CALL TO ORDER - ROLL CALL ACCEPTANCE OF,MINUTES (No Previous Meeting) III. RESIDENTIAL REHABILITATION PROGRAM In last year's municipal budget, the Village adopted as a policy its desire to proceed with a Residential Rehabilitation Program utilizing Community Development Block Grant funding. This policy direction was '• reconfirmed with the adoption of the current year's budget. The central philosophy of this program attempts to prevent deterioration in residential property in a fashion similar to the Business Rehabilitation Loan Program. Those occupant/owners of residential property meeting certain income guide- lines would be eligible for loans to bring their properties into conformance with our local building codes. We have a total of $150,000 of current funds available for this program, $100,000 carry-over from the prior year and $50,000 j'n the current year. We have 11 inquiries that appear eligible at this time. This matter was initially reviewed by the Building Committee earlier this year, however', before we proceed any further, we need a confirmation on the part of the entire Board as to the program guidelines, eligibility and method of administration. The Manager's Office recommends that the Board accept the guidelines and eligibility requirements of the Community Development staff. In terms of administration of the Program, we are seeking the concurrence of the local banking institutions to accept this program's administration in a fashion similar to the Business Rehabilitation Program. If the.baiaks are unable, within a relatively short period of time, to join with us in the administration of the program, we would recommend that we utilize,existing staff and have the program move ahead, If the Committee of the Whole concurs with the recommendations and the reports attached, this matter can be scheduled on the following Village Board Agenda for formal approval to proceed. DEVELOPMENT CODE AND ZONING ORDINANCE ADMINISTRATIVE UPDATES For a number of years, the Municipal Code has contained provisions setting forth guidelines and standards for the development of all properties in the Village. A number of months ago when the Village staff began strict enforcement of these regulations, we discovered several omissions, contradictions or rigidity of certain standards. Most of these matters came to our attention when we were drafting the Rauenhorst Annexation Agree- ments, and when the Board reviewed the Agreements„ there was basic consensus to allow for changes. The staff has reviewed the entire Development Code and is now prepared to recommend a series of design standard changes and certain administrative language changes in an effort to ease administration of the Code and head off continual requests for deviations from the Code by prospective developers. This matter has been reviewed by all applicable Departments and Mr. Fritz will be available at the meeting to discuss the proposed changes, The Department of Community Development, in an attempt to strictly enforce the Zoning Ordinance, has discovered a series of problems relating to non-conforming residential structures and other administrative matters, Over the years, through annexation of developed properties, we inherited a large number of residential structures that do not meet the specific requirements of our Zoning Ordinance in terms of setbacks, l.ot size, etc. Either by design or by inadvertent omission, we have no mechanism in our Zoning Ordinance that would allow these property owners to make improvements to their properties without getting a host of Zoning variations. For instance, under Section 14.107,A, a property owner cannot construct a nominal addition to their home if the existing structure is in violation of yard requirements. The owner is faced with three basic alternatives - 1) To try and build without a permit in violation of our local Codes; 2) To seek Zoning variations through a lengthy process costly to all parties; or, 3) To abandon the improvement. Often, residents are faced with relocation in order to gain adequate room for their family, It is,,obvious that we should be encouraging residential upgrding rather than discouraging such. The staff recommends, therefore, that the Zoning Ordinance be amended to recognize these l.ncongruities within our residential districts. The staff will. be available at the Committee of the Whole meeting to give additional examples and administrative problems, (Development Code text changes and Zoning Ordinance memo attached.) V. COMMITTEE OF THE WHOLE PROCEDURES The adoption of the Committee of the Whole system is intended primarily to allow the elected officials to focus their attention upon policy issues requiring comprehensive direction and basic discussions by the Committee of alternative approaches, municipal costs, and long-term implications. The transition from our former system to the new system will not be without some problems and confusion. The change will be effective if we take the time and effort to discuss and determine those types of matters that should rightfully consume the attention of the Committee of the Whole and describe those kinds of matters that may be taken directly to a Village Board meeting or should be delegated to the staff and submitted as a subsequent report. In previous discussions about the new Committee system, three matters may need some further clarification. These are: Procedures for zoning cases; liquor license matters; and legislative updates. The Committee of the Whole should agree upon its Procedures and specifically'make recommendations for handling the above named items. (Manager's memo attached.) Vi. MANAGER'S REPORT A.
