ORDINANCE NO. 4667
AN ORDINANCE GRANTING A CONDITIONAL USE FOR PROPERTY
GENERALLY LOCATED AT 101 EAST RAND ROAD
VVHEREAS, Smart SMR of Illinois (hereinafter referred to as Petitioner) has filed a petition
for a Conditional Use with respect to property generally located at 101 East Rand Road;
and legally described as follows:
All of Lot 1 and Lot 2 (except the west 140 feet thereof) in N. J. Funk's
Subdivision of the south 150.09 feet of the north 511.60 feet of that part of
the northwest 1/4 of the northeast 1/4 lying west of the centerline of Rand
Road of Section 34, Township 42 North, Range 11, East of the Third
Principal Meridian, in Cook County, Illinois; and
WHEREAS, Petitioner seeks a Conditional Use to permit a ground-mounted antenna
tower one hundred twenty feet (120') in height; and
WHEREAS, a public hearing was held on the request for Conditional Use, being the
subject of ZBA 31-CU-94, before the Zoning Board of Appeals of the Village of Mount
Prospect on the 14th day of July, 1994, pursuant to proper legal notice having been
published in the Mount Prospect Herald on the 28th day of June, 1994; and
WHEREAS, the Zoning Board of Appeals has submitted its findings to the President and
Board of Trustees relative to the request being the subject of ZBA 31-CU-94; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
given consideration to the request herein and have determined that the same meets the
standards of the Village and that the granting of the proposed Conditional Use would be
in the best interest of the public.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact
by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TVVO: The President and Board of Trustees of the Village of Mount Prospect
do hereby grant a Conditional Use to the subject property to permit a ground-mounted
antenna tower one hundred twenty feet (120') in height, which tower shall be a soft white
in color.
SECTION THREE: That the Conditional Use granted with this Ordinance is subject to the
following conditions:
1. A security deposit of $5,000 shall be posted with the Village Clerk in the event that
the proposed antennae tower is abandoned for longer than three months. The
Village shall provide Nextel written notice of its intent to execute the takedown of
the proposed tower. All costs associated with such removal shall be the
responsibility of Nextel.

2. The proposed Conditional Use permit shall be administratively reviewed by the
Village Board on an annual basis to ensure that all conditions are being complied
with. Should the Village find that any of the conditions of approval are being
violated, written notice shall be made to Nextel requesting prompt remedial action.
If no action is taken by Nextel, then the Village shall take appropriate steps to
revoke the Conditional Use permit.
3. Upon any complaint of interference to radio, television or other home appliances,
Nextel shall promptly investigate the alleged interference to determine if it is
being caused by its facility and, if so, remedy the complaint.
SECTION FOUR: This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.
