CAF/ 9~29~94 ORDINANCE NO. 4680 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP WITH RESPECT TO THE REZONING THE SUBJECT PROPERTY FROM R-X TO R-1 (SINGLE FAMILY RESIDENCE) DISTRICT (105, 109 AND 111 SOUTH BUSSE ROAD) WHEREAS, Semar Home Builders (hereinafter referred to as Petitioner) has filed an application to rezone the property commonly known as 105, 109 and 111 South Busse Road (hereinafter referred to as Subject Property), legally described as follows: That Part of Lots "F" and "J" in Kirchoff's Subdivision of the Northwest Quarter of the Northwest Quarter and the North 10 Chains of the Southwest Quarter of the Northwest Quarter of Section 11, Township 41 North, Range 11, East of the Third Principal Meridian, According to the Plat Thereof Recorded May 22, 1917 as Document Number 6117296 Described as Follows: Commencing at a Point in the West Line of Said Lot "F" 440.00 Feet North of the Southwest Corner Thereof; Thence Fast on a Line 440.00 Feet North of and Parallel to the South Line of Said Lots "F" and "J" as Measured on the West Line of Said Lot "F" 729.55 Feet to the Center of Weller Creek; Thence Northerly Along the Center of Weller Creek, 120.12 Feet to a Line 560.00 Feet North of and Parallel to the South Line of Said Lots "F" and "J" as Measured on the West Line of Said Lot "F"; Thence West on Said Parallel Line 721.75 Feet to the West Line of Said Lot "F"; Thence South on the West Line of Said Lot "F", 120.00 Feet to the Point of Beginning, (Excepting the West 50.00 Feet Thereof Falling in Busse Road and Conveyed to the County of Cook by Document Number 26880700) in Cook County, Illinois. BA 43-Z Page 2 of 2 WHEREAS, Petitioner has requested the Subject Property be rezoned from R-X to R-I (Single Family Residence) District; and WHEREAS, a public hearing was held on the request for rezoning, being the subject of ZBA Case No. 40-Z-94, before the Zoning Board of Appeals of the Village of Mount Prospect on the 25th day of August, 1994, pursuant to due and proper notice thereof having been published in the Mount Prospect Journal and Topics on the 10th day of August, 1994; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have considered the request being the subject of ZBA 40-Z-94 and have determined that the best interests of the Village of Mount Prospect would be served by granting said request. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The official zoning map of the Village of Mount Prospect, Illinois, as amended, is hereby further amended by reclassifying the property being the subject of this Ordinance from R-X to R-1 (Single Family Residence) District. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
