ZBA 1-97, 1401 North Sauk Lane This case was ' continued from the last meeting of the Village Board in order to give the Petitioner an opportunity to consider an alternative to the plan which included a request for a variation to permit a 2 story addition 4 feet from the exterior side yard for a garage and living quarters. The Zoning Board of Appeals recommended granting the request to allow the garage to be constructed 4 feet from the lot line but eliminate the 2nd floor living space over the proposed garage. IX. NEW BUSINESS A. Safety Commission recommendations: vf. Request for 3 -way STOP at Marina & Council Trail, Safety Commission recommends denial by a vote of 8-0. .,/2. Increase speed limit on Busse Avenue between We -Go Trail and Weller Lane from 20 to 25 MPH. The Safety Commission recommends denial by a vote of 8-0. 3. Request to establish the following traffic restrictions around Robert Frost Elementary School (south) on school days only between 8:30 & 9:30 AM and 3:00 - 4:00 PM: a. One-way for westbound traffic on Frost Drive between Cypress and Circle; b. One-way for southbound Circle between Frost and Cottonwood; C. Prohibit turns from Cottonwood onto Circle. The Safety Commission recommends approval. 4. Delete 2 hour parking on the west side of Maple Street for 100 feet south of Central and create "No Parking Any Time". The Safety Commission recommends approval by a vote of 8-0. 5. Request for 3 -way STOP for north and southbound Meadow at Strafford; for north and southbound i Wedgewood at Strafford; and, for westbound Strafford at Meadow and eastbound Strafford at Wedgewood. The Safety Commission offered no recommendation on this request. p. Request for 3 -way STOP at Sunset and Louis. The Safety Commission recommends denial by a vote of 8-0. X. VILLAGE MANAGER'S REPORT A. Bid result: 1. Briarwood Watermain Replacement Project Phase III 2. Reject the one bid received for parkway trees in order to re -bid this item. B. Status Report X1. Bob Skates, 911 South Albert Street, expressed his opposition to the Zoning Board of Appeals recommending approval of various zoning variations, specifically the recent request for a 4 foot side yard in order to build a garage at 1401 Sauk Lane. OLD BUSINESS ZBA 1-97, 1401 Sauk Lane The Petitioner is requesting a variation to permit an addition to their home of a 2 -car garage with living space above the garage, which would result in a 4 foot side yard setback. The Zoning Board of Appeals recommended 7-0 to grant the request for the variation to allow a 4 foot side yard provided the Petitioners eliminate their plan for living space above the garage. Members of the Board had considered this request at the last meeting at which time the Board stated they could not support the request for a 4 foot side yard, and deferred action on the request in order to give the Petitioner an opportunity to work with staff to come up with a revised plan. The Petitioner stated that they were unable to reach a compromise acceptable to both parties. The Petitioner stated they had not exhausted all possibilities for the location of a new garage therefore it was the opinion of the Village Board that this matter be deferred to the next meeting or, since the Petitioner was due to deliver a baby within the next couple of weeks, it was stated that the deferral could be until a meeting in the near future. ZBA 2-97, 201 West Central Road An Ordinance was presented for first reading that would allow the number of required parking spaces to be reduced from 24 to 6 for this commercial property which has existed with 6 parking spaces for approximately 30 years. The Zoning Board of Appeals recommended granting this request by a vote of 7-0. It was explained to the Petitioner that if, at sometime in the future, a problem arises relative to the number of parking spaces, it will be the responsibility of the property owner to provide spaces and not the responsibility of the Village. Trustee Hoefert, seconded by Trustee Clowes, moved to waive the rule requiring two readings of an Ordinance. Upon roll call: Ayes: Clowes, Hoefert, Juracek, Wilks, Nays: None Motion carried. Janonis presented a request to waive the bidding process in order to proceed with Phase 11 of the Traffic Pre-emption Equipment replacement, It was noted that there are only two manufacturers of this type of equipment and two companies that install and maintain the equipment. It is recommended that the Village continue purchasing the equipment from Tomar, since that has proven the best for the Village and it would provide compatibility with existing equipment. It was also noted that two companies install and maintain this equipment and both have committed to provide their services at the same price as last year. Trustee Wilks, seconded by Trustee Juracek, moved to concur with the recommendation of the administration to waive the bidding process for the purchase of traffic pre-emption equipment and authorize the purchase of equipment from Tomar at a cost not to exceed $103,000, which amount includes both the purchase and installation of the Phase 11 project. Trustee Wilks, seconded by Trustee Juracek, moved to concur with the recommendation of the administration to enter into a contract with Lyons -Pinner Electric for the installation of the traffic pre-emption equipment for all intersections under the jurisdiction of the Village. Trustee Wilks, seconded by Trustee Juracek, moved to concur with the recommendation of the administration to enter into a contract with Contract & Material Company for the installation of the traffic pre-emption equipment for all intersections under the jurisdiction of Cook County and/or State of Illinois. Page 5 - February 18,1997 RES.NO. 14-97 TRAFFIC PRE-EMPTION EQUIPMENT LYONS- PINNER ELECTRIC CONTRACTING & MATERIAL COMPANY FIRE DEPT, A request was presented to waive the bidding process in order to UNIFORMS extend the existing contract with Kale Uniforms, which will allow the purchase of uniforms for members of the Fire Department at the current contract price. KALE UNIFORMS Trustee Wilks, seconded by Trustee Clowes, moved to concur with the recommendation of the administration and waive the bidding process and authorize extending the existing contract with Kale Uniforms for the purchase of uniforms for members of the Fire Department at a cost not to exceed the negotiated amount, Upon roll call: Ayes: Clowes, Hoefert, Juracek, Wilks Nays: None Motion carried, PUBLIC WORKS A request was presented to waive the bidding process in order to UNIFORM RENTAL/ extend the existing 3 -year "contract with Cintas Corporation for CLEANING uniform rental and cleaning contract for the Public Works Department. CINTAS CORP. Trustee Hoefert, seconded by Trustee Clowes, moved to concur with the recommendation of the administration and,waive the bidding process and extend the contract with Cintas Corporation to provide the uniform rental and cleaning for Public Works Department for a 3 year period at is cost not to exceed an annual cost of $13,629.20. ANY OTHER BUSINESS PROSPECT AUTO Trustee Hoefert noted that the new owners of Prospect Auto Body BODY on south Main Street appear to be ready to open for business however a few of the wrecked vehicles from the previous owner are still being stored on the empty lot in the rear of the property. Mr. Janonis stated that the Police Department is working to obtain titles for these vehicles which have not been claimed by their owners in order to legally dispose of the vehicles. POT HOLES Trustee Clowes stated that he noticed asphalt mixed with some snow that had been plowed off Village Streets and asked if the plows are causing damage to the roads. Mr. Janonis stated that in those instances, the street was probably in poor condition prior to being plowed and that there is no way to prevent it other than having streets in good condition, CABLE TV Trustee Wilks stated that a resident had complained to her about the bill she received from TCI and suggested that any resident who has a question about their bill for cable TV service should call TCI and the Villages Communications Division for assistance, Page'6 - February 1;6,1997 Trustee Wilks also stated that the Electoral Board had met ELECTORAL to consider an objection filed by Ernest Lasse, candidate for BOARD Mayor, which objection was filed against the Nominations DECISION Petitions submitted by Gerald Farley for Mayor. The Electoral Board had denied most of the objections filed by Mr. Lasse and Mr. Lasse has filed an Appeal in the Court, which Appeal will be heard by the Court in Chicago on Friday, February 28th. The only other a|tarnatives, constructing on attached garage to the rear of the kitchen or constructing a tandem garage, both require the demolition of a portion of the rear deck. While it is unfortunate that we were unable to come up with m solution that satisfies the petitioner, the petitioner has the ability toconstruct ntwo-car garage onthe property and comply with Village codes. The petitioner has not demonstrated that the proposed four foot setback is an existing condition throughout the Village, nor have they been able to provide ohardship justifying the variation. Staff therefore continues horecommend the denial of the request and that the petitioner consider alternate designs that would comply with Village code. The petitioners are requesting approval of a four (4') foot exterior side yard building setback in order for a garage addition to be built. Section 14.9053 of the Zoning Ordinance states that the required exterior side yard in the R-1 zoning district is twenty (20') feet. The requested variation was heard by the Zoning Board of Appeals during their regular meeting on January 23, 1997. Mr. Sims, Planner, summarized the petitioner's request and staffs report. He noted the garage would be attached to the south side of the existing home and would be setback four (4') feet from the exterior side yard property line. He stated the setback requirement encourages the harmonious development of comer lots with adjacent lots and provides for maximum vehicular and pedestrian safety. He added there are alternative locations for the garage, including a location in the rear lot for a detached garage and an attached garage to the rear of the kitchen. He reported that the petitioner has not provided valid justification for the requested variation and that there are other locations to construct a garage in compliance with the Zoning Ordinance. Given these reasons, staff recommended denial of the variation request. The Zoning Board of Appeals discussed the variation request. Rosette Johnson stated there are other homes in the area that do not comply with the required twenty (20) building set back. Commissioner Leo Floros stated that is due to the area having been developed prior to its annexation into the Village. Further discussion centered on the height of the addition and location of the driveway. Chairman Basnik stated he would be in favor of allowing the construction of a one story garage with a driveway angled further away from the intersection of'rano and Sauk Lanes. Staff noted the proposed driveway is too close to the intersection and that angling it, as suggested, may violate the thirty-five (35%) percent front yard lot coverage requirement in the Zoning Ordinance. The petitioners noted they were agreeable to this alternative. Chairman Basnik asked staff to meet with the petitioner to help them develop a revised site plan for a one story attached garage and angled driveway. The Zoning Board of Appeals further discussed the variation request and voted 7-0 in favor of recommending approval of the petitioner's request for a four (4) foot required exterior side yard Case No. ZBA- I -97/Johnson Page 2 building setback and asked that the petitioners meet with planning staff to develop a revised site plan showing a one story attached garage and redesigned driveway. Staff met with Rosette Johnson and discussed with her alternative plans for the garage and driveway. The petitioners, Mr. & Mrs. Johnson, were sworn in and summarized their request. Mrs. Johnson stated they have lived in their home seven years. The existing home has a one -car garage presently used for storage. They are proposing to construct a two -car garage with a second story that will be used for storage. Mrs. Johnson further explained that, given the orientation of their existing home on the property, they are requesting a variation to locate the garage addition 4' from the exterior side yard lot line. Michael Sims, Planner, presented staff's report. He indicated that the petitioners are seeking approval of a variation to construct a building addition in the required exterior yard of their comer lot. The addition would be attached to the south side of the existing home and be set back 4' from ZBA-1-97 Page 2 the exterior side yard property line. The first floor of the addition would be used as a garage and the upper level would be used for storage. Mr. Sims explained that the existing residence is located on a comer lot and currently has a setback of 26'-4" from the exterior side yard. The zoning ordinance requires that principal structures maintain a minimum 20' exterior side yard setback. He stated that staff has reviewed the petitioner's site plan and plat of survey and believes that there are alternate locations for the proposed addition. He noted that the petitioner could construct a detached garage at the rear of the property or attach the garage to the rear of the kitchen. Mr. Sims concluded that the petitioners have not provided valid justification for the variation request and, therefore, staff recommends denial of the variation to reduce the setback for a garage addition on the exterior side yard from 20' to 4' for the residence located at 1401 North Sauk Lane, Case No. ZBA-1-97. Chairman Basnik asked staff if constructing the garage in a staggered form would be an acceptable alternative. Mr. Johnson explained they had looked at that alternative, however, the design described would require the removal of a recently built deck. He further explained that the deck had been constructed with a permit in conformance with the Village's various building and zoning requirements. Staff explained that it would be difficult to build an attached garage without demolishing a portion of the deck or requiring a variation request. Chairman Basnik stated that it would seem their only option would be to build a detached garage. Elizabeth Luxem stated that it was her understanding was that the permit they had previously received was for the deck only. Any future development on their property would require a permit and would be required to comply with the Village's building and zoning codes. Mrs. Johnson stated she has found that there are other homes located closer than 20' from the same property line. Her street is curved and, therefore, some of the homes appear to be closer to the street than her existing home. She stated she understood the Village's desire to require a uniform setback for homes, however, many of the homes she observed are located closer than 20' from that property line. Leo Floros stated that many of those homes were built before the area was annexed into Mount Prospect. Mr. Cassidy agreed. Mr. Sims presented architectural drawings for the proposed building addition. Chairman Basnik asked staff if the addition would have any impact on the site line requirements for the driveway and the intersection. Mr. Ungerleider explained the addition would meet our site triangle requirements given its setback from the intersection and that the driveway and curb cut would not be blocked from view by the building addition. Mr. Johnson stated that the garage addition would not be set any closer to the front property line than the existing home is placed now. ZBA-1-9? Page 3 Leo Floros asked the petitioner to explain how tall the building addition would be. The petitioner explained it would be a one story garage with a second story storage area above it. When completed, the garage addition would be similar in design and compatible with the existing home. Mr. Ungerleider confirmed that the building addition was be approximately 18' in height to the peak of the roof. Chairman Basnik expressed his concern at having such a tall structure set back only 4' from the property line, 5' from the sidewalk. Mr. Ungerleider stated that staff has two main issues: first, the mass of the proposed structure will be located in what the Village would consider the front yard of the property and, second, the precedence this variation would set for the rest of the community in allowing a principal structure to be located in the front yard (exterior side) setback. Leo Floros asked the petitioners how long they had owned the home and how old the home was. Mrs. Johnson explained that they had lived there for seven years and they have completed many household improvements to the thirty-five year old home. Mr. Floros inquired how the second floor of the addition would be finished. Mr. Johnson explained that it would be drywalled. The petitioner added that the old garage would be converted into a library or possibly a playroom for the children. Chairman Basnik asked the petitioner if they would be willing to compromise in building a one story garage addition and relocating the storage portion of that addition to another part of the property. Chairman Basnik added that his biggest concern is having such a tall structure so close to the property line. Petitioners responded that they would be willing to consider a one story addition as a compromise so they can build their addition as proposed. Mr. Floros agreed with Chairman Basnik's suggestion in that a one story addition would have less of an impact on the streetscape and the surrounding neighborhood. He further stated that he supports existing residents in the investment in their properties. The petitioners presented photographs of their property and the other properties in the area. Mr. Ungerleider stated to the Board that the proposed driveway would be located approximately 12' away from the street and comer of the intersection of the two streets. Although it is a residential intersection, the location of the driveway would not be permitted in the case where this home was first being constructed. The Village encourages that driveways and curb cuts be located as far from an adjacent intersection as possible. The petitioners stated they would be willing to redirect their proposed driveway to increase the distance between the driveway's curb cut and the intersection. The Zoning Board discussed the petitioner's request further. Chairman Basnik polled the board and determined that the Board would not be in support of granting this variation as proposed. Chairman Basnik stated that he would not be pleased with any variation which would allow the primary structure of a property be located ZBA-1-97 Page 4 4' back from the property line. However, he stated that he wanted to accommodate the petitioner in the spirit of the Zoning Board being a recommending body. Mr. Basnik added he therefore would be able to support this with the condition that it was a one story building addition. Mr. Ungerleider noted that such a request would require that the Village grant an ordinance for a building setback variation. The ordinance would not specify the height of the building, but rather the fact that the building would be set back 4' from the property line. He added that, at a later date, the petitioner could very well apply for and receive a building permit to add the second story. There were no further comments made by the Zoning Board. Chairman Basnik entertained a motion to grant the petitioner's request for a variation to reduce the setback for a building addition in the exterior side yard property line from 20' to 4' for the residence located at 1401 North Sauk Lane, Case No. ZBA-1-97, subject to the following conditions: 1. The building addition shall be reduced to one story and be designed to be compatible with the existing home. 2. Part-time one-way street designation does not make sense to them. Mr. McLeod said that he may have to move his cars if his car is parked against the one-way designation. Sean Won said that he does not have to move his car as long as the car is parked. Chairman Lee Beening said that streets surrounding several schools in the Village are designated as one-way to improve the safety of school children. 5. One-way street will not make streets safer to children. Only the police presence will make streets safer. 6. They wanted to know the results of the survey. Chairman Lee Beening said that 11 out of 19 residents gave positive responses to the one-way street designation in the first survey done by Mr. Kevin Hess, a member of the Concerned Citizens Group. The Village performed another survey in December, 1996. A total 24 surveys were sent out. 12 surveys were returned. 10 residents favored and 2 residents were against the proposed one-way street designation, Chairman Lee Beening said that the majority of the residents supported the proposed one-way street designation. Robert Frost School Principal Linda Allison said that the following: 1. Robert Frost School is to be renovated starting June 1997. 2. The Renovation Committee studied two options to improve the safety of school children. One option was to provide a turn around in the school property. Another option was to provide a curb cut. Neither of these options was recommended due to the site configuration problems. However, site improvement plans for the school are under review by the village staff. The engineering staff will work with the school to determine if onsite modifications can be made to provide for onsite loading and unloading of students. If this can be accomplished then these one way street designations may serve as only an interim solution. 3. Therefore, Robert Frost School requested the above one-way street designation. Commissioner Joan Bjork said that she lives near Forest View School and Estates Dr has been designated as one-way during school hours. Commissioner Bjork said that this one way street designation inconvenienced her but it also will make streets safer for school children. Commissioner Phyllis Moliere said that the time limitation could be shortened. Principal Allison agreed that the time limitation could be shortened as follows: from 8:00 A.M. - 10:00 A.M. & 2:00 P.M. - 4:00 P.M. to 8:30 A.M. - 9:30 A.M. & 3:00 P.M. - 4:00 P.M,. The above accident records do not meet the stop sign warrant (minimum five accidents per year) for the Multi -Way Stop Warrants. 2) Speeding Problem Speed studies were performed on Meadow Lane and Wedgewood Lane between Monday, August 12, 1996 and Wednesday, August 14, 1996. The 85th percentile speed of Meadow Lane was 25 mph and that of Wedgewood Lane was 33 mph while the speed limits of these streets are 20 mph. 3) Traffic Volume The minimum traffic volume for the multi -way stop sign warrant is 500 vehicles/hour for an eight hour period (500 x 8 = 4000 cars/8 hrs). The 24 hour traffic volume at the Meadow and Stratford intersection is approximately 240 cars which is 6% of the stop sign warrant and the 24 hour traffic volume at the Wedgewood/Stratford is approximately 420 cars which is 11% of the stop sign warrant. 4) Sight Obstruction A number of mature parkway trees are located at these intersections. However, these parkway trees do not present sight obstruction problems. 5) Survey Results A total of 29 surveys were sent out in January, 1997 to collect and analyze the resident's opinion. 20 surveys were returned to the Village. 13 residents favored and 7 residents were against the 3 -way stop signs at Mead ow/Stratford and Wedgewood/Stratford intersections. The intersections of Meadow/Stratford and Wedgewood/Stratford do not meet the multi -way stop sign warrants. Therefore, the Village Traffic Engineer recommends: The existing one-way Yield Signs onStrafford Place at Meadow Lane and Wedgewood Lane should not beremoved and replaced with u-wmvstop signs. b) Discussion Commissioner Nancy ouUikewwzsaid the following: 1. Trustee Hoefert instructed the Village Traffic Engineer mprocess this a - *ay stop sign request. 2. This subdivision is bordered by three major streets (Rand/Euclid/Elmhurst). This subdivision has experienced cut through traffic and speeding. 3. Due tuspeeding, the speed limits of the streets were reduced to2omph and children atplay signs were installed last year. This did not slow down the traffic. 4. This subdivision does not have sidewalks and streets are narrow (only 18'wiuo). Chairman Lee Bemningsaid that the Village asked the residents about installing sidewalks about ten years ago. The residents wanted tumaintain the rural atmosphere ot that time. Therefore, the Village did not install sidewalks. 5 Some residents wanted mhave two-way stop signs instead nra+v v stop signs. Commissioner Nancy eobixewczunderstood that this intersection does not meet the stop sign warrants, But she said that u*mystop signs mthese intersections should Uvconsidered because most v[the stop signs inthe Village may not meet the stop sign warrants. Therefore, the Village Traffic Engineer recommended: 3 -way stop signs at the intersection of Sunset Road and Louis Street should not be installed. b) Discussion Chairman Lee Beening explained the stop sign study performed by the Engineering Staff and said that this intersection does not meet the stop sign warrants. Commissioner Joan Bjork also said that this intersection does not meet stop sign warrants. Commissioner Andy Mitchell said that there are no speed limit signs on Sunset Road west of Louis Street for westbound traffic. Sean Won said that he will check Sunset Road and have additional speed limit signs installed if needed. HE VI Commissioner Andy Mitchell, seconded by Chuck Bencic, moved to deny 3 -way stop signs at Sunset Road and Louis Street. The motion was approved by a vote of 8-0. Chairman Lee Beening announced that the March Safety Commission Meeting will be held on Saturday, March 15, 1997 at the Christian Life Church at 400 E. Gregory Street to discuss the turn restrictions at the intersections of Rand/Isabella, Rand/Louis and Rand/Henry. With no further business to discuss, the Safety Commission voted 8-0 to adjourn at 9:33 P.M., upon the motion of Commissioner Chuck Bencic. Commissioner Andy Mitchell seconded the motion.
