AN ORDINANCE GRANTING MODIFICATIONS FROM
THE DEVELOPMENT CODE (CHAPTER 16) OF THE VILLAGE
CODE OF MOUNT PROSPECT FOR PROPERTY LOCATED
WITHIN THE MEIER ROAD SUBDIVISION
WHEREAS, Gettysburg Development Corporation (hereinafter referred to as Petitioner)
has requested modifications from the Development Code (Chapter 16) for property
commonly known as the Meier Road Subdivision (hereinafter referred to as Subject
Property), legally described as follows:
Lots 1 through 9 in Meier Road Subdivision, being a subdivision in the
Northwest 1/4 of Section 10, Township 41 North, Range 11, East of the
Third Principal Meridian, Cook County, Illinois;
and
WHEREAS, the Petitioner has requested a modification from the Development Code to
allow the cul de sac to have a diameter of one hundred ten feet (110'), rather than the
required one hundred twenty feet (120') and modifications from the Development Code
to allow a reduced lot depth on the north side of Lot 7, the south side of Lot 8 and the
east side of Lot 9; and
WHEREAS, the Plan Commission did consider the modifications from the Development
Code, as set forth hereinabove, at their regular meeting held on August 3, 1994; and
WHEREAS, the Plan Commission has forwarded its recommendation to the President
and Board of Trustees of the Village of Mount Prospect, and the President and Board of
Trustees have determined that the best interests of the Village would be served by
granting the modifications requested herein.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the recitals set forth hereinabove are incorporate herein as
findings of fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: That modifications from the Development Code (Chapter 16) are hereby
granted to the Subject Property as follows:
1. To allow a 110 foot right-of-way diameter cul de sac, rather than the required 120
feet.
2. To allow a lot depth of 101.95 feet between Lots 7 and 8, rather than the required
120 feet.
3. To allow a lot depth of 106.75 feet along the east lot line of Lot 9.
SECTION THREE: Except for the modifications granted herein, all other requirements
of said Development Code shall apply to the Subject Property.
SECTION FOUR: This Ordinance shall be in full force and effect from and after its
