MANAGER'S REPORT
Village Manager Burghard reporting on a meeting held between
Mayor Krause, administration and the Illinois Department of
Transportation, relative to the closing of Gregory Street at
Rand Road. Mr. Burghard reported that IDOT had rioted that
it might be advisable for the Village to monitor the situation
with Gregory Street closed and review the matter in 6 months
at which time the State would approve the recommendation of
the Village,
Mrs. Menczywor, 509 N. Elm, and Mrs. Passenhelm, 519 N. Elm,
spoke in opposition to the fact that Gregory Street was closed
and presented a petition requesting that Gregory Street be
re-opened. It was the feeling of those residents objecting to
the curbing of Gregory that it created a safety bazard.
Mr. Dennis Granahan, 319 North School, presented a petition
signed by area residents requesting that Gregory Street remain
curbed at Rand Road.
Mr. Rasmus, 320 N. Elm and Glen Held,orn, 310 N. William, also
spoke in favor of allowing Greogry Street to remain closed,
Mr. Burphard reported that the State of Illinois would allow
a traffic signal at Council Trail and Route 83, however, it was
the intent of the Village to have a pedestrian crossing signal at
that location to insure the safety of school children going to and
from Lions Park and Lions Park School. Since the State stated
that a pedestrian light would have to be installed in mid-block,
it was determined that the matter should be referred back to
the Public Works Committee for a recommendation.
MAYOR'S REPORT
Mayor Krause informed the Board that Clarence Schlaver, former
Village President and presently the Executive Director of the
Mount Prospect Chamber of Commerce is confined to Northwest
Community Hospital. AH members of the Board signed to 'Get
Well' card and expressed their wishes for a speedy recovery.

Mayor Krause then requested direction from the Board as to AMENDMENT' TO
an amendment the Northwest Municipal Conference is seeking NORTEWES'.1"
to their By -Laws whereby the voting privilege would be MUNICIPAL
restricted, to Village President, Chief Appointed Official, or CONFERE�ITCE
Trustee. It was a verbal opinion of the Board that the Mayor BY-LAWS
should cast her vote at the next Conference meeting as she
judged the best.

FINANCE COMMITTEE
An Ordinance Amending Chapter 13 of the Municipal Code,
amending the text and creating an additional Class "C" and
Class "W" liquor license had its first reading and would be
presented at the December 18th meeting for 2nd reading,
FIRE AND POLICE COMMITTEE
An Ordinance Relating and Regulating the Use of Privately
Owned Electronic Burglary, and/or Robbery Alarm Systems
and Prescribing Fees, Penalties, and Removal of Certain
Alarm Systems From Police Department Facilities for False
AMEND CHAPTER'13,
FALSE ALARMS
BURGLARY
Alarms and Other Related Operational Offenses had a first
reading and would be presented December 18th for 2nd reading.
An Ordinance Amending Specified Sections of the Building AMEND CHAPTER 21
Code of the Village of Mount Prospect, pertaining to life LIFE SAFETY
safety features, would be presented December 18th for first FEATURES
reading, following clarification.
Trustee Murauskis, seconded by Trustee Miller, moved to FOREST RIVER
concur with the recommendation of the Fire and Police FIRE
Committee to enter into an Agreement with the Forest River DISTRICT
Fire Protection District, for 1980.

A resolution authorizing the execution of the Forest River
Fire Protection Agreement would be presented December 18th.

Committee to direct the administration to investigate the
possibility of increasing the tee for fire piotection service
in the Forest River Fire Protection District in future
agreements.

SUBJECT: 1980 MFT Maintenance Fund
MFT Maintenance funds are based on a fiscal year that begins on
January 1. A resolution is required to appropriate finds so
that we can pay for salt, traffic signal maintenance and traffic
signal energy beginning January of 1980.
The Village appropriated $450,000 for MFT maintenance in 1979.
At this time, I am asking that the Village again appropriate
$450,000, and recommend that the attached resolution be adopted
by the Village Board. 11

DEPARTMENT OF MANAGEMENT SERVICES
SECTION 4.501. Creation of Department. There is hereby created
'and e`stablished the Department of Management Services which
shall be under the jurisdiction and control of the Village Manager.
SECTION 4.502. Appointment, Term and Removal of Director. The
supervisor of the Department ofmanagement ffe'_rvH._ces shall be called
the Director of Management Services. Said Director shall be
appointed by the Village Manager and shall serve as Director until
removed from such position by the Village Manager.
SECTION 4.503. Jurisdiction. The Department of Management Services
shall -encompass tie _f_inEiH`cia1 functions of ' the Village including
the work of the Comptroller, Village Treasurer and Budget Officer,
if any, and the functions of the Village Clerk.
SECTION 4.504. Duties of Director. The Director of Management
Ser_v_l es shall have the following uties, responsibilities and
functions:
A. To supervise the Village Clerk and the Village Comptroller.
B. To supervise the Village treasury.
C. To maintain all accounting records and reports as to Vil-
lage finances in accordance with applicable law and
generally accepted accounting principles.
D. To report at least monthly on financial matters to the
Village Manager.
E. To establish all procedures relating to the collection,
encumbrance and disbursement of the Village's funds.
F. To make recommendations to the Village Manager as to the
financial condition of the Village and to make suggestions
as to its improvement.
G. To maintain an inventory of real and personal property
owned or leased by the Village together with tax
exemption records therefor.
H. To supervise all other offices of the village insofar as
they relate to the collection or disbursement of Village
funds.
I. To supervise all duties and . responsibilities charged to
the Village Comptroller.
J. To supervise all duties and responsibilities charged to
the Village Clerk.
K. To act as Village Budget officer if designated as such by
the Village Manager. If the Director is so designated as
Budget officer, the Director shall perform the following
duties, responsibilities and functions:

1. To permit and encourage the use of efficient planning,
budgeting, auditing, reporting, accounting and other
fiscal management procedures.
2. To compile a budget in accordance with the following,
which budget shall contain estimates of revenues
available to the Village for the fiscal year for
which the budget is drafted, together with recommended
expenditures for the Village and all of the Village's
departments, commissions and boards:
a. The budget shall be itemized in a manner consis-
tent with a chart of accounts as may now or in
the future be approved by the Auditor of Public
Accounts of the State of Illinois.
b. The budget shall contain actual or estimated reve-
nues and expenditures for the two (2) years imme-
diately preceding the fiscal year for which the
budget is prepared. So far as is possible, the
fiscal data for such two (2) preceding fiscal
years shall be itemized in a form consistent with
the chart of accounts approved by the Auditors of
Public Accounts for the State of Illinois.
C. Each budget shall show the specific fund from
which each anticipated expenditure shall be made.
d. The annual budget shall contain money set aside
for contingency purposes not to exceed ten percent
(10%) of the total budget, which monies may be
expended for contingencies upon a majority vote
of the corporate authorities then holding office.
e. One-half (1/2) of one percentun (1%) of equalized
assessed value of property subject to taxation by
the Village shall be accumulated in a separate
fund for the purpose or purposes of specific capi-
tal improvements, repairs and/or replacements of
specific types of Municipal equipment or other
tangible property to be designated as the "Capital
Improvement, Repair or Replacement Fund."
(1) Expenditures from the Capital Improvement,
Repair or Replacement Fund shall be budgeted
in the fiscal year in which the capital
improvement, repair or replacement will occur.
(2) Upon the completion or abandonment of any
object for which the Capital improvement,
Repair or Replacement Fund, or should any sur-
plus moneis remain after the completion or
-abandonment,of any object for which the Capital
Improvement, Repair or Replacement Fund was
inaugurated, thlen such funds no longer neces-
sary for capital improvement, repair or
replacement shall be transferred into the
General Corporate Fund of the Village on the
first day of the fiscal year following such
abandonment, completion or discovery of such
funds.

E. To keep records showing all money received, showing the
source from which it is received and the purpose for which
it is paid, and to keep records at all times showing the
financial status of the Village money.
F. To keep such books and accounts as may be required by
state or local law and keep them in the manner required by
law and good accounting principles and as directed by the
Director of Management Services.
SECTION 4.507. Special Assessment Funds.

A. All monies received on any special assessment shall he
held by the Treasurer as a special fund to be applied
only to the payment of the improvement, or bonds and
vouchers issued therefor, together with the interest
thereon, for which the assessment was made, and said money
shall be used for no other purpose, unless to reimburse
the village for money expended for such improvement.
B. Payments on bonds or vouchers shall be made in accordance
with the state and local law and the Treasurer shall keep
books and accounts in such a manner so that proper prora-
tions in payments of principal and interest can be made
and ascertained.
SECTION 4.508.•Warrants; Transfer- of Funds.
A. All warrants drawn on the Treasurer must be signed by the
Mayor, stating the particular fund or appropriation to
which the same is chargeable, and the person to whom pay-
able, and no money shall be otherwise paid except as may
be provided by law.
B. Money shall not be transferred by the Treasurer from one
fund to another, after it has been received, nor appro-
priated to any other purpose than that for which it has
been collected or paid, except as may be ordered by the
Mayor and Board of Trustees in manner and form prescribed
by law.
SECTION 4.509. Village Camptrrlluer. There is hereby created the
position o. Village Comptroller. The village Comptroller shall be
appointed and removed by the Village Manager. The Village
Comptroller shall perform such duties and responsibilities as are
assigned to the Comptroller from time to time by the Village
Manager or Director of Management Services.
SECTION 4.510. BOND. The Director of Managowient Services,
Comptroller,Budget --- 6_t" ---- officer and Treasurer shall give a bond, before
entering upon the duties of office, in the sum required by the
Board of Trustees; but such amount shall not be less than that
required by state law. This bond shall be conditioned to indemnify
the Village for any loss by reason of any neglect of duty or any
act of the Director of management Services, Comptroller, Budget
officer and Treasurer. The premium of the bond shall be paid by
the Village.

records the Village Clerk is required to keep and main-
tain.
G. To perform such of -her duties as may be assigned to the
Village Clerk from time to time by the Director of Manage-
ment Services or the Village Manager or as may be -required
by law.
SECTION 4.513. DEPUTY CLERK. The Village Manager may appoint a
deputy Vrll.aye Clerk, who in the temporary absence of the Village
Clerk shall be empowered to perform all the duties of the Village
Clerk.
SECTION 4.514. ➢,EGAL PUBLICATIONS. All or-di.nances require() to be
published, except those published in. pal-riphleL form, and any and
all other notices required to be published shall be published in a
newspaper of general circulation within the Village.

A RESOLUTION AUTHORIZING A TEMPORARY
SUSPENSION IN THE RECLASSIFICATION OF ZONING DISTRICTS
WHEREAS, the Village of Mount Prospect has heretofore on July 20, 1976, adopted
a comprehensive plan for the present and future development and redevelopment of
land within and without the corporate limits of the Village, and
WHEREAS, the Village of Mount Prospect has, on April 5, 1977, approved
revisions and amendments to the said comprehensive plan; and
WHEREAS, the President and Board of Trustees, the Zoning Board of Appeals,
and the Plan Commission of the Village have been required to consider frequent
requests for changes in the zoning district classifications of land within the Village,
many of which applications for changes have involved requests for the
reclassification of land zoned for single family development to districts in which
multiple family development would be permitted; and
WHEREAS, only approximately 8% of the land area of the Village remains
undeveloped; and
WHEREAS, approximately 10% of the land in the Village may be presently
underutilized and subjject to redevelopment; and
WHEREAS, the President and Board of Trustees have found and determined th

and guidelines should be determined for changes in the zoning classificatiolno

WHEREAS, the President and Board of Trustees have found and determined that
in order to insure a rational and harmonious balance of types of land uses and
intensity of land uses within the Village it is imperative that there be a temporary
pause in the consideration of rezoning applications pending a review,
reconsideration and augmentation of the comprehensive plan of the Village so as
to provide meaningful and useful guidelines for the decision of applications for
the reclassification of particular tracts of land; and
WHEREAS, the President and Board, of Trustees have found and determined that
the process of reviewing, reconsidering, and augmenting the comprehensive plan
of the Village so as to provide mo.re meaningful and useful guidance to the Village,

LiquorLicense Application -- Balaka Foods, Inc.
Mr. iinetti, attorney for Balaka Foods, 'Phyllis and Francis Balaka, owners
of the'Chanticleer Restaurant addressed the Committee regarding their request
for a glass R, liquor license for their restaurant located at 15 West Prospect
Avenue, Staff indicated the application was complete and all fees have been
paid.
It wasnotedthat the previous owners had given up their liquor license and
that the Balaka's were requesting the same type of license.: They will comply
with the resident manager requirement if necessary.

TrusteRichardson requested that in the future when a restaurant has been
operat ng.during the liquor license application period, that a copy, of the
HealthjInspection Report with the information be,-psavi:ded to the Committee.:
Mssrs.�Miller, Richardson and wattenburg`had no objections to this license
being issued; Chairman; Miller informed the owners that the Committee would
reportout their recommendation that the license be created at the Board
Meeting on December 18,'1979. The enabling ordinance would be presented at
the January 2, 1986 Board Meeting.

Chairma "Miller requested Mrs. Eisenman to present report on the Senior
Citizen Employment Counselor Program's funding needs.

Mrs. Eisenman reported that a Chicago - based group involved in area Senior
CitizenEmployment Programs, OPERATION ABLE, has agreed to partially fund this
position until September, 1984. The Village would need to make up the differ-
ence b tween the expenses and the grant inthe amount of $86.44 per month until
September. The Committee agreed to recommend that the Village participate in
this p zng"ram in this amount.

A general discussion of the activities of the Employment Counselor was held.
Mrs. Eisenman stated that between October of 1978 and'September of 1979, 1,126
Senior Citizens were registered in the program; the placement ra'Me is approxi-
mately thirty-three percent. These individuals were placed on a broad spec-
trum of job types and in various locations; many area agencies also assist our
program with placement possibilities. Trustee Richardson noted that this dis-
cussion had been very helpful in understanding the specifics of this program.
Along the same lines; Manager Burghard'noted that there were other programs co-
ordinated out of the Senior Center. For example, the part -.time nurse program
which attends to the specific health needs of many seniors on a'regular basis
and the Outreach program which attempts to meet the needs of Mount Prospect's
Seniors who are in crisis situations. Mrs. Eisenman was asked to discuss the
Outreach Program.
The Outreach Program is designed. to reach those Seniors who are having financial,
emotional, or physical problems and. who have no place else to turn. This pro-
gram receives referrals for assistance daily from the paramedics, over one
hundred -seventy cases have developed since May, 1979. Cases are, also referred
by apartment managers, neighbors, family members, area hospitals and the home
delivered meals volunteers. The total cases; handled by the Outreach Pro( tram
from October, 1978 to September, 1979 is 366. These people receive counseling,
personal encouragement, assistance with medical forms, insurance problems and
other financial counseling, help with securing groceries.; The. process :is that
of co-ordinating area resources to be be of benefit to those individuals in
need.
The program is currently funded by a; minimal grant from CEPA Title 3 for $3.00
per hour. .Mr. BUrghard,and Mrs. Eisenman feel. that it will be extremely diffi-
cult to fill rr,i,; wosition at this rate. To fund it at a more appropriate level
through this fiscal near,would, require approximately $1,500. The Committee unani-
mously recommended to report favorably to the Board on 12/18/79 to authorize the
Manager to expend the additional funds to fill this position. Mrs. Eisenman
was requested to attend the Hoard Meeting.,
Fiscal Policy
Mrs. Peppler presented a,report on the personal property replacement tax. She
reported that a meeting was held with area Finance Directors and the State of
Illinois Department of Revenue to discuss the Personal Property Replacement
Tax, ,in light of the court decision which upheld the taxaThis decision,
coupled with the State's „projections for allocations, now affords us accurate
enough information to make a decision about abating additional taxes to avoid
a replacement tax "windfall
The State has projected that 'Mount Prospect will receive $172,273 during
calendar year 1980. "
As has been discussed in the past, the replacement tax revenues must be allocated
first to General Obligation Debt and second to the various pension funds in the
proportion of the levy which had been previously extended to the personal, prop-
erty assessed valuation. In Mount Prospect's case, 9.1% is the percentage of
personal property to the total assessed valuation. ° Considering the levy, this
would result in the following, required allocation of our replacement tax revenues;

The balance of the estimated revenues would be $20,156; this would be 20,156
available for purposes previously supported by property taxes.

The County Clerk will automatically reduce our G. 0. Bond levy 'by;$60,616 to avoid
over -funding this obligation. with a combination of our property tax receipts
and replacement tax revenues, we should meet the $666,115 obligation with no diffi-
culty or excess received.
The County Clerk will not, however, adjust the pension levies to reflect the
additional revenues to,be received from the replacement tax; nor will he adjust
for additional non -allocated funds to be received. This approximate $110,000
would be available for abatement, prior to December 31, 1979,, to avoid "wind -
falling" from the replacement tax.
From a practical point of view, the $20,000 non -allocated revenues should probably be
left alone to guard against the possibility of the State's estimate 'being on the
high side.
Considering the pensions, $90,000 could ,be abated without affecting our pension
obligations for this year. It should be noted that all of the pension funds
have substantial unfunded accrued liabilities that will have to be made up from
property taxes in future years and this $90,000 'could be used to meet these future
liabilities.
After sante discussion, the Committee unanimously agreed to recommend to the Board
to abate $90,000 in the various pension funds at the Board Meeting on 12/1879.
It was considered that this would be in keeping with Board's previous_ policy of
only raising enough revenues to meet current necessary obligations.
Mr. Richardson left at 9.30.
All other items were deferred until next Committee Meeting.;
Meeting was adjourned at 9:40 p.m.

lieu of property tax in the area of pensions.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That $27,900 of the money received from the personal property
tax replacement fund is hereby directed to be applied to the appropriation for
Police Pension for the fiscal year beginning May 1, 1979.
SECTION TWO: That $27,900 of the Police Pension Tax Levy is hereby abated
and cancelled from the $318,354 Police Pension Tax levied by Ordinance No. 2936

Section 24,1301. Unlawful Use Prohibited. It shall
be unlawful for any person, firm, or corporation to
have or maintain on any premises an audible type
burglary and/or robbery alarm without first having
made application for such alarm with the Mount Prospect
Police Department
and it is unlawful for any such person to fail to appear
and turn off or reset any such alarm within one hour
after being notified by the police to do so.
Section 24.1302. False Alarms Prohibited --Fees for
Response se .
A. It is unlawful for any person to knowingly activate
any robbery or burglary alarm for the purpose of
summoning police except in the event of an actual
or attempted burglary or robbery, or for any person
to notify the police of an activation of an alarm
having the knowledge that such activation was caused
by an electrical or other malfunction of the alarm
system without also notifying the police of such
malfunction.
B. For the purposes of this Section, the term "false
alarm" shall mean the activation of a burglary
and/or robbery alarm at a time when no burglary
or robbery is being committed or attempted on the
premises.
C. Should the police respond to any false alarm, the
Village of Mount Prospect shall charge and collect
from the person having or maintaining such burglary
and/or robbery alarm on premises owned or occupied
by him, the following fees:

All ORDINAACE AMENDING SPECIFIED SECTIONS OF THE BUILDING CODE
OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
determined that it is necessary to the health, safety and welfare of the Village
residents to require self-closing doors, smoke detectors and emergency lighting in
existing multiple family dwellings in the Village of Mount Prospect.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: Article III of Chapter 21 (Building Code) of the Municipal Code of
the Village of Mount Prospect be, and the same is hereby amended by adding thereto
a new Section 21.308 entitled "Special Requirements for Existing Multiple Family
Dwellings", which said new Section 21.308 shall hereafter be and read as follows.
"SECTION 21.308. Special Requirements for Exisitng Multiple

The owners of existing multiple family dwellings within the Village
of Mount Prospect shall comply with the following requirements:
A. Self -Closers.
Doors between apartments and corridors shall be self-closing.
The self-closing device shall be of an, approved type.
B . Smoke Detectors.
An approved single station smoke detector, battery powered,
shall be installed in an approved manner in every living unit within
the Multi -Family dwelling. When activated, the detector shall
initiate an alarm which is audible in the sleeping rooms of that unit.
C. Emergency Lighting.
Any Multi -Family dwelling with twenty-six (26) or more living
units shall have emergency lighting. All emergency lighting shall
be in accordance with N.F.P.A. #101, Section 5-9.11
D. The word "approved" for the purposes of this Section 21.308 shall
mean - accepted by the authority having jurisdiction by reason
of tests or investigation conducted by it or by an agency satisfactory to
the authority, based upon nationally accepted test standards or principles.
SECTION TWO: The provisions of this Ordinance shall be deemed to be separable,
and the invalidity of any portion of this Ordinance shall not affect the validity of
the remainder.
SECTION THREE: This Ordinance shall apply retroactively to 111 multiple
family dwellings.
SECTION FOUR: This Ordinance shall be in full force and effect from and after
its passage, approval ard publication in the manner provided by law.

Department of the Village to said District during 1980; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that it would be in the best
interest of the Village and of said District to enter into an
agreement with the terms and conditions set forth in Exhibit A
hereto for the provision of Village Fire Department services to
said District.

December 31, 1980, at 12:00 midnight said day, the Village shall furnish
all fire fighting, fire protection, fire prevention, and other emergency
services, including emergency ambulance service, by such volunteer or
paid on call and/or regular firemen available to the Village as the Fire
Chief Of the Village shall determine, to the District for a certain area
as shown and outlined in orange on Exhibit I attached hereto and made
a part hereof.
2. That for the period -of time during which this agreement,
shall be in full force and effect, the District agrees to pay and the
Village agrees to accept as full payment for said fire protection, fire
prevention services, and emergency services that amount of monies
received from tax receipts collected during the period beginning
January 1, 1980, and ending December 31, 1980, less all costs of running
the said District including but not limited to all administrative legal
.salaries and other expenses incurred.
a. It is understood that the District shall levy taxes
at the maximum rate authorized by statute without referendum;
and shall apply for and make all efforts to receive any
available state and/or federal aid to fire protection districts
as is now available or may be made available during the term- - -
hereof;-all—such leviest-however; shall -be exclusive of the
amount of taxes -levied for payment of the bonded indebtedness -
of the District which existed prior to the discontinuance of
the fire department of the District. It is understood that
the District will continue to levy and extend taxes upon the
taxable property in its territory for its proportionate share
of such bonded indebtedness of the District at the time of the
said discontinuance for the purpose of amortizing such bonds
until such timeassufficient funds to retire such bonds have
been collected.
b. The payments by the District to the Village shall be
made in the following manner:
(i) The SUM Of FIVE HUNDRED DOLLARS ($500.00) shall
be paid upon the execution of this agreement.

(ii) The sum of FIVE HUNDRED DOLLARS ($500.00) on
or before April 1, 1980.
(iii) The sum of FIVE HUNDRED DOLLARS ($500.00) on
or before July 1, 1980.
(iv) The balance remaining after all expenses have
been paid shall be paid on or before December 31, 1980.
3. That the Fire Chief of the Village shall have the sole and
exclusive right, duty, and responsibility to prescribe the manner and
method of giving the alarm for fire and/or other emergencies occurring
--within the District's territory as outlined upon said Exhibit I.
4. That the Fire Chief of the Village or his authorized
representative shall have the sole and exclusive authority and responsi-
bility to direct and control any and all fire fighting, fire protection,
fire prevention, and other emergency operation carried on at the scene
of any alarm or emergency -occurring within that territory of the District
shown upon the said Exhibit I.
5. That all fire fighting, fire protection, fire prevention
and other emergency procedures conducted under the provisions hereof
shall be conducted in accordance with the regulations of the Mount
Prospect Fire Department and the ordinances of the Village. Furthermore,
the District agrees that within ten (10) days of the execution hereof,
it shall pass and approve ordinances identical in form and content to
the ordinances of the Village which deal with fire fighting, fire
protection, fire prevention, building construction as related to fire
safety, and other emergency procedures.
6. That all expenses and cost of maintaining equipment,
apparatus, salaries, insurance premiums, and any and all other items of
expenses connected with the several services contemplated herein to be
supplied by the Village to the District shall be borne by the Village.

FOR EMERGENCY FIRE DEPARTMENT SERVICE
WHEREAS, from time to time the Village of Mount Prospect Fire
Department is called upon to render emergency fire, ambulance or
paramedic services to persons and areas not within the jurisdiction
of the Village of Mount Prospect Fire Department, and with whom the
Village has no mutual aid agreement or other contract for such
service; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect find that it would be in the best interest of the
Village to require a person who requests and receives such services
of the Fire Department to be required topaytherefor.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, Cook County, Illinois
as follows:
SECTION ONE: Any person who does not have a mutual aid agreement
or other contract with the Village providing for fire, ambulance
or paramedic service and who requests the Village of Mount Prospect
Fire Department to render such service to a person or area not with-
in the jurisdiction of.the Village of Mount Prospect Fire Department
and for whom or on whose behalf the Fire Department renders such
service shall be deemed to have entered into a contract with the
Village of Mount Prospect for the rendition of such service and
shall be required to pay said Village within thirty days of a
receipt of a bill therefor, the fees and charges for such service
set forth in Section Two of this Ordinance.
SECTION TWO: The following fees and charges shall be paid by any
person requesting and receiving any one or more of the following
services:
1. Two Hundred Dollars ($200.00) per apparatus per hour of
portion thereof for fire fighting equipment.
2. One Hundred Dollars ($100.00 ) per vehicle per hour
or portion thereof for ambulance response.
3. One Hundred Dollars ($100.00) per vehicle per hour
or portion thereof for staff car response.
SECTION THREE: This Ordinance shall be in full force and effect

Chairman Farley called the meeting of the Public WorksCommittee to order
at 7:30 p.m.
A. CHURCH DIRECTIONAL SIGNS
Village Engineer, Ben Hemmeter, stated that he has recently received
a request from a church for placement of ''a church directional sign onto an
existing street sign. In the past, this has been provided with no problem,
but we now have a few locations that involve more than one church. Should
all the churches request a directional sign,, there would be a problem trying
to affix that many atop an existing street sign., The Committee recommended
to continue the existing policy and that staff should review possible alter-
natives to provide more than one church directional sign when, and if, the
situation may arise.
B. PROPOSED TRAFFIC LIGHT COUNCIL & 83
This item was put back into Committee upon request of the Village'Mana-
ger. Ben Hemmeter reported we have two alternatives; one, that the traffic
light be located at the intersection of Route 83 and Council and be actuated
by traffic on Council Trail, and two, the signal be located mid block and
be only a pedestrian signal. Estimated cost of a fully signalized inter-
section would be $60,000.00, whereas a pedestrian signal would be $40,000.00.
The Illinois Department of Transportation will submit 'a formal report
regarding this installation, but have indicated they will approve either
location. Mr. Hemmeter further stated that the Safety Commission has review-
ed the proposed traffic signal but their recommendation was not available at
this time. The Committee recommends that this be placed on the January 10,
1980 Public Works Committee Agenda and that staff have available copies of
those reports previously mentioned. Also staff should make the necessary
arrangements to !notify School District #57' and those people who petitioned
for the installation of the signal.

C. WELLER CREEK. TREE REPLACEMENT
This was a request from Mr. Miedler who resides at 717 South William
regarding Village participation in replacing some Russian Olive trees
that run along his south lot line. These trees are located on the Village
easement for Weller Creek and are not on his property. Mr. Miedler stated
that he has maintained this easement for the ,past 10 years and he has
never asked for assistance from the Village. However, he now feels it's
the Village's turn to do their part and replace the dying trees. The
Committee informed Mr. Miedler that at the present time, the Village has
not budgeted funds for any type of tree replacement within Village ease-
ments, but the Committee would review this matter and consider some type
of Village beautification program for the upcoming fiscal year.
D. LAKE BRIARWOOD
This item was continued from the November 17, 1979 Public Works Commi-
ttee Meeting regarding a request from Mr. Plaza, Mr. Henneberry, and Mr.
Schranz of Lake Briarwood for Village assistance of bank stabilization of
a drainage ditch that runs through their properties. The Committee was
presented with proposals from two local contractors with estimates that
ranged from $17,500.00 to $62,600.00 and involved different designs. Copies
of the recorded plot of annexation were presented showing no dedicated
public easement for this drainage ditch. Through the services of Anton
Adams, a registered Illinois land surveyor, copiesof the original sub-
division plot of survey were also made available 'showing that there was a
recorded 20 feet easement for storm water drainage. However, it did not
reveal to whom the easement was granted and for what purpose.
Therefore, the Committee' recommends that the staff authorize legal
'counsel to conduct a title search to determine whether or not the Village
has any responsibility in this matter. Staff was further directed to
secure additional quotations and ask that legal counsel be present at the
next scheduled Public Works Committee Meeting to explain their findings of
the title search.
E. SEWER SYSTEM EVALUATION SURVEY
It was Village Engineer, Ben Hemmeter's recommendation to approve
Donohue and Associates final sewer system evaluation report. This report
was initially presented to the Committee at a public hearing on October 4,
1979. Village Board approval of this report is necessary in order to apply
for federal funds that have been ear -marked for the next phase of this
program. The Committee concurred by a majority vote with this recommendation.
The next Public Works Committee Meeting is scheduled for January 10, 1980.
The meeting was adjourned at 9:59 p.m.
