CALL TO ORDER - ROLL CALL II. ACCEPTANCE OF MINUTES OF JANUARY 12, 1982. III. MOUNT PROSPECT ROAD Several months ago, the Village staff was approached by Cook County with the offer that jurisdiction of Mount Prospect Road between Central and Northwest Highway be transferred from the County to the municipality. Both the County and the State have been trying, as a policy matter, to divest themselves of roadways that are essentially local in nature even though tradition may have dictated that these roads were under the jurisdiction of the County or the State. The Village's standard policy has been to reject such overtures since the accepance of such roadways increase our maintenance costs without any commensurate increase in Motor Fuel Taxes however, in this instance recognizing that Mount Prospect Road was in need of some basic restoration and that if the Village were ever to move ahead with a special assessment for curb and gutter for the neighborhoods to the west, certain kinds of improvements to Mount Prospect Road would be a necessity. Based upon these perceptions, the staff suggested to the County that the Village could consider acceptance of the jurisdictional transfer if Mount Prospect Road were formally reconstructed t�,include curb and gutter, drainage, and necessary repaving'.' To our surprise, the County responded that it could, in fact, make such improvements prior to the transfer. Before bringing the matter directly to the Mayor and the Board, the administration sponsored an informational meeting with the residents in the neighborhood to solicit their reactions. While a few residents expressed approval, the majority of comments received, including a petition, objected to the improvements for fear of increased traffic flows, accidents, and basic change to the neighbor- hood. Some residents suggested, as an alternative, that the roadway not be widened but instead curb and gutter be installed along the western edge of the roadway and, therefore, limit the amount of improvement. The roadway widening discussed initially between the County and the Village staff included a parking lane on the western edge similar to that now existing along the eastern edge;i� Des Plaines. The staff made no proposal to widen t1 January 2( roadway for active vehicular traffic movements. Th ic— suggested alternative by residents in the area s, the staff's opinion, unsafe and that discussion is contained in the Engineer's report which is attached. Residents along the roadway on both sides have been given specific notice of the pending Committee of the Whole meeting and news releases have been distributed to the media. IV. ELECTRONIC GAMES - GAME ROOMS At a previous Committee of the Whole meeting, the staff was assigned to review the situation governing the absence of effective regulations on electronic games and game rooms. At a subsequent Village Board meeting, a moratorium was instituted holding in abeyance the further issuance of any licenses or permits for games or game rooms. That moratorium is due to expire on March 31, 1982. Currently, the Zoning Ordinance allows game rooms/arcades as a permitted use in B-4 Districts. Additionally, the Village Manager's office had made and implemented an interpretation that electronic games were not prohib under our Ordinance in other business establishment� park district facilities so long as the games were �. accessory use subordinate to the principal use of th"NUMans"FAM establishment. Beyond that interpretation, there is no specific Ordinance that regulates the location or the number of games. Research would also seem to indicate that our current permit fee, $37.50 annually, may need -updating. Attached for your review are suggested changes to the Zoning Ordinance and the Municipal Code licensing sections. In the absence of concrete regulations, the staff is recommending that we approach the subject from both the Zoning and the licensing aspects. In terms of Zoning, we suggest the Board consider allowing no more than 6 amusement devices as a permitted use incidental and accessory to bowling alleys, governmental uses, Class 1 and Class 2 restaurants, taverns, temporary carnivals or circuses and theaters. The operation of more than 6 amusement devices would then fall within the definition of a game roam and require a special use permit in both B-3 and B-4 Districts. In terms of licensing, we would recommend that the Mayor and the Board consider regulations to conform with the Zoning Ordinance and to provide controls as to the licensee/supplier and a new sy4 " tem of fees. The license Ordinance draft was prepared in 'the Village Manager's office and is modeled after sections adopted or under consideration in neighboring communities. An amortization clause is provided for those establishments currently having licensed machines. Attached are the proposed draft amendments. V. MANAGER'S REPORT 1.
