lane was not a collector or arterial street and that there are no similar circular drives in the area. Mr. Forsythe also indicated that the petitioner could add a parking pad or widen the driveway and increase the number of parking spaces, without such a large lot coverage variation. The Zoning Board of Appeals generally discussed the request. By a vote of 0-6, the Zoning Board recommends denial of the variance. DMC:hg 1 MINUTES OF THE REGULAR MEETING OF THE MOUNT PROSPECT ZONING BOARD OF APPEALS ZBA CASE NO. 22-V-92 Hearing Date: April 23, 1992 PETITIONER: James M. Handschiegel SUBJECT PROPERTY: 1308 North Lama Lane PUBLICATION DATE: April 7, 1992 REQUEST: The petitioners are seeking a variation to the Mount Prospect Zoning Ordinance Section 14.3016.A.1 to allow a circular driveway; also a variation to Section 14.1102.A to allow 48% of the front yard to be covered with impervious surface instead of the allowed 35%. ZBA MEMBERS PRESENT: Gilbert Basnik, Chairman Robert Brettrager Ronald Cassidy Peter Lannon Dennis Saviano Michaele Skowron ABSENT: Richard Pratt OBJECTORS/INTERESTED PARTIES: None Chairman Basnik then introduced the next case as being a request to allow a circular driveway at 1308 Lama Lane with a 48% front yard coverage rather than 35%. Mr. James Handschiegel stated that he was proposing to construct a circular drive from his property to allow safer exiting onto the street from the driveway and garage. He stated that there is a safety concern with the existing driveway and the grade change from the street to the garage, and he believed that the circular driveway would be more attractive for the front of the house rather than just merely constructing a turn -around. Mr. Forsythe then summarized the staff report for the Zoning Board of Appeals and stated that the request was filed to allow a circular driveway with a 48% front yard coverage rather than 35%. Mr Forsythe stated that the petitioner indicated that the grade of the driveway to the street, and the number of children in the area, makes a circular driveway safer for drivers in the family and pedestrians an the sidewalk. However, Mr. Forsythe stated that staff was concerned with the designof this circular driveway, as well as with the amount of lot coverage that was requested. He pointed out that there were no other circular driveways in the immediate area along Lama Lane and that typically the Zoning Board loops favorably on circular driveways on neighborhood collector streets or arterial streets. He pointed out that Lama Lane is a residential street. ZBA•22-V-92 April 23, 1992 Page 2' Also Mr. Forsythestated that the Engineering Division had some questions about the radius of the driveway. They questioned whether the drive is adequate for turning movements for vehicles. Mr. Forsythe stated that he would encourage the petitioner to consider alternatives such as a turn -around apron rather than a circular drive, and indicated that with the high percent of lot coverage requested, the staff would prefer to see the turn -around rather than a circular driveway, and accordingly, staff would recommend that the circular driveway request and the lot coverage variation be denied. Mr. Lannon stated that he had a concern with the proposed radius and felt like this radius on a"65 foot lot may not be sufficient for maneuvering. Mr. Basnik questioned the dimension of the circular driveway and Mr. Handschiegel stated that this was a 9 foot drive. Mr. Handschiegel also addressed the lot coverage request and stated that his property abuts a park to the rear and this large amount of open space helps justify the lot coverage variation. He also explained that he had tested this proposed driveway radius on a similar driveway at 2007 Chinkapinoak and that this driveway is the same as proposed with his request. Mr. Handschiegel stated he would be happy to go out and take measurements of this similar driveway to provide the Zoning Board with additional information. Mrs. Skowron asked if Mr. Handschiegel had considered a turn -around apron. He responded that he preferred the circular driveway because this would be more attractive for his lot rather than a turn -around. Mrs. Skowron stated she was concerned with the; lot coverage in the required front yard and stated that this Ordinance requirement is for the purpose of regulating stormwater run-off near the street, and that it would not be appropriate to consider the park as a way to justify this particular variation. Mr. Handschiegel stated that the 48% lot coverage is'a maximum figure and this could be reduced somewhat by changing the driveway dimensions. Mr. Cassidy stated that he was concerned with the lot coverage in the required front yard and that this circular driveway provided too much paving on a narrow 65 foot lot. He stated that circular driveways are not necessary on residential streets and this request was merely for the convenience of the owner. Mr. Brettrager explained that the circular driveway was tight and that the radius may not be sufficient for a full-sized car. He felt like a 65 foot lot could: not support a circular driveway and that, in effect, a driveway would take 'out any amount,of significant landscaping in the required front yard. Chairman Basnik questioned what the real hardship was with this request and Mr. Handschiegel stated that there was a safety factor involved and that on two occasions he has backed cars out of his garage and collided with other automobiles parked in the driveway. He would like to be able to maneuver on the lot and drive directly face out into the street. ZBA-22-V-92 April 23, 1992 Page 3 Zoning Board of Appeals generally discussed the request and there was concern about circular driveways on 65 foot lots, particularly on typical residential streets. Mr. Brettrager suggested that perhaps the petitioner could increase the existing driveway to the 21 foot maximum to allow more pavement width. Mr. Basnik suggested the petitioner consider a parking pad or a tum -around apron and Mr. Handschiegel again indicated that he believed a circular driveway was a more attractive feature for the lot, and would be a safer design for maneuvering. Mr. Lannon explained that he believed the circular, driveway would be a convenience only and that the 48% lot coverage was too high to justify this request. The Zoning Board continued discussion on the matter and believed the lot coverage variation and the circular driveway were not necessary in this particular neighborhood and that there was no hardship demonstrated with the request. Mr. Handschiegel offered to research other circular driveway dimensions and radii in the neighborhood, but the Zoning Board did not think this information would provide them with sufficient reason to approve this request. There being no further discussion, Mr. Lannon moved that the Zoning Board of Appeals approve the request for a circular driveway and 48% front lot coverage at 1308 Lama Lane. The motion was seconded by Mr. Cassidy. Upon Roll Call: AYES: None NAYS: Lannon, Saviano, Cassidy, Brettrager, Skowron and Basnik Motion denied by a vote of 0-6. Variation of Section 14.3016.A.1 to allow a circular driveway. 2. Variation of Section 14.1102.A to allow 48% of the front yard to be covered with impervious surface instead of the allowed 35%. Summary of application: The petitioners are seeking variations to allow a circular driveway and subsequently an increase in the maximum allowed front yard coverage from the maximum allowed 35% to 48%. The petitioner has indicated that the pitch of the driveway and the number of children in the area, along with the number of drivers in the family, a circular driveway would greatly improve the situation. Impact on Surrounding Properties: Staff is concerned with the design of the circular driveway as well as the amount of lot coverage that is requested. There are no other circular drives in this area and Lama Lane is not designed as an arterial or collector street. There were questions from the other departments regarding the ability to maneuver a vehicle on the circular driveway as designed. The Engineering Division has indicated that a minimum of 28'-30' radius along the outer edge of the drive is needed to adequately maintain a vehicle on the curve. Staff would encourage the applicant to be prepared to discuss the design of the driveway as shown on the site plan. A detailed site plan which indicates the actual radius of the driveway should be submitted. The Zoning Ordinance allows driveways with a width of 21 feet for two -car garages. The petitioner may want to investigate the possibility of widening the driveway or adding a turn -around instead of the circular driveway. Staff would prefer one of the above mentioned alternatives to the circular drive. This alternative would also serve to reduce lot coverage in the required front yard. The dish is to be located 15 feet from the side and rear yards and landscaping along the side and rear property lines is proposed as 11 Techny Arborvitae (evergreens) which are 5 feet in height. The Zoning Ordinance requires .satellite antennas exceeding forty inches in diameter to obtain a Special Use Permit. There are general criteria which must be met in order to obtain the Special Use Permit. a. The maximum diameter of a dish shall not exceed 11 feet. The proposed dish is 10 feet in diameter. b. The dish shall be located entirely behind the rear building line and shall not be located within any required side or rear yard. The site plan submitted for the satellite dish indicates the location to be within the 25 foot required rear yard. Staff would suggest that the dish be relocated to meet this requirement. This would mean shifting the location a minimum of 10 feet to the west. C. Any dish exceeding 40 inches in diameter shall be mounted on the ground. The proposed satellite dish is mounted on the ground. d. No more than one satellite antenna shall be installed on a lot. One satellite antenna is being proposed. e. No dish shall be located closer than ten feet from a principal building or structure. The proposed location as well as the suggested relocation exceed 10 feet from the principal building. E Any ground -mounted dish shall not exceed 15 feet in height above grade. The dish is proposed to be 8 feet in height. g. All ground -mounted satellite antennas shall be installed and landscaped so as to be compatible with surrounding properties. The proposed site plan indicates landscaping to screen the dish from neighboring properties. With the relocation 10 feet to the west, staff would ask the petitioner to be prepared to discuss with the Zoning Board members where the landscaping will be placed. Gil Basnik, Chairman Mount Prospect Zoning Board of Appeals Page 3 Impact on Surrounding Properties: The subject property contains 41,945 square feet and is zoned R-1, Single Family. This is a large lot with comparable lots to the north and south. The lots to the east are smaller, however, theyare175 feet deep. By placing the dish 15 feet into the side and 25 feet from the rear of the property, there is a minimum of 50 feet between the dish and the building line of the properties to the east. With the setbacks, the existing fence and the proposed landscaping, staff feels that there should be no major impact to the surrounding property owners. It has been brought to staffs attention that there have been several complaints to the Environmental Health Coordinator regarding the possibility of a kennel being operated on this property. A kennel is defined in the Village Code as a place where more than three dogs or cats are kept. Attached is a memo from the Health Coordinator regarding this matter. No other issues or concerns were brought up by other departments in this review and staff would like to note to the petitioner that should the Special Use Permit be granted for the proposed satellite dish, all building permits and inspections must be obtained. SUMlam; RYIRECOMMENDATJON Staff has no objections to the proposed satellite dish and would recommend approval of the Special Use Permit to allow a ground -mounted satellite dish subject to the relocation of the dish out of the required rear yard. The lot is large and the staff -suggested location and screening should not have any negative impact on the surrounding properties. Staff would recommend to the petitioner that compliance with all Village Codes regarding the dog kennel be complied with. CLEMENTS, DIRECTOR OF PLANNING AND ZONING DATE: APRIL 29, 1992 SUBJECT: ZBA-24-V-92, JOHN AND GRACE KINSELLA LOCATION: 508 SOUTH OWEN STREET The Zoning Board of Appeals transmits for your consideration their recommendation for a variation from Section 14.1103 to allow a floor area ratio of .45 instead of the maximum allowed .35 in order to construct a second story addition and a sun room. The Zoning Board of Appeals considered the request at their meeting of April 23, 1992. At the meeting, John and Grace Kinsella explained that they would rather add on to their existing home to accommodate their needs than relocate to a new home. Ray Forsythe, Planner, stated that the request would only increase the total lot coverage by 3%. He also indicated that the architect has matched the existing architecture and that there are other two-story dwellings nearby. The Zoning Board generally discussed the request. By a vote of 6-0, the Zoning Board of Appeals recommends approval of the variance. Gilbert Basnik, Chairman Robert Brettrager Ronald Cassidy Peter Lannon Dennis Saviano Michaele Skowron Richard Pratt None Chairman Basnik introduced the next agenda item as a variation to allow a floor area ratio of .45 instead of the maximum .35 in order to construct a second story addition and a sun room to the home at 508 South Owen Street. Mr. & Mrs. Kinsella introduced themselves to the Zoning Board of Appeals and stated they are proposing to construct the additions to provide additional room for their growing family, Mr. Kinsella indicated that they had considered relocating out of the Village but had made the decision that they preferred to keep their family in the community, and that the best approach to satisfy their needs was to do the addition to their existing home. They preferred to stay in the community and believed that the variations requested were reasonable in helping them meet the goal of keeping their family in the Village. He stated that the total square footage of the home with addition would be about 3,600 square feet which calculates to 600 square feet more than the allowable floor area ratio. He stated that the existing house is a partial two-story and that the addition would make the house a complete two-story structure. ZBA-24-V-92 April 223, 1992 Page 2 Concerning the proposed sun room, an addition, Mr. Kinsella noted that the total overall lot coverage is well below the maximum of the Zoning Ordinance. He stated that lot coverage is 40% with 45% permitted. Mr. Forsythe then summarized the staff report for the Zoning :Board of Appeals. He explained that there are other two-story homes in this area so the proposed construction would not be out of character with the neighborhood and that the proposed additions meet all applicable setback requirements. Mr. Forsythe stated that the elevations of the addition would match the existing house and the character, so the design would blend in with the existing house. Architect DeLattre introduced himself to the Zoning Board and stated that a portion of a rear deck or patio would be removed to allow construction of the sun room. Mr. Basnik questioned the lot coverage figures for this proposal and Mr. Forsythe stated that lot coverage is proposed at 40% and the Zoning Ordinance allows a 45% maximum. Mr. Cassidy explained that he believed this .was a reasonable request and that it helped satisfy the needs of the petitioner without requesting extreme variations of setbacks. The Zoning Board generally discussed the request and noted that the second floor addition would have no adverse impact on adjoining properties inasmuch as the addition was being built within the same bulk setbacks of the existing house. Mr. Kinsella thanked Mr. Forsythe for his work in helping him prepare the Zoning Board application. There being no further discussion, Chairman Basnik asked for a motion on the request. Mr. Cassidy moved that the Zoning Board recommend approval of the variation to allow a .45 floor area ratio rather than .35 to allow an addition at 508 South Owen Street. The motion was seconded by Mr. Lannon. Upon Roll Call: AYES: Lannon, Saviano, Cassidy, Brettrager, Skowron and Basnik NAYS: None Motion carried by a vote of 6-0. Summary of application: The applicants are seeking to add a second story addition and a sun room on to their home. The application indicates that the space is for a master bedroom, bathroom, laundry room, general purpose room and a sun room. The applicants have indicated that they would rather upgrade their existing home to meet their needs than have to relocate elsewhere. Elevations of the proposed additions have been submitted. Impact on Surrounding Properties: The proposed additions meet the Ordinance for setbacks and lot coverage. Actual lot coverage will only be increased by approximately 3%. The architectural elevations indicate that the additions will match the existing architecture. The neighboring properties are generally one-story structures, however, there are two 2 - story homes across the street from the subject property and others on the nearby blocks. No major objections or concerns have been brought up by other departments. Staff has no objections to the proposed variation. While the additions increase the floor area ratio of the lot, the setbacks are maintained and the lot coverage remains below the maximum allowed. The architect has done a good job of matching the current architecture and staff feels that no major impact will be felt by the neighbors. Staff would recommend approval of the request. FARLEY AND BOARD OF TRUSTEES FROM: VILLAGE MANAGER DATE: APRIL 6, 1992 SUBJECT: AGREEMENT FOR PARKING IN A VILLAGE PARKING LOT BETWEEN MAPLE STREET TOWNHOMES ASSOCIATION AND THE VILLAGE OF MOUNT PROSPECT Attached is the third or fourth draft Agreement. We have had discussions with Mr. Ramesh Gandhi, of 342 South Maple Street. He has not been satisfied with the original agreements that we have had. He has tried to extend the time during the day as well as the time for the number of months in which they want parking. I have received phone calls from other members of the Association that indicate he is not speaking on their behalf but it has become very convoluted. In a conversation with Mr. Gandhi, he has indicated to me that he is dissatisfied with the last Agreement. Staff feels very strongly that it is a reasonable Agreement to be used for any and all instances in the future for people who may wish to park in the parking lot. It is fair, easily understood and also is one that would not cause problems in the future. Mr. Gandhi has indicated he will be present on April 14 and is upset that this has not been done sooner. When Mr. Gandhi was reminded that he has rejected every other Agreement up to this point in time, it did not seem to concern him. We would suggest that the attached Agreement makes sense and should be approved as is. I would strongly urge the Board to make sure that it is very clear with Mr. Gandhi that the Agreement is with the Homeowners Association and the signature should be after a vote of the Homeowners Association. The Engineering staff has reviewed the subject agreement and has had subsequent discussions with I.D.O.T. The Illinois Department of Transportation has given the Village this opportunity because of the good working relationship they have had with the Engineering Staff, particularly Fred Tennyson, who has been our project engineer for the paving programs for the past 10 years. We will also be purchasing steel for plow frames and bumpers and lighting systems for the dump bodies. I recommend acceptance of the bid as submitted by Freund interna- tional at $37,782 for each of the two 1993 Model 4900 Interna- tional cabs and chassis, for a total contract award of $75,564. These units meet or exceed our specifications. After bid award, we project that our mechanics will have these units outfitted with hydraulics, plow frames, and bodies by January 1993. The two trucks we are replacing are both 1981 International trucks with the following history: Village I.D. Nos. Odometer Readings Hour Meter Readings Adjusted Mileage 40 MPH x No. Hrs. Current Maintenance Costs 4518 31,586 3,002 hrs. 120,080 $12,975 4550 34,904 3,363 hrs. 134,520 $13,441 As I stated at the budget hearings, our type of use places a strain on the vehicles, especially when plowing snow. As a result, odometer mileage readings are usually not good indica.- tors of the condition of the trucks. Both units need the dump body sub -frames replaced at an estimat- ed cost of $4000 each, plus repair and repainting of the cabs at an estimated cost of $2500 each. The two replacement units are not being offered as trade-ins, but will be sold. at the first available NWMC public auction after the two new units are placed in service. We have a total amount of $34,000 in two separate accounts available for crack sealing. This method is utilized in order to extend the length of time between full resurfacing of streets and is very beneficial from a cost benefit analysis for extension of road surfaces. The $1.34 per pound is very comparable to prices in the past. In 1990, we paid $1.03. In 1991, we paid $1.023. I recommend the acceptance of the contract with Behm Pavement Maintenance for a cost not to exceed $34,000. The following' five firms were sent invitational bids: 1) Camp Dresser McKee 2) 'HDR Engineering Inc. 3) Harza Environmental Services Inc,. 4) RJN Environmental Associates Inc. 5) SEC Donohue Camp Dresser McKee submitted a letter regretting that it was their decision not to submit a proposal at this time due to conflicts with availability of proper staff. HDR Engineering also submitted a letter indicating that they would not be submitting a proposal at this time. Harza Environmental Services contacted me the last week in April and verbally informed me that, because of commitments on other ongoing projects, they would not be able to provide services. of this nature at this time. Responses were received from our design engineer, RJN Environmen- tal Associates, and from SEC Donohue. Their proposals are thus: SEC Donohue projected labor 1818 hours; fee not to exceed $130,000 RJN Environmental Associates projected labor 2052 hours; fee not to exceed $145,541 The design of this storm sewer project was completed by RJN Environmental Associates. In most cases, it is preferable to award a construction engineering services contract to the design engineer under the assumption that they have more familiarity with the project and design. However, in our RFPs, I attempted to cover all aspects of the project so that a competitive bid could be received and a competent firm would have the means to give the community an alternative for this segment of the storm water project. After reviewing both proposals, it is my recommendation to award the low bid as submitted by SEC Donohue in an amount not to exceed $130,000. The bid opening for the storm sewer project is scheduled for May 12, 1992. As part of this proposal, if ap- proved, SEC Donohue will be representing the Village on review of bids and recommendation for award. They will then follow through with all other aspects; i.e., preliminary preconstruction meetings, materials testing, and staking. 'KQJ Ifirbert, L. Weeks HLW/td attach. CDOTAPRO. MEM /FILES/SEWERS Mount Prospect Public Works Department INTEROFFICE MEMORANDUM 7= an USA TO: Village Manager FROM: Director Public Works DATE: April 16, 1992 SUBJECT: Engineering Design Fees for Senior Center Building For over a year, the staff at the Senior Center have been re- questing additional office space. Several alternatives have been reviewed and, in the final analysis, it was felt that the best way would be to build a one-story addition in the northwest corner of the existing building, taking up most of the space where the landscaped garden is located. Some space could be obtained on the second floor, but would involve temporarily relocating the Communi-cations.Division and remodeling the entire space. The cost for that opt -ion would be prohibitive, and they still wouldn't have all their space needs met. Another option, was to take away some space from the seniors' activity areas, but that also wasn't feasible. What we are recommending is solving the long-term space needs of the center with a proposed 401x501 addition. I have sought proposals from three architectural firms for design work on this project: Archiplan International Ltd. - $7500 Donohue - 7930 Kurtz Associates Architects - 9100 The design contract proposal would include: a. Preliminary planning b. Schematic design documents_ C. Construction documents d. Specifications and final plans for bidding e. Estimated construction costs Until we have actual bidding documents available, it would not be possible to provide anyone with accurate construction esti- mates. Part of the architect's charge will be for design of the project to meet all codes or for advising us on what variances, if any, would be required. Once all documents are approved and a cost estimate is received, a determination can be made to continue with bidding. If the project is bid, the contractor would only construct the outer walls and roof. As a cost savings measure, Public Works person- nel would erect all interior walls, electrical, including lights, and subcontract HVAC system and floor treatment work. If landscaping is required, we would purchase the plant material and do the planting. We may need to install.a fire sprinkle system into the entire center. If required, it would cost an additional $650 for designing the system to serve the whole building. I would expect Public Works personnel would bring the water line into the building and subcontract out the interior piping. If funds were not available to pipe the entire build- ing, my recommendation would be to install sprinklers in the new addition only and phase in the other areas over the next two years. Additional design fees would be required for the remain- der of the building sprinkler system. I recommend waiver of a formal bidding procedure for design services and award the contract to Archiplan International Ltd. for $7500. This firm has done work for the Village in the past, and everything was satisfactory. Herbert L. Owen On April 21, 1992, the Village Board acted on an emergency re- quest for repair to a main line sewer in front of 202 S. Owen Street. It was estimated that this sewer repair would be approx- imately $15,000. However, any contractor who works on an emer- gency repair of this nature can only speculate on the projected cost of repair. Rossetti Contractors made that clear on their proposal, which was based on a spot repair of a sewer approxi- mately 201 deep. Once they got down to the bottom, they had to put in approximate- ly 30' of pipe due to deteriorated and broken 2411 sewer. In fact, to even make a connection, they had to insert a liner into the pipe to maintain the structural integrity of the pipe. Because of the extra pipe plus making a "Y" connection for two homes and the extra excavation and backfill, the cost for the pipe repair is $18,987.68. In addition, there is a not -to -ex- ceed figure of $2500 for replacement of a concrete driveway and several squares of sidewalk. I have made the commitment that the resodding of the parkway in front of 202 and 204 S. Owen will be made either with Village forces or by a landscape contractor working for the Village. Ac- cordingly, this emergency repair not -to -exceed figure is $21,487.68. HLW/td 2025—OWE.N/FILES/SEWERS Herbert L.
