This Ordinance creates one additional Class "Wit
liquor license for Rosati's Pizza, 1629 S. Busse
Road and one additional Class 'OR" liquor license
for the Crossroads Restaurant, 1800 S. Elmhurst
Road.

The Petitioner is requesting a Special Use to permit
a allow the garages on Lots 2, 3, 5 and 8 to be

rather than the permitted 600 sq. ft. The
Zoning Board of Appeals recommended granting this
request by a vote of 6-0.
C. A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT
BETWEEN THE VILLAGE OF MOUNT PROSPECT AND THE
SUBURBAN PRIMARY HEALTH CARE COUNCIL, INC.

Village Manager John Fulton Dixon called the
meeting of the Mayor and Board of Trustees of
the Village of Mount Prospect to order at 7:35 P.M.

WAIVE FEES:
Mr. Dennis Reindl, representing the Downtown
HOMETOWN DAYS
Merchants Association, requested that all fees and
licenses that may be required in order to conduct
the annual Hometown Days festivities be waived. It
was noted that this occasion will be held on Sunday,
July 30th on Prospect Avenue between Main Street and
Pine Street.

to waive any and all fees in conjunction with the
annual Hometown Days festivities on July 30, 1989.

1629 South Busse Road. It was noted that this

business has been in operation as a carry -out for

many years. The business will be moving to the

the new Plaza United Shopping Center with the new
location consisting of approximately 3,500 sq. ft.
and will provide seating for 95 patrons.

NEW BUSINESS
A Resolution was presented that would authorize the MABAS
Village to enter into an amended Agreement to
participate in the Mutual Aid Box Alarm System (MAGAS).
It was noted that the Village has been a member of this
program for approximately 19 years. The proposed
Agreement has been amended to include updated technology
and increase the number of participating, communities.

A Resolution was presented that would authorize entering MELAS PARK
into an amended agreement with the Metropolitan Sanitary
District of Greater Chicago, now known as the Metropolitan
Water Reclamation District of Greater Chicago, The
proposed amendments would permit alcohol to be served on
the subject property for 5 civic events each year, and
extend the term of the agreement for another 20 years.
The existing agreement expires this year.

Village Manager Dixon presented a proposal to DONOHUE &
authorize the Village to enter into a contract ASSOCIATES
with Donohue & Associates to design the. underground ENGINEERING
storm sewer at Melas Park.

it was noted that this is not a budgeted item and no
cost f igures as to the engineering costs covering
Donohue & Associates are available at this time.

engineering design for the underground storm sewer at
Melas Park.

A Resolution was presented that would authorize the
TRAFFIC AGREEMENT
the renewal of a traffic enforcement agreement between
the Village and the Colony Country Homeowners
Association. The proposed renewal provides f or an
agreement of 20 years.

Village Manager, John Dixon, presented a request for
EVERGFZW WOODS
a field change for the Evergreen Woods Subdivision,
FIELD CHANGE:
located on the south side of Golf Road and just east
LANDSCAPING
of Meier Road. The proposed field change deals with
the landscape plan.
Trustee Wattenberg, seconded by Trustee Arthur, moved
to concur with the recommendation of the Village
Manager and authorize the field change relative to
landscaping for the Evergreen Woods Subdivision.

Mr. Dixon noted that, in accordance with the direction
VILLAGE HALL
of the Village Board at the last Committee of the
EXTENDED
Whole meeting, to have the Village Hall open
HOURS
every Tuesday evening until 7:30 PM, tonight was the
first time open. The Village will also be open the
2nd Saturday of each month from 9 AM to noon. The
staff will keep track of those residents making use
of the Village Hall on those evenings and will report
back to the Board.
It was noted that since the inspectors are coming in
early each day in an effort to perform the necessary
inspections, there will be occasions when no inspector
is available to work the evening hours. The clerical
personnel are knowledgeable in the procedures of
obtaining permits, etc. and will be able to answer
questions that residents may have.
Mr. Dixon announced that the Committee of the Whole COMMITTEE OF
meeting scheduled for July 25th has been cancelled. WHOLE MEETING

ANY OTHER BUSINESS
Trustee Corcoran stated that with the repairs in PROSPECT AVE.
the Maple Street Municipal Parking Lot, he became IMPROVEMENTS
aware of the fact that the proposed improvement of
Prospect Avenue between School and Edward Streets will
not provide for on -street parking. Trustee Corcoran
noted that this is a collector street and since there
is an apparent shortage of parking spaces this might
be the appropriate time to consider improving Prospect
Avenue to a width capable of providing parking with the
possibility of have those spaces metered.
Village Manager Dixon noted that during the budget
process the Village Board was presented 3 options for
the improvement of Prospect Avenue, which were with or
without a center median and the Board's decision was
the narrowe-- roadway with no parking.
Various members of the Village Board stated that while
that may have approved such a plan, they didn't
recall that discussion. It was noted that requests
for bids are pending and that if there is a change in
the plan it could cause the project to be delayed until
spring.
It was the consensus of opinion among the Board members
that plans and cost proposals be presented for Prospect
Avenue to be improved which improvement would include
on -street parking spaces.

MR. BEEF AND PIZZA, 1.796 SOUTH ELMHURST ROAD
Lou Bosco, who owns two Mr. Beefs has acquired the interest in the WaterFall
Restaurant, located at 1796 South Elmhurst Road. The owner is requesting a Class W
Liquor License, for consumption of beer or wine only at dining tables. This would be
consistent with the other "Mr. Beefs" that he owns in Arlington Heights and Elk Grove
Village.
Mr. Bosco intends on doing extensive remodeling which is presently underway to the
Waterfall Restaurant. His hours of operation will be 11:00 a.m.-11:00 p.m. Monday -
Saturday and 12:00 noon -9:00 p.m. on Sunday. In conversations with Arlington Heights
and Elk Grove staff members, there has not been any complaints against Mr. Bosco.
We are waiting for the Incorporation papers so that Mr. Bosco can be issued his Liquor
License. All other matters have been processed in the Police Department, Mr. Bosco
will be present Tuesday evening if you have any questions.

Mr. Cesaretti is requesting permission to have a 10 foot front yard instead of the required
30 feet so that he may install a parking pad in his front yard. Mr. Cesaretti presented his
case before the Zoning Board of Appeals on July 13. He stated that his home is on a
corner lot across from Aspen Park and that the park activities make it difficult to drive in
and out of the driveway. He also stated that there are currently four cars in his family with
another to be added soon. This proposed parking pad will, in his opinion, better facilitate
exiting and entering the driveway.
Planning and Zonin staff -rated that a brief inspection of the neighborhood indicating no
other similar parking pads in front yards. It was also noted that there are two large
evergreen trees in front of this proposed parking pad that will help screen the view of this
parking area from the street The Zoning Board of Appeals discussed the issue and agreed
that because of the heavy use of the park across the street, it would be acceptable to allow
a parking pad if screened by these large evergreen trees. The Zoning Board then voted to
approve this request by a unanimous 6-0 vote. There were no neighbors or objectors
present at this hearing to voice any concerns.
A fence height variation was also requested and discussed at this hearing. The Zoning
Board of Appeals being final in this matter, voted to approve their request,

Mr. Jeffrey Cesaretti, 1813 Maya Lane, Petitioner, stated that his
home is on corner lot across from Aspen Park, There are currently
four cars with another to be added soon in the family. Due to intense
park activities and cars parked on both sides of the street during
these times, Mr. Cesaretti indicated the difficulty in pulling in and
out of his driveway. The danger of children running out between
parked cars was also stated. A parking pad is being requested to
facilitate exiting and entering the drive and to reduce the hazard of
hitting a car or child.
The second variation request is for a 51 high fence extended all the
way to the front building line along Buckthorn Drive. After speaking
with his neighbor, the Petitioner has since reduced the height to 41.
A small back yard and large side yard with a lack of privacy were
stated as hardships. The fence will be approximately 251 from the
front sidewalk.
Mr. Paul Bednar, Planner for the Village, stated that upon inspection
of the neighborhood no other similar situations were dicovered in
regard to the parking pad. It was noted that the two large evergreens
will help to screen the pad from the street. Mr. Bednar noted that

the Petitioner would be gaining an additional 1,550 square feet of
private enclosed space with the addition of the fence. Variations
have been granted for such fence extensions, but they were on busy
streets rather than residential. No precedent has been set within
this neighborhood.
Mr. Brettrager noted that Maya Lane is a busy street. Mr. Lannon
indicated his support of the parking pad, but not the fence.
Mr. Cesaretti argued that the fence is necessary for his privacy to
enjoy his property without people or cars coming through his yard. He
stated that he could plant bushes along the sidewalk and allow them to
grow to heights of 8-101 and let them hang over the sidewalk.
Pictures were offered with such examples of this less acceptable
alternative.
Upon motion by Ms. Brothers, and seconded by Ms. O'May, it was moved
to grant a variation from Section 14.1102.A to allow a 101 front yard
instead of 30, in order to permit a parking pad.

The applicant is requesting a variation from Section 14.1102.A to allow a 10 foot front yard
permitting a parking pad. Code normally requires a 30 foot front yard setback. Also a
variation is requested from Section 21.601-k3 to allow a five foot high fence extending to
the front building line along the side street on a corner lot. Code normally permits a fence
entirely behind the rear building line along the side street on a corner lot.
ELIAGE UAEE COMMENTS
Both the Engineering and Inspection Services Departments request that the width of the
driveway be tapered to a maximum 21 feet at the property line. Permits will be required
for both the fence construction and for any driveway construction if variations are granted.
No other comments or objections were received regarding this case.
P HM AC ZONING COMMEM
This property is located at the comer of Buckthorn Drive and Maya Lane in a single family
neighborhood on the northeast side of town. Across Maya Drive on the north side is a
park and school site. Mr. Cesaretti is requesting two separate variations from the Zoning
Code. One variation is to allow a parking pad to be constructed off the existing driveway
reducing the front yard open landscaped area to 10 feet in this location. The location of
this new parking pad is to be tucked in back of two large existing Blue Spruce trees. As
we have stated in similar cases, the main question we have is one of hardship. The
petitioner should be able to substantiate any need for the additional parking pad in this
front yard. We question whether it is an inconvenience rather than a hardship that parked
cars would have to shuffled in and out .of the driveway in order to access the garage.
Presently, the applicant has a two car garage with a two -car wide driveway. It is possible
to park four cars total on the property; (two in the garage and two in the driveway.) The
fact that there are two large Spruce trees located directly adjacent to this proposed parking
pad, will help minimize any visual impact this parking space may have from Maya Lane.
Upon a field inspection of the neighborhood, we found no other similar situations.

The second variation request is for a 5 foot fence extended all the way to the front building
line along Buckthorn Drive. The applicants have stated in their application that, since they
live on a comer lot, they have a small back yard for private living space. Upon a field
investigation of the property, it is apparent that the allowed rear yard fenced area would
be smaller than normal. If granted the variation as proposed, the applicants could gain an
1,550 square feet of private enclosed space. Extensions of fenced yards have generally been
approved in the past for comer lots when the side yard abuts the heavily traveled street.
This is not the case on this particular property. There have been only a few other cases
where a fence extension, such as this, has been proposed for a comer lot on two local
streets. A brief inspection of the neighboring area indicated no other fenced in side yards
on comer lots.
In summary, Mr. Cesaretti must establish a hardship for both requests. In our opinion, the
two large existing Spruce trees in the front yard will help to screen most of the visibility of
a new parking pad, if it is allowed. It is also true that the large side yard along Buckthorn
Drive of 1,550 square feet would not normally be fenced per the Zoning Code.

Mr. Miller, the developer of this subdivision, is requesting a special use for three -car
garages for all the subject lots. He also requested variations to increase the size of the
garages from 600 to 750 square feet for Lots 2, 3, 5 and 8. Lots 1 and 9 (1451 and 1419
Bonita) will be allowed to have garage size of 650 square feet. Also requested was a
variation to allow driveway width on these subject parcels of 30 feet at the garage and then
tapering to 21 feet at the property line. Finally, he requested a two year time period on
the subject variations rather than the I year period normally allowed.
Mr. Miller presented his case to the Zoning Board of Appeals on July 13, 1989. He stated
that in 1988 he requested and received blanket variations for Lots I through 9 in this
subdivision for three car garages, 650 square foot garage sizes, and 30 foot driveway widths
tapering to 21 feet at the property line. Ordinance # 3943, allowing these variations with
basic conditions, expired on May 17, 1989. Mr. Miller is now requesting the same variations
(slightly revised) that had already been approved. The petitioner also explained that a two
year time period for the variations was necessary as he is a custom builder and it will
probably take this length of time to build these six homes.
The Board discussed the issue briefly and agreed that Lots 1 and 9, because of their width,
should have garages held to a maximum 650 square feet. They then voted to approve the
special use for the three car garages on the balance of the lots and also the subject
variations on the condition that Lots 1 and 9 be allowed a maximum 650 square foot
garage. No neighbors or objectors were present at this hearing to voice their concerns.

properties, stated that he would like to continue the variances
granted last year which expired in May, 1989. These large homes will
be built within the Fathcon Subdivision. Two homes have been
completed to date. Two lots are currently under contract and require
three car garages. Mr. Miller indicated that the trend for $400,000+
homes is three car garages to keep cars off the street and safe from
weather and vandalism.
Paul Bednar, Planner for the Village, noted that these variations were
granted over a year ago. Due to a recent Zoning amendment, it is now
necessary that three car garages be presented as a special use. The
750 square feet garages requested are due to side load garages which
require more room to maneuver• Mr. Bednar suggested that the Board
may consider limiting the size of the garage and drive on lots 1 and 9
due to their narrow front yards.

The Board questioned the request for a two year time period on the
variations. Mr. Miller stated that due to the time involved in custom
building, only three homes will be built this year, with four expected
to be built next year. These sites will not be able to be built out
completely within one year's time.
The homes square footage was discussed with the low end being 3100
square feet and the maximum 4500 square feet. Mr. Miller also agreed
to the 650 square foot maximum garage size for lots 1 and 9.
Mr. Lannon, seconded by Ms. Brothers, moved to grant a special use for
the three -car garages for the balance of the lots in the Kathcon
Subdivision along with the variations from Section 14.102.B.4 to allow
the size of these garages to be up, to 750 square feet, if they are
side load garages on lots 2,3,5 and 8 and 650 square feet on lots 1
and 9i and from Section 14.3016.A.3 to allow maximum driveway widths

Both the Engineering Department and Inspection Services Department note that a grading
plan will be required for each lot. It may require that special grading treatments be used
as a result of the wider driveways. The comment was also made by Village staff that 1419
and 1423 Bonita (Lots 9 and 8) be "eluded from this blanket Proposal due to the smaller
frontage cul-de-sac location and the easements located on these properties. No other
comments or objections were received from Village staff regarding this case.
In 1988 Mr. Miller requested and received blanket variations for lots I through 9 in the
Kathcon Subdivision for three -car garages 650 square foot garage size and 30' driveway
width, tapering to 21' at the property line. Ordinance #3943 outlines the granted variations

Recently the Zoning Ordinance was amended to allow three -Car garages as a special use
rather than a variation, as was originally approved in this case. Therefore, this new
proposal is for both a special use for the three -car garages and variations for the size and
driveway widths. The only difference from the original request is that a 750 square foot
maximum garage size is now proposed for lots 2, 3, 5 and 8, whereas lots I and 9 will be
the same 650 square foot size originally approved in Ordinance #3943,
To date, only two of the nine lots in the subdivision have been built upon. It is Mr. Miller's
intent to have the three -car garage special use and subject variations on hand for each
remaining lot in order to allow him the flexibility to design homes and driveways at the
client's request.
Lots 9 and 8 (1419 and 1423 Bonita) are located at the end of the cul-de-sac and, as a
result, have narrow front yards. The Board may consider treating these two lots differently
from the others as was suggested by other Village staff. Perhaps three -car garages and
wider drives are not appropriate on these two lots. Be aware that Ordinance #3943
granted three -car garages and wide drives to these lots also.
Although this request differs very little from the original request that was approved in 1988,
Mr. Miller has requested a 750 square foot garage size for a number of lots instead of the
650 square foot size. The reason for this is that a side -loading three -car garage sometimes
requires more space for car maneuvering purposes. For instance, in a recent request by
the Mitroff Companies on Kennicort Place, a three -car garage was approved at a 730 square
foot size because of the side -load issue.

referred to as the "COUNCIL"'), an Illinois Not -for -Profit Corporation.
Statement of PuMgse
As a grantee of Community Development Block Grant funds (hereinafter referred to
as CDBG funds) by the U. S. Department of Housing and Urban Development (hereinafter
referred to as HUD), the VILLAGE elects to contract for services with the COUNCIL for
operation of a program to facilitate access to primary health care for low- and moderate -
income residents of the Village of Mount Prospect as outlined in the Scope of Services
attached herewith as Exhibit "N'.

The VILLAGE does hereby contract for services with the COUNCIL up to a
maximum of $13,600.00 and the COUNCIL agrees to abide by the provisions and
regulations of the 1974 Housing and Community Development Act, as amended under
which said contract is made, and to use said contract funds for the purposes set forth in
Section I hereof and as conditioned by the provisions of Section III next.
The VILLAGE's contractual obligation as identified in Section I shall be limited to
the maximum amount specified in Section H, to the actual amount invoiced by the
COUNCIL, and only to the extent such amount is received from HUD for such purposes.
Conditions of Contract
A. Indemnification, The COUNCIL agrees to indemnify and save and hold harmless
the VILLAGE and each and everyone of its officers, agents, employees, servants, attorneys,
insurers and successors from any and all claims, demands, causes of action, expenses,
injuries, losses or damages of whatever kind, character of description the VILLAGE may
BE
suffer as a result of any cause, matter, act, or omission arising out of the failure of the
COUNCIL, or those acting under it, to conform to the statues, ordinances or other
regulations or requirements of any governmental authority, in connection with the
COUCIL's performance under this Agreement. The COUNCIL agrees to defend against
any claims brought or actions Filed against the VILLAGE with respect to the subject of the
indemnity contained herein, whether such claims or actions are rightfully or wrongfully
brought or filed. In case of such a claim brought or such an action filed, the VILLAGE
agrees that the COUNCIL may employ attorneys of its own selection to appear and defend
the claim or action on behalf of the VILLAGE, subject to reasonable approval by the
VILLAGE, at the expense of the COUNCIL. The COUNCIL, at its option, shall have the
sole authority for the direction of the defense.
B. Non-discrimination The COUNCIL, performing under this Agreement, shall not
discriminate against any worker, employee, or applicant or any member of the public,
because of race, creed, color, sex, age or national origin. Such affirmative action shall
include, but not be limited to the following: employment, upgrading, demotion or transfer,
termination, recruitment or recruitment advertising, layoff or termination rates of pay, other
forms of compensation, selection for training including apprenticeship. The COUNCIL
agrees to post in conspicuous places available to employees and applicants for employment,
notices setting forth the provisions of this non-discriminatory clause. This policy of non-
discrimination and affirmative action shall be applicable with regard to both COUNCIL's
internal personnel practices and its actions in the performance of this Agreement. The
COUNCIL agrees and authorizes the VILLAGE and HUD to conduct compliance reviews
or any other procedures to assure compliance with these provisions, subject to applicable
laws and regulations concerning privacy with reasonable notice to the COUNCIL.
C. ExgMinalion of Records The COUNCIL will, at all times, give HUD, the
Comptroller General of the United States, and the VILLAGE, through any authorized
representative, access to, and the right to examine all records, books, papers or documents
related to the contract, in accordance Adth state and federal law. Said records shall include
verification of household income and information on race or national origin. Eligible
households for this program must have incomes below those noted in Exhibit C. The
COUNCIL may establish program income criteria below that noted in Exhibit C.
D. Filjne of Records The COUNCIL shall file with the VILLAGE such duplicates
of records covering such activities to be performed in whole or in part, as specified in
Exhibit "A".
E. v i ility of _L4% Regulation s and Qrders.The VILLAGE shall, upon the
request of the COUNCIL, provide it with copies of all laws, regulations and orders,
including those cited in this contract, which regulate the operation of the Block Grant
funded programs, or which might otherwise affect the performance of this Agreement.

Compliance With LAWS
The COUNCIL shall, at all times, observe and comply with all laws, ordinances or
regulations of the Federal, State, County and local government which may in any manner
affect the performance of this Agreement, and the COUNCIL shall be required to perform
all acts under this Agreement in the same manner as the VILLAGE, as a contractor of the
Federal Government, is or would be required to perform such acts.
SECTION
Subsequent to the execution of this Agreement, the VILLAGE shall forthwith file all
necessary documents with HUD and shall comply with all applicable rules and regulations
necessary to facilitate acquisition of funds approved for this program by HUD. The
COUNCIL shall not file any lawsuit against the VILLAGE or any of its officers or
employees as a result of this contract, except that this Section shall not act as a bar to any
lawsuits arising from the negligent or willfully wrongful acts of the VILLAGE or any of its
officers or employees.
SECTION VI
affling and Revorting Arrantements
Pursuant to this Agreement, the VILLAGE will disburse CDBG funds to the
COUNCIL on the following basis:
I. The VILLAGE shall allocate the $13,600.00 contract amount for the services
stipulated in this Agreement~ The COUNCIL shall submit no more than one
invoice per month for an amount equal to one -twelfth of the contract amount.
Every month, the COUNCIL shall submit to the VILLAGE a Monthly
Performance Report. Said report shall include available information on:
a. Each Mount Prospect client served during the month, showing the client's
COUNCIL number, address, and type(s) of service rendered. Services may
also include number of applications received and the number of applicants
approved for the program.

The first report shall be due on June 10, 1989. All others shall be submitted no
later than the 10th of the month.
2. A final report shall accompany the COUNCLL:s final billing and regular monthly
report in May of 1990. This report will highlight the accomplishments of the
program over the past year, summarize for the fiscal year, from May 1, 1989 to
April 30, 1990, the number of Mount Prospect residents served by type of
assistances, and include the completion of Exhibit B herein attached.
SECTION VII
Leneth of Contract
This, Agreement shall be valid from the date it is entered into thru April 30, 1990 and
may be terminated by either party upon thirty (30) days written notice. All costs associated
with the completed tasks shall be billed to the VILLAGE and reimbursed upon
presentation of all documentation required under Section VI.
The COUNCIL shall not assign this Agreement or any part thereof and the COUNCIL
shall not transfer or assign any funds or claims due or to become due hereunder without
the prior written approval of the Village Manager. Any transfer or assignment of funds
pursuant to this Agreement, either in whole or in part, or any interest therein which shall
be due to the COUNCIL shall be deemed of no force or effect and shall not be binding
upon the VILLAGE.

THE ACCESS TO CARE PROGRAM
In Illinois, 1.5 million persons are without public or
private health insurance coverage. Between 50 and 60 percent of
the uninsured live in Cook County. Most are unable to afford
even basic health care services.
The Access to Care program allows access to basic health
care services for uninsured suburban Cook County residents with
limited income. Demonstration projects are operational in two
suburban areas. The northwest demonstration area, where the
program became operational in December, 1988, includes the
townships of Barrington, Elk Grove, Hanover, Maine, Palatine,
Schaumburg and Wheeling. The south demonstration area became
operational in May, 1989 includes the townships of Rich and
Bloom.
Any resident of the demonstration area with a family income
less than twice the poverty level who is uninsured for primary
health care and ineligible for public programs, such as Medicaid
and Medicare, may enroll in the program. Enrollees will be able
to obtain primary health care services from participating Access
To Care providers and pay only a small co -payment to providers.
Covered services include physician office visits, routine
laboratory, x-ray and pharmacy services.
Access to Care physicians are family practice, internal
medicine, and pediatric specialists who see clients in private
office settings with the exception of the arrangement between the
Council and the Lutheran General Medical Group where clients are
cared for at the Nessett Health Center in Park Ridge.
Registration is at Township offices, CEDA offices, the Cook
County Department of Public Health in Mt. Prospect and Markham,
and the Park Forest Health Department. Eligible clients are
able to select a first, second, and third choice Access to Care
physician at the time of registration. Appointments can be made
with the first choice physician immediately. The client copy of
the registration forms serves as a temporrry (thirty day) patient
identification. Within thirty days after Council staff verifies
the absence of health insurance coverage, a permanent (six month)
identification card is mailed to the client.
The Center for Health Services Research of the University of
Illinois School of Public Health is under contract with the
Council to perform an evaluation of the Access to Care program.
The study is due in August, 1989. The Council is paving new
ground in developing a program for those who "fall between the
cracks" of coverage and the program evaluation will serve to
answer questions about the effectiveness of the delivery
mechanism.
Physicians submit monthly reports and clients complete a
questionnaire which provide data for the evaluation. An
additional client survey is included in the evaluation design.
Clients receive resource inventories for preventive services
available through community agencies which are free or low cost.
The Council has coordination agreements with these agencies.
These materials, along with the questionnaire, are in english and
spanish.

EQUAL EMPLOYMENT AND APPIRHATIVE ACTION
The Suburban Primary Health Care Council is committed to

GOALS AND OBJECTIVES
The Council will rely on those resources in recruiting
personnel that will assure qualified employees and will
make every effort to maintain a goal of an equitable
and balanced representation of minority and ethnic
groups.
2. Utilization of Present Skills of E to ees
All Council positions are covered by the program.'
Positions are filled on the basis of training and
experience. Any advertisements for vacant positions
will state the education and experience requirements
for the position. Emphasis will be placed on
recruitment of minority candidates.
To insure that Council employees are given an
opportunity to apply for advancement or lateral
movement, all employees shall be offered the
opportunity to apply for position openings.
Applications received from employees within the time
period specified will be considered. In the event an
employee 1s not selected for the position opening,
he/she will be so notified in writing. If a
previously announced position opening is deleted, all
applicants for such position shall be so notified in
writing.
The President will communicate promotional
opportunities to employees providing existing and
projected vacancies, application and testing procedure
and qualification requirements.
3. Evaluation and Reporting
The Council appoints its President as its responsible
agent in full implementation of its affirmative action
program. He/she shall submit an annual report to the
executive committee providing a review of the
implementation of the affirmative action program.
Grievance Procedure
Any employee who feels that he or she has been
discriminated against on the basis of race, ancestry,
creed, color, linguistic background, sex, Vietnam
veteran and other veteran status, national origin,
marital status, unfavorable discharge from military
service, age, or physical disability will follow the
grievance procedures outlined in this manual.

Catch Basin and Inlet Repairs
Sealed bids were opened at 10:00 AM on July 25, 1989 for the
proposed repair/reconstruction of catch basins and street storm
water inlets. There were eight invitational bids sent out in
addition to advertising in the local paper. Bid results as
follows:
Artley Paving and Contracting Corp. $29,052.50
Martam Construction Co. 32,375.00
Ed Pontarelli Construction Co. 62,505.00
The totals include 41 catch basins and inlets for re-
pair/reconstruction and replacement of curbing, pavement and
sidewalks damaged as a result of repair work. There was $29,000
allocated in the current budget for this work. The funding is
under account codes 1-071-07-6260, 1-071-07-6262 and 1-071-11-
6263.
I recommend acceptance of the lowest bid of $29,052.50 as submit-
ted by Artley Paving and Contracting Corporation.

SUBJECT: PROSPECT AVENUE RECONSTRUCTION
The Village Board reviewed the reconstruction Of Prospect Avenue at the Committee of
the Whole meeting on April 11, 1989. At that meeting, options concerning the
construction of a seven foot island in the center of Prospect Avenue as opposed to a 31'
wide back-to-back, curb with no islands was reviewed. The cost considerations, because
of the poor soil conditions under the road, led the Board to decide that the center island
was not necessary. There was some discussion concerning whether or not it was
necessary for additional parking along Prospect Avenue, however, there was not extensive
discussion held at that time. From a transition standpoint, it makes sense to have the
next block that is to be reconstructed on Prospect Avenue dictate the width for the
entire additional length of Prospect Avenue all the way to Mount Prospect Road.
I am attaching cost estimations for a 31' back of curb street which would not permit
parking lanes on both sides of Prospect Avenue and also a cost estimation for a 41'
back of curb road which would permit two lanes of parking; one on either side of the
street as well as two twelve foot passing lanes for traffic. The estimated cost for the 31'
is $360,000; the cost for the 41' is $422,000 or approximately 17% more.
The cost considerations that are attached are for two blocks of Prospect Avenue to be
constructed from School Street to Edward Street Presently, plans are out for bid and
are to be returned on July 26 for the 31' back of curb design. We should proceed with
the bid and if the Board decides to consider the 41' street, we should then go back to
the low bidder and increase the quantities that were accepted in the bid to build a 41'
road. If the bidder agrees to this increase, then we would be able to continue the
construction without any further delays.
Other considerations that need to be reviewed by the Board are whether or not providing
additional parking is a policy that the Board wishes to provide on this section of Prospect
Avenue.

On July 26, 1989, at 10:00 A.M., sealed bids were received for the
Prospect Avenue Reconstruction. At this time, the sealed bids were -
publicly opened and read aloud.
BID FORM
The Bidder was requested to submit unit prices for a total of 25
individual bid items.
BIDS RECEIVED
Seven Contractors received Contract Bid Documents. A total of four
Contractors submitted bids. The bids range from a -low of
- $382,810-00 by Martam Construction Co. to high. of $444,610.35 by
Arrow Road Construction Co. The Engineer's Estimate for the
project was $360,200.00.

All Bidders submitted Bid Bonds in the amount of lot of their totaL,_
bid as required by the Contract Documents. All Bidders correctly:

NOTE: At the bid opening, Martam Construction Co.'s bid was
read as $397,810.00. When the engineering division checked the
tabulation of the bid, it was noted that Martam Construction Co.,
failed to submit a unit price for Item No. 25 "Traffic Control."
Per the contract bid form, the total bid is determined by
multiplying our estimated quantities by the Bidder's unit prices.
By omitting a unit price, it is assumed that the bidder has
determined the bid item to be an incidental cost to the overall
contract.
Martam Constz7uction"- 'Co., has been notified that the
Village will not pay any amount for "Traffic control". Martam
Construction Co., agrees to this stipulation.
QHA—LIFICATIONS OF LOW BIDDER
The low bidder is Martam Construction Co., Inc.
Martam Construction Co. is a frequent bidder of Village projects.
Last year, they performed the "Evergreen Avenue Water Main
Replacement Project" and also the "George St. Bridge Repair".
RECCMXENDATION
Therefore, the Engineering Division recommends awarding a Contract
to Martam Construction Co., Inc. with a Bid Price of $382,810.00.
Funding for this project is shown on Page 153 of this year's budget
under Account Code No.1-071-04-8495.

SUBJECT: Alternate Proposal for Prospect Avenue Reconstruction
(School Street to Edward Street)
On July 26, 1989, at 10:00 A, M. sealed bids were received
for the Prospect Avenue Reconstruction. At this time the sealed
bids were publicly opened and read aloud. The bids were based on
plans prepared by the Village Engineering Division for a 311 Back
to Back of Curb pavement.
Pursuant to the Village Board discussion at their Meeting
of July 18, 1989, regarding a 411 Back to Back pavement which would
allow parking on the roadway the Engineering Division has taken
the Unit Bid Prices submitted by the bidders and extended them with
the revised quantities for a 411 B -B roadway. The results were as
follows:

agreed they will abide by the unit prices quoted for the increased
quantities of 411 B -B pavement.
Based on the unit costs as bid, and the increased
quantities for a 410 B -B roadway vs a 311 B -B roadway the bid price
of Martam Construction Co. is $456,240.00 vs $382,810.00 - a
difference of $73,430.00.

If the Village Board decides to approve a 410 B -B roadway
for Prospect Avenue Reconstruction, the Engineering Division
recommends awarding a contract to Martam Construction Co., Inc.
with a Bid Price of $456,240.00.
Funding for this project is shown on Page 153 of this
year's budget under Account Code No. 1-071-04-8495. Unobligated
amount remaining in this account as of 7/25/89 is $310,081.07.

SUBJECT: RESOLUTION - PAUL WATKINS
The Village Board had previously discussed the pension for Firefighter Paul Watkins.
Under the Manager's Report, I wish the Board to consider a Resolution authorizing the
return of any excess funds that have been transferred from the Firemen's Pension Fund
into the special Paul Watkins Firemen's Pension Fund should there be any funds left
after Paul and his wife pass away.
The actuarial exposure for Paul Watkins is $311,000 of which $274,000 is already in the
Fund meaning that the Village's outside exposure is $37,000.
It is necessary for us to pass this Resolution indicating to the State our intent should
there be any funds left in the special Paul Watkins' Fund.

A RESOLUTION AUTHORIZING RETURN OF ANY
EXCESS FUNDS IN THE PAUL WATKINS SPECIAL ACCOUNT
TO THE MOUNT PROSPECT FIREMEN'S PENSION FUND
WHEREAS, on December 8, 1971, the village of Mount Prospect
entered into an agreed order, In the Matter of a Petition to
71-C-6-05261 then pending in the Circuit Court of Cook County,
Illinois, County Department, County Division, providing for the
annexation of the territory of the Forest River Fire Protection
District ("District") to the Village of Mount Prospect ("agreed
order"); and
WHEREAS, the agreed order also provided that Paul Watkins, one of
the firefighters in the District, as well as two other
firefighters in the District, would be accepted into the Mount
Prospect Firemen's Pension Fund and that their accrued benefits,
rights, and future expectancies would be preserved; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect on April 18, 1978, adopted Ordinance No. 2783
which established a plan of deferred compensation for Paul
Watkins, among others, and pursuant to that Ordinance the Village
of Mount Prospect on April. 29, 1978, entered into an Agreement
For A Plan of referred Compensation with Paul Watkins ("Watkins
Agreement"); and
WHEREAS, -Ordin¢..Ge .ao. 2783 and the Watkins Agreement provide
that the Treasurer of the Village of Mount Prospect shall oversee
the plan -and make payments thereunder to the Paul Watkins Special
Account; and
WHEREAS, upon the deaths of the beneficiaries of the Paul Watkins
Special Account, there may be funds remaining in said account,
and the President and Board of Trustees of the Village of Mount
Prospect, Illinois, find and believe it to be in the best
interest of said Village that those excess funds be transferred
to the Mount Prospect Firemen's Pension Fund for the benefit of
all participants in that Fund.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: Upon the deaths of the beneficiaries of the Special
Account set up for Paul Watkins, the Village Treasurer shall
determine what funds, if any, remain.
SECTION TWO: The excess funds in the Paul Watkins Special
Account which remain after the deaths of the account's
beneficiaries shall be transferred by the Village Treasurer to
the Mount Prospect Firemen's Pension Fund for the benefit of all
participants in that Fund.
SECTION THREE: This Resolution shall be in full force and effect
front ,and after its passage, and approval in the manner provided
by law.

MINUTES of the REGULAR MEETING of the
MOUNT PROSPECT PLAN COMMISSION
July 19, 1989
CALL TO ORDER
The regular meeting of the Mount Prospect Plan Commission was
called to order by Chairman Donald Weibel at 8:00 P.M. at the
Village Hall, 100 South Emerson St., Mount Prospect, Illinois.
Chairman Weibel reported that Mr. Borrelli had resigned from
his position as Commission secretary and that Mr. Kloster would
replace him.

APPROVAL OF MINUTES
Mr. Richardson moved, and Mr.Breitsameter seconded, that the
minutes of the meeting of June 7, 1989 be approved as submitted.
All members voted Aye and the Chairman declared the motion passed.
SUBDIVISIONS
Amoco Oil Station, 1631 East Euclid - The applicant was requesting
Development Code modifications permitting detention basin floor
slope of 1 % and building proximity to detention facility of 50 feet.
The applicant's attorney, Mr. John Murphy, stated that one additional
modification was being requested to allow a 3:1 detention side slope.
Staff had reported no objections to the first two modification re-
quests but had not reviewed the third request.
There was discussion concerning the fact that two adjacent residents
buildings were within 75 feet of the proposed detention facility and
the affected residents had not been made aware of this to voice their
objections or comments, if any. Mr. Murphy stated that he had talked
to both neighbors and they were in favor of the project but he could
not say if they were aware of the building proximity matter.

Mr. Velasco moved, and Mr. Navigato seconded, that the Development
Code modification request to allow the 1% basin slope be approved.
All members present voted Aye and the Chairman declared the motion
passed.
Mr. Richardson moved, and Mr. Navigato seconded, that the Develop-
ment Code modification request to allow a 3:1 side slope be appro-
ved subject to review and approval by Staff. All members voted
Aye and the Chairman declared the motion passed.
Mr. Navigato moved, and seconded by Mr. Borrelli, that the Devel-
opment Code modification request to permit the Amoco building and
two adjacent buildings to be within 75 feet of the detention fac-
ility be approved with the provision that Staff review and approve,
and notify the adjacent neighbors. The vote on the motion was
6 Aye; 2 Nay and the Chairman declared the motion passed.
Mr. Velasco stated that he voted against the motion because he
felt he could not vote for something on which the people who are
directly affected have not been notified and have not had a chance
to voice their objections.
ST PAUL SCHOOL RE -SUBDIVISION, 100 S. School Street
Mr. Robert Moore, Attorney for the applicant, explained this request
which was for consolidation of six lots into one lot of record. Mr.
Richardson move, and seconded by Mr. Borrelli, that the re -subdiv-
ision be approved. All members voted Aye and,the Chairman declared
the motion passed.

D. Text Amendment: Mr. Velasco reported on the rescinding of a
Village ordinance that had required a down-
town business to make a $1500 payment for
each required parking space that the business
was unable to provide. In rescinding the ordi-
nance, provision was made that payments made
previously under the ordinance would be returned.

OLD BUSINESS
Chairman Weibel reported that Commission terms for himself,
Mr. Boege, and Mr. McGovern had been extended to April 30, 1993.
In connection with the newly revised Fair Housing ordinance, Mr.
Weibel stated that consideration might be given to creating a
separate crnmittee and he asked the members to think about it,
an give their opinions.
Mr. Sims reported that a minor revision would be made to the
present Village complaint form to provide for Fair Housing
complaints.
Mr. Borrelli inquired as to the status of the Schoenbeck Road
relocation and access to Rand. Mr. Sims said there are details
that haven't yet been worked out.
Mr. Sims reported that a copy of the map for the proposed bike
path was at the park district for review. Staff has reviewed it
and he will try to get a copy to the Plan Commission members
for their comments at the next meeting.

QUESTIONS AND COMMENTS
On behalf of the Commission and himself, Chairman Weibel thanked
Mr. Borrelli for the fine job he had done as commission secretary
and welcomed Mr. Kloster as the new secretary.
ADJOURNMENT
There being no further business, the Chairman declared the
meeting closed at 9:50 P.M.
