Information
The Petitioner, Mount Prospect School District 57, recently underwent parking lot
improvements at several school district properties, including Fairview Elementary
School (Subject Property). As part of the approval, the Village required the
existing two lots of record be consolidated, and subsequently rezoned as the two
lots feature different zoning districts. The subject property's parking lot
improvements have substantially been completed. The administrative plat of
consolidation and zoning map amendment help clean up existing non -conformities
on the property.
Plat of consolidations such as this are required as noted in Section 15.401 of the
Subdivision Code; this section ensures that new development, or significant
expansions to existing developments, are brought into zoning conformance.
Staff has reviewed the request and is supportive of the proposed zoning map
amendment. The school and parking lot foundations and boundaries occupy two
lots, and the proposed amendment removes some non -conformities. The parking
lot improvements provide better access for school buses and ride pickups, and
additional parking for staff and visitors. The R -A Single -Family Residential zoning
district is the more consistent zoning district in the immediate area, and the
request unifies the school property under one zoning district.

The Planning and Zoning Commission voted to recommend approval of the zoning
map amendment following an administrative plat of consolidation by a vote of 5 -
0 at the public hearing dated July 8, 2021.
No public comment has been received for the request.
Alternatives
1. To approve a zoning map amendment from R-1 Single Family Residential to
R -A Single Family Residential following an administrative plat of
consolidation.
2. Action at the discretion of the Village Board.
Staff Recommendation
Staff recommends that the Village Board approve a zoning map amendment from
R-1 Single Family Residential to R -A Single Family Residential subsequently after
the property has been administratively consolidated.

2. What reasons prevent you from building within the requirements of the Zoning Ordinance/Building Code?
The new building and all village required parking fall within the requirements of the Village Zoning
Ordinance/Building Code. The specific request contained in this application asks for a variance to allow for the
addition of parking designed to improve safety, traffic, and access to be located in front of the school.
Specific site considerations prevent the relocation or shifting of the building in order to accommodate the proposal
for additional parking. A fire lane and construction buffer between the existing and still occupied school and the
new school facility mitigated against locating the footprint of the new building any further north.
Again, all other aspects of the plan meet the requirements of the Zoning Ordinance/Building Code. This request
for a variance deals with an enhancement which will improve safety, traffic, and access to the school.
What hardship or difficulty would you suffer if you were required to build according to the Zoning
Ordinance/Building Code?
Without the proposed parking, student safety, neighborhood traffic and community access may be adversely affected.
By allowing the variance for parking in front of the school, all three factors can be addressed in positive ways.
In order to maximize student safety, minimize traffic congestion on neighborhood streets adjacent to the school, and
facilitate greater access to the building by the entire community, a limited number of visitor/drop-off parking spaces
will be needed in front of the school. The additional parking will help ensure the safe and efficient drop off of
students, will help to reduce traffic on local streets and discourage parents from stopping cars on the street and
blocking traffic, and will more appropriately locate the handicap parking to accommodate Americans With Disability
Act requirements and other members of the community who would benefit from easier access to the facility. The
additional parking is designed to enhance the situation in and around the school facility.
The proposed improvements are for the use and benefit of all concerned. As proposed, the parking and its location
are consistent with the use of facility, will serve to enhance public safety, will reduce traffic issues by improving
circulation and reducing congestion in adjacent neighborhoods and increase community access to the facility.

Standards for zoning map amendment
Fairview School / SD57 Administration property
1. The elementary school and administration building are compatible with the
surrounding residential neighborhood. The school straddles two lots, zoned R1
and RA. There has been a school on the property for decades.
2. Changing the R1 lot to RA will unify the property as RA prior to consolidation.
3. Schools are a permitted use in R1.
4. Both R1 and RA are consistent with the neighborhood residential character and
zoning.
5. The proposed RA residential neighborhood zoning permits school buildings.
6. The two lots will be consolidated at the request of the Village.
7. Schools are a permitted use in the proposed RA zoning.

The Planning & Zoning Commission recommended approval of our zoning map amendment by a 5-0
vote. Our request is scheduled to go before Village Board for the ordinance's first reading July 8, 2021.
We are requesting that the Village Board waive the second reading, tentatively scheduled for August
3, 2021, and take final action at the July 8, 2021 meeting because of the positive vote; we are anxious
to start the project as soon as possible.

Chairman Donnelly called the meeting to order at 7:02 PM. Commissioner Fitzgerald made a motion
seconded by Commissioner Mizwicki to approve the minutes from the Planning and Zoning Commission
meeting on June 10, 2021. The minutes were approved 4-0, with Commissioner Beattie abstaining.
Chairman Donnelly introduced case, PZ -04-20 300 Fairview Avenue, 701 W. Gregory Street to
administratively consolidate two parcels, and rezone the subsequent consolidated parcel. This case is
Village Board final.
Mr. Harmon gave a brief description and explained the zoning history of the Subject Property. The parcel
to the west is currently zoned R-1 and the plat to the east is currently zoned R -A. Mr. Harmon explained
the plat is an administrative plat and can be consolidated without any Village Board action, but the
request for a zoning map amendment requires Village Board action.
Mr. Harmon stated Staff has reviewed the Petitioner's request to rezone the plat from R-1 to R -A
following an administrative plat of consolidation. Mr. Harmon stated that Staff finds that the proposal
meets the zoning map amendment standards as listed in the zoning code. Staff recommends that the
Planning and Zoning Commission make a motion to adopt staff's findings as the findings of the Planning
and Zoning Commission and recommends approval of the following motion:

1. "A zoning map amendment from the R-1 Single -Family Residential zoning district, to R -A Single
Family Residential zoning district following an administrative plat of consolidation."
He stated that the Village Board's decision is final.
Commissioner Beattie asked why the school had not had a zoning map amendment prior.
Mr. Harmon stated that the reason the school was built on two different underlying zoning districts is
unknown and that prior zoning maps, dating back to the 1990's, identify that the two plats were in
separate zoning districts.
Chairman Donnelly stated that zoning map amendments and administrative plat of consolidation were
not as common in the past.
Chairman Donnelly swore in Jason Kaiz, 701 W. Gregory, Mount Prospect, Illinois.
Mr. Kaiz stated that he is the Assistant Superintendent of Finance for Mount Prospect School District 57.
He stated that he is unsure why the plats were never rezoned in the past.
Hearing no further comments, Chairman Donnelly closed the hearing and asked for a motion.
Commissioner Beattie made a motion seconded by Commissioner Szymczak to approve the following
motion:
1. "A zoning map amendment from the R-1 Single -Family Residential zoning district, to R -A Single
Family Residential zoning district following an administrative plat of consolidation."
UPON ROLL CALL AYES: Fitzgerald, Beattie, Mizwicki, Szymczak, Donnelly
NAYS: None
The motion was approved 5-0 with a positive recommendation to the Village Board.
After hearing two additional cases, Commissioner Beattie made a motion seconded by Commissioner
Mizwicki and the meeting was adjourned at 7:46 PM.

BRIEF SUMMARY OF REQUEST

The Petitioner is proposing to administratively consolidate two lots into one lot of record, and rezone the new
consolidated lot to R -A Single Family Residential. Currently, two lots feature two separate zoning districts, R-
A Single Family residential, and R-1 Single Family residence, which make up Fairview Elementary School. As
part of the administrative consolidation, the new lot is required to be rezoned. Overall, this process was
initiated as part of the parking lot improvements, upon which a building permit was applied for, and issued in
2020. Work has substantially been completed. The plat of consolidation and zoning map amendment help
clean up existing non -conformities on the property.
COMPATIBILITY WITH VILLAGE CODE
The standards for map amendments are listed in Section 14.203.D.8.a of the Village Zoning Ordinance.
When a Map Amendment is proposed, the Planning and Zoning Commission shall make findings based upon
the evidence presented to it in each specific case with respect to, but not limited to, the following matters:
• The compatibility with existing uses and zoning classifications of property within the general area of
the property in question;
• The compatibility of the surrounding property with the permitted uses listed in the proposed zoning
classification;
• The suitability of the property in question to the uses permitted under the existing and proposed
zoning classifications; and
• Consistency with the trend of development in the general area of the property in question, and the
objectives of the current Comprehensive Plan for the Village.
The Petitioner states the proposed zoning map amendment will unify the property under one zoning
district, and the change is consistent with the character of the neighborhood, as nothing is changing besides
the parking lot improvements. The Petitioner also states schools are a permitted use in the proposed R -A
Single Family Residential zoning district, and the amendment is consistent with the current Comprehensive
Plan.
Staff initiated the consolidation and map amendment request, and is supportive of the proposed zoning
map amendment. The school and parking lot foundations and boundaries occupy two lots, and the
proposed amendment removes some non -conformities. The parking lot improvements provide better
access for school buses and ride pickups, and additional parking for staff and visitors. The R -A Single -Family
Residential zoning district is the more consistent zoning district in the immediate area, and the request
unifies the school under one zoning district.
Staff finds that the proposal meets the zoning map amendment standards as listed in the Zoning Code.
Therefore, staff recommends that the Planning & Zoning Commission make a motion to adopt staff's
findings as the findings of the Planning and Zoning Commission and recommend approval of the following
motion:
1. "A zoning map amendment from the R-1 Single -Family Residential zoning district, to R -A Single
Family Residential zoning district following an administrative plat of consolidation."
The Village Board's decision is final for this case.
