AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
COMMONLY KNOWN AS FAIRVlEW SCHOOL,
LOCATED AT 300 NORTH FAIRVIEW STREET
WHEREAS, the Dr. Thomas W. Many, on behalf of Mount Prospect Schools, District 57,
(hereinafter referred to as Petitioner) has filed an application for a variation from Chapter
14 of the Village Code of Mount Prospect, Illinois, for property commonly known as
Fairview School, located at 300 North Fairview Street (hereinafter referred to as Subject
Property), legally described as:
Lots 1-22, both inclusive, in Block 12 in Prospect Manor, being a
subdivision of part of the south 3/4 of the West 1/2 of the West 1/2 of
Section 34, Township 42 North, Range 11, East of the Third principal
Meridian.
Also
That part of the East 1/2 of Section 33, Township 42 North, Range 11, East
of the Third Principal Meridian, lying between the south line of Gregory
Street extended Westerly and the North line of Isabella Street extended
Westerly and Easterly of a line parallel with and 231 feet Westerly of the
Easterly line of Forest Avenue, in the Village of Mount Prospect
Also
That part of vacated Forest Avenue lying between the North line of Isabella
Street extended West and the south line of Gregory Street extended West.
All as laid out in Prospect Manor, being a subdivision of part of the South
3/4 of the West 1/2 of the West 1/2 of Section 34, Township 42 North,
Range 11, East of the Third Principal Meridian, in Cook County, Illinois
and
WHEREAS, Petitioner seeks a variation from Section 14.905.B.2 to permit parking in the
front yard setback; and
WHEREAS, a public hearing was held on the variation requested being the subject of
ZBA Case No. 46-V-94 before the Zoning Board of Appeals of the Village of Mount
Prospect on the 27th day of October, 1994, pursuant to due and proper notice thereof
published in the Mount Prospect Journal on the 12th day of October, 1994; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation
to the President and Board of Trustees of the Village of Mount Prospect and the
President and Board of Trustees of the Village have given further consideration to the
variation being the subject of ZBA 46-V-94 and have determined that the best interests
of the Village of Mount Prospect would be served by granting said variation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings

of fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect
hereby grant to the Subject Property a variation from Section 14.905.B.2 to allow parking
in the front yard setback of the Subject Property, as shown as the Site Plan attached
hereto and hereby made a part hereof as Exhibit "A".
SECTION THREE: Except for the variation granted herein, all other applicable Village
of Mount Prospect Ordinances and regulations shall remain in full force and effect as to
the Subject Property.
SECTION FOUR: This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.
