Meeting December 7, 2021 - REGULAR MEETING OF THE MOUNT PROSPECT VILLAGE BOARD Fiscal Impact Dollar Amount $697,170.00 Budget Source Congestion Mitigation / Air Quality (CMAQ) grant funds and Street Improvement Construction Fund Category VILLAGE MANAGER'S REPORT Type Action Item A key component of the Mount Prospect Strategic Plan is to partner with appropriate government agencies to resolve troublesome intersection issues. One such area that has received attention in recent years is the three closely spaced intersections involving Rand Road (US 12), Central Road and Mount Prospect Road. The traffic -signalized intersections form a triangle that experiences operational issues on a daily basis. Blocked intersections and poor vehicle progression are common complaints from motorists. Timing adjustments have been made over the years with minor improvement. The Village of Mount Prospect is committed to developing a project that will provide significant enhancements to the transportation system that will benefit motorists, pedestrians, bicyclists, nearby businesses, and our residents. In February 2017, the Village adopted the Rand Road Corridor Study, a document which was the result of years -long data collection and analysis on how best to improve this corridor; this intersection, along with Rand/Kensington/Rte 83, were of particular focus. Recommendations in this study include studying this particular intersection in detail, and complete road 1 network modifications based upon the findings. In 2017 the Village awarded a contract using local funds to Christopher B. Burke Engineering, Ltd. (CBBEL) of Rosemont, IL to complete a Phase I Engineering Study of the intersection. Components of the study included a right-of-way survey, topographic survey, data collection, alternatives analysis report, drainage analysis, environmental survey, and lighting review. An initial public meeting was held in August 2017 to solicit input on issues and suggestions for improvement. A presentation was then made to the Village Board in April 2018 on a range of possible alternatives including focused attention on the preferred alternative, and in May 2019 a second public meeting was held to present the preferred alternative in greater detail. The Phase I Engineering Study followed the federal guidelines in order for the project to be eligible for federal funding in future phases. In 2019, the Village applied for and was awarded in excess of $5.3 million in federal Congestion Mitigation & Air Quality Program (CMAQ) funds to be used in all remaining phases: Phase II Engineering (final design), land acquisition, construction, and Phase III Construction Engineering (inspection). The Village was also awarded $460,500 in Invest in Cook funds to be used toward Phase II Engineering (final design) and land acquisition. In May 2020 the Village awarded a contract to CBBEL to perform Phase II Engineering and land acquisition services. Components of this contract include developing final construction plans & specifications, creating right-of-way and temporary easement plats, appraising affected properties, and negotiating land acquisition with property owners. CBBEL has also been instrumental in securing an additional $2.0 million in CMAQ funds during the past eighteen months for the project. The contract is anticipated to be completed in January 2022 in order to meet the March 2022 IDOT letting date. The Village is now in a position to prepare for the final phases of the project, construction and Phase III Construction Engineering. IDOT will advertise the project and open construction bids on March 11, 2022. Once bids have been opened and IDOT is prepared to award a construction contract, Village staff will present to the Village Board of Trustees a recommendation to authorize funding for the local share of the project. IDOT will enter into a construction contract with the contractor and pay the contractor directly using CMAQ funds. The Village will reimburse IDOT the local share of the project. Construction is anticipated to begin in May 2022 and be completed in the summer of 2023. At this time, Village Staff seeks to enter into a contract with an engineering 2 consulting firm to provide Phase III Construction Engineering services using CMAQ and local funds. The consultant selected by the Village and approved by IDOT will provide full-time inspection during construction. The Village will be responsible to pay the consultant using local funds and seek reimbursement from IDOT for the federal share. We are approved to receive 80% reimbursement up to $560,000 for Construction Engineering. • -IN - 1 • • 11• As required by the federally -mandated Qualification Based Selection (QBS) process, the Village solicited Statement of Qualifications from engineering consulting firms to provide Phase III Construction Engineering services for the Rand -Central -Mount Prospect Intersection Improvements. A notice was posted on the DemandStar bidding website and in the Daily Herald. Firms were asked to submit as part of their proposal the following information: 1. Resumes of key personal 2. Related experience on similar type projects 3. Summary of the firm's approach to the project 4. Prequalification status with IDOT The Village received seven (7) submissions. The seven consulting firms' Statement of Qualifications were reviewed on the basis of their understanding of our goals and their methodology to complete the study. The top three firms were also interviewed by Village staff. They were then rated (with a maximum score of 100 points) according to these specific categories: project understanding & technical approach, similar project experience, project team capabilities, IDOT prequalification status, and overall completeness of submittal. The rankings are as follows: Firm Points Christopher B. Their proposal is thorough and anticipates the many different tasks to complete construction and meet all state and federal requirements. They also have a working relationship with IDOT and the necessary skills to engage property owners and the community throughout construction. CBBEL has provided high quality work throughout the project and has the knowledge and tools to easily transition to the construction phase. Please note the QBS process is required for this contract as it uses federal funds. Similar to the Phase II Engineering contract, it does not permit simultaneous consideration of cost proposals. The IDOT Bureau of Local Roads Design Manual is the primary guide for utilization of federal funds for road construction projects in the State of Illinois. The manual stipulates: "'In no case shall the LPA (Local Public Agency), prior to selecting a consultant for negotiation, seek formal or informal submission of verbal, written, or sealed estimates of costs or proposals in terms of dollars, hours required, percentage of construction cost, or any other measure of compensation". In general, the QBS process requires owners to advertise the need for services, request qualifications statements or proposals from consultants, evaluate and rank consultants, select the most qualified firm, and negotiate a fee. Cost Proposal Upon selection of CBBEL as Village staff's highest ranked firm, they provided a detailed cost proposal including a breakdown of hours by task. Village staff negotiated with CBBEL to assure the cost proposal has sufficient hours for each task, is reasonable in price, meets the goals and schedule of the project, and is in the best interest of the Village. CBBEL's cost proposal includes 3,905 hours to accomplish pre -construction work including: shop drawing review and utility relocation, construction observation and documentation, public outreach, quality assurance of materials, and project closeout documentation. They will provide full-time inspection throughout the project and be available outside working hours to address any need that may arise during construction. Village staff is confident that they have committed a sufficient number of hours for a project of this size and scope. CBBEL's rate is approximately $160 per hour (excludes subconsultant costs). Village staff believes this rate is competitive and is acceptable compensation for construction engineering based on a project of this complexity. 4 Village staff supports the cost proposal submitted by CBBEL in the amount of $697,170 to provide Phase III Construction Engineering services. The Village has been awarded up to $560,000 in CMAQ funds for Construction Engineering. This represents 80% of the estimated cost of $700,000 for this contract. At a contract cost of $697,170, the federal share is $557,736 (80%) and the local share is $139,434 (20%). Alternatives 1. Accept proposal from Christopher B. CONSTRUCTION ENGINEERING Our Construction Engineering Department is prequalified by IDOT for construction inspection and survey and is comprised of civil engineers, construction managers, and technicians. Our department of 40, including 19 professional civil engineers and 7 El's, is familiar with the many facets of engineering that are required for public improvement projects. Additional staff members are well versed in the construction of civil engineering projects and most of our staff is certified by IDOT in one or several areas: Our staff has remained current with IDOT requirements related to Construction Specifications and Documentation requirements by attending classes frequently. This allows us to finalize and complete projects in a timely manner. CBBEL's Construction Department understands that providing a liaison to keep the area residents, businesses, and the public informed of construction activities is of the utmost importance to the success of any project. Main Street Bridge Reconstruction over Crystal Creek, Algonquin: Project Manager. Improvements include the full reconstruction of the concrete structure, superstructure with prestressed concrete deck beams and approach pavements. Work included construction of a new exit ramp and Toll Plaza at Roselle Road and ITS buildings and gantry foundations for an Active Traffic Management System. The current congestion causes poor access to businesses adjacent to the project for motorists and pedestrians. The project most notablywill include newtraffic signals, lighting, and dual leftturn lanes on Rand Road at Central Road to alleviate intersection congestion and improve traffic operations. We also note that the bike path on the south side of Rand Road will be extended throughout the project limits. CBBEL's approach for the successful completion of the Rand - Central - Mount Prospect Road Improvements begins with composing a project team with the experience and expertise to meet all anticipated challenges. Due to the complexity and expected traffic challenges this project will require senior leadership. Prior to the start of construction, the construction team will conduct a public meeting to allow those impacted to ask questions and voice concerns regardingthe project. The team will provide a general overview of the work that will take place and the anticipated duration of these operations. The contact information obtained from those participating will be used to create a contact list for future email blasts and updates. Due to COVID-19 this meeting may have to be conducted in a virtual format. PUBLIC CBBEL strives to provide excellent service to business owners and residents by engaging the community. Working with the municipalities to include construction updates in their newsletters or on Village websites will help make the local public aware of lane closures and construction activities so that motorists can take alternate routes to save time during their local commutes. CBBEL will provide an open line of communication with high profile stakeholders, such as the Mall, Des Plaines and other businesses to minimize the impacts. The team can use a variety of strategies to accomplish this goal. We have identified John Heinz as a liaison to impacted businesses. A project website will be created and updated weekly. If selected, CBBEL would want to facilitate a discussion with the Village to discuss the possible benefits of including a subcontractor, that specializes in Public Outreach (Metro Strategies), to lead the teams efforts in providing transparency to the project stakeholders. CBBEL has an ongoing relationship with Metro Strategies and we frequently use their services on high profile projects. We have previously used "Constant Contact" marketing software to provide weekly email blasts to those in the project contact list. The team will also host monthly "Coffee with the Contractor" meetings for all the project stakeholders. This will allow for questions and concerns to be raised and addressed and allow for those impacted to become part of the team delivering a successful project. The work will be completed under staged traffic on Rand Road. CBBEL will work with the Contractor and Mount Prospect staff to update changeable message boards located at project limits or within the work zone. This method of communication has worked well in the past because it notified the traveling public of major changes due to construction, and also communicates important information to those traveling from out of town that may not be familiar with any ongoing construction. COMPLETION/ PROGRESS SCHEDULE This project is scheduled for the January 2022 IDOT letting, with construction anticipated to begin Spring 2022. Because of the magnitude of work on this project, our design staff has estimated that 150 working days will be required to complete the proposed improvements. Construction will continue into 2023. We will ensurethat Rand Road, Central Road and Mount Prospect Road are in such a condition as to allow for safe passage and maintenance (snow plowing) during the Winter months. CBBEL will work with the Contractor to develop a progress schedule that is logical, accounts for any conflicts or permitting issues, and causes the least disruption to the homes and businesses. Discussion of the schedule will be an agenda item at every weekly progress meeting. If the Contractor falls behind more than 14 days, a revised schedule will be required. The revision will need to show how the Contractor intends to mitigate all delays. Due to recent supply chain slow downs, CBBEL expects that the Contractor will submit a request for project delay to IDOT at the pre -construction meeting. This procedure is outlined in Article 801.04 of the Standard Specifications. The delay request is for a period of up to 120 consecutive calendar days after the execution of the contract. This request is typically granted by IDOT. MEETINGSWEEKLY CBBEL will conduct weekly meetings with the Contractor, the Village, IDOT and appropriate utility representatives. The purpose of these meetings will be to discuss progress on utility conflicts, MOT issues, actual contract progress verses approved progress schedule, design revisions required, submittal status and planned Contractor activities for the upcoming two weeks. Any project complaints or concerns expressed by stakeholders will also be addressed. CBBEL will distribute timely meeting minutes to all attendees. The utility coordination on this project presents a complex challenge. There are numerous existing underground and overhead facilities that conflict with the proposed work. This includes overhead ComEd cables, underground Nicor, cable TV, and AT&T facilities. CBBEL is acutely aware of the disruption that unresolved utility conflicts can cause to a project duration and cost. We have employed several strategies on previous projects to assist with the relocation process. The construction team needs to walk the project with the Contractor and review all the known conflicts. This will take place after the joint meeting with the utility locators on site. Once J.U.L.I.E. locates are complete a project database will need to be established for each individual conflict to monitor until resolution. Due to the number of conflicts identified, a weekly coordination meeting with the utility companies would be appropriate. CBBEL will develop a schedule that incorporates all the known utility work to track progress. This will be critical to identify which work items are on the critical path and to discuss possible alternates if the Contractor's work is impacted. CBBEL's design and construction team will work in tandem until all conflicts are fully resolved. COMMUNICATION IVILLAGE Our construction engineering department places an emphasis on open communication with the owner before, during, and after construction is completed. During construction, CBBELwill keepthe Village informed of schedule changes, construction phasing and all major construction activities. We will provide weekly progress reports to the Village and Contractor. A separate weekly update can also be sent to the Village for posting on the Village website in order to keep the public informed (this is in addition to the project website that CBBEL will create). The scope of the Rand - Central - Mount Prospect Road Improvements is large enough that we require weekly meetings in order to keep all parties fully informed as it relates to progress and changes; CBBEL's relationship with the IDOT Local Area Supervisor (Lukasz Brozek, PE) is very good and we would anticipate his attendance at these meetings. MAINTENANCETRAFFIC The plans indicate that 5 MOT Stages are anticipated. In general Stage 1 will remove medians and islands to allow for the lane relocations in upcoming stages. Work will be completed using daytime lane closures. Stage 2 will create a permanent work zone on the north part of Rand Road throughout the project limits. Stage 3 will create a permanent work zone on the south part of Rand Road throughoutthe project limits. Stage 4 will constructthe median area throughout the project using daytime lane closures. Stage 5 will complete the patching, asphalt binder surface, pavement markings and energizing the permanent signals. All of these stages will need to be coordinated with the placement and location of all temporary signals. CBBEUs construction team will need to be proactive throughout the staged construction. Changeable Message Signs (CMS) will need to be used extensively to inform the public of changes to the lane configurations. We recommend updates to the CMS during the following milestones: • Prior to the Start of Construction • Detours • Additional Lane Closures or Moving Lane Closures • Change to Traffic Patterns (Stage Construction) • Special Events Within or Adjacent to Work Zone On similar past projects business owners frequently have extensive concerns about access to their property. While it is desirable to gather and respond to concerns prior to traffic changes, requests from businesses frequently are received after a traffic change. Requests for additional signage to delineate entrances and exits are most frequent. CBBEL will work with the Contractor to have additional directional entrance signs available to accommodate these requests. CBBEL will meet on site with business/property owners to eliminate all concerns. Due to the extensive amount of utility conflicts identified in the plans, it may be necessary to modify parts of the MOT presented in the plans. CBBEL will organize meetings with the Contractor, the Village, IDOT and the design team if a change to the MOT becomes necessary. CBBEL will perform daily traffic control checks in the morning and afternoon and notifythe Contractor of any deficiencies that require attention. Our goal is to ensure that the Contractor maintains a safe work zone for the motoring public and pedestrians. In addition, CBBEL will complete a detailed daytime traffic control check once a week and two detailed nighttime weekly traffic control checks per month, which follows IDOT procedures. Both daytime and nighttime checks will be recorded on IDOT's form BC 726. As previously discussed there is limited space in the corridor underground and overhead for signal foundation poles and mastarms, and new conduits. Additionally temporary signal facilities will be installed to further crowd the corners. Every corner will need to be examined with the Contractor after J.U.L.I.E. locates and layout by the Contractor. It is not unusual for field changes to be required to fit all proposed facilities. Any changes will need to be discussed with the design team to evaluate impacts on ADA considerations and other design considerations. We note that the traffic signal design is unique given the triangular geometry of the three signals and service by one traffic signal controller. We anticipate that due to these factors more than the usual amount of coordination will be required between the Resident Engineer, electrical Contractor, IDOT, equipment vendor and the design team. Due to the complexity of the installation questions will certainly arise. CBBEUs in-house staff can assist with the shop drawing process. The electrical Contractor will submit shop drawings directly to IDOT using their TOCS system. The status of all long lead time equipment will be discussion items at the project weekly meetings. We note that the three intersections will all be served by a single controller. This will result in numerous conduit runs terminating at a single location. The Resident Engineer will need to walk the area around the proposed cabinet location immediately after the J.U.L.I.E. locates are completed. The team will determine if the area is free of conflicts with existing utilities and formulate a plan to successfully route all required conduits to the new cabinet. A meeting with the design team will be scheduled if changes are required. TEMPORARY SIGNALS In order to accommodate the proposed staged construction, temporary signals will be installed at three intersections, along with a temporary interconnect of these locations. The installation of temporary signals will requirethatthe maintenance of the signal systems be transferred to the General Contractor. We understand thatthere is an intergovernmental agreement in place that requires the Village to maintain the existing signals. The Resident Engineer and design staff from CBBEUs Traffic Operations Department will work together with the Signal Contractor to ensure, prior to the transfer of maintenance meeting, all temporary signals are functioning per the plans and specifications. The Resident Engineer and Traffic Operations staff will be present at the meeting to transfer maintenance to the Contractor. The contract contains line items for the Contractor to develop the temporary traffic signal timing. CBBEUs Traffic Operations staff will review the Contractor developed timing to verify conformance with the contract documents. We note that the temporary signals will be connected using a wireless interconnect. DRAWINGSHOP I Items with long lead times such as traffic signal and lighting equipment, also require approval of shop drawings. Installation on State Routes for Federally funded projects require the Contractor to submit these items directly through the IDOT TOCS system for IDOT review and approval. The TOCS review typically bypasses the design team. This prevents the staff who have historic project knowledge from commenting on the proposed equipment submittal until after the IDOT review is complete. Because of the unique nature of the traffic signal design, in particular, CBBEL will encourage the Contractor to present the required submittals for comment by the design team prior to submission to IDOT. We also will organize a meeting to review the design team comments to include the design team, Contractor, vendors supplying equipment and Resident Engineer. We feel this process is importantto prevent any procurement delays and impacts to the final completion date. On similar projects, CBBEL has encountered challenges at ADA ramp locations due to conflicts with signal equipment. Frequently, early in the project, signal posts and temporary poles are moved to accommodate underground utility conflicts. These relocations occasionally will impact the proposed sidewalk and ramp construction and conflict with the required geometry and slopes of the ADA ramps. It will be essential for CBBEUs construction team to meet with the design team throughout the project regarding any changes at the corners. This will require the field staff to provide as -built survey data of the changed locations to the design team to develop alternatives. Every corner will need to be evaluated for as -built conditions prior to forming the concrete ramps. The plans outline multiple parcels that will be impacted by the proposed improvements. We understand that acquiring the property at these parcels is currently under negotiation. Past experience on similar projects of this size demonstrated a need to work on private property that was not anticipated by the design team. This work is typically short duration and access frequently related to driveway restoration. Once this relationship is established, we will obtain any sign offs and commitments required by the property owner and be engaged through any restoration required. The status of each specific situation will be updated weekly to the Village. LIGHTING The contract calls for a new lighting system throughout the project length. The existing lighting system will be utilized through construction until the new system is operational. Temporary lighting will be installed where the existing is in conflict with the proposed widening. Similar to the traffic signals there are numerous overhead and underground utility conflicts with the proposed system. The Resident Engineer and Contractor will need to examine every proposed location and, if needed, consult the design team to implement sensible solutions. DOCUMENTATIONPROJECT This project is federally funded and will follow CMMS and Mistic database management for construction services. Many of the Shop drawings will need to be uploaded to IDOT Springfield for review, including traffic signal and electrical items - these are submitted by the Contractor using TOCS. Familiarity with these systems will be key to the consulting staff to move the project forward without delays. The CBBEL Resident Engineer and team members assigned to this project have been trained and are familiar with the use of these programs; the administration of this project is a task that our staff is efficient at because of our high volume of federal projects every year. Due to the project limits extending through both the Village and the City of Des Plaines, the project line items will contain multiple funding codes for same line items. CBBEL is familiar with the requirements in documenting this work to ensure the invoicing is directed correctly. Additionally we have identified staff member JEFF MYSLIWIEC, PE as a Liaison to IDOT. Jeff is a recently retired Area Supervisor in the Bureau of Construction. We will use his 30 plus years of experience and existing relationships to assist with the IDOT process. We plan to use the expertise of a Documentation Engineer, NICOLE LEHMANN, P, to assist the Resident Engineer during this project. IDOT specifications, procedures, and documentation will be followed due to federal funding participation. CBBEL completes many federally funded projects in coordination with IDOT each year and has a good working relationship with IDOT staff. CBBEL will follow the IDOT Construction Manual and Project Procedures Guide for documentation and material inspection requirements. CBBEL internally runs QC audits on the project documentation to ensure everything is in order for a quick approval and close-out. BALANCEZERO L Due to CBBEL's strong relationship with local governments in the Chicagoland area, we complete and close-out over a dozen local agency Federal funded led projects annually. Frequently on these projects, usually due to a low bid, there is grant money available to offset costs that would be incurred by the Village. On any project with State and Federal funding CBBEL works with the municipality and IDOT to maximize State and Federal dollars used on the project. We will utilize these relationships to resolve any funding issues and explore any possible awareness for additional project funding. N n M We understand the permitting for this project is nearly complete, with only the MWRD outstanding. The construction team is very familiar with SWPPP and NPDES permits and requirements. We are currently working with MWRD staff on construction projects in the Village and also in the Village of Arlington Heights, and have an excellent relationship with their staff. CBBEL is the design engineer for the Rand - Central - Mount Prospect Road Improvements. As such, we believe that the overall coordination related to Requests for Information and the Pre - Construction startup will be reduced because we have extensive knowledge of the project in-house. We understand issues related to utility coordination and land acquisition for this project. Our traffic signal and lighting design staff can complete reviews on work that they designed, on a timely basis, which will be more efficient than a third party providing this service. In addition, our traffic and electrical staff will be available for field inspections or signal turn -ons when necessary. Lastly, CBBEL is a bike -friendly business that has completed many multi -modal transportation projects; we have a good understanding of construction, signage, and markings related to bike lane construction. CBBEL is a multi - disciplined engineering firm, which allows us to complete this work in house without subconsultant assistance. CBBEL will furnish qualified engineers, construction observers and/or technical personnel to perform these services. The following are the tasks that CBBEL will use for the Rand - Central - Mount Prospect Road Improvements. TASK I ® PRE -CONSTRUCTION SERVICES 1. Review of Bidding/Contract Documents and Engineering Drawings; Advise the Village of potential conflicts or problems, so that solutions can be developed prior to construction. 2. Attend a Pre -Construction Meeting at IDOT with Contractor, Village Staff, and IDOT personnel. 3. Attend and participate in Village Administered Project Informational Meeting with Impacted Property Owners and other Project Stakeholders. 4. Reviewthe construction schedule submitted bythe Contractor for compliance with the contract. 5. Produce a Pre -Construction Video to ensure project site conditions have been adequately documented prior to the start of construction. CBBEL shall document all existing conditions with a GoPro camera. 6. Review the Inspector's Checklists provided through IDOT for contract line items including Erosion Control, Hot -Mix Asphalt, Storm Sewers, Earth Excavation and Embankment, and Concrete Structures other than Bridge Deck. 7. Provide information to the Village so you can update the Village website with construction updates. Create a project specific website for the Rand - Central - Mount Prospect Road Improvements. TASK 2 ®SUBMITTALS/ INFORMATION (RFI) RESPONSES 1. Review of all submittals to ensure conformance with the requirements set forth in the Contract Documents and Engineering Drawings. CBBELwill review, return, and comment to Contractor within 7 days of receipt of shop drawings, diagrams, illustrations, samples, schedules, results of tests, and other data required to be submitted by Contractors. 2. Shop Drawings and Contractor Submittals: • Record data received, maintain a file of drawings and submissions, and check construction for compliance with them. • Notify the Village of any deviations or substitutions. With the notification, provide the Village with a recommendation for acceptance or denial, and request direction from the Village regarding the deviation or substitution. • Alert the Contractor's field superintendent when materials or equipment are being installed before approval of shop drawings or samples, where such are required, and advise the Village when it is necessary to disapprove work as failing to conform to the Contract Documents. 3. Review and coordinate responses to any RFI from the Contractor in a timely manner and maintain a separate file for each request. 4. Coordinate with design team as the letting date approaches. TASK 3 ® CONSTRUCTION OBSERVATION LAYOUT VERIFICATION AND/OR CONSTRUCTION LAYOUT 1. Verify Construction Layout Performed by Contractor; 2. Coordinate with the design engineer and Contractor to verify initial geometric controls. 3. Since the Contractor is responsible for construction staking, perform periodic measurements to ensure the Contractor's construction staking and construction layout is accurate per plan. CONSTRUCTION OBSERVATION 1. Develop and distribute regular Project Notifications (letters to impacted residents, businesses, refuse and delivery companies, etc.). 2. Construction Inspection of all Contract Work to ensure improvements are constructed with minimal impact on the public and in accordance with the project specifications; CBBEL will keep the Village informed of the progress of the work, guard the Village against defects and deficiencies in the work, and advise the Village of all observed deficiencies of the work and disapprove or reject all work failing to conform to the Contract Documents. CBBEL staff will interpret specifications when necessary. 3. Answering of construction questions and resolving issues and concerns from impacted property owners. 4. Review that Construction Completion Schedule is adhered to; Review Contractor's progress on a bi-weekly basis and update the progress schedule. Compare actual progress to the Contractor's approved schedule. If the project falls 14 calendar days behind schedule, work with the Contractor to determine the appropriate course of action to get back on schedule. The Contractor is required to submit a revised schedule for approval prior to further payments being made. a. Deviations from the schedule will be addressed immediately and the engineer shall work with the Contractor on returning to the original schedule. Major deviations from the schedule shall be documented in writing, notifying the Contractor of the need to increase production rates. 5. Conduct Weekly Progress Meetings. 6. Provide Weekly Progress Updates to Village Staff. 7. Discuss the truck routes with the Contractor and monitor that the identified routes are being used. 9. All CBBEL personnel and their sub -consultants will comply with the Village's current safety guidelines. 10. Coordinate with IDOT Bureau of Traffic. TRAFFIC CONTROL INSPECTION Perform Traffic Control Inspection as outlined in Section 700: Work Zone Traffic Control of IDOT's Construction Manual. At a minimum, CBBEL shall perform the following in accordance with STP procedures: • One detailed daytime inspection per week and two detailed nighttime inspections per month. These inspections shall be recorded on Form BC 726, Traffic Control Inspection Report. • In addition, the Resident Engineer will drive through the jobsite daily and document the drive through in the project diary. • If traffic control is in place during project suspensions, two drive- throughs per week will be performed. • If major deficiencies are observed, the Resident Engineer will notify the Contractor immediately and insure that the Contractor takes the appropriate actions as outlined in the contract documents. T CONSTRUCTION TTI CBBEL follows all IDOT guidelines and procedures for Construction Engineering, including, but not limited to, IDOT Construction Manual, BLR Manual, and IDOT Project Procedures Guide. We shall complete all work in a professional and satisfactory manner while complying with STP and TAP -L program requirements. 1. Maintain Daily Project Diary, Daily Inspection Reports, Field Books, Quantity Books, and all other Pertinent Records. 2. Contract Administration/Documentation. 3. Quantity Measurements. 4. Field Notes: Engineer shall keep an ongoing mark up set of plans consisting of all field changes from the design. Provide detailed sketches and photos when necessary. 5. Maintain and update CMMS. 6. CBBEL will provide staff, equipment, computers and any necessary office supplies to complete the work. We understand the Village of Mount Prospect will provide access to restrooms, copy machine, and one workspace for the engineer's use. 7. Construction Engineer shall provide his/her own vehicle for use in the field at all times. 8. Process Pay Requests and provide Village Staff with a Recommendation for Payment. 9. Develop and Process Change Orders as necessary including Final Balancing Change Order. TASK 5 ® MATERIAL QA TESTING CBBEL will provide a subconsultant, Material Solutions Laboratory (MSL), for the material testing portions of this contract. MSL is an IDOT DBE certified Professional Civil Engineering Firm prequalified in QA Complete. The Resident Engineer provided by CBBEL is familiar with the frequency of QA testing as required by IDOT as outlined in their Project Procedures Guide. The Resident Engineer will coordinate the QA material testing and review all required reports submitted by the Contractor's QC sub -contractor for compliance with the project specifications. TASK 6 ® POST -CONSTRUCTION/ PROJECT CLOSE-OUT 1. Develop and ensure completion of "Punch List"; 2. Completion of a Warranty Inspection to identify and direct Contractor to address any issues that arise during warranty period (up to 1 year beyond date of final payment to Contractor). 3. Prepare final pay estimate and change order for the Village's approval. 4. Verify all necessary material inspection has been received and documented. 5. Submit the job box to IDOT with all pertinent project information, including Record Drawings (see Task 7). All documentation shall be the property of the Village of Mount Prospect and shall be provided to the Village upon the completion of the project. TASK 7 ® RECORD DRAWINGS Provide one (1) hard copy and one (1) electronic copy of the As - Built Topographical Survey and Engineering Drawings Detailing the "As -Built" conditions. SUMMARY The staff that we have assembled for this project is highly qualified to provide construction engineering services for the Village. They have the expertise and commitment required for this project. Our proposed team has years of experience inspecting and managing construction projects similar to the Rand - Central - Mount Prospect Road Improvements, giving us the understanding and knowledge to communicate with the residents and business owners to ensure construction is completed with minimal disruptions. Our team's broad experience on the various engineering aspects of this project including all roadway, bike lane construction, maintenance of traffic, ADA improvements, traffic signal improvements, lighting improvements, and project documentation and close-out will allow the upcoming project to be undertaken in a comprehensive, efficient, and cost effective manner to benefit the Village. One such area that has received attention in recent years is the three closely spaced intersections involving Rand Road (US 12), Central Road and Mount Prospect Road. The traffic -signalized intersections form a triangle that experiences operational issues on a daily basis. Blocked intersections and poor vehicle progression are common complaints from motorists. Timing adjustments have been made over the years with minor improvement. The Village of Mount Prospect is committed to developing and implementing a plan that will provide significant enhancements to the transportation system that will benefit motorists, pedestrians, bicyclists, nearby businesses, and our residents. Rand Road (US 12) and Central Road west of Rand Road are under the jurisdiction of the Illinois Department of Transportation (IDOT). Central Road east of Rand Road is under local jurisdiction. Mount Prospect Road from Rand Road to Busse Avenue is also under local jurisdiction. The City of Des Plaines owns the east half of Mount Prospect Road from Busse Avenue to approximately 300' north. The Village of Mount Prospect owns the remaining portion. From Busse Avenue south, Mount Prospect Road is under the jurisdiction of the Cook County Department of Highways (CCDH). The Mount Prospect Plaza driveway at Rand Road and Mount Prospect Road is privately owned. The traffic signals at the three interconnected intersections are operated by IDOT but maintained by the Village. The Village of Mount Prospect completed a Phase I Engineering study in 2020. The Village's Phase II Engineering consultant has completed pre -final plans, pre -final specifications, and an estimate of cost. These documents are made part of the RSQ. The Village applied for and received funding from the CMAQ Program. The grant from the CMAQ Program will cover a portion of Phase II Engineering, Right -of -Way Acquisition, Construction, and Construction Engineering. The remaining costs will be paid using Village funds. The award letter is made part of this RSQ. At this time, the Village seeks to enter into a contract with an engineering firm to provide Phase III Construction Engineering services. IDOT plans to let the project in January 2022 with construction to begin in the spring. A majority of the work will be completed in 2022 with final completion in 2023. The successful firm will be responsible to meet all Federal/State/Village requirements for these services. At a minimum, the following tasks are to be included in the scope of services. Additional tasks, at the consultant's recommendation, will be considered by the Village. 1. Become familiar with the traffic operations at the intersections and surrounding access to Rand Road, Central Road, and Mount Prospect Road within the project limits. 2. Coordinate a Preconstruction Meeting with IDOT, Village Staff, and the Contractor. 6. Review shop drawings and other equipment/material submittals as may be required. 7. Coordinate with private utility companies to relocate facilities as necessary prior to construction. 8. Provide horizontal and vertical construction layout of the proposed improvements as necessary. 9. Coordinate material testing and QA/QC with the contractor during construction. 10. Coordinate private property work with property owners to minimize disruption. 11. Respond to inquiries from various stakeholders and address issues in a timely manner. 12. Attend and conduct weekly construction coordination/status meetings. 13. Prepare pay estimates for contractor work performed. That the ENGINEER shall be responsible for the accuracy of the work and shall promptly make necessary revisions or corrections required as a result of the ENGINEER'S error, omissions or negligent acts without additional compensation. Acceptance of work by the LPA or DEPARTMENT will not relieve the ENGINEER of the responsibility to make subsequent correction of any such errors or omissions or the responsibility for clarifying ambiguities. 4. That the ENGINEER will comply with applicable Federal laws and regulations, State of Illinois Statutes, and the local laws or ordinances of the LPA. 5. To pay its subconsultants for satisfactory performance no later than 30 days from receipt of each payment from the LPA. 6. To invoice the LPA for Preliminary and/or Design Engineering: The ENGINEER shall submit all invoices to the LPA within three months of the completion of the work called for in the AGREEMENT or any subsequent Amendment or Supplement. 7. To submit a completed BLR 05613, Engineering Payment Report, to the DEPARTMENT within three months of the completion of the work called for in this AGREEMENT or any subsequent Amendment or Supplement. The form shall be submitted with the final invoice. 8. The ENGINEER or subconsultant shall not discriminate on the basis of race, color, national origin or sex in the performance of this AGREEMENT. The ENGINEER shall carry out applicable requirements of 49 CFR part 26 in the administration of US Department of Transportation (US DOT) assisted contract. Failure by the Engineer to carry out these requirements is a material breach of this AGREEMENT, which may result in the termination of this AGREEMENT or such other remedy as the LPA deems appropriate. 9. That none of the services to be furnished by the ENGINEER shall be sublet assigned or transferred to any other party or parties without written consent of the LPA. The consent to sublet, assign or otherwise transfer any portion of the services to be furnished by the ENGINEER shall be construed to relieve the ENGINEER of any responsibility for the fulfillment of this AGREEMENT. 10. For Construction Engineering Contracts: (a) The ENGINEER shall be prequalified with the STATE in Construction Inspection. All employees of the ENGINEER serving as the onsite resident construction supervisor or providing construction inspection shall have a valid Documentation of Contract Quantities certification. (b) For all projects where testing is required, the ENGINEER shall obtain samples according to the STATE Bureau of Materials. "Manual of Test Procedures for Materials," submit STATE Bureau of Materials inspection reports; and verify compliance with contract specifications. 11. That the engineering services shall include all equipment, instruments, supplies, transportation and personnel required to perform the duties of the ENGINEER in connection with this AGREEMENT See Exhibit C). To certify by execution of this AGREEMENT that the selection of the ENGINEER was performed in accordance with the following: (a) Professional Services Selection Act (50 ILCS 510), The Brooks Act (40 USC 11), and the Procurement, Management, and Administration of Engineering, and Design Related Services (23 CFR part 172). Exhibit D is required to be completed with this AGREEMENT. 2. To furnish the ENGINEER all presently available survey data, plans, specifications, and project information. 3. For Construction Engineering Contracts: (a) To furnish a full time LPA employee to be In Responsible Charge authorized to administer inherently governmental PROJECT activities. (b) To submit approved forms BC 775 and BC 776 to the DEPARTMENT when federal funds are utilized. 4. To pay the ENGINEER: (a) For progressive payments - Upon receipt of monthly invoices from the ENGINEER and the approval thereof by the LPA, monthly payments for the work performed shall be due and payable to the ENGINEER, such payments to be equal to the value of the partially completed work minus all previous partial payments made to the ENGINEER. (b) Final Payment - Upon approval of the work by the LPA but not later than 60 days after the work is completed and reports have been made and accepted by LPA and DEPARTMENT, a sum of money equal to the basic fee as determined in this AGREEMENT less the total of the amount of partial payments previously paid to the ENGINEER shall be due and payable to the ENGINEER. To pay the ENGINEER as compensation for all services rendered in accordance with the AGREEMENT on the basis of the following compensation method as discussed in 5-5.10 of the BLR Manual. Method of Compensation: ❑ Lump Sum ❑ Specific Rate ® Cost plus Fixed Fee: Fixed Total Compensation = DL + DC + OH + FF Where: DL is the total Direct Labor, DC is the total Direct Cost, OH is the firm's overhead rate applied to their DL and FF is the Fixed Fee. The Fixed Fee cannot exceed 15% of the DL + OH. Field Office Overhead Rates: Field rates must be used for construction engineering projects expected to exceed one year in duration or if the construction engineering contract exceeds $1,000,000 for any project duration. The recipient shall not discriminate on the basis of race, color, national original or sex in the award and performance of any US DOT -assisted contract or in the administration of its DBE program or the requirements of 49 CFR part 26. The recipient shall take all necessary and reasonable steps under 49 CFR part 26 to ensure nondiscrimination in the award and administration of US DOT -assisted contracts. The recipient's DBE program, as required by 49 CFR part 26 and as approved by US DOT, is incorporated by reference in this agreement. Implementation of this program is a legal obligation and failure to carry out its terms shall be treated as violation of this AGREEMENT. Upon notification to the recipient of its failure to carry out its approved program, the Department may impose sanctions as provided for under part 26 and may, in appropriate cases, refer the matter for enforcement under 18 U.S.C. 1001 and/or the Program Fraud Civil Remedies Act of 1986 (31 U.S.0 3801 et seq.). To certify by execution of the AGREEMENT that the selection of the ENGINEER was performed n accordance with the Local Government Professional Services Selection Act 50 ILCS 510, the Brooks Act 40 USC 11, and Procurement, Management, and Administration of Engineering and Design related Services (23 CRF part 172). Exhibit C is required to be completed with this agreement. III. IT IS MUTUALLY AGREED, 1. No work shall be commenced by the ENGINEER prior to issuance by the IDOT of a written Notice to Proceed. 2. To maintain, for a minimum of 3 years after the completion of the contract, adequate books, records and supporting documents to verify the amount, recipients and uses of all disbursements of funds passing in conjunction with the contract; the contract and all books, records and supporting documents related to the contract shall be available for review and audit by the Auditor General, and the DEPARTMENT, the Federal Highways Administration (FHWA) or any authorized representative of the federal government, and to provide full access to all relevant materials. Failure to maintain the books, records and supporting documents required by this section shall establish a presumption in favor of the DEPARTMENT for the recovery of any funds paid by the DEPARTMENT under the contract for which adequate books, records and supporting documentation are not available to support their purported disbursement. 3. That the ENGINEER shall be responsible for any and all damages to property or persons arising out of an error, omission and/or negligent act in the prosecution of the ENGINEER's work and shall indemnify and save harmless the LPA, the DEPARMTENT, Completed 11/29/21 Page 3 of 12 BLR 05530 (Rev. 08/05/21) 55 and their officers, agents, and employees from all suits, claims, actions or damage liabilities, costs or damages of any nature whatsoever resulting there from. These indemnities shall not be limited by the listing of any insurance policy. The LPA will notify the ENGINEER of any error or omission believed by the LPA to be caused by the negligence of the ENGINEER as soon as practicable after the discovery. The LPA reserves the right to take immediate action to remedy any error or omission if notification is not successful; if the ENGINEER fails to reply to a notification; or if the conditions created by the error or omission are in need of urgent correction to avoid accumulation of additional construction costs or damages to property and reasonable notice is not practicable. 4. This AGREEMENT may be terminated by the LPA upon giving notice in writing to the ENGINEER at the ENGINEER's last known post office address. Upon such termination, the ENGINEER shall cause to be delivered to the LPA all drawings, plats, surveys, reports, permits, agreements, soils and foundation analysis, provisions, specifications, partial and completed estimates and data, if any from soil survey and subsurface investigation with the understanding that all such material becomes the property of the LPA. The LPA will be responsible for reimbursement of all eligible expenses incurred under the terms of this AGREEMENT up to the date of the written notice of termination. 5. In the event that the DEPARMENT stops payment to the LPA, the LPA may suspend work on the project. If this agreement is suspended by the LPA for more than thirty (30) calendar days, consecutive or in aggregate, over the term of this AGREEMENT, the ENGINEER shall be compensated for all services performed and reimbursable expenses incurred as a result of the suspension and resumption of its services, and the ENGINEER's schedule and fees for the remainder of the project shall be equitably adjusted. 6. This AGREEMENT shall continue as an open contract and the obligations created herein shall remain in full force and effect until the completion of construction of any phase of professional services performed by others based upon the service provided herein. All obligations of the ENGINEER accepted under this AGREEMENT shall cease if construction or subsequent professional services are not commenced within 5 years after final payment by the LPA. 7. That the ENGINEER shall be responsible for any and all damages to property or persons arising out of an error, omission and/or negligent act in the prosecution of the ENGINEER's work and shall indemnify and have harmless the LPA, the DEPARTMENT, and their officers, employees from all suits, claims, actions or damages liabilities, costs or damages of any nature whatsoever resulting there from. These indemnities shall not be limited by the listing of any insurance policy. 8. The ENGINEER and LPA certify that their respective firm or agency: (a) has not employed or retained for commission, percentage, brokerage, contingent fee or other considerations, any firm or person (other than a bona fide employee working solely for the LPA or the ENGINEER) to solicit or secure this AGREEMENT, (b) has not agreed, as an express or implied condition for obtaining this AGREEMENT, to employ or retain the services of any firm or person in connection with carrying out the AGREEMENT or (c) has not paid, or agreed to pay any firm, organization or person (other than a bona fide employee working solely for the LPA or the ENGINEER) any fee, contribution, donation or consideration of any kind for, or in connection with, procuring or carrying out the AGREEMENT. (d) that neither the ENGINEER nor the LPA is/are not presently debarred, suspended, proposed for debarment, declared ineligible or voluntarily excluded from covered transactions by any Federal department or agency, (e) has not within a three-year period preceding the AGREEMENT been convicted of or had a civil judgment rendered against them for commission of fraud or criminal offense in connection with obtaining, attempting to obtain or performing a public (Federal, State or local) transaction; violation of Federal or State antitrust statutes or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements or receiving stolen property, (f) are not presently indicated for or otherwise criminally or civilly charged by a government entity (Federal, State or local) with commission of any of the offenses enumerated in paragraph (e) and (g) has not within a three-year period preceding this AGREEMENT had one or more public transaction (Federal, State or local) terminated for cause or default. Where the ENGINEER or LPA is unable to certify to any of the above statements in this certification, an explanation shall be attached to this AGREEMENT. 9. In the event of delays due to unforeseeable causes beyond the control of and without fault or negligence of the ENGINEER no claim for damages shall be made by either party. Termination of the AGREEMENT or adjustment of the fee for the remaining services may be requested by either party if the overall delay from the unforeseen causes prevents completion of the work within six months after the specified completion date. Examples of unforeseen causes include but are not limited to: acts of God or a public enemy; act of the LPA, DEPARTMENT, or other approving party not resulting from the ENGINEER's unacceptable services; fire; strikes; and floods. If delays occur due to any cause preventing compliance with the PROJECT SCHEDULE, the ENGINEER shall apply in writing to the LPA for an extension of time. If approved, the PROJECT SCHEDULE shall be revised accordingly. 10. This certification is required by the Drug Free Workplace Act (30 ILCS 580). The Drug Free Workplace Act requires that no grantee or contractor shall receive a grant or be considered for the purpose of being awarded a contract for the procurement of any property or service from the DEPARTMENT unless that grantee or contractor will provide a drug free workplace. False certification or violation of the certification may result in sanctions including, but not limited or suspension of contract on grant payments, termination of a contract or grant and debarment of the contracting or grant opportunities with the DEPARTMENT for at least one (1) year but not more than (5) years.
