III. LANDLORD TENANT ORDINANCE

Several weeks ago the Village Board directed staff to research
and draft a proposed landlord/tenant ordinance. The Board
indicated that the ordinance should include two basic programs,
the annual inspection of common areas and a portion of
individual units and multi -family rental dwellings, and provide
for Village participation in the mediation of landlord/tenant
lease agreement disputes. To date, staff has visited the City
of Evanston and the Village of Oak Park to review their ordinances
in these areas, and discuss the programs with staff in those
organizations. In addition, we have reviewed the ordinances
in both Evanston and Oak Park, as well as material produced
by the City of Elgin. Recently we met with representatives of
landlords as well as tenants throughout the Mount Prospect
community. During this session the components of the proposed
ordinance were reviewed and we received feedback from both
groups relative to their interests. The concensus of this
group, although guarded on some issues, was that if administered
properly and fairly, the program could be of an overall benefit
to both landlords and tenants as well as the community as a
whole.
Based upon the direction given,by the Village Board and the
research and feedback received to date, Mr. Hedges will be
prepared to review the first draft of the proposed ordinance
with the Village Board on the 27th. Individuals who have
participated in discussions on this subject have been notified
of the meeting time and date. As has been discussed earlier,
it is anticipated that this program will require additional
staff in the form of one full-time inspector and one individual
to administer the landlord/tenant lease mediation program. The
Board has previously directed that all personnel costs related
to the administration of the landlord/tenant program should be
funded by revenue produced through licensing of multi -family
rental buildings.
IV. SPECIAL SERVICE,AREA/JAWA
The Village Board has directed staff to begin initial preparations
to create a special service area for the purpose of levying
a tax on all residents of the Village of Mount Prospect, with
the exception of users of the Citizens Utility area, to provide
funding for capital costs related to the acquisition of Lake
Michigan water. Ongoing operating costs, however, would be
funded through our water rate structure. At the Committee of the
Whole Meeting on July 27, staff will be prepared to review with
the Village Board the procedures involved in creating a special
service arch as well as a draft timetable for implementation.
We are advised by legal counsel that we must have formal action
on a special service area and notification to Cook County by
December 31, 1982, in order to collect the tax in 1983. Initial
preparations have been initiated to establish the district,
however we are now at a point where significant funds must be
encumbered and further Board direction is necessary.
