This Ordinance amends specified Sections
regulating the operation of Cable Television. (Exhibit A)

1. 1st reading of AN ORDINANCE AMENDING SPECIFIED
SECTIONS OF CHAPTER 14 ENTITLED "ZONING ORDINANCE"
OF THE VILLAGE CODE
This case proposes amendments to the Zoning
Ordinance (Chapter 14) relative to standards for
size of residential garages; impervious surface
coverage; setbacks for parking in commercial
areas; satellite dishes in B-3 and B-4 Districts;
excluding retail uses in an I-1 District; and, to
permit day-care as a Special Use in B-1, B-3
and B-4 Districts and, driveway width of 151
for a one -car garage. The Zoning Board of
Appeals recommended approving these text amendments
by a vote of 6-1. (Exhibit B)
2. 1st reading of AN ORDINANCE AMENDING
SECTION 21.601 OF CHAPTER 21 OF THE VILLAGE
CODE OF MOUNT PROSPECT
This ordinance amends Chapter 21 by increasing
the height of fences in residential districts
from five feet to six feet. The Zoning Board
of Appeals recommended approving this text
amendment by a vote of 6-1. (Exhibit C)

2nd reading AN ORDINANCE AMENDING ARTICLE XI OF
CHAPTER 11 OF THE VILLAGE CODE
This ordinance creates a drug and alcohol testing
procedure for taxi cab drivers.

IX. NEW BUSINESS
A.
ZBA 8-V-89, The Alter Group, Lake Center Plaza
The Petitioner is requesting variations from the
interior side yard requirement of 30 feet to allow
fifteen feet plus one foot for every two feet of
building height above fifteen feet; to allow a thirty
foot yard, rather than the required forty feet, for
side yards in an 1-1 District adjacent to Residential
Districts subject to landscaping; to a twenty foot
rear yard in an I-1 District adjacent to Resident
District instead of the required forty feet; to allow
two parking lots or shared drive of service/loading
facilities rather than the required ten foot side and
rear yards; to allow a zero yard for loading and
ten foot yard for parking, instead of the required
forty feet and ten feet; to allow a five foot side
yard, rather than the required ten feet, where 2
parking lots abut, provided a minimum of 10, of
landscaped area be provided between the 2 lots. Also
requested are variations to permit a minimum 2 acre
parcel in the I-1 District, rather than the required
4 acres; to permit 2 parkings spaces 121 x 351 for
buildings less than 40,000 sq. ft. in area, rather than
the required 121 x 501 loading space; and, to
permit a two parking lots of shared drive or service
facilities to abut in an O -R District, rather than the
ten foot side yard required. The Zoning Board of
Appeals recommended granting these variations by a
vote of 6-0. These variations were approved by the
Zoning Board of Appeals and Viilage Board in 1987,
however the effective period of one year has expired.
B.
A RESOLUTION APPROPRIATING MOTOR FUEL TAX FUNDS
This Resolution authorizes the appropriation of
$107,000 for street maintenance for 1989.

COMMUNICATIONS AND PETITIONS
Trustee Arthur noted that he had attended the Mount
Prospect Jaycees reception over the weekend at which the
Village Board members and some administrators were
acknowledged for their support of the Jaycees.
MAYORS REPORT
Mayor Krause noted that Kra. Egan's 3rd grade class
at Lions Park Elementary School would be watching
this Board meeting on Channel 63 and encouraged
their involvement in local government and civic
affairs in future years.
OLD BUSINESS
ZBA 70-V-88 ZBA 70-V-88, 1400 Cleven Avenue
1400 CLEVEN An Ordinance was presented for first reading that
would- grant a • variation► to permit a 4 foot
separation between the principal structure and a
detached garage. It was noted that the petitioner
has agreed to provide the drywall required to
provide an adequate barrier between the garage and
the neighboring house, as well as other safety
features recommended by the Fire Department.
At the request of the Petitioner, Trustee Farley,
seconded by Trustee Arthur, moved to waive the rule
requiring two readings of an Ordinance,

PUBLIC HEARING: Mayor Krause called a Public Hearing, called
pursuant to proper legal notice having been
published in the local newspaper, to order at 7:45
P.M.
The purpose of this Public Hearing is to consider
amendments to the Ordinancegoverning the operations
of Cable T. V. and to consider the matter of a fine,
as discussed last month at a meeting of the Village
Board.

Mayor Krause asked if there was anyone in the audience
who would like to voice their opinion relative to the TCI
operation of Cable T. V. in Mount Prospect.
Ralph Dee, 220 W. Coventry Place and the resident at
1701 Cottonwood, stated that they have had service
problems, getting through to TCI via the telephone and
problems with resolving the outage.
Dan Delaney, State Manager of TCI, Inc. stated that
many improvements have been made in the quality of
service, including increased number of customer service
representatives, which has reduced the amount of time a
customer remains on hold, and increased the efficiency
of handling problems. Mr. Delaney also stated that since
the Village is amending the ordinance regulating operations
of cable T.V., it would be appropriate to negotiate an
amendment to the Franchise Agreement.
It was the opinion of the Village Board that the proposed
amendments should be adopted in an effort to reduce the
number of customer service complaints being received. It
was noted that the Cable Council will be meeting within
the next few days and that entity will be recommending
various changes to the regulations governing Cable T.V.
Trustee Farley also brought up the matter, continued from
a previous public hearing, on whether the Village should
levy a fine against TCI for non-compliance.
It was the recommendation of Trustee Farley not to levy a
fine since improvement in the many problem area, customer
service, as improved.
Trustee Farley, seconded by Trustee Arthur, moved to concur
with the recommendation that no fine be levied against
TCI, Inc. for non-compliance through the date of this
Public Hearing.

There being no further discussion, Mayor Krause declared the
Public Hearing relative to TCI Cable T.V. closed at 8:20 P.M.
NEW BUSINESS
ZRA 66-A-88, Text Amendment ZBA 66-A-88
This case proposes several text amendments to Chapter 14, TEXT AMEND.
Zoning, including: standards to increase the size of
residential garages; reduce the lot coverage of
impervious surface in R-1 District from 501 to 45%;
establish a 30 foot front yard setback for commercial
property; provide for satellite dishes as a special
use in B-4 District; prohibit retail use in an 1-1
District; provide for day-care centers as a Special
Use in B-1, B-3 and B-4 Districts; increase the height
for fences behind the front lot line from 5 feet to
6 feet: restrict driveway width for one -car garage to
15 feet; and, to delete specific language which is
addressed in the newly adopted parking requirements.
The Zoning Board of Appeals recommended approving these
amendments by a vote of 6-1.

There was discussion as to whether the 30 foot front
yard setback would create a hardship on businesses
and concern that the subject of fence height did not
provide for aboard-on-board type fence or
decorative area above the 5 foot height. The
administration will 'look into these concerns.

to concur with the recommendation of the Zoning
Hoard of Appeals and approve the text amendments
being the subject of ZBA 66-A-88.

VILLAGE MANAGER'S REPORT
Village Manager John Fulton Dixon presented a request PURCHASE
to purchase personal computers/word processors COMPUTERS
for specific departments.
Trustee Floros expressed his concern relative to this
expenditure due to the fact that a recent memo from
the Village Manager indicated a request to be
presented with the upcoming budget to increase
the number of employees.
Trustee Murauskis, seconded by "Trustee Farley, moved
to waive the bidding procedure and authorize the
administration to solicit quotes for the purchase of
the specified computers/word processors as determined.

It was noted that the low bidder, PJM Contractors, Inc.,
indicated they would sub -contract tate mechanical work,
which is in violation of the specifications. It was also
noted that the PJM Contractors have lost a portion of
their bonding power with the Stats of Illinois. It is
the recommendation of Greeley and Hansen that the Village
not accept the low bid submitted by PJM Contractors and
accept the next lowest bid submitted by A.J. Lowe & Son,
Inc.

reject all the bids submitted for modifications to a high
service pump and award the Did to A.J. Lowe & Son, Inc.
at a cost not to exceed $69,959.

Mr. Dixon presented a request to redistribute previously

approved funds for the School Street reconstruction and

the Evergreen Avenue water main project with Fletcher

Engineering.' The amounts approved, on December 15, 1987
were $12,000 for the School Street portion of the project
and $2,000 for the Evergreen Avenue portion. The new
amounts are $9,663 for School Street and $4,335.23 for
Evergreen Avenue.
Trustee Arthur, seconded by Trustee Van Geem, moved to
concur with the recommendation of the Village Manager
relative to the Fletcher Engineering costs for the School
Street reconstruction and Evergreen Avenue water main,
which total should not exceed $14,000,.

hired Assistant Finance Director for the Village.

An Ordinance Amending Article VI, Section 7 of the Village/City Code
of A'
Be it ordained by the Village/City President/liayor and Board of
Trustees of the Village/City of Cook County,
Illinois: A
Sect% That Section 7 of Article VI entitled "Operational
Requirements and Records' of the Village/City code of
as amended, is hereby further amended by adding thereto paragraph
G; so that hereine.iter said Section 7,G shall be and read as
follows:
"G. Grantee shall meet the following standards:
1. Phone Service:
a) All calls must be answered within four (4) rings by an
operator or by a mechanical device;
b) Hold time for all calls may be no more than two minutes
(120 seconds) except in those situations where an Act of
God or failure of a third party to provide power or
service to the cable operator shall cause a backlog on the
phone system.
c) The abandonment rate for calls shall be no more than
ten percent (10%) of the calls reported as incoming.
2. Repair Service:
a) All requests for installation shall be completed within
ten (10) working days of the time service is requested in
serviceable areas unless scheduled at a date convenient to
the customer in excess of the ten working days established
herein;
b) All customer service calls regarding repairs a d/or
service problems,tbat are not outage related,sball receive
a return phone call within twenty-four (24) hours
following receipt of the complaint, and the repairs
completed within fourty-eight (48) hours, unless
documented that the necessary repairs and/or service will
take longer, however at no time should the repairs and/or
service take longer than one week to complete.
c) dfhen practicable, a designation of AN or Phi shall be
given to the resident for the time designation on the
service call or open call basis.
d) If a resident misses a service call, a new date for the
repair must be given within ten (10) business days which
include Honday through Saturday, 8 a.m. to 5 p.m. If a
technician misses a service call, a new date for repair
shall be made at the resido--t's convenience and in accord
with the operator's business hours.
e) Outage calls affecting three (3) -customers in the same
geographic area, off the same line or feeder, reported
before 9:00 p.m., every aay, lncluiaing veexenis ana
holidays,shall be corrected the same day except
In cases of severe damage caused by an Act of God. The
determination of three (3) customers shall be the
responsibility of the cable operator. Outage calls
affecting three (3) customers in the sane geographic area,
off the same line or feeder, received after 9:00 p.m. may
be postponed until the following morning, and corrected
within twenty-four (24) hours. In the event of extensive
system failure, corrective action shall begin immediately.

f) The Company will initiate prompt corrective action
any is needed to satisfy unresolved complaints. It a
customer is not satisfied with the Solution of a
complaint, that customer shall eutowticaIly be referred
to a management person. Local management shall work with
the person to resolve the problem within 48 hours. In the
event that local management does not satisfy the
customer's complaint, the complaint shall be referred to
the District Manager.
g) Customer service operators and service technicians,
including contracted help, shall identify themselves by
name. Vhen performing work at a customer's hose, a company
identification badge shall be displayed on the outer
clothing of the technician or contractor.
h) Customers shall receive a copy of the service report
and a phone riumber to call to resolve any additional
problems at the tile the service is completed.
Billing:
a) subscribers shall receive a monthly statement with a
date for payment due.
b) All statements shall clearly denote a postmark or
initiated date of bill.
c) A phone number for bill adjustment shall be printed on
the statement.
d) The statement shall clearly state the dates of service
for which the subscriber is being billed.
e) Upon request of the subscriber, ar4k adjustment of 1/30
of the monthly bill shall be credited for the loss of
service for each twenty-four (24) hour period commencing
with the report of the loss of service to the cable
operator. This adjustment shall be made no later than, one
billing cycle after the notification occurs. The rt

of the daily basic cable charge.
f) Credit for 1033 Of service on additional converters
shall be not less than 1/30 of the monthly charge per day

cycle.
h) Late payment charges end the time of institution shall
be clearly stated.
4. Notification Procedures:
a) The company shall, at the time service is initiated,
provide the customer with written information covering
1) the time allowed to pay outstanding bills
2) grounds for termination
3) steps taken before termination
4) how customers may resolve billing disputes
5) steps necessary to restore service
6) the fact that customer service representatives and
service technicians shall identity themselves
7) the fact that customers have the right to speak to I
supervisor
8) the time frame for resolving reception and billing
problems
9) the appropriate regulatory authority with who' 0
register a complaint and a listed phone number
10) charges for late payment and returned checks
b) The cable operator must notify subscribers in writing,
on an annual basis, that the aforementioned information is
located in the subscriber handbook, and that additional
copies are available upon request.
5. Agreements and Promotions:
A copy of all local, national and co-op promotions
pertaining to this system must be filed with the
municipality ten (10) days before implementation. All
promotions must clearly state the cost of the promotion to
the subscriber, restrictions of the promotion, and the
date the promotions terminates.
6. Notification to the Thmicipality:
a) The operator stall notify the municipality and
regulatory authority, of the resolution of all complaints
received by the municipality or regulatory authority
within ten (10) working days.
b) The operator shall notify the municipality and
reguiatorr authority --of -all outages, location- of -the
outage, ani the homes affected on a monthly basis.
c) The operator shall make a good faith effort to notify
the municipality and regulatory authority of outages
within the municipality on the day of occurrence.
d) The operator shall notify the municipality and
regulatory authority through a monthly report, a daily
breakdown for normal business hours, including Saturday,
of phone statistics on all phone lines for customer
service and repair.
7. Customer Service Survey:
The cable operator shall be required to conduct a survey
of it's current subscribers to determine the degree to
which the operator is meeting the needs of the community,
as a part of their performance evaluation sessions.
Results will be provided to the municipality and
regulatory authority.
8. Penalties:
For failure by the grantee to comply with the Customer
Service Standards within thirty (30) days following notice
from the municipality, the penalty shall be two hundred
dollars ($200.00) per day or part thereof, such failure
occurs or continues.
Separability:
Any provisions contain within this ordinance or the
franchise agreement, inconsistent with this section shall
be deemed to be preempted and superceded.

repair shall be made at the resident's convenience and,
in accord with the operator's business hours.

corrected the same day, except for outages caused by an
Act of God. The determination of three (3) customers

shall be the responsibility of the cable operator. This
standard is for reports received before 9:00 P.M.
f) Outage calls affecting three (3) customers in the
same geographic area, off the same line or feeder,
received after 9:00 P.M. may be postponed until the
following morning and corrected within 24 hours.
g) In the event of extensive system failure, corrective
action shall begin immediately.
h) If customer service representatives cannot
resolve the complaint, the customer shall have the right
to speak to a supervisor or have a supervisor return
their calls within 24 hours.
i) Customer service operators and service technicians,
including contracted help, shall identify themselves by
name. When performing work at a customer's home, a
company identification badge shall be displayed on the
outer clothing of the technician.

for the additional convertors or outlets.
h) Billing complaints shall be resolved within ninety
(90) days.
i) Late payment charges and the time of institution
shall be clearly stated.

officer that complaints may be forwarded to in
the event a subscribed is dissatisfied
11) charges for late payment or returned checks
5. Agreements/Promotions:

filed with the municipality ten (10) days before
implementation. All promotions must clearly state the cost
of the service to the subscriber, restrictions of the
promotion, and date the promotion terminates.
6. Notification to the Municipality:
a) The operator shall notify the municipality, through
a monthly report, or by other devices as determined by
the municipality, of the resolution of all complaints
within the municipality.
b) The operator shall notify the municipality of all
outages, location address of the outage, and the homes
affected on a monthly basis.
C) The operator shall make a good faith effort to
notify the municipality of outages within the
municipality on the day of occurrence.
d) The operator shall notify the municipality through
a monthly report, a daily (Monday - Sunday) breakdown of
phone statistics on all phone lines for customer service
and repair.
e) The operator shall notify the municipality on a
monthly basis, the number of customer service staff and
technicians available to render service to the residents
of the municipality. The municipality shall determine,
in cooperation with the operator, the sufficient number
of staff needed to maintain the requirements of the
Customer Service Standards.
Customer service survey.
The cable operator shall be required to conduct
Cable - Village
survey of its current subscribers to determine the degree
to which the operator is meeting the needs of the
community as a part of the performance review. The
survey technicians shall be paid for by the operator and
shall be selected with the approval of the municipality.
This survey shall take place in the 3rd, 6th, 9th and
12th years, in conjunction with the Performance
Evaluation Session
a. Penalties.
For failure by the Grantee to comply with the Customer
Service Standards within thirty (30) days following
notice from the municipality, the penalty shall be five
hundred dollars ($500.00) per day or part thereof, such
failure occurs or continues.
SECTION Two: That this Ordinance shall be in full force and
effect from and after its passage, approval and publication in

AN ORDINANCE AMENDING SPECIFIED SECTIONS OF
CHAPTER 14 ENTITLED 'ZONING ORDINANCE' OF
THE VILLAGE CODE OF MOUNT PROSPECT
WHEREAS, the Village of Mount Prospect, through its administration
(hereinafter referred to as Petitioners) have filed an application
to amend various Sections of Chapter 14, entitled "Zoning
Ordinance" of the Village Code of Mount Prospect; and
WHEREAS, public hearings were held on the amendments requested
being the subject of ZBA Case No. 66-A-88 before the Zoning Board
of Appeals of the Village of Mount Prospect on the 17th day of
November, 1988, and on the 15th day of December, 1988, pursuant to
due and proper notice thereof published in the Moupt Prospect
Herald on the 10th day of October, 1988; and
WHEREAS, the Zoning Board of Appeals has submitted its findings
and recommendation to the President and Board of Trustees of the
Village of Mount Prospect and the President and Board of Trustees
of the Village have given further consideration to the amendments
requested and have determined that the same would be in the best
interest of the Village and the Board of Trustees further find that
it would be in the best interests of the Village to grant the
amendments specified herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
herein as findings of fact by the President and Board of Trustees
of the Village of Mount Prospect.
SECTION TWO: That Sections 14.1001.B.3 and 14.1101.8.3 of Chapter
14 entitled "Zoning", as amended, are hereby further amended; so
that hereinafter said Sections 14.1001.B.3 and 14.1101.8.3 shall
be and read as follows:
"3. Garages designed to house more than two (2) motor
vehicles, except as provided in Section 14.1001.C.6 and
Section 14.1101.0.6 respectively."
SECTION THREE: That Section 14.1001.C.6 and 14.1101.0.6 of Chapter
14 entitled "Zoning", as amended, is hereby further amended by
adding thereto the following; so that hereinafter said Section
14.1001.C.6 and 14.1101.C.6 shall be and read as follows:
116. Allow garages designed to house more than two (2) motor
vehicles."
SECTION FOUR: That Section 14.1102.E of Chapter 14 entitled
"Zoning", as amended, is hereby further amended in its entirety,
so that hereinafter said Section 14.1102.E shall be and read as
follows:
11E. Total Lot Coverage: Not more than forty-five percent
(45%) of the total lot area may be covered by impervious
surface, for R-1 Single Family Districts."
SECTION FIVE: That Section 14.1301.B.3 of Chapter 14 entitled
"Zoning", as amended, is hereby further amended by deleting said
Section 14.1301.B.3 in its entirety and renumbering the subsequent
paragraphs in proper numerical sequence.

"A. Minimum Front Yard: A thirty foot (301) minimum front
yard shall be required except if it is for a use on a lot
abutting another zoning district in which event the
setback from the front lot line shall be not less than
that required in the district that this district abuts."
SECTION SEVEN: That Sections 14.1702.B, 14.1802.B and 14.2102.E
of Chapter 14 entitled "Zoning", as amended, are hereby further
amended by deleting said Sections in their entirety and replacing
as follows; so that hereinafter said Sections 14.1702.8, 14.1802.B,
14.2002.B and 14.2102.B shall be and read as follows:
11B. Minimum Side Yard: In this District a ten foot (101)
minimum side yard shall be required except that where such side
yard is adjacent to a right-of-way, this setback shall be thirty
feet (301), if adjacent to a residential district the setback shall
be twenty feet (201).11
SECTION EIGHT: That Sections 14.1702.C, 14.1802.C, 14.2002.0 and
14-2102.0 of Chapter 14 entitled "Zoning", as amended, are hereby
further amended, so that hereinafter said Sections 14.1702.C,
14.1802.C, 14.2002.0 and 14.2102.0 shall hereinafter be and read
as follows:
11C. Minimum Rear Yard. Any building or structure hereafter
erected or relocated in this District shall be set back
from the rear lot line and shall maintain a rear yard of
at least twenty feet (201), except that when such rear
yard is adjacent to a right-of-way the setback shall be
thirty feet (301).11
SECTION NINE: That Section 14.1701.A.1 of chapter 14 entitled
"Zoning" of the Village Code of Mount Prospect, as amended, is
hereby further amended in its entirety and replaced as follows; so
that hereinafter said Section 14.1701.A.1 shall be and read as
follows:
Ill. Shopping Center which shall be located on not less than
two and one-half acres in area."
SECTION TEN: That Section 14.2101.A.1 of Chapter 14 entitled
"Zoning" of the Village Code of Mount Prospect, as amended, is
hereby further amended by deleting said Section 14.2101.A.1 in its
entirety and replacing as follows; so that hereinafter said Section
14.2101.A.1 shall be and read as follows:
111. Automobile laundries."
SECTION ELEVEN: That Section 14.2101.C.3 of Chapter 14 entitled
"Zoning" of the Village Code of Mount Prospect, as amended is
hereby further amended by deleting said Section in its entirety and
replacing as follows; so that hereinafter said Section 14.2101.C.3
shall be and read as follow:
"3. Satellite antennas with a diameter exceeding forty
inches (4011) subject to the following:
a. The maximum diameter of a dish shall not exceed

thirty feet (301).
b. All ground -mounted antennas (including pole -mounted
antennas shall not exceed the height of the
buildings to which they are accessory.
C. All non -ground mounted antennas (including roof and
wall mounted antennas):
(1) Shall be located on the roof or on the rear or
side of the building to which they are
accessory;
(2) Shall have a maximum diameter of one-third
(1/3) of the height of the building to which
they are accessary; and
(3) Shall have a maximum height as allowed in
Section 14.2002.A.2.
d. All satellite antenna installations:
(1) Shall be located outside any required yard and
shall be a minimum of twenty feet (201) from a property line;
(2) Shall have an overall size and height which are
in proportion with the scale of the building to which they are
accessory; and
(3) Shall be fully screened from view from adjacent
roadways and properties (from grade level) with materials which are
compatible with the building to which they are accessory. Ground -
mounted satellite antennas shall be landscaped in a manner which
enhances the visual impact of the installation.
e. The area of a satellite antenna installation,
including screening materials, shall be included within the floor
area of the building to which it is accessory for purposes of
calculating maximum land coverage and floor area ratio, but not for
purposes of calculating the required number of parking spaces. 11
SECTION TWELVE: That Section 14.2201.B of Chapter 14 entitled
"Zoning" of the Village Code of Mount Prospect, as amended, is
hereby further amended by adding thereto in proper alphabetical
sequence "Retail Uses"; so that hereinafter said Section 14.2201.8
shall include the following:

the permitted height of fences within the Village; and

will be allowed nearer to the lot line than the building
is permitted, provided:

ORDINANCE NO.
AN ORDINANCE AMENDING SPECIFIED SECTIONS OF CHAPTER 10
AND CHAPTER 11 OF THE VILLAGE CODE OF MOUNT PROSPECT
WHEREAS, the Village Code of the Village of Mount Prospect requires
all businesses operating within the Village of Mount Prospect to
first obtain a business license; and
WHEREAS, Chapter 11 of the Village Code of the Village of Mount
Prospect provides for annual license fees, setting forth the amount
for such business licenses based on a fiscal year; and
WHEREAS, the corporate authorities of the Village of Mount Prospect
have determined that it is in the best interest of the Village to
create an annual billing cycle for specified businesses based on
a calendar year;
WHEREAS, for the business license year commencing may 1, 1989, the
annual business license fee shall be prorated for the eight month
period from May 1, 1989 through December 31, 1989 for the purpose
of facilitating said change in the billing cycle from fiscal to
calendar year; and
WHEREAS, from and after December 31, 1989 the billing cycle for
those licenses designated in Chapter 11 shall commence on
January 1.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE; That effective May 1, 1989 for the calendar year
ending December 31, 1989, all business licenses and business
inspection certificates established in Chapter 11 of the Village
Code requiring an annual licensing fee shall be prorated to equal
eight -twelfths (8/12) of the annual fee as set forth in said
Chapter 11 and for the purposes of this SECTION it shall deemed
that all Sections of Chapter 10 and Chapter 11 of the Village Code
are amended to reflect an eight month proration.
SECTION TWO: That effective January 1, 1990, Section 10.202 of
Chapter 10 of the Village Code of Mount Prospect, as amended, is
hereby further amended by deleting the language "Director of Code
Enforcement" and replacing therewith "Director of Inspection
Services; so that hereinafter said Section 10.202 shall be and
read as follows:
"Sec.10.202. Investigation. The Director of Inspection
Services shall make or cause to be made an investigation in
regard to such business inspection certificates to be granted
in connection with all fire prevention, building and zoning
matters."
aECTION THREE: That effective January 1, 1990, Section 10.304,
entitled "License Term", of Chapter 10 of the Village Code of Mount
Prospect, as amended, is hereby further amended by changing the
termination date from April 30 to December 31; so that hereinafter
said Section 10.304 shall be and read as follows:
"Sec. 10.304. License Term. Unless otherwise specified in
this village Code, all annual licenses set forth in Chapter
11 of the Village Code of Mount Prospect, issued pursuant to
this Chapter shall terminate on December 31 following such
issuance."
aECTION FOUR. That effective January 1, 1990, Section 11.1701.A.1

of Chapter 11 of the Village Code of Mount Prospect, as amended,
is hereby further amended by deleting "April 3011 and replacing
therewith "December 3111, so that hereinafter said section
11.1701.A.1 shall be and read as follows:
"1. Such license shall expire the December 31 after the date
of issuance, but may be renewed under the provisions of
the Article for additional periods of one year."
SECTION SIVE: That effective January 1, 1990, Section 11.3407 of
Chapter 11 of the Village Code of Mount Prospect, as amended, is
hereby further amended by deleting "October 3111 and replacing
therewith "June 30"; so that hereinafter said Section 11.3407 shall
be and read as follows:
"Sec. 11.3407. Mid -Year Fee Reduction. Any Class I or Class
II business license issued to a business opening after June
30 shall only pay fifty percent (50%) of the annual fee as set
forth in subsection A of Sections 11.3404 and 11.3405
respectively. Such business shall also have the inspection
limit, as set forth in subsection B of Sections 11.3404 and
11.3405 respectively, reduced by fifty percent (50%).11
SECTION SIX: That effective January 1, 1990, Sections 11.3411 of
Chapter 11 of the Village Code of Mount Prospect, as amended, is
hereby further amended in its entirety; so that hereinafter said
Section 11.3411 shall be and read as follows:
"Sec. 11.3411. Late Payments.
A. Whenever an application for a renewal of a license
previously issued for the prior calendar year is received
by the Village Clerk after December 31 but before
February 1 of any given calendar year, the license fee
shall be computed at one hundred ten percent (1100 of
the annual license fee heretofor designated in this
Article.
B. Whenever an application for renewal of a license
previously issued for the prior calendar year is received
by the Village Clerk after January 31 but before March
1 of any given calendar year, the license shall be
computed at one hundred twenty-five percent (125%) of the
annual license fee heretofor designated in this Article.
C. Whenever an application for renewal of a license
previously issued for the prior calendar year is received
by the Village Clerk after the last day of February but
before April I of any given calendar year, the license
shall be computed at one hundred fifty percent (150%) of
the annual license fee heretofor designated in this
Article.
D. Whenever an application for renewal of a license
previously issued for the prior calendar year is received
by the Village Clerk after March 31 but before May 1 of
any given calendar year, the license shall be computed
at one hundred seventy-five percent (1750 of the annual
license fee heretofor designated in this Article.
E. Whenever an application for renewal of a license
previously issued for the prior calendar year is received
by the Village Clerk after May 31 but before July 1 of
any given calendar year, the license shall be computed
at two hundred percent (200%) of the annual license fee
heretofor designated in this Article. Any application
for renewal not received by July 1 will be enjoined from
conducting business until all fees have been paid to the
Village."
SECTIQN SEVEN: That effective January 1, 1990, Section 11.3605 of
Chapter 11 of the Village Code of Mount Prospect, as amended, is
hereby further amended by deleting the language "Director of Code
Enforcement" and replacing therewith "Director of Inspection
Services; so that hereinafter said section 11.3605 shall be and
read as follows:
"Sec. 11.3605. Investigation. The Director of inspection
Services shall make or cause to be made an investigation in
regard to such business inspection certificates to be granted
in connection with all fire prevention, building and zoning
matters."
SECTION EIGHT: That effective January 1, 1990, Section 11.3607
of Chapter 11 of the Village Code of Mount Prospect, as amended,
is hereby further amended by deleting the language "April 3011 and
replacing therewith "December 31; so that hereinafter said Section
11.3607 shall be and read as follows:
"Sec. 11.3607. Expiration Date. All certificates issued under
the provisions of this Article shall terminate on December 31
of the calendar year following such issuance."
SECTION NINE: That effective January 1, 1990, Section 11.3610 of
Chapter 11 of the Village Code of Mount Prospect, as amended, is
hereby further amended by deleting the language "October 3111 and
replacing therewith "June 30"; so that hereinafter said section
11.3610 shall be and read as follows:
"Sec. 11.3610. Mid -Year Fee Reduction. Any certificate issued
to a business opening after June 30 shall only pay fifty
percent (50%) of the annual fee as set forth in Section

On December 20, 1988, the village Board adopted ordinance #4011,
which approved an Amendment #1 to the Tax Increment Redevelopment
Project and Plan of the Village of Mount Prospect. As you know,
this Amendment includes the propertiesoneblock west of Main, to
WilleStreet, in the Tax Increment Finance District.
The Ordinance makes certain findings about the need for tax
increment financing in this area, and meets all the requirements
of State Statutes. However, an amendment to State Statutes became
effective July 31, 1988 requiring a redevelopment plan to include
"a commitment to fair employment practices and an affirmative
action plan." Ordinance #4011 did not include this required
statement.
Attached for consideration by the Village Board is an Ordinance
that amends ordinance #4011, providing the required statement. The
Village Board may adopt this ordinance without public hearing as
it does not alter the exterior boundaries of the district, affect
the general land uses established by the Plan, or change the nature
of the redevelopment project.
I would ask that the Village Board adopt this ordinance so our Tax
Increment Finance District remain in strict compliance with all
State Statutes.

WHEREAS, the Board of Trustees of the Village of Mount Prospect has
previously adopted Ordinance No. 3554, approving the Village of
Mount Prospect Tax Increment Redevelopment Project and Plan No. 1
("the Plan"), and
WHEREAS, the Board of Trustees of the Village of Mount Prospect
thereafter adapted Ordinance No. 4011 which amended the Plan; and
WHEREAS, the Board of Trustees of the Village of Mount Prospect

No. 4011, to include an affirmative action plan and commitment to

The Inspection Services Department notes that the access shown from
Lot 1 to Algonquin Road must be for Lot I only. They also note
that all Development code and Building Code requirements will apply
to this development. The Engineering Department notes that
adjoining parcels to the west, northwest and north of this property
have natural drainage through this parcel. They caution that
variations granted to the setbacks of each lot may reduce the
drainage flow area. Therefore, they recommend that a drainage
study be required before any permits are issued. No other comments
or objections were received.'
PLMNING AND ZONING COMENTS
You may recall, that requests for text amendment, rezoning, special
use and variations for this property were heard by the Zoning Board
of Appeals in June of 1987. As a result of that hearing process,
all requests were approved as amended on September 1, 1987. Since
construction did not begin within one year of the approval date,
the variations became null and void. (The text amendment, rezoning
and special use remain intact.) Therefore, the Alter Group is
returning before the Board to request the same variations that were

will be mailed to every participant in the punt area asking them
to fill it out and return to us so that we can incorporate any
of their suggestions into our program prior to going Village -
wide - These questionnaires will be distributed by February 4
requesting return by reurvecr 15. The oomwutuo will compile the
information and discuss ,t at our meeting March 2.

would be phased in over e three to four month period with

discuss the start up but Tom has already indicated that once we
go Village -wide it will be necessary to go to e five day pickup
pcogrem. It is my recommendation to follow the same schedule as
our leaf pick un program. In the pilot area we will however,
have to re-educate people. Their day for recycling is currently
rrzuo/, the same as tnc^c garbage p`rx up. It would change to
either Tuesday or Wednesday uon,nginq on where they livo, we
will send out a special notice to that effect.
Aso kick-off to going Village -wide the Mayor has set up a
recycling public information meeting in the Senior Center on
Wednesday evening, April 19 at 7,30 p.m. All those in the
current pilot area will be invited to attend and offer any input
they may have on our current program. This meeting will also be
publicized in the upcoming newsletter which will be distributed
to all Village residents and serve as e kick-off for going
Village -wide. we will also ask the local newspapers to run
periodic articles between now and then advising residents or our
May 1 recycling program start up.
Finally l have been in contact with nehcig pu,irir Company
regarding the purchase of the remaining bins. we currently have
12,003 residential units being picked up by BFI for single family
service^ The original purchase was for 1 20 bins or which we
are using 1,000. l would therefore recommend we purchase /2,000
additional bin*. This will give us approximately 1 20 in stock
to cover loot or damaged bine and also be available should we
decide to offer o second bin to those who want to purchase onn.
This is an issue that is addressed in our questionnaire and
will be discussed by the ed hoc committee. Rehrig Pacific
Company has quoted me o price of $4.73 per bin as opposed to the
original $5.08 we paid initially.
I therefore request the vulaon Board authorize us to expand the
recycling program to Village -wide on May /, 1989 and that the
Village Board waive the bidding pcounea and award o contract to
Rehrip Pacific Company for 12,000 bins at e unit coot or $4.73
per uin.

Rand Road to Wolf Road
Attached find a copy of the local Agency Agreement For Federal
Participation for the Central Road Improvement - Rand Road to
Wolf Road. Based on the percentages shown on page two it seems
IDOT has accepted our request to share the non -Federal portion of
the cost on an equal basis. IDOT is paying 20% while the two
Municipalities are paying 10.% each. It also appears the
Federal share of cost does include the street lighting, but IDOT
has rejected our request that they share in the cost for street
lighting. one cost item that IDOT has included in this agreement
that was not included in our original estimate is the construct-
ion engineering at $102,000.00, the Village share being $10,200.
Our total cost per this agreement is $156,200.
It appears from Section 4 - "The State Agrees" Item 2 (page 5)
that the Village may have to front the Federal Share of the
Construction Engineering Cost ($20,400) and then be reimbursed by
IDOT.
The only section of the agreement which we may want to clarify
with the City of Des Plaines is Page 4, Section 3, Item 2 - the
Village is agreeing to accept maintenance of the entire develop-
ment of Central Road between Rand Road and Wolf Road. This would
include the new sidewalk Des Plaines is paying for on the south
side of Central Road. Do we want to try to get Des Plaines to
agree to maintain that sidewalk? Also as part of the Wolf Road
project, Des Plaines has agreed to maintain the intersection of
Wolf Road and Central Road including the traffic signals. Would
we want to clarify somehow that our jurisdiction would end at the
westerly R.O.W. line of Wolf Road?

IDOT requested that both Municipalities return the signed
agreement by February 1, 1989. 1 explained to them that our
Board would not meet until 7th and that the Des Plaines City
Council will not meet until February 6th. IDOT then requested
that we write a letter indicating we agree in principle with the
joint agreement and that the Village Board will take action on
the agreement, the required ordinance for jurisdiction transfer
and the resolution for appropriating the Village's share of the
costs at their February 7, 1989, Board Meeting.

(l) To provide for all utility aujustments, and to regulate the use of the
right-of-way of this improvement by utilities, public and private. in
accordance with the current Utility Accommodation Policy For Local
Agency Highway and Street Systems.
(2) Tocomply with all apolicableExecutive Orders and Federal Highways
Acts pursuant to the Equal Employment opportunity and
Non-discrimination Regulations required by the U.S. oepartment or
Transportation. -
(3) To preserve and produce upon request of responsible STATE or FHWx
officials all records for this project for the purpose or an audit for
a period of three years after the FHWA payment of the final voucher.
(4) The failure of MOUNT PROSPECT AND oESPLAIwEs to comply with Federal
requirements may result in the lona (partial or total) or Federal
participation as determined by the FHWA.
(5) That upon receipt of the Contractor's first and subsequent progressive
bills for this improvement they will pay to the State, an amount equal
to each of their shares or the construction cost, divided by the
estimated total cost' multiplied by the actual progress payment
(appropriately adjusted for non -participating costs) made to the
contractor until the entire obligation incurred under this agreement
has been paid.

3. THE VILLAGE OF MOUNT PROSPECT AGREES:
(1) To provide for surveys and the preparation ofplans for the proposed
improvement and engineering supervision during construction of the
proposed improvement, including acceptance sampling and testing of the
materials in accordance with the specifications, Project Procedures
ouide and methods prescribed by the sT4rs/
(2) To accept jurisdiction and to maintain or cause to be maintained the
entire completed improvement on Central Road between Rand Road to wolf
Road after the completion or the improvement in a manner satisfactory to
the STATE and the FmxA.
(3) To pass an ordinance providing for the transfer from the State Highway
System to the LA's Municipal Street System of Central Road (Fnu 1300)
between Rand Road and Wolf aoad' o location map showing this location
and a copy or said ordinance are attached hereto as "Exhibit n" and
"Exhibit B", respectively.
(4) To pay 100% of the energy costs for the lighting within the limits of
theimprovement-
(z) To submit to the STATE, for final approval shop drawings or poles,
luminaries, cables, oonuuits, junction boxes, splicing *its' lomps,
oaDasts and other similar items prior to ordering such items.
4. THE STATE AGREES:
(l) To provide independent assurance sampling, to furnish off-site material
inspection and testing, at sources normally visited by State inspectors
of steel' cnment, aggregates, structural steel and other materials
customarily tested by the state' and to provide contract construction
administration and general supervision of the resident engineer.

(2)To reimburse MOUNT PROSPECT ANoDESPmINES for the Federal share of
construction engineering on the basis of periodic bill1ngs, provided
each bill includes evidence of payment by MOUNT PROSPECT AND
ossPLoIwss .
V. IT ISMUTUALLY AGREED:
(l) That this agreement shall be null and void in the event that the rHwA does
not approve the proposed improvement for Federal -Aid participation and in
the event the contract covering the construction work contemplated herein
is not awarded within three years or the uetc of execution of this
agreement'
(2) That the authority to make changes in the State Highway System is granted
the STATE by Section 2-101 of the Illinois Highway Code, and the authority
to make changes in the Municipal Street System is granted the LA by
Section 7-101 or the Illinois Highway Come.
(s) That the jurisdictional transfer hereinbefore described shall take place
upon completion of the physical construction or this improvement and final
inspection therof by the STATE.
(^) This agreement shall be binding uoon the parties, their successors and
assigns.
(z) It is the policy of the U.S. Department of Transportation that minority
business enterprises, asdefined in4nOFR Part 23, shall have the maximum
opportunity to participate in the performance of contracts financed in
whole or in part with Federal funds under this agreement. Conseqvently,
the wec requirements of 49 CFR Part 23 apply to this agreement'
The STATE, mouwT pnOSPEI�T AND oESPL4zwES agree to ensure that minority
business enterpzises, as defined in 45 CFR Part 23, 'lave the maximum
opportunity to participate in the performance of this agreement. In this
regard the STATE' wouwr PROSPECT AND oESPLAImES shall take all necessary
and resonable stops' in accordance with 49 CFR Part 23' to ensure that
minority business enterprises have tlie maximum opportunity to compete for
and perform portions of contracts and subcontracts financed in whole or in
part with Federal funds provided under this agreement. The STATE, mouwr

color, national origin, or sex in the selection and retention or
contractor or subcontzactor, including procurement of materials and leases
of equipment.

of equipment, Failure to carry out the requirements set forth above shall
constitute a breach or this agreement and may result in termination of the

A RESOLUTION AUTHORIZING EXECUTION OF AN ADDENDUM
TO AN AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT,
THE CITY OF DES PLAINES, AND THE STATE OF ILLINOIS
FOR THE IMPROVEMENT OF CENTRAL ROAD BETWEEN
RAND AND WOLF ROADS ORIGINALLY ADOPTED BY
RESOLUTION NO. 1-88
WHEREAS, the corporate authorities of the Village of Mount Prospect
did determine that it would be in the best interests of the Village
to participate with the State of Illinois and the City of Des
Plaines in the improvement of Central Road between Rand and Wolf
Roads through passage and approval of Resolution No. 1-88; and
WHEREAS, it has been further determined that it would be in the
best interest of all concerned to execute the Addendum to the
Agreement being the subject of Resolution No. 1-88.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:

For the past six years, xacriaon and Byrne' Certified Public Accountants, have
provided independent audits of the Village's annual financial statements.
Their audit work has been highly professional and during this time they have
provided other valuable services to the Village as well. They have performed
special accounting w"m' for certain Village Water accounts and the vulaeo'a
Old Special xoeoeomenu rummo and they were instrumental in helping the vdlmgo
obtain the Certificate of Achievement for Excellence in Financial Reporting
from the Government Finance Officers Aoonciau^n,
In prior ynucn, the Village has had a policy of formally soliciting audit
proposals from CPA firms every four to six years- Based upon this practice *o
recently submitted a neq000/ for Proposal (m,) for Auditing s*c,icnu from
eleven CPA firms. Because of the quality of work performed by uarcia^o and
Byrne over the past six years, we included mem in the firms that were invited
to submit prupuae,a. In addition to xurrioun and Byrne, one other local firm
was included, one regional firm and eight national firms commonly called the"nig siw^+," From the eleven invitations to submit proposals, we receive*
seven proposals.
Auditing roapunououiti=e have increased very significantly over the past five
years, and z had expected this factor to have a *arxuu *rrecc on our audit
fees. During this time period, the Federal o^,arnmun+ has imposed the require-
ments or the Single Audit Act on any governmental unit receiving $100,000 o,
more in Federal grants; the Government Accounting Standards Board has mandated
stringent reporting requirements for pension obligations and investments; and
in 198e the State of Illinois auormo legislation requiring an independent
compliance audit for any municipality with a TIF District. In addition to
these reqoirem~nta, the magnitude or the Village's financial transactions have
increased and the memberships in 3AwA, HELP, Northwest Central Dispatch and
the sulm Waste Agency have added to the scope of the auditor's respon-
sibilities.

Audit Proposals
The Finance Department has attempted to keep audit rceo down by assuming an
increasing share of the audit work. In the RFP we indicated that the Village
would make all closing entries and would prepare audit workpapers for all
omo*t and liability acoounta, we also ato^au that for the last three years
the Village has prepared "pencil copies" or the financial statements thus
reducing the amount or time required from the auditors. This erruct has
r=av\teu in rooe for 1986. 1987 and 1988 averaging $13,600 per year compared
to average rnea of $15'600 for the previous eight years. In the current RFP
we muxou for optional quotations if the pencil copy or the statements would be
prepared by the Village.
Inthe nrp'e, we asked for quotations for a three-year period. This feature
was included because an audit firm makes a substantial investment in time
during the first year of an audit and the rnn is "ovally more caaumnauze if
the aouui,^ol first-year costs can be spread over a three-year period. l
should mention, however, that the nrp stated that the Village rosccv*a the
right to terminate the agreement at any time if the audit wucx does not meet
our expectations. The proposals were generally very competitive and are
summarized on the attached schedule.
xurriaon and Byrne submitted the proposal for the lowest nan under uvtx
upuuna. Their fee for the ncat year is $14,000 if the vulug* prepares the
pencil copies of the statements, and $43,200 for the three-year normu. If
they prepare the statements, the first-year fee in $l^,oOn and the three-year
total is $45,600- The next lowest rona are from the other local firm,
pamuo/ri' mpo|exi' wri*o and Co. If the Village prepares the statements the
first year fee is $14,nOU and for three years the total roe is $^a,mo. If
they prepare the statements the first year fee is $17,800 and the three year
totals are $55,300.
The third lowest fees and the lowest pcupneol from a national firm in the
proposal. from Touche mmo a co. Their rrea are competitive at $15,765 for the
first year if we prepare the statements and $17.533 if they prepare the
statements. The three year totals are $rO,la» and $55,472 for the two
upuuoe.
I believe each or the firms which submitted proposals are qualified to do the
audit and would provide highly professional services. However, because or the
make-up or the firms there are certain advantages that each firm can offer a
municipal client, Some of txuav xin»/ig»te are summarized below:
Karr/so" and Byrne has experience with the Village of Mount Prospect and
has a great deal of governmental auditing experience. They list 33
curront or former municipal clients in the Chicago Area and 24 Tu~naxipa'
Libraries, park Districts and School Districts. Additionally, they un
the audit work for the Northwest Municipal Conference, Icmx, axwx, mwCo
and *s/p. The partners of x a a have been active in orOo and the
Certificate of Achievement Program. xarrinon and Byrne has stated that
to maintain objectivity they will assign a new audit partner and manager
to our account.

Audit Proposals
Pvndulfi, Topolski, Weiss 8 Co, listed 16 municipal clients and a number
or special districts and state agencies. They have been active in GFOx
and have demonstrated a commitment to municipal auditing. They are a
relatively small firm and as such the partners have a closer aaanoiotiv^
with the audit client, They also indicated that they provide some
graphics and trend information to supplement the financial statements.
Touche Ross and Co, is one of the "big eight" firms with a/ vrricoo and
27,000 employees nationwide. The Chicago v[rico is staffed by zno pro-
fessionals. Touche Ross has had a strong commitment to governmental
accounting with 207 local, state and Federal governmental units or
agencies as clionta, In the Chicago orrice, 14: of their ousmuao is in
governmental auuiti^o. The proposal submitted to the village of Mount
Prospect contained a detailed audit plan which demonstrated the serious-
ness or moic interest in the villaoe.
A firm like Touche Ross has the resources to provide not only quality
audit services, but a number or other services as well. They provide
actuarial oer.icee, benefit consulting, advanced technology consulting
and financial management services. Each of these services and the extent
of their experience amu to their value as auditors.
The other rnvr firms listed are all national firma and have excellent
reputations as auditors. Each one also has unique qualities that they
can offer to their clients.
In summary, I believe the Village has received very competitive quotations
from good accounting firms. When we consider that the three lowest proposals
are at the level of or less than the amount the vulene paid for the years or
1978 - 1985, l think it demonstrates that they are good proposals. Kacrieon
and Byrne submitted the lowest overall quotation and they have served the
Village well, Touche noaa had previously been the Village's auditors from
1973 - 1978 and there would be a benefit to the Village in using o nationally
recognized firm.
Because the lowest quotation is from the firm that has been doing the audit
for the last six yearo, z think we m»num look to the v/uugo Board for
direction. Karrioon a Byrne is a oouU firm, but under the circumstances, it
may be an opportune time to move to Touche Ross & Co.

On August 19, 1o88, the Village Board approved m study to
determine if there was any asbestos which had to be cvmo,au from
the village Holl and Historical Society. That firm, Asbestos
Control Methods has completed their survey.
Their findings are that the Village Hull does have asbestos which
could be either removed or encapsulated. They are recommending
encapsulation and have proposed a Out fee for o bidding docu-
ment. This coot would be $2,500 and they also would be available
to do all the inspection and sampling during the encapsulation
process. Their fen for project management would be $2,700.
That would include all samples, supplies, etc.
To the best or my knowledge there ,s no staff person available
that has the expertise to prepare this type or bidding document
nor do we have the knowledge and equipment to sample air
quality.
I recommend that bidding be waived and to award the contract to
Anh=atoa Control Methods for preparation or bid documents in the
amount of $2,500 and project management $2,700. On Page 146 of
the budget, account code 1-071-02-6111, there is $10,275 remain-
ing for this work.

the Zoning Board of Appeals. The applicant is requesting a
variation from Section 14.1102.B.1 to allow a 51-7 1/211 side yard
instead of 10 feet as required by Code, in order to construct a
room addition. Village Board action will be required in this case.

This case has been continued from the January 26, 1989 meeting of
the Zoning Board of Appeals. The applicant is requesting a
rezoning from B-3 to B-4 and a special use permit in order to allow
a drive-through, fast-food restaurant at this location. Also
requested is a variation from Section 14.2102.E to allow a zero
foot parking lot setback instead of 10 feet on the south property
lot line. The zero foot parking lot setback from the Elmhurst Road
right-of-way instead of 30 feet as required by Code is also
requested. Village Board action will be required for all the
requests.

The Mount Prospect Park District is requesting both a text
amendment and a variation to the Zoning Code. The Text Amendment
is to Section 14.3012 to change the parking space requirements from
10 per thousand square feet of floor area to 5 per thousand square
feet of floor area for the following uses: Recreational
facilities, convention halls, dance halls, skating rinks, assembly

halls, gymnasiums, bowling alley, arcades, health club, and indoor
swimming pools (not including locker rooms). Also included in this
revised text is a new requirement for outdoor swimming pools of one
space per 75 square feet of water area. The applicant is also
requesting a variation from Section 14.1104.A to allow a 38 foot
maximum building height instead of 24 feet allowed by Code.
Village Board action will be required for all requests.
In all cases where the Zoning Board of Appeals is final, a fifteen
(15) day period is provided for anyone wishing to appeal their
decision. No permit will be issued until this period has elapsed.
MINUTES OF THE MEETING OF THE
MOUNT PROSPECT SIGN REVIEW BOARD
January 23, 1989
CALL TO ORDER:
A special meeting of the Sign Review Board (SRB) was called to
order by Chairperson Thulin at 7:37 p.m. Monday, January 23, 1989
at the Village Hall, 100 South Emerson Street, Mount Prospect,
Illinois.
ROLL CALL:
Members of the SRB present: Hal Predovich, Pete Pointner, Warren
Kostak, and Chairperson Thulin. Village staff present was Kenneth
Fritz. Chairperson Thulin declared a quorum present. Representa-
tives from Firestone Tire Company were also present as well as a
representative from Doyle sign Company.
APPROVAL OF MINUTES:
The minutes for the January 9, 1989 meeting were approved as
presented on a motion by Mr. Kostak, seconded by Mr. Pointner. The
motion passed with 3 ayes, 0 nays and one pass. Mr. Predovich
voted to pass.
OLD BUSINESS:
Sign -15-88. MoUnt Prospect Plaza.1200-12?g East Central Road
A request was made by Mount Prospect Plaza, Ltd, to place signage
at the rear of Building W adjacent to Central Road. This case was
referred back to the SRB for their final review and decision
regarding the layout of signage on the back of Building W adjacent
to Central Road. As previously reported, the H & R Block sign was
to be eliminated. This now has been accomplished and the five
signs that are to be located on the back of the building average
12.36 square feet which is under the maximum width bonus provision
of 12 1/2 square feet. A motion was made by Mr. Kostak, seconded
by Mr. Pointner that SIGN -15-88 be approved as modified, as it is
consistent with the Village Sign Code. The SRB further requested
that the Western Development corporation revise the sign criteria
to reflect the change in signage at the rear of Building W and
incorporate it in their sign criteria. The purpose of this
revision is to establish consistency between the guidelines in the
sign criteria for the Mount Prospect Plaza and the Village Sign
Ordinance. The motion passed unanimously 4-0.

A request was presented by Firestone Tire Company to seek a special
use equity option in order to place two signs on the east side of

their building adjacent to Elmhurst Road instead of the maximum of
one wall sign per street frontage (Section 7.330). The petitioner
also seeks a variation to reinstall a new sign on the south wall
48 feet from the nearest property line instead of the required 50
feet (Section 7.305.B.). The petitioner plans to retain the non-
conforming freestanding sign erectedin 1965 which is noncon-
forming in height, area and location.
Mr. Timothy Cavanaugh from Firestone Tire Company in Akron, Ohio,
indicated that Firestone is 'upgrading their signage at the
established tire centers and, in accordance' with this new 'policy,
they want to change the wall signs on the building. They propose
to reduce the existing wall signage from 360 square feet to 150
square feet, or'a reduction of 58%. The existing signage on the
rear of their building would be 'removed completely and the signage
above the service bays on the east side of the building would be
removed, as well as one of the Firestone signs on the retail
showroom facility adjacent to the service bays having frontage on
Elmhurst Road. The new signage to be erected over the service
storage would read "'MASTERCARE CAR SERVICE" while the familiar copy
style in the word "Firestone" would be located' over the retail
section of the facility adjacent to the service bays', and "Fire-
stone" would be located on the south wall of the building. All of
this wall signage would be illuminated individual letters.
Mr. Cavanaugh also stated that it was the desire of Firestone Tire
Company to retain the non -conforming freestanding sign located
adjacent to Elmhurst Road. This sign` is 150 square feet in area
or double the 75 foot standard and encroaches the 'public right-of-
way by 5 feet and is therefore 10 feet closer to 'traffic than the
current Ordinance permits. The height of the freestanding sign is
35 feet instead of the new standard of 12 foot high. Mr. Cavanaugh
stated further that, because of budgetary constraints, there isnot
sufficient money to remove or 'replace the existing freestanding
sign. They would therefore, seek permission to continue the use
of the freestanding sign until 1992
Mr. Pointner stated that the signage on the wall was definitely an
improvement over the present signage and complimented the Firestone
Tire Company for their effort to reduce wall signage and upgrade
the quality of the sign copy. He indicated however, that he could
not reconcile the extended life of the freestanding sign until 1992
in light of the current Code requirements and establish practice
of the Village to seek compliance of all non -conforming; signs being
eliminated when any improvements were made to any signage on the
property. He further stated that thestandardsfor special use in
Section 7.720 had not been sufficiently demonstrated. Namely,
conditions #1 (public convenience) and 6 (plight of the owner due
to unique circumstances) were not satisfied, in his opinion.

Mr. Kostak also stated a concern over the continuance of the non-
conforming freestanding sign inasmuch as it encroached on pubic
right-of-way and exceeded the area in height requirements -of our
Sign Ordinance.
Mr. Predovich suggested that the non -conforming freestanding sign,

MINUTES OF THE MEETING OF THE
MOUNT PROSPECT SIGN REVIEW BOARD
January 23, 1989
CALL TO ORDER:
A special meeting of the Sign Review Board (SRB) was called to
order by Chairperson Thulin at 7:37 p.m. Monday, January 23, 1989
at the Village Hall, 100 South Emerson Street, Mount Prospect,
Illinois.
ROLL CALL:
Members of the SRB present: Hal Predovich, Pete Pointner, Warren
Kostak, and Chairperson Thulin. Village staff present was Kenneth
Fritz. Chairperson Thulin declared a quorum present. Representa-
tives from Firestone Tire Company were also present as well as a
representative from Doyle Sign Company.
APPROVAL OF MINUTES:
The minutes for the January 9, 1989 meeting were approved as
presented on a motion by Mr. Kostak, seconded by Mr. Pointner. The
motion passed with 3 ayes, 0 nays and one pass. Mr. Predovich
voted to pass.

A request was made by Mount Prospect Plaza, Ltd. to place signage
at the rear of Building W adjacent to Central Road. This case was
referred back to the SRB for their final review and decision
regarding the layout of signage on the back of Building W adjacent
to Central Road. As previously reported, the H & R Block sign was
to be eliminated. This now has been accomplished and the five
signs that are to be located on the back of the building average
12.36 square feet which is under the maximum width bonus provision
of 12 1/2 square feet. A motion was made by Mr. Kostak, seconded
by Mr. Pointner that SIGN -15-88 be approved as modified, as it is
consistent with the Village Sign Code. The SRB further requested
that the Western Development Corporation revise the sign criteria
to reflect the change in signage at the rear of Building W and
incorporate it in their sign criteria. The purpose of this
revision is to establish consistency between the guidelines in the
sign criteria for the Mount Prospect Plaza and the Village sign
Ordinance. 'The motion passed unanimously 4-0.

A request was presented by Firestone Tire Company to seek a special
use equity option in order to place two signs on the east side of

their building adjacent to Elmhurst Road instead of the maximum of
one wall sign per street frontage (Section 7.330). The petitioner
also seeks a variation to reinstall a new sign, on the south wall
48 feet from the nearest property line instead of the required 50
feet (Section 7.305.B.). The petitioner plans to retain the non-
conforming freestanding sign erected in 1965 which- is noncon-
forming in height, ;area and location.
Mr. Timothy Cavanaugh from Firestone Tire Company in Akron, Ohio,
indicated that Firestone is upgrading their signage at the
established tire centers and, in accordance with this new policy,
they want to change the wall signs on the building. They propose
to reduce the existing wall signage from 360 square feet to 150
square feet, or a reduction of 58%. The existing signage on the
rear of their building would be removed completely and the signage
'above the service bays on the east side of the building would be
removed, as well as one of the Firestone signs on the retail
showroom facility adjacent to the service bays having frontage on
Elmhurst Road. The new signage to be erected over the service
storage would read "'MASTERCARE CAR SERVICE" while the familiar copy
style in the word "Firestone" would be located over, the retail
section of the facility adjacent to the service bays,, and ""Fire-
stone" would be located on the south wall of the building. All of
this wall signage would be illuminated individual letters.
Mr. Cavanaugh also stated that it was the desire of Firestone Tire
Company to retain the non -conforming freestanding sign located
adjacent to Elmhurst Road. This sign is 150 square feet in area
or doublethe75 foot standard and encroaches the public right-of-
way by 5 feet and is therefore 10 feet closer to traffic than the
current ordinance permits. The height of the freestanding sign is
35 feet instead of the new standard of 12 foot high. Mr. Cavanaugh
stated further that, because of budgetary constraints, there is not
sufficient money to 'remove or replace the existing freestanding
sign. They would therefore, seek permission to continue the use
of the freestanding sign until 1992,
Mr. Pointner stated that the signage on the wall was definitely an
improvement over the present signage and complimented the Firestone
Tire company ,for their effort to reduce wall signage and upgrade
the quality of the sign copy. He indicated however, that he could
not reconcile the extended life of the freestanding sign until 1992
in light of the current Cade requirements and establish practice
of the Village to seek compliance of all non -conforming signs being
eliminated when any improvements were made to any signage on the
property. He further stated that the 'standards for special use in
Section 7.720 had not been sufficiently demonstrated. Namely,
conditions #1 (public, convenience) and. 6 °(plight of the owner due
to unique circumstances) were not satisfied, in his opinion.

Mr. Kostak also stated a concern over the continuance of the non-
conforming freestanding sign inasmuch as it encroached on pubic
right-of-way and exceeded the area in height requirements of our
Sign Ordinance.
