CALL TO ORDER - ROLL CALL II. ACCEPTANCE OF MINUTES OF NOVEMBER 10, 1981. III. ELECTRONIC GAMES AND REGULATIONS As reported previously to the Mayor and the Board, arcades are permissible according to the local Zoning Ordinance under B-4 Districts. The administra- tion has made an interpretation in the past that electronic games, as accessory uses; i.e., not principal uses, are allowable anywhere in the Village. Additionally, the Municipal Code licenses electronic games at a fee of $37.50 each. After this matter was discussed previously by the Mayor and.Board of Trustees in consideration of a possible moritorium, the newspaper carried an article regarding several northwest suburban communities and concluded that Mount Prospect had the least number of restrictions of any community. Obviously, this created a number of calls to the Village Hall from persons and corporations interested in starting businesses and expanding the distribution of electronic games. Inquiries are now made almost on a daily basis. In reviewing our situation as compared to municipalities generally, we do find that local Ordinances are substantially inadequate in regulating the various aspects of the game. The Village Manager has, therefore, directed that the staff prepare an analysis and a series of recommendations governing possible regulations in this area. These recommendations will be available at the Committee of the Whole meeting on Tuesday, November 24, 1981. Areas to be discussed include: A specific definition of electronic games, licensing regulations to define the supplier and/or operator of games, fees, the relationship of operations to the local curfew ordinance for the youth in the community, and the location of arcades and game rooms in relation- ship to schools, major highways, and residential neighborhoods. IV. LIQUOR LICENSE CODE In prior discussions with liquor license holders, one of the topics that was suggested to the Village fo� potential change dealt with the provisions of our Municipal Code regulating sampling. The Municipal— November 24 Code, currently in Section 13.113, B-1, says that no more than 12 daily sampling permits shall be issued to any one licensee during the period of one year. Depending upon the marketing strategy of any one licensee, we have discovered that some licensees will not use this privilege and other licensees will use the sampling permits in a very short period of time. Currently, the administration determines that each day is a separate permit. The administration requests that the Mayor and the Board consider removing any specific number of permits for such samplings, and establish a $10.00 per day permit to cover the municipal expense in issuing the daily permit licenses. If any local establishment tends to abuse the privilege, then the Local Liquor Control Commissioner can deny daily licenses in the future. Another Section of the Local Liquor License Ordinance, 13.105, indicates that the fee to be paid during the fiscal year for the applications made after May 1 shall be prorated in proportion to the full calendar months that expire in the year prior to the issuance of the license. It means that someone that comes in after six fiscal months have transpired pays only one -hal year fee. Additionally, in Section 13.110, Transfe— of License, the language is somewhat unclear as to the potential for a refund for a portion of the lic""Mm year paid when the license is prevented from operating. What occurs administratively is that in the absorption of the license or the termination of a license, we have a licensee approach the office asking for a refund. Additionally, someone coming in mid -year asks to pay less than the full fee. Because of the work effort that is involved in processing the liquor license, examining the background, interviewing perspective licensees and their managers, the Village administration recommends that anyone applying for a liquor license at any time of the year pay the full fee prescribed for the license and that refunds for unexpired months of the license not be allowed. This would be similar to the practice we try to follow with business licenses. If someone comes in during the middle of the year to apply for a business license, they must pay the full year. If the business closes, we do not allow them to have a refund for that portion of the business license that is unexpired. V. MANAGER'S REPORT 1. Xytel 2. Audit/Tax Abatement 3. Budget Schedule VI.
