Trustee Floros requested information as to why the motion ARCHIPLAN
relative to the contract with Archiplan for a new roof on the Public CONTRACT
Safety Building failed with a 3-2 vote. General Counsel, Marlin Public Safety Bldg,
Smith, explained that a 2/3 vote is required when the motion Roof
applies to the expenditure of funds.

COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD
Mrs. Judy Kermin, 1042 W. Central Road, requested the Board to 1000 W. CENTRAL
look into the construction equipment operating at the 1000 W. Central Rd.
site operating before 8: 00 A.M . The Village Manager stated that
additional action would be taken.
Mrs. Menczywor, 509 N. Elm St., and Mrs. Passenheim, 519 N. Elm St. GREGORY ST
requested information as to why Gregory Street had been closed on a - AT RAND RD.
permanent basis at Rand Road. Mayor Krause stated that a meeting had
been called with the Illinois Department of Transportation to clear up that
situation, since that was not the intention of the Village Board when the
Rauenhorst Development was approved.
Mark Schoeffmann, 512 N. Maple Street, requested the proposed ELM AND
ordinance on the agenda regarding parking restrictions at Elm and HIGHLAND
Highand be referred back to Committee for further study, since PARKIN(I
several residents in that area did not want to see such restrictions
imposed on their streets. Trustee Wattenberg invited those residents
to attend the November 29th meeting of the Public Health & Safety
Committee for further discussion on the problem.
Mrs. Passenheim, 519 N. Elm Street, noted that there was a ELM & HIGHLAND
problem with the parking problems in the area around Elm & Highland. PARKING
Miss Nipper, 1216 East Cardinal Lane, complimented the work being

done on Westgate Road and that the contractor was doing a fine job,

Trustee Wattenberg, seconded by Trustee Richardson, moved for
passage of Resolution No. 43-79 and to authorize the Mayor to sign
and Clerk to attest her signature on the subject Agreement.

Mr. Burghard requested direction from the Village Board relative ARCHIPLAN
to the proposed repair or replacement of the roof on the Public CONTRACT
Safety Building since the motion had failed at the November 6th Public Safety Bldg,
meeting to enter into a contract with Archiplan, Inc. for a Roof
new pitched roof on that building,
Trustee Richardson, seconded by Trustee Floros, moved to
reconsider the action taken at the November. 6th meeting relative
to the Public Safety Building roof repair or replacement.

authorize the Manager to enter into an agreement vrith
Archiplan, Inc. for the design, bidding and necessary

the rule requiring two readings of an ordinance.

Trustee Floros also requested that ZBA 67-Z-79, proposed commuter ZBA 67-Z-79
parking at Sha Bonee Trail and Maple Street, be reported out Sha Bonee & Maple
before the entire Village Board at the December 4th meeting, instead Commuter Parking
of the Building Committee meeting, All interested parties would be
notified.
FINANCE COMMITTEE
Trustee Miller presented the Finance Committee report of the
meeting held November 11, 1979
It was reported that the new Dominicks, Elmhurst Road and Golf DOMINICKS
Road, requested a Class "C" liquor license. LIQUOR LICENSE
Trustee Miller, seconded by Trustee Richardson, moved to concur

with the recommendation of the r ina:ic,-, C or;mittep and, create a
Class "C" liquor license for Dominicl�s 1'incr Foods at Flmhurs: AMENDMENT
and Golf Roads, provided that a separate cash register be TO CHAVIIEP 13
provided for all such liquor purchases.

General Counsel was directed to draft the necessary ordinance
creating R Class "C" liquor license and to amend Chapter 13
requiring food establishments selling alcoholic beverages as
an additional use to food sales, to provide a separate cash
register.
Trustee Miller presented a request from Wag's Restaurant WAG'S RESTAtJRANT
(Elmhurst and Golf Roads) for a Class "W" liquor license. LIQUOR LICENSE
Trustee Miller, seconded by Trustee Richardson, moved to
concur with the recommendation of the Finance Committee
to create a Class "W" liquor license for Wag's Restaurant.

of the meeting held October 22, 1979.

concur with the recommendation of the Fire and Police Committee
to pass the necessary ordinance regulating fal,�e alarms.

SUBJECT: MINUTES OF NOVEMBER 12, 1979 BUILDING COMMITTEE MEETING
DATE: November 26, 1979
The meeting was called to order at 7:35 p.m. Present were
Chairman Leo Floros and Trustee Norma Murauskis. Staff present
were Ken Fritz, Director of Community Development, Bill Amundsen,
Zoning officer, Laura Mansfield, Administrative Assistant,
Fire Chief Larry Pairitz, and Herb Weeks, Director of Public Works.
ZBA-50-V-79 Dr. Alexander Ronnett, 502 Garwood Dr., (Map 17-N).
Petitioner is requesting a side yard variation to allow his
replacement utility shed to remain. The utility shed originally
was erected 18 years ago complying with Cook County zoning. The
new shed is larger and has been erected without a building permit.
After hearing testimony, the Building Committee felt that the
petitioner could place the utility shed elsewhere on the subject
property,in conformance with the Zoning Ordinance. To allow the
shed to be erected in the side yard adjacent to neighboring
property would not be in conformity with the Zoning Ordinance, and
therefore the Building Committee recommended denial of the request
by a 2-0 vote.
ZBA-55-SU-79 Clarence & Bernadine Rasmus, 320 N. Elm St., (Map 7-N).
Petitioner requested a Special Use permit to operate a day-care
home.in an R-1 district. The day-care home is presently in operation
and complies with all State of Illinois requirements for the operation
of day-care facilities. Several letters of recommendation were
received regarding approval of the day-care center. On a vote of
2-0 the Building Committee recommended approval.

Petitioner has requested a variation to allow an above ground
swimming pool to be erected in a required side yard. The petitioner
has erected a swimming pool this past summer in ignorance of the

Village Zoning Ordinance requirements. The staff studied the
various alternative locations, recommending a location in the
side yard (Exhibit #1), set back ten feet off the property line
and a safe distance from the electrical service to the residence.
The Building Committee, by a 2-0 vote, recommended approval of
the variation as shown in Exhibit #1.
ZBA-59-V-79 Dr. Gregory Padovani, 407 W. Prospect Ave.; (Map 6-S).
Robert Krug, attorney, represented the petitioner. The petitioner
indicated his desire to amend Ordinance #695 (1959), which was
adopted by the Village Board, limiting the use of the property at
407 W. Prospect Avenue to a dental office only. The petitioner
stated that the building is presently half empty for the reason
that he cannot find another dental tenant. He wishes to use it
instead as a small office. After considerable discussion, the
Building Committee voted 2-0 to approve the variation, provided
that a parking plan would be submitted by the petitioner to the
Director of Community Development, to ensure that adequate parking
would be provided for the potential tenant (s).
ZBA-61-Z-79 Roman Franczak, 2015 W. Golf Road, (Map 21-S).

Al Estabros, attorney, represented the petitioner. Petitioner is
requesting a rezoning from R -X to R-4 and to allow more than one
main building upon a lot. He intended to develop four 3 -story
multi -family buildings upon the lot.
Extensive discussion ensued. Herb Weeks stated that the water
supply is marginal, and he would like to see the water main ex-
tended to go under Golf Road. Petitioner agreed to conform to this.
Another point of discussion was the proposed Zoning Ordinance
amendments regarding density and parking (off-street) requirements.
The Committee would like the petitioner to conform to the new
decreased density (16 units/acre) and increased off-street parking
(2 spaces/unit) standards. Petitioner is to draw up new plans
conforming to these standards and present the plans to the
December 10th Building Committee meeting.

Robert Weber, attorney, represented the petitioner, and
explained the above requests. Fire Chief Pairitz then
discussed some potential problems:
1) The existance of an aboveground gas storage tank is a
hazard. Petitioner explained he has replaced this with
underground tanks.
2) The building leased out by Arrow Road needs a Class B
fire door, which it presently does not have. Petitioner
agrees to comply.
3) The primary problem is that of water supply. Hydrants
need to be installed as required, which petitioner agrees
to do. The water main needs to be looped. Herb Weeks,
Public Works Director, alohq with petitioner and Chief
Pairitz discussed extensively the specifics of looping
the water main, such as pipe size, and also who would
bear the cost of the extension. Petitioner agrees to
bear the cost of on-site extension, but feels he cannot
absorb the cost of off-site extension.
The Building Committee voted 2-0 to approve the petitioner's
requests contingentuponthe Village staff and petitioner
working out a satisfactory agreement on extending the water
main.

ROBBERY ALARM SYSTEMS AND PRESCRIBING FEES,
PENALTIES, AND REMOVAL OF CERTAIN ALARM SYSTEMS
FROM POLICE DEPARTMENT FACILITIES FOR FALSE
ALARMS AND OTHER RELATED OPERATIONAL OFFENSES
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, IN THE
EXERCISE OF THEIR HOME RULE POWERS:
SECTION DNE� That Chapter 24 of the Municipal Code of the
.ixe7T—Mount Prospect of 1957, as amended, be and the
same is hereby further amended by adding -thereto an additional
Article, Article XIII, regulating privately owned electronic
burglary and robbery alarm systems; so that hereafter the said
Article XIII of Chapter 24 shall be and read as follows:
ARTICLE XIII
ALARM SYSTEMS
Section 24.1301. Unlawful Use Prohibited. It shall
be unlawful for any person, firm, or corporation to

burglary and/or robbery alarm without first having
made application for such alarm with the Mount Prospect
Police Department
and it is unlawful for any such person to fail to appear
and turn off or reset any such alarm within one hour
after being notified by the police to do so.
Section 24.1302. False Alarms Prohibited --Fees for

any robbery or burglary alarm for the purpose of
summoning police except in the event of an actual.

to notify the police of an activation of an alarm
having the knowledge that such activation was caused
by an electrical or other malfunction of the alarm
system without also notifying the police of such
malfunction.
B. For the purposes of this Section, the term "false
alarm" shall mean the activation of a burglary
and/or robbery alarm at a time when no burglary
or robbery is being committed or attempted on the
premises.
C. Should the police respond to any false alarm, the
Village of Mount Prospect shall charge and collect
from the Derson having or maintaining such burglary
and/or robbery alarm on premises owned or occupied
by him, the following fees;

For a response to premises at which no other
false alarm has occurred within the preceding
six months period, hereinafter referred to as
a "first response", no fee shall be charged,
but the person having or maintaining such
burglary and/or robbery alarm shall, within
three working days after notice to do so, make
a written report to the Chief of Police on forms
prescribed by him setting forth the cause of such
false alarm, the corrective action taken, whether
such alarm has been inspected by an authorized
serviceman, and such other information as the
Chief of Police may reasonably require to determine
the cause of such false alarm.
For a second response to premises within six
months after the first response, no fee shall be
charged, but a written report shall be required
as for a first response and the Chief of Police
shall be authorized to inspect or cause to be
inspected the alarm system at such premises,
prescribed necessary corrective action, and
shall give notice to the person having or main-
taining such alarm system of -the conditions and
requirements of this Section. %
3. For a third response to premises within six months
after such a second response, and for all succeeding
responses within six months of the last response,
a fee of Fifty Dollars ($50.00) shall be charged,
and if such third false alarm or any such succeeding
false alarm is as a result of failure to take

of Police, said Chief of Police may order the
disconnection of such alarm system and it shall be

A G R E E M E N T
WHEREAS, the Village Of Mount Prospect, hereinafter referred
to as "the Village," a municipal corporation organized under the laws
of the State of Illinois and the Forest River Fire Protection District,
hereinafter referred to as 'the District,"' a municipal corporation
organized under the laws of the State of Illinois, are municipal Corp-
orations organized under the laws of the State of Illinois and as such
have the power under State law to enter into agreementsforproviding
fire protection;-�an-d
WHEREAS, the Village is desirous of providing such services
to the District.
NOW, THEREFORE, IT IS AGREED BY AND BETWEEN THE VILLAGE AND
THE DISTRICT AS FOLLOWS:
1- That for the period beginning January 1, 1980 to
December 31, 1980, at 12:00 midnight said day, the Village shall furnish
all fire fighting, fire protection, fire prevention, and other emergency
services, including emergency ambulance service, by such volunteer or
paid on call and/or regular firemen available to the Village as the Fire
Chief of the Village shall det*rmine, to the District for a certain area
as shown and outlined in orange on Exhibit I attached hereto and made
a part hereof.
2. That for the period of time during which this agreement
shall be in full force and effect, the District agrees to pay and the
Village agrees to accept as full payment for said fire protection, fire
prevention services, and emergency services that amount of monies
received from tax receipts collected during the period beginning
January 1, 1980, and ending December 31, 1980, less all costs of running
the said District including but not limited to all administrative legal
..salaries and other expenses incurred.
a. It is understood that the District shall levy taxes
at the maximum rate authorized by statute without referendum;
and shall apply for and make all efforts to receive any
available state and/or federal aid to fire protection districts
as is now a✓ailable or may be made available during the term
hereof; all such levies, however, shall be exclusive of the
amount of taxes levied for payment of the bonded indebtedness
of the District which existed prior to the discontinuance of
the fire department of the District. It is understood that
the District will continue to levy and extend taxes upon the
taxable property in its territory for its proportionate share
of such bonded indebtedness of the District at the time of the
said discontinuance for the purpose of amortizing such bonds
until such time as sufficient funds -to retire such bonds have
been collected.
b. The payments by the District to the Village shall be
made in the following manner:
W The sum of FIVE HUNDRED DOLLARS ($500.00) shall
be paid upon the execution of this agreement.

(ii) The sum of FIVE HUNDRED DOLLARS ($500.00) on
or before April 1, 1980.
(iii) The sum of FIVE HUNDRED DOLLARS ($500.00) on
or before July 1, 1980.
(iv) The balance remaining after all expenses have
been paid shall be paid on or before December 31, 1980.
3. That the Fire Chief of the Village shall have the sole and
exclusive right, duty, and responsibility to prescribe the manner and
method of giving the alarm for fire and/or other emergencies occurring
within the District's territory as outlined upon said Exhibit I.
4. That the Fire Chief of the Village or his authorized
representative shall have the sole and exclusive authority and responsi-
bility to direct and control any and all fire fighting, fire protection,
fire prevention, and other emergency operation carried on at the scene
of any alarm or emergency occurring within that territory of the District
shown upon the said Exhibit I.
5. That all fire fighting, fire protection, fire prevention
and other emergency procedures conducted under the provisions hereof
shall be conducted in accordance with the regulations of the Mount
Prospect Fire Department and the ordinances of the Village. Furthermore,
the District agrees that within ten (10) days of the execution hereof,
it shall pass and approve ordinances identical in form and content to
the ordinances of the Village which deal with fire fighting, fire
protection, fire prevention, building construction as related to fire
safety, and other emergency procedures.
6. That all expenses and cost of maintaining equipment,
apparatus, salaries, insurance premiums, and any and all other items of
expenses connected with the several services contemplated herein to be
supplied by the Village to the District shall be borne by the Village.

The only expense falling upon the District shall be in the form of
the payments scheduled to be made hereinabove under Paragraph 2b.
7. That, within seven (7) days of receipt of notice of
annexation by any municipality of land and territory within its district
(as shown in orange upon the said Exhibit I hereto), the District shall
forward a copy of said notice (with the legal description contained
therein) to the Village.by addressing tame to the attention of the

AN ORDINANCE AMENDING SPECIFIED SECTIONS
OF THE BUILDING CODE OF THE
VILLAGE OF MOUNT PROSPECT
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that it is necessary to the health, safety and welfare of the
Village residents to require self-closing doors, smoke detectors and emergency
lighting in existing multiple family dwellings in the Village of Mount Prospect.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: Article III of Chapter 21 (Building Code) of the Municipal Code of
the Village of Mount Prospect be, and the same is hereby amended by adding thereto
a new Section 21.308 entitled "Special Requirements for Existing Multiple Family
Dwellings", which said new Section shall hereafter be and read as follows:
"SECTION 21.308. Special Requirements for Existing Multiple
Family Dwellings.
The owners of existing multiple family dwellings within the Village
of Mount Prospect shall comply with the following requirements:
A. Self -Closers.
Boors between apartments and corridors shall be self-closing.
The self-closing device shall be of an approved type.
B. Smoke Detectors.
An approved single station smoke detector, battery powered,
shall be installed in an approved manner in every living unit within
the Multi -Family dwelling. When activated, the detector shall
initiate an alarm which is audible in the sleeping rooms of that unit.
C. Emergency Lighting.
Any Multi -Family dwelling with twenty-six (26) or more living
units shall have emergency lighting. All emergency lighting
shall be in accordance with N.F.P.A. #101, Section 5-9. 11
SECTION TWO: The word "approved" for the purposes of this new
Section 21.308 shall mean.- accepted by the authority having jurisdiction by
reason of tests or investigations conducted by it or by an agency satisfactory to
the authority, based upon nationally accepted test standards or principles.
SECTION THREE: The provisions of this Ordinance shall be deemed to be
separable, and the invalidity of any portion of this Ordinance shall not affect the
validity of the remainder.
SECTION FOUR: This Ordinance shall apply retroactively to all multiple family dwellings
SECTION FIVE: This Ordinance shall be in full force and effect from and after
its passage, approval and publication in the manner provided by law.

Forest River Fire Protection District Contract:
Fire Chief Pairitz presented the proposed contract of the Forest
River Fire Protection District, calendar year 1980. Chief Pairitz
explained the history of the Forest River Fire Protection District,
and that the contract was a result of the New Town annexation. After
considerable discussion regarding the amount being paid to Mount
Prospect for fire protection by this District, the Committee voted
3-0 in favor of acceptance of the proposed contract for 1980.
Additionally, the Committee directs the administration to investigate
the possibility of increasing the dollar amount of this contract in
future years.
Fees for Emergency Services:
Chief Pairitz presented a Fire Department proposal to establish a
fixed fee for emergency services given other persons and parties
that are not covered by a contract --mutual aid or otherwise. The
fee proposed was $200 an hour per emergency unit.
By a vote of 3-0 the Committee recommends approval and directs legal
counsel to prepare a suitable ordinance
The next regular meeting of the Fire & Police Committee would fall
on December 24. Therefore, the Chairman announced that the regular
meeting for December will be cancelled.

The meeting was called to order by Chairman Richardson at 8:07 p.m.
Present were: Chairman Richardson, Trustee T.J.Wattenberg, and
Village Manager T. Burghard. Trustee skip Farley was absent.
Property Maintenance Code:
Chairman Richardson explained that he had been in contact with Attorney
Baran who explained that she was still working on the final draft of
the Property Maintenance Code and that, in fact, she and Mr. Geick had
met in the Village Hall on Saturday, November 10, to work on the
revisions. Chairman Richardson and Trustee Wattenberg were unanimous
in their opinion that the Property Maintenance Code should address
exterior maintenance on all structures and not interior maintenance
matters. It is the Committee's opinion that the interior of structures
is covered adequately by our Building and Fire Prevention Codes. They
reiterated that the new ordinance should be kept as simple as possible
and written in laymen's language so that it is easily understood by
the public.
Furthermore, it should address those major issues that concern the
administration, elected officials and citizens mostly, i.e., abandoned
or unused vehicles parked in residential lots, exterior home maintenance,
Yard maintenance, and unfinished home improvements. Mr. Richardson
gave to the Village Manager a copy of a draft that had been amended by
Mr. Richardson, and asked that the changes be included in the final draft.
On -Street solicitation:
The Committee reviewed again the report from Mr. Diamond from the
Insurance Risk Management Agency, and directed that an ordinance should
be prepared for the December agenda to comply with the State Statutes.
Downtown Rehabilitation Program:
Chairman Richardson reported that the attorneys were researching current
municipal ordinances in the area of rehabilitation in order to prepare
a recommendation and analysis for the Committee. There was some general
discussion regarding the work and opinions of various groups interested
in downtown rehabilitation, and potential methods of financing, including
the use of the Community Development Block Grant Program. This is a
continuing program review and should appear periodically on the
Legislative/judiciary Committee agenda.

New Business:
Chairman Richardson reviewed a bulletin from the Illinois municipal
League asking that we contact our Representatives and Senators in
Washington regarding pending legislation to cTeate an Energy Mobilization
Board. The Illinois municipal League bulletin compared the revision
as drafted by one of the Federal Commissions, and an alternate proposal
by Senator Udall. After some general discussion, the Committee
directed that the administration do nothing in this instance because
of the lack of complete information and knowledge of the impact of
both the legislative proposals.
Mr. Burghard reported that Mr. Geick had discussed the.IMRF legislative
amendments, as prepared by Senator Regner, with him. Mr. Geick indicates
that the Illinois Municipal League may take a position in support of
this legislation; however, we do not expect any action until next year.
Other Committee Charges:
The Committee reviewed the other charges and took no direct action.
There then ensued a general discussion about numerous matters related
to our municipal operations, with no action taken and no specific
direction given.

Numerous concerned citizens appeared at the meeting (names s addresses on file)
concern/ng the proposed ordinance prohibiting parking on specific streets in the
Butch McGuire area between lo`no P.M. and 6:00 A.M. The concern of the citizens
in attendance was the fact that maple Street shouldba eliminated from the proposed
ordinance. After considerable deliberation and discussion, the Committee agreed
unanimously to eliminate Maple Street and that area west of Maple Street. It was
also agreed by the Committee that in the Spring or Summer` if those residents find
the proposed parking restrictions encourage those patrons to stray to Maple street,
the matter will then be brought before the Committee and n request noae for the
inclusion of Maple Street in the proposed ordinance. It appears that the ordinance
/s acceptable to all residents in the area and hopefully the problem will be resolved.

The Meeting of the Public Works Committee was called to order by Chairman
Farley at 9:00 a.m.
A. LAKE BRIARWOOD
This was a request from Mr. Plaza and Mr. Henneberg for drainage ditch
bank stabilization or repair of existing metal retaining wall. Mr. Plaza
put in a plea for the Village to expend approximately $4,000.00 to straight-
en a retaining wall adjacent to his home. This wall was originally in-
stalled partially with funds from Elk Grove Township prior to the area
being annexed to Mt. Prospect.
While the Committee theoretically agreed there possibly was some
responsibility on the part of the Village because of the annexation of this
property to assist in wall repair, they deferred any action until the
December 6, 1979 meeting. In the interim period, Village staff was direct-
ed to investigate cost of enclosed culverts, the cost of replacing the wall
with concrete, the cost of returning the metal wall to its original position
appropriately anchored, and to determine cost of temporary repairs to pre-
vent further bank and wall deterioration.
Staff was further directed to determine lot lines to ascertain if ade-
quate room was available for placement of retaining rods and to check the
easements of the property. The president of the Lake Briarwood Home Owner's
Association is to be invited to the next Public Works Committee Meeting to
present the Association's view regarding financial responsibility for wall
repair. Staff was also directed to obtain a legal opinion from our Attorney
relative to the responsibility of Elk Grove Village, Illinois Tollway
Authority and the Home Owner's Association as this ditch deals with storm
water run off affecting all three bodies.
B. WELL #11 REHABILITATION
Presentation was made for scheduled budgeted maintenance work on this
pump facility. A request was made for permission to waive the bid process
and contract with Wehling Well Works in an amount not to exceed $60,000.00
for the rehabilitation of this well. The committee concurred with the
recommendation by a 3 to 0 vote.

C. FLOOD PLAIN ORDINANCE
Village Engineer Ben Hemmeter stated that at the present time, we
still do not have a fully approved flood plain field map from HUD. The
ordinance was sent back to the MSD for evaluation. No Committee action.
D. TAMARACK PARK
It was the staff recommendation to remove this charge from the Committee
agenda. This neighborhood park was constructed as part of a consent
decree with DiMucci Builders and all work has now been completed. The
Committee concurred by a majority vote with that recommendation.
E. RELOCATION OF RAILROAD PASSENGER PLATFORM
This item was placed on the agenda in error. A prior board vote had
authorized administration to continue with this platform extension and
preampter signalization equipment. A check with Community Development
indicates that this project is in the planning stage with the RTA. No
Committee action.
F. INTERIM REPORTS
Interim reports were given to the Committee on several Public Works
programs. On the snow removal program,,the Committee was advised that all
snow removal equipment is operational and that approximately 800 tons of
salt are on hand for ice control purposes.
On the leaf program, the Committee was advised that the program progress-
ed fairly smooth this year. The addition of an extra piece of equipment
assisted in the improvement of the program. The cost of this year's leaf
removal has been estimated at $46,000.00.
G. STREET RE -SURFACING PROGRAM
This is an MPT funded project. It was estimated that the Public Works
Department re -surfaced approximately 3 miles of Village streets while 43�2
additional miles were re -surfaced by private contract.
H. LAKE MICHIGAN WATER
No new information on this subject pending receipt of a final report
from the Venture Lake Michigan Water Study.
I. CABLE TV
This is an item that will soon be before the Committee for a decision
as quickly as reports are forthcoming from the NWMC.
J. WELLER CREEK
This was a request from a resident at 717 S. William requesting the
Village to participate in beautification of an easement adjacent to his
home bordering the north bank of Weller Creek. No action taken on the
request at this time. It was recommended that it be placed on the December

THIS AGREEMENT, made and entered into this

NATIONAL BANK OF CHICAGO, as Trustee, under a Trust Agree-
ment dated may 18, 1977, and known as Trust No. 22461, and
ARROW ROAD CONSTRUCTION COMPANY, the sole beneficiary thereof
(hereinafter the term "Owner" shall be deemed to be a refer-
ence to each of said parties individually and also to both
of said parties collectively), and the VILLAGE OF MOUNT
PROSPECT, an Illinois municipal corporation, located in Cook
County, Illinois (hereinafter referred to as "Village");
WITNESSETH:
WHEREAS, Central National Bank of Chicago, as
Trustee, under a Trust Agreement dated May 18, 1977, and
known as Trust No. 22461, is the record owner of the follow-

WHEREAS, the Subject Property is located in an
unincorporated portion of Cook County, Illinois, and is
shown on the plat of annexation attached hereto and incor-
porated herein by this reference as Exhibit B; and
WHEREAS, the Subject Property consists of terri-
tory which is not within the boundaries of any municipality
and which is presently contiguous to, and may be annexed to,
the Village as provided in Article 7 of the Illinois munici-
pal Code; and
WHEREAS, pursuant to and in accordance with the
provisions of Section 7-1-8 of the Illinois Municipal Code,
111. Rev. Stat. ch. 24, 97-1-8, there has been filed with
the Village a petition for annexation which is attached
hereto and incorporated herein by this reference as Exhibit C,
executed by the Owner, requesting annexation of the Subject
Property; and
WHEREAS, Owner desires to have the Subject Property
annexed to the Village in accordance with the terms and con-
ditions hereinafter set forth; and
WHEREAS, the Owner has requested the following -
1. Tiat the Subject Property be zoned in the
I-1 Light Industrial District under the
Village of Mount Prospect Zoning Ordinance;
2. That the provisions of thr- I-1 Light Indus-
trial District under the Village of Mount
Prospect Zoning Ordinance be amended to
allow asphalt manufacturing and refining
as a part of a planned unit development

4. That a variation from Section 14.101F
of the Zoning Ordinance of the Village
of Mount Prospect be granted to allow

Section 14.2201 of said Zoning Ordinance
on the premises of the Subject Property
without subdividing the Subject Property;
WHEREAS, on October 25, 1979, the Zoning Board
of Appeals of the Village of Mount Prospect, being the
Board duly designated by the corporate authorities of the
Village to hold public hearings on applications for zoning
amendments and special permits, did hold a public hearing
in all respects conforming to law, pursuant to notice
thereof duly published on October 11, 1979, in the Mount
1��ectLHerald and, in compliance with Section 14.703
of said Zoning Ordinance, notice mailed to property
owners within 250 feet of the Subject Property and notice
posted on the Subject Property; and
WHEREAS, pursuant to the provisions of Section
11-15.1-1, et seq. of the Illinois Municipal Code, Ill.
Rev. Stat., ch. 24, §11-15.1-1, et seq. (1977), the cor-
porate authorities of the village did hold a public hearing
on the proposed Annexation Agreement in substance and form
the same as this Agreement on November 20, 1979, pursuant
to notice duly published on November 3, 1979, in the Mount
Prospect Eerald, as provided by law; and

WHEREAS, due and timely notice of the proposed
annexation has been given to the Elk Grove Rural Fire
Protection District, the Highway Commissioner of Elk Grove
Township and the Board of Auditors of Elk Grove Township
in the manner and form required by statute as appears from
the copies of such notices attached hereto, respectively,
as Exhibits D and E; and
WHEREAS, no library district has jurisdiction
of the Subject Property; and
WHEREAS, the corporate authorities of the Village,
after due and careful consideration, have concluded that
the annexation of the Subject Property to the Village an
the terms and conditions hereinafter set forth will enhance
and promote the general welfare of the Village; and
WHEREAS, following the aforesaid public hearings,
the corporate authorities did on 19—,
by a vote of two-thirds (2/3) of the corporate authorities
then holding office, direct the President to execute and
the Village Clerk to attest this Agreement on behalf of
the Village; and
WHEREAS, Owner has executed all petitions and other
documents that are necessary to accomplish the annexation of
the Subject Prooprty to the Village;
NOW, THEREFORE, for and in consideration of the
mutual covenants herein made and pursuant to the provisions
of Chapter 24, Article 11, Section 15.1-1, et seq., Ill.
Rev. Stat. (1977), the parties do hereby enter into the
following Annexation Agreement:

SECTION ONE: Premises. The fordgoing recitals
are incorporated herein as findings of the President and
Board of Trustees of the village of Mount Prospect.
SECTION TWO: Annexation. Contemporaneously
with the execution of this Annexation Agreement, the
Village agrees that it will annex the Subject Property
to the Village, subject to the terms and . conditions set
forth in this agreement, by adopting a proper ordinance,
attached hereto as Exhibit F,and incorporated herein
by this reference, providing therefor.
SECTION THREE: Amendment to Zoning Ordinance.
Immediately subsequent to the annexation of the Subject
Property, the village shall adopt an ordinance attached
hereto as Exhibit G and incorporated herein by this refer-
ence amending the provisions of the I-1 Light Industrial
District under the Zoning ordinance of the Village of .
Mount Prospect to permit asphalt manufacturing and refining
as a part of a planned unit development in said District.
SECTION FOUR: Special Permit and variation for
Subject Property. Immediately subsequent to the adoption
of said amendment•.to the Zoning Ordinance as provided in
Section Three hereinabove, the Village shall adopt an ordi-
nance, attachehereto as Exhibit H and incorporated herein
by this reference, amending its zoning map by classifying
the Subject Property in the I -I Light Industrial District
under the Zoning Ordinance of the Village of Mount Prospect,
granting the Owner special permit approval for a planned
development to be located on tiie Subject Property and grant-
ing Owner a variation '-.n jt,rmit more than one main use on
the Subject Property without subdivision of the Subject Propert,,,

SECTION FIVE: Devel2pritnt and Use of the
Sued Pro xe*r owner agrees that the use and develop-
ment of the Subject Property shall be in accordance with
the provisions of this Agreement; the site plan for the
Subject Property, attached hereto as Exhibit I and in-
corporated herein by this reference; the provisions of
the 1-1 Light Industrial District under the Zoning
Ordinance of the Village of Mount Prospect, except as
such provisions are modified by the variation for the
Subject Property, Exhibit I hereto; other applicable
provisions of the Village of Mount Prospect Zoning
Ordinance and any and all other applicable Village
ordinances.
SECTION SIX: Fees, Contributions and Costs.
Owner shall not be obligated to pay to the Village any
fee, contribution or cost by virtue of this annexation.
Owner and the Village expressly agree, however, that
Owner shall pay any and all costs, expenses and fees
normally charged by the Village of other Village resi-
dents for building permits, tap -on charges, storm and
sanitary sewers and water distribution charges and any

said off-site and on-site improvennnts shall be submitted
to the Village Engineer for review no later than

for any breach of the terms and conditions of this Annexa-
tion Agreement; provided, however, that the parties agree
that they will not seek and do not have the right to seek
either to recover a judgment from or monetary damages
against the Village or any elected or appointed officials
or employees thereof or against the Owner.
SECTION TEN: Severabili,tI. If any provision,
covenant, agreement or portion of this Agreement or its
application to any person, entity or property is held
invalid, such invalidity shall not affect the application
or validity of other provisions, covenants, agreements or
portions of this Agreement which can be given effect with-
out the invalid provisions or applications, and to this
end, the provisions, covenants, and agreements in this
agreement are e*clared to be severable.

OF THE ZONING ORDINANCE OF THE VILLAGE
OF MOUNT PROSPECT
WHEREAS, an Annexation Agreement dated by and
between the Village of Mount Prospect and Central National Bank of
Chicago as Trustee under Trust No. 22461 dated May 18, 1977 and
the beneficiary thereof, Arrow Road Construction Company, provides
that the Village will amend Sections 14.2201A and B of the Zonina,
Ordinance of the Village of Mount Prospect to allow asphalt manu-
facturing or refining when developed as part of a planned unit
development as a permitted use in the I-1 Light Industrial District
under said Zoning ordinance; and
WHEREAS, on October 25, 1979, a public hearing on said requested
amendments to said Zoning ordinance was held before the Zoning
Board of Appeals of the Village of Mount Prospect in all respects
complying with law and pursuant to notice duly published in the
Mount Prospect Herald on October 11, 1979; and
WHEREAS, the Zoning Board of Appeals has recommended to the

WHEREAS, a written Petition under oath signed by all the
owners of record of the land hereinafter described, there
being no electors residing thereon, has been filed with the
Village clerk of the Village of Mount Prospect requesting
that said land be annexed to the Village Of-Maunt Prospect;
and
WHEREAS, said land is not within the' corporate limits of any
municipality, but is contiguous'to I the'Village of Mount Prospect;
and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect, Illinois, find and believe it to be in the
best interest of the said Village that the said land -and ter-
ritory beannexed to the Village;

AN 0PDINANqCE AMENDING SPECIFIED SECTIONS
OF THE ZONING ORDINANCE OF THE VILLAGE
OF MOUNT PROSPECT
WHEREAS, an Annexation Agreement dated by and
between the Villa:3c, of Mount Prospect aTTEentralRational Bank of
Chicago as Trustee under Trust No. 22461 dated May 18, 1977 and
the beneficiary thereof, Arrow Road Construction Company, provides
that the village will amend Sections 14.2201A and B of the Zoning
Ordinance of the village of Mount Prospect to allow asphalt manu-
facturing or refining when developed as part of a planned unit
development as a permitted use in the 1-1 Light Industrial District
under said Zoning ordinance; and
WHEREAS, on October 25, 1979, a public hearing on said requested
amendments to said Zoning ordinance was held before the Zoning
Board -of Appeals of the Village of Mount Prospect in all respects
complying with law and pursuant to notice duly published in the
Mount Prospect Herald on October 11, 1979; and
WHEREAS, the Zoning Board of Appeals has recommended to the Presi-
dent and Board of Trustees of the Village of Mount Prospect that
said amendments to said Zoning Ordinance be approved; and
WHEREAS, the Presi,dent and Board of Trustees find that it would be
in the best interest of the Village and its resident to approvc-..,
the requested amendments.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS

PLANNED UNIT DEVELOPMENT APPROVAL AND SPECIFI
VARIATIONS
WHEREAS, the real estate hereinafter described i ' n Section Onp of
this Ordinance has been newly annexed to the Village of i4ount
Prospect and is the subject of an Annexation Agreement dated

National Bank Of Chicago as Trustee under
Trust No. 22461 dated May 18, 1977 and the beneficiary thereof,—
Arrow Road Construction Company; and
WHEREAS, said Annexation Agreement providd� that the Village sha
zone said real estate in the I -I Light Industrial District, gran
special permit approval for a planned development for asphalt
manufacturinN and refining to be located on said real estate and
grant a variation from the provisions Of Section 14.101p to perm'
an additional use permitting in the 1-1 Zoning District on said
real estate without subdividing said real estate; and
WHEREAS, a Publia hearing on the proposed zoning of said real
estate, the Proposed special permit and requested variation was
duly held before the zoning Board of Appeals,of the Village of
Mount Prospect on October 25, 1979 pursuant to proper legal notic,

WHEREAS, the zoning Board of Appeals has recommended to the Board
Of Trustees of the Village of Mount Prospect that aforesaid
requests, knoWn as ZBA-63-Z-79, 65 -SU -79 and 66-V-79, be granted;
and
rHEREAS, the President and Board of Trustees have considered said
requests and reviewed the recommendation of the Village of mount
Prospect Zoning Board of Appeals in ZBA-63-2-79, 65 -SU -79 and
66-V-79; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that with respect to the requested
yariation, that the standards for the grant of variations set forth
in Section 14.605.of Article vi of the Zoning Ordinance have been
satisfied and find that it would be in the best interest of the
Village of Mount Prospect to grant the requested variation; an d
WHEREAS, the Pr#sident and Board of Trustees of the Village of
Mount Prospect have determined that with respect to the requested
planned development approval, that the! standards for approval of a
special permit set forth in Section 14-704 of Article VII of the
Zoning Ordinance and in Sections 14.2503 and 14.2504 Of Article
XXV Of the Zoning Ordinance have been satisfied and find that it
would be in the best interest of the Village to approve the
requested special permit for a planned development for asphalt
manufacture and refining on said real estate.
