CALL TO ORDER - ROLL CALL II. ACCEPTANCE OF MINUTES OF OCTOBER 12, 1982 III. CITIZENS TO BE HEARD IV. BETHESDA LUTHERAN HOME ZONING CASE Because of the lengthy testimony given.thiscase at the Zoning Board of Appeals meeting, this case should be 'first reviewed by the Committee of the Whole :in order to have sufficient time to assess all the information. Bethesda is seeking a Special Use (Case 41 -SU -82) to allow the operation of a group home for eight clients and two supervisors- They are also seeking a Variation (Case 42-V-82) to allow the existing front yard parking area to meet the requirements of three off-street parking spaces as required by Village Ordinance. The property is located at 1318-1320 Linneman Road and is developed as a duplex residence -and zoned R-2. The matter was heard before the Zoning Board of Appeals on Thursday, October.�7-1982 and the voteon-theSpecial Use appeared to fail in the record with three members voting "for" the Special Use, two members "passing" and one member absent. On the Variance, the record appeard to indicate the motion failed with three members 'voting "for", two members "passing" and one member absent. Subsequent.to the Zoning . Board of Appeals meeting, the Village attorney prepared a legal opinion demonstrating that upon an Illinois Supreme Court case-- and the.Village's own rules and procedures., the two. -"pass" votes must be counted on the prevailing side of the motion and,. therefore, both Zoning matters have received favorable recommendations from the Zoning Board of Appeals. .As of the writing of this Agenda, the absent member has not cast her vote. -- The Village staff has notified the petitioner, as well as those residents who appeared at the Zoning Board of . Appeals meeting in either opposition-.-orl-support of the proposal. 7 Staff report attached. V. SIGN ORDINANCE REVIEW At the Committee of the Whole meeting,of October.12, 1982, we reviewed the substance of the Sign Ordinance exclusive of that section commonly referred to as Non -Conforming Signs/Amortization. This appears.on page 19 of the Sign Ordinance draft. What this section attempts to do is to establish procedures whereby signs that become non -conforming because of the adoption of the new Ordinance, will be either brought into conformance or, subsequently, replaced by legal signs. In reviewing this specific subject matter with the various advisory Boards and Commissions,. a number of qN= proposals were brought forward. For instance, the Sign Committee recommended a five-year amortization schedule; i.e., a business person would have five years from the date of the permit of an existing sign to comply with the new Ordinance. This position was subsequently modified after meetings before the Planning Commission and from input by the sign industry to read effectively: ---Ten years from -date of permit. The Zoning Board of Appeals further modified the proposal to say in effect: That the ten year from permit date period would not be enforced for five years from the date of the adoption of the Ordinance. Everyone has agreed that if changes are made to the sign that it must be brought into full conformance at the time of the change. The Planning Commission's approach to this was different and will be presented verbally at the meeting. The major issue before the Board is the effective date of full compliance with the Ordinance for those signs in non-conformance. Staff will be available at the meeting. VI. ALLEY VACATION At a prior Village Board meeting, the staff was requested to prepare a recommendation regarding the dedicated alleys in the vicinity of Wille and Kensington abutting property commonly referred to as Huntzicker's Subdivision. Attached is a staff report outlining the procedures necessary in a vacation together with three options available to the Mayor and the Board. This property is residentially zoned and with any vacation, the property must go equally to abutting property owners. It is the staff's recommendation that the Village vacate the alleys for a nominal fee ($1.00) in order to facilitate the resubdivision of Lots.1 and 2 in Huntzicker.'s Sub- division for residential development. The Committee of the Whole should consider a motion -directing staff to prepare the necessary documents, notify -the affected propertyowners and place the matter on subsequentBoard Agendas for appropriate Village action.l�._, VI.
