AN ORDINANCE GRANTING A VARIATION FROM THE MOUNT PROSPECT ZONING ORDINANCE WHEREAS, The Board of Appeals did heretofore on October 1, 1965, conduct a public hearing on a request by Wieboldt's Stores, Inc. for a variation from the height restric- tions contained in the Mount Prospect Zoning Ordinance to per- mit the construction of a second floor on the west 90 feet of the premises occupied by said Wieboldt's Stores, Inc. in the Randhurst Shopping Center in Mount Prospect, Illinois; and WHEREAS, Notice of public hearing was given in the manner provided by law; and WHEREAS, Similar height variations were granted to Montgomery Ward and Carson Pirie Scott & Co. at the time the said Randhurst Shopping Center was constructedj and WHEREAS, The Board of Appeals of the Village of Mount Prospect has recommended that a variation sought by Wieboldt's Stores, Inc. be grantedj NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT: SECTION ONE: That a variation from the Zoning Ordi- nance of the Village of Mount Prospect is hereby granted to Wieboldt's Stores, Inc., to permit the maximum building height ........ . on the west 90 feet of the premises occupied by the Wieboldt's Stores, Inc., in the Randhurst Shopping Center, to be increased from 24 feet to 33 feet, which premises are more particularly described as: ~- Parcell: The West 1/2 of the Southeast Quarter of Section 27, Township 42 North, Range 11 East of the Third Principal Meridian, (Except that part thereof falling in a 100 foot strip conveyed to the County of Cook by Deed recorded May 6, 1941 as Document 12674702 and filed May 6, 1941 as Document LR 895623, the center line of which is described as follows: Beginning at the Northwest corner of the Southeast Quarter of Section 27 aforesaidj thence East along the North line of said Southeast Quarter, a distance of 550 feet to a point of c~rvej thence in a generally Easterly direction along a curved line tangent to said North line of the Southeast Quarter, convexed Northerly, and having a radius of 24,555.35 feet, a distance of 1028.57 feet to a point of tangencyj thence in a generally Easterly direction along a straight line tangent to the last described curved line a distance of 165.03 feet to a point of curvej thence in a generally Easterly direction along a curved line tangent to the last described straight line, convexed Southerly, and having a radius of 24,555.35 feet, for a distance of 1028.57 feet)~ Parcel 2: The West 460 feet as measured along the North line, of the East 1/2 of the Southeast Quarter of Section 27, Township 42 North, Range 11 East of the Third Principal Meridian (except that part thereof falling in a 100 foot strip conveyed to the County of Cook by deed recorded October 8, 1941 as Document 12771139, the center line of which is described as follows: Beginning at the Northwest corner of the Southeast Quarter of Section 27 aforesaidj thence East along the North line of said Southeast Quarter, a distance of 550 feet to a point of curvej thence in a generally Easterly direction along a curved line tangent to said North line of the Southeast Quarter convexed Northerly and having a radius of 24,555.35 feet a distance of 1028.57 feet to a point of tangencyj thence in a generally Easterly direction along a straight line tangent to the last described curved line, a distance of 165.03 feet to a point of curve; thence in a generally Easterly direction along a curved line tangent to the last described straight line, convexed Southerly, and having a radius of 24,555.35 feet for a distance of 1028.57 feetj and also except the North 70 feet of the West 70 feet of the South 120 feet of said East 1/2 of the Southeast Quarter of Section 27) all in Cook County, Illinois. SECTION TWO: That the Superintendent of Building of the Village of Mount Prospect is hereby directed to issue a building permit in accordance with the variation hereinabove \ -3- granted upon proper application therefor. SECTION THREE: The variation granted by this ordi- nance shall become null and void and of no force and effect what- soever unless an application for a building permit pursuant to such variation is made and construction commenced within one year from the date this said ordinance becomes effective.
