ACCEPTANCE OF MINUTES OF AUGUST 25, 1981 For several months now, the staff has been attempting to meet the needs and requests of the residents in the vicinity of the Old Orchard Joint Venture Townhomes. Several townhome buildings remain unfinished. The developer, Frank DiMaria, is now requesting an extension on the building permits because of his inability to sell and complete certain units. The President of the Homeowners Association has been invited to the meeting. Attached are reports from the staff and a map locating the subject development. Pursuant to our Municipal Code, the Mayor and the Board must determine by policy as to whether or not a time extension on the building permits is granted. If a time extension is not granted, the Municipality would have the authority to institute court proceedings to have the uncompleted buildings removed. IV. ST. JOHN'S LUTHERAN CHURCH REZONING REQUEST The Zoning Board of Appeals has denied the rezonin,� I the variation for multi -development (R-4) at the 3o"No"Now" location. Copy of a staff report, Zoning Board mitt— September and case analysis is attached. Since affirmative action to grant the variance and the rezoning takes place within 6 months of the adoption of the Comprehensive Plan, a two-thirds vote of the President and Board of Trustees would be required. V. SELF-SERVICE GAS STATIONS Since the Spring of this year, we have been carrying a question about self-service gas stations on the Deferred Items list of the Committee of the Whole Agendas. In the past, the Village staff has interpreted a request from a service station to incorporate self-service facilities as a "trigger" mechanism to warrant rezoning. Numerous service stations in our community are in B-3 districts and comtemporary zoning ordinances permit their use only in B-4 districts. We consider these service stations to be legal non -conforming uses, however, when a request was made for self-service facilities, we then required them to go through the rezoning process. This, of course, is a costly procedure and in effect does not change the location of the station. Village staff has reviewed this situation and we are of the opinion that self-service facilities are a benefit to the consumer and not of sufficient intensity to warrant the triggering of a costly and time-consuming zoning process. Since this is in effect a policy change from previous administrative viewpoints, we are seeking the concurrence of the Mayor and Board of Trustees. We would continue to consider that building additions or substantial remodeling would be a change in intensity sufficient to warrant rezoning. Staff report is attached. VI. MANAGER'S REPORT 1.
