Mayor Krause called the meeting to order at 8:04 P.M,

COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD
Mr. Lorin Hess of 1050 East Meadow Lane, addressed the Board
regarding the waiving of improvement requirements for sub-
dividing. Mr. Hess was referred to Mr. Ken Fritz, Community
Developer, who would arrange for Mr. Hess to address the
Planning Collmlission on this matter.

MANAGER'S REPORT
The first item under the Manager's Report was the 2nd reading
of an Ordinance authorizing the sale of personal property
owned by the Village of Mount Prospect,
Trustee Floros, seconded by Trustee Murauskis, moved to adopt
ORDINANCE NO. 2935 - AN ORDINANCE AUTHORIZING THE SALE BY
PUBLIC AUCTION OF PERSONAL PROPERTY OWNED BY THE VILLAGE OF
MOUNT PROSPECT.

Motion carried.
Mr. Burghard rought up the subject of the repair of the
Fire House roof. Mr. Burghard noted that this has been a
problem for a number of years and recommended that someone
be hired to investigate the problems surrounding the roof
design, whether to go with a flat or pitched roof.
Following discussion, Trustee Miller, seconded by Trustee
Richardson, moved to enter contract with Archiplan, Inc.
Architects - Planners in which they will prepare preliminary
drawings and reviews to determine and give advice as to the
best roof for the Public Safety Building and the fee for this
contract not to exceed $2,500.00.

Mr. Burghard reported on the preliminary results of the
special census of the newly annexed areas. The preliminary
count indicates 1,973 new residents bringing the population
to 53,897. The census cost was $2,000.00. On an annualized
basis intergovernmental revenues would amount to $25.00 to
$28.00 per capita, which amply covers the expense of the
census.
The next item under Manager's Report was Davey Tree Engineer-
ing. Mr. Burghard reported that the developer had requested
a change in the site plan and that all.hough the request was
not a significant change in the intentofthe planned unit
development ordinance, the law firm of Ross Hardies had
recommended Board guidance in this matter.
Trustee Floros, seconded by Trustee Richardson, moved to
concur with the Manager's determination of this field
change as a necessary engineering change as outlined in the
original PUD Ordinance,

Mr. Burghard introduced an item not listed on the agenda.
Recently Mt. Prospect received an $8,000 grant from Elk Grove
Township, $3,000.00 of which was to go for an employment
counselor for the senior center, and $5,000.00 for the
police department to replace the 1972 Officer Friendly
Van. The Manager and Chief of Police recommended that
since Lattof Chevrolet has a van available for the price
of $5,319.00 and since they (Lattof) anticipate a price
increase after September 9, 1979, that the bidding process
be waived and allow the Manager and the Chief of Police
to negotiate the purchase of a 1980 van from Lattof
Chevrolet in amount not to exceed $5,319.00. The old vehicle
would be auctioned at the next available auction.
Trustee Richardson, seconded by Trustee Floros, moved to
waive the bidding process and to authorize the Village Manager
and the Police Chief to proceed to purchase a 1980 van from
Lattof Chevrolet in an amount not to exceed $5,319.00.

MAYOR'S REPORT
Mayor Krause issued two Proclamations:
School's Open, September 4, 1979
Constitution Week, September 17 - 23, 1979.
The presentation of Citations for Bravery was held in
abeyance until later in meeting, pending the arrival of the
recipients.
COMMITTEE REPORTS
BUILDING COMMITTEE
Trustee Floros presented the Building Committee report.
The Building Committee held the public hearing of the
proposed vacations of Prospect Avenue, Henry Street, and
the alley between, as required by Chapter 14 of the
Municipal Code. A $1.00 compensation to the Village from
involved citizens was found to be acceptable to all parties
involved. The Building Committee recommended vacation of
Prospect Avenue, Henry Street, and the alley.
Trustee Floros, seconded by Trustee Murauskis, moved to
concur with the Building Committee's recomendation of
vacation of Prospect Avenue, Henry Street, and the alley.

Mr. R, .1 Stobe of 16 North Lancaster requested L Board
waive the ruling requiring two readings of an Ordinance, in
regard to the vacating ordinances.
Trustee Floros explained that normally there are three steps
in an ordinance adoption, the first being concurrence, the
second a lst reading, and the third a 2nd reading and
adoption. Since the concurrence and lst reading were being
accomplished at this meeting, which cut the process by one
step, to waive the 2nd reading would be reducing the process
to one step, which would be setting a precedent Trustee Floros
felt the Board should avoid.
Mayor Krause called for the vote on concurrence.

The following Ordinances had a lst reading:
An Ordinance Vacating a Portion Of Henry St. Located In
The Village of Mount Prospect
An Ordinance Vacating A Portion Of Prospect Avenue Located
In The Village Of Mount Prospect
An Ordinance Vacating A Portion Of The Alley Located Between
Henry Street And Prospect Avenue Located In The Village Of
Mount Prospect
Trustee Floros, seconded by Trustee Murauskis, moved to concur
with the Building Committee's recommendation in the case of
ZBA-36-V-79, that the variation be granted for this building to
be subdivided into 4 separate units and be occupied by four
separate tenants. This property is located at 100 W. Northwest
Highway.

The attorney was directed to draw up an ordinance for the
September 18th Board meeting.
The next case discussed was ZBA-26-Z-79 and ZBA-27-V-79.
This property is located at 213 14. Euclid'and the two adjacent
lots. The petitioner requested a rezoning from R -X to B-2
and variations to permit less than required minimum parking
spaces, to eliminate truck loaking spaces, to permit parking
in the front lo!-, and to permit a low profile ground sign,
Mr. Lemoine Stitt, 102 S. Arlington Hts. Road, Arlington
Heights, Illinois, attorney for the petitioner addressed
the Board on behalf of this proJect,

Mr. Dick blaurock, 2000 Woodland, Park Ridge, IllinL�is,
developer of the property involved, reviewed for the Board
some of the history of the project, requesting the Board
to find in favor of the project.
Trustee Richardson stated that although.he felt the project -
was good, due to the Zoning Board denial and the citizen
objections he recommended denial.
Trustee Floros stated that there was much in the way of
merit for the project, but due to a prior committment
from previous village officials at the time of a special
assessment that this section of Rand Road would maintain
its' residential character and thus far all commercial
developments request have been denied, he recommended
denial.

Trustee Floros, seconded by Trustee Richardson, moved for
concurrence with the Building Committee's recommendation
to support the Zoning Board of Appeals in denying the
request ofthe petitioners in the case of ZBA-26-Z-79
and ZBA_27_V-79, by recorunending denial of the rezoning
and the variations requested.

The next case discussed was ZBA-38-SU-79, the Citgo station
606 W. Northwest Highway. Mr. Ken Fritz, on behalf of the
Village, requested an amendment to SECTION ONE of Ordinance
No. 2625, whereby two sections of the fence -on the back of
the property would be removed, in order to improve traffic
visibility. The Building Committee recommended approval.
Trustee Floros, seconded by Trustee Murauskis, moved to
concur with the Building Committee's recommendation as it
relates to the removal of a fence in ZBA-38-SU-79.

The next item discussed was the question of elevators in
buildings in excess of 3 stories. The Building Committee
recommended an ordinance requiring elevators in buildings
four stories or taller.
Trustee Floros, seconded by Trustee Murauskis, moved to
concur with the recommendation of the Building Committee
for an ordinance requiring elevators in four story buildings.

Trustee Floros requested that an appropriate ordinance
be drawn up for the next meeting.
Mayor. Krause requested delay of the Finance Committee
Report, so that Item C, under the Mayor's Report could
be addressed, namely, the Presentation of Citations for
Bravery.
The following persons were presented Citations for Bravery:
Miss Dawn Maychszak
Firefighter Gary Klein
Firefighter Virgil Strzelecki
Lieutenant Edward Druffel
Miss Maychszak saved a young man from choking by applying
a method of dislodging ice from his throat that she learned
while employed by the Village.
Firefighters Klein and Strzelecki rescued Dolores Tucker
from a burning building on Wheeling Road. Upon arriving out-
side it was discovered she was in respiratory arrest, by
Lieutenant Edward Druffel, who also answered the call. Using
advanced life support techniques learned as Paramedics, Lt.
Druffel and Firefighter Klein successfully revived Mrs. Tucker,
who was then transported to Lutheran General Hospital for burn
treatment. Both Firefighter Strzelecki and Firefighter sustained
injuries in the process of this rescue.
FINANCE COMMITTEE

ORDINANCE NO. 2936 - AN ORDINANCE AUTHORIZING, THE 1-979 TAX
LEVY

FIRE AND POLICE COMMITTEE

LEGISLATIVE/JUDICIARY COMMITTEE
Trustee Richardson, chairman, requested of the attorney if
the revised version of the condominium ordinance was ready.
The attorney replied that the ordinance was not ready at that
time.
Trustee Richardson called the Board's attention to the Committee
of The Whole meeting on September 20, 1979, with the State
Senators and Representatives.
PUBLIC HEALTH AND SAFETY COMMITTEE
Trustee Farley, in the absence of Trustee Wattenberg, gave the Public
Health and Safety Cazmittee Report.
On the subject of Elm and Highland - The problem centers
around the parking problem which is still prevelant on Tuesday
and Friday evenings from the overflow parking created by the
patrons of Butch McGuifes. Trustee Farley reported that all
ordinances as regards parking and fire regulations are being
followed. Trustee Farley said the Committee is open to
any suggestions that might bring citizenry relief in this
area.
One suggestion was to eliminate late parking in this area.
This brought up the question of the possibility of this
solution just moving the problem to another area still in
Mount Prospect.
Mayor Krause stated that citizens from this area have attended
the Saturday morning coffees with petitions asking for help
with this problem.
Some of the suggestions from the Board. were_incre-ased Police
patrol, restricting parking between 1:00 A.M. and 6:00 A.M.
restricting parking to residents only, issuances of more
traffic tickets, that the administration come up with a
restrictive parking plan for this area.

The general feeling of the Board was that this problem is
urgent to the citizens involved and should be addressed as
soon as possible.

a waiver of the rules in order to bring up a matter not
on the agenda.

adopt ORDINANCE NO. 2938- AN ORDINANCE AMENDING THE VILLAGE
OF' MOUNT PROSPECT TRAFFIC CODE

Trustee Farley reported the Committee is awaiting a review
by Legal Counsel of the proposed amendment to the current
Taxi -Cab ordinance.
Liability on Snow Removal from Sidewalks was removed from the
charge, based an the bill signed by (3overnor Thompson,, ret,-,ently,
relieving homeowners fromliability of snow removal. from
walkways which encompasses their respective homes and./or
businesses.
The Snow Removal and Towing ordinance is awaiting a drafting
of an ordinance by Ross, Hardies and Associates.
The Committee is continuing to work on, Bicycle Safety for
Commuters.
The charge of Outside Use of Water Testing Laboratory -
the Committee recommends the removal of this charge based
on the Village Manager's reco=nendation dr,,at: the Water Testing
Laboratory riot be pursued at this time due to the resignation
of Health Director, Mr. Larry Ei
a) Dis,--Lbution of reports on Mount Prospect's ac—Lvities
in Loss Prevention made available to the Truste:cs to
inform them on, the, progress of -.related matters.
b) Summarization of cases handled should be reviewed by
the Judiciary CommiLtee in order that they would
be made Tcnowledgeable as to the disposition of said
cases by legal counsel.
PUBLIC WORKS COMMITTEE
Trustee Farley gave the Public Works Committee Report
Trustee Farley reported on the subject of Street Name
Changes, noting the reason for this undertaking being to
enable emergency vehicles as well as mail persons to
locate addresses within the Village.
Trustee Farley requested Mr. Ken Fritz to give a report
on the proposed ordinance on this matter.
Mr. Fritz stated that on August 20th, letters had been
delivered to citizens who would be affected by the prOT)osed
changes, and that an ordinance was being drafted for
a first reading at the next Board meeting.

Trustee Farley thanked these people for sharing their
views .
Trustee Farley requested Mr. Burghard report on the scope
of services for the acquisition of Lake Michigan water.
Mr. Burghard reported that the administration has hired
Fletcher Engineering for the study of Lake Michigan 1,dater
Acquisition and that there would be a more definite report
available at the Public Works Coiinittee meeting on September 6,
1979, including fees.

OTHEte, BUSINESS
There was some discussion on the publishing of the ballots
as regards how many newspapers should be used for publication
for the upcoming referendum in November.

Richardson, moved to adopt Ordinance No. 2939 - AN ORDINANCE
ESTABLISHING PROCEDURES FOR SPECIAL ELECTION ON NOVEMBER 10,
1979.

On the matter of the Memorandum of Agreement Re. K -Mart
Commercial Development Bond Financing,- based on the new
development that Cermak had refused to subordinate the
land, the attorney was.directed to draft a new Memorandum
of Agreement between Maisel and Associates and the Village
of Mount Prospect.

WHEREAS, unwanted fires from accidental and malicious acts cause
more than eight thousand deaths each year; and
WHEREAS, these same fires cause a national property loss in excess
of six.billion dollars last year; and
WHEREAS, the citizens as "Partners in Fire Prevention" with the
Fire Department can reduce and avoid these unwanted fires by being
aware of the causes and conditions that produce these horrible
conditions;
NOW, THEREFORE, I, Carolyn Krause, Mayor of Mount Prospect, do
hereby proclaim and'designate the week of October 7 through
October 13, 1979 as Fire Prevention Week. I call upon our citizens
of Mount Prospect singly and as a community to actively support
Fire Prevention by removing fire cause* and learning how to escape,
should a fire happen where you are.
I urge the news media and other public information agencies to
cooperate in the promotion of Fire Prevention Week as a pre-lude
to year round fire prevention efforts.

AN ORDINANCE REQUESTING THE SALE OF PROPERTY
FROM THE BOARD OF LIBRARY DIRECTORS OF THE
VILLAGE OF MOUNT PROSPECT
WHEREAS, The Board of Library Directors of the Village of Mount Prospect is the
owner of a parcel of real estate which if; legally described on Exhibit A which is
attached hereto and incorporated herein by this reference (said parcel of real
estate shall be referred, to hereinafter as the "Subject Property"); and
WHEREAS, the Village of Mount Prospect is a duly organized and existing
municipal corporation within the County of Cook and State of Illinois; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that it is necessary and convenient for the Village of
Mount Prospect to use and occupy the Subject Property for proper public
purposes; and
WHEREAS, the President and Board of Trustees of the Village Of Mount Prospect
desires that The Roard of Library Directors of the Village of Mount Prospect
convey the Subject Property to the Village of Mount Prospect, pursuant to the
authority conferred by An Act in Relation of the Transfer of Real Estate Owned
by Municipalities, III.Rev.Stat., 1977, ch 30, Sees. 156-158a; and

Village of Mount Prospect authorized the issuance of a special
use permit subject to specified conditions for a parcel of
property which is legally described as follows:

PARTICIPATION AND SUPPORT IN THE CABLE TELEVISION
ANALYSIS STUDY OF THE NORTHWEST MUNICIPAL CONFERENCE
WHEREAS, the Northwest Municipal Conference has undertaken a joint analysis of
proposals submitted to it for Cable Television services in its member municipalities;
and
WHEREAS, the Village of Mount Prospect is participating in this study to determine
the most qualified companies for purposes of possible franchising for such services;
and
WHEREAS, the need of professional consulting services to assist in that analysis
is of the utmost importance; and
WHEREAS, the costs of such a consultant service are diminished when purchased
by the Conference jointly.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The Village of Mount Prospect agrees to pay its pro rata share
of providing consultant services for the project in an amount not to exceed $1,500.00.
SECTION TWO, In accordance with Section 11, (A) (3), of the Request for
Proposal distributed on July 5, 1979, by the Northwest Municipal Conference, all
monies received for evaluation from the company (s) receiving a franchise (a) will
be distributed back to the participating municipalities in this program.

The NWMC Cable TV Task Force has developed specifications for
the selection of a consultant to review the CATV proposals due
on October 1, 1979. The selection of a consultant will be com-
pleted by approximately October 12, 1979.
To date, 28 cable TV companies have taken out requests for pro-
posals. Based upon the number of questions returned to the
Conference's offices by the cable companies, it is estimated that
at least 20 proposals will be received that will include a majority
crf the 21 participating communities.
The Northwest Municipal Conference is asking each community who
still wishes to participate in the Cable TV Study to pass a Resolu-
tion of Support prior to the selection of a consultant. A Resolu-
tion of Support will require each participating Community to pay
$1,500 to help cover the cost of the consultant's review of -the CATV
proposal (please see attached). This is the maximum amount the
Village would have to pay. The money would be recoverable at the time
the Village awards a franchise through the franchise fee of $10,000
that each Cable TV Company must pay. It should be pointed out that
each company pays this fee to the NWMC and is required to pay it
only once rather than for each franchise. However, the area being
considered in the CATV Study will probably be broken up into three
separate territories. This observation was made based upon the
geographical characteristics and the alignment of the communities
involved. Each of the 21 participating communities will be tacgeted
by one or more cable TV company for franchising.
The scope of the CATV Consultant's Analysis is attached for ytiur
information. Following the in-depth review of each proposal, the
consultant will provide each participating community a two pA,10 sum-
mary report on the proposals received and will select the tht0l' most
qualified proposals.
The time is approaching for each community to begin deliberALLons on
whether or not Cable TV Franchises will be awarded should thot com-
munity receive an acceptable proposal. Even if the Village Of Mount

Prospect did not continue to participate in the Northwest
Municipal
cipal Conference Cable TV Study, it would certainly be pushed
to accept franchise proposals from cable TV companies acting on
their own. In deciding whether or not to franchise cable TV,
several areas should receive consideration: (1) setting limits for the
rates to be charged, (2) the rate of return the community will re-
quest (normally this is I to 5 percent), (3) term of the franchise
agreement, (4) the need for and degree of local programming, and (5)
deadlines for completion of the CATV System. The Cable TV Task Force
and the conference staff will develop a model franchise agreement
ordinance to cover this list of items and more. This information
will be referred on to the Committee as soon as it is received.
Thus far the Cable TV Study is progressing smoothly and rapidly.
Because of the number of communities involved and the use of a
professional consultant to review the proposals for Cable TV, the
Northwest Suburban area will receive a more thorough review than
could have been possible by each community considering franchising
cable on its own. If the Committee feels it is appropriate for the
Village of Mount Prospect to continue to participate in the Cable TV
Study then the attached Resolution should be passed by the Village
Board Prior to Octover 1, 1979.

AN ORDINANCE ESTABLISHING VILLAGE
ELECTION PROCEDURES IN THE VILLAGE
OF MOUNT PROSPECT
WHEREAS, by virtue of Section 6(a) of Article VII of
the 1970 Constitution of the State of Illinois, the Village
of Mount Prospect is a home rule municipality, and may under
the power granted by said Section 6(a) of Article VII exercise
any power and perform any function pertaining to its government
and affairs; and
WHEREAS, pursuant to such authority, the President
and Board of Trustees have determined that it is necessary and
desirable that they exercise their authority as a home rule
municipality to establish an election procedure for municipal
elections;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS:
SECTION ONE: That Chapter 8, Article V, Section 8.505
of the Village of Mount Prospect Municipal Code is hereby repealed
and that a new Section 8.505 is adopted as follows:
"Section 8.505. Election Procedures.
A. Conduct of Elections by Village Clerk. Elections for
municipal offices shall be conducted pursuant to the provisions
of this Ordinance. However, in those instances where a
provision of this Ordinance does not apply, the provisions
of the Illinois Election Code, Ill. Rev. Stats. Chapter
46 §1-1 et seq., and Chapter 24 §3-5 et seq., shall apply
as near as may be.
B. Right to Vote. Each registered voter residing within the
Village of Mount Prospect on any election day shall have
the right to cast a ballot.
C. Time andPlace of Elections. Prior to December 1, 1980,
all municipal elections in the Village of 1111ount Prospect
shall be held upon the day and date herein prescribed or upon
said day and date prescribed by an ordinance providing
for the same. From and after December 1, 1980, . all
such municipal elections shall be held in accordance with
the schedule prescribed by Chapter 46, Sections 2A-1
through 2A-50, inclusive, of the Illinois Revised Statutes.
The polls shall be opened at 7:00 o'clock a.m. and closed
at 7:00 o'clock p.m.
D. Voting Precincts. The President and Board of Trustees shall prescribe
establish and fix by ordinance the boundaries of one or
more voting precincts within the Village of Mount Prospect
for each election and shall designate one polling place
for each such precinct.
E. Appointment of Election Judges. The Village Clerk shall
appoint three election judges for each polling place. In
the event an election judge declines to serve, or is incapable
of serving, the judges present may appoint some other
qualified legal voter as election judge.
F. Tally Eld OjiteL Equii2ment. The Villaae
Clerk shall cause the ballots and tally sheets to be
printed, the poll books to be prepared, the polling places
to be set up and equipped, and the election judges in-
struczed. minimum equipment for a polling place shall
include: polling booths, ballot boxes, pencils, registra-
tion lists if available, and voting machines where such are
provided for by the County Clerk.
G. Voter's Instruction Sheets. The Village Clerk shall prepare
a Voter's Instruction Sheet and post one in each polling
booth and at the entrance of each polling place.
H. Preparation and Publication of Ballots. Ballots shall be
prepared at least 20 days before the election so as to be
available for absentee voters.
I. Absentee Voting. Voters who will not be within the Village
of Mount Prospect on any election day, or who are ill or
otherwise physically unable to come to a prescribed polling

place, may receive ballots by applying for the same to
the Village Clerk. Such application shall be under oath
and may be made in person up to 3 days, or by mail
postmarked not less than 5 days prior to an election day.
The Village Clerk shall initial all such ballots. When
completed the ballot shall be inserted by the voter in a
sealed envelope and deposited with the Village Clerk. The
Village Clerk shall initial and deliver such sealed ballot
envelopes to the proper polling place on election day,
and the ballots are to be initialed by an election judge
when counted along with the cast ballots. An election
judge shall first verify that the absentee voter is a
legal voter.
J. Election Officials - Residence Requirements - Oath. The
Village Clerk, all election judges and pollwatchers must be
residents of the Village of Mount Prospect. Election
judges must take and file the same oath of office required
of all other state election judges, and such must be
filed with the Village Clerk along with the return.
K. Duties of Election judges Regarding Polls and Ballot Boxes.
On election day, the election judges shall open the polls
at the prescribed time and shall check the ballot boxes be-
fore any votes are cast to assure that they are empty,
and shall then close and seal them. Votinq machines-wii,.zre
provided, shall also be checked to assure their proper
o`Deration and that all vote counters register zero.
L. Watchers. One person may be permitted to act as a poll -
watcher for each candidate or slate of candidates. In
the case of an election on a proposition, one watcher
shall represent those in favor of the proposition and one
watcher shall represent those opposed thereto.
M. Presence at Polling Places. Only election officers, watchers
and voters present for the purpose of voting may be within
any polling place and voters must depart upon casting their
ballots.

N. Openingof Ballot Boxes - Counting - Results - Returns. Upon
closing the polls at the prescribed time, the election
judges shall then and there open the ballot box and first
count the number of ballots and compare such with the number
of voters who have cast a ballot at that polling place.
If any blank ballots are discovered, then such blanks shall
be removed. If an excess of ballots still exists, the
judges shall replace the remaining ballots in the ballot box,
shake it thoroughly, and then draw out and remove a number
of ballots equal to the excess. Removed ballots shall be
identified as such and deposited in a separate sealed
envelope, and the judges shall sign the seals.
When the number of ballots equals the number of ballots
cast, the judges shall canvass the ballots. When the canvass
has been completed, the judges shall publicly announce the
results and verify the same upon the tally sheets and shall
complete their return as in the case of other elections.
They shall then place the counted ballots in a sealed
envelope and sign the seals. If voting machines have been
used the judges shall canvass the ballots cast. The judges
may then leave the polling place and deliver the return,
ballots, tally sheets, poll boxes and excess supplies to the
Village Clerk.
0. Canvass of Returns - Certificate of Results. The President
and Board of Trustees shall, together with our watcher
for each candidate or slate of candidates, canvass the
returns at a regular or special meeting of the village
Board and within 7 days, adopt an ordinance canvassing
the results of the election.
P. Ballots - Preservation and Destruction - Returns, Tally -
Sheets, etc. The Village Clerk shall retain and preserve
all the ballots in the sealed envelopes signed by the judges
in a safe place not accessible to anyone else, for 60 days after
any electinn. Thereafter, the Clerk may destroy thr unless

he has been served with written notice of an election contest
and one is actually pending. In case of such a contest,
the ballots shall be preserved and inspected only purusant
to an order of a Circuit Court of the state. The returns,
tally sheets, poll books, proof of publication, certificate
of restults, and a supply of the ballots used shall be
retained by the Village Clerk for a period of 4 years.
Q. Tie -vote in Election of Trustees - Determination by Lot -
Vacancies. In the event of a tie -vote in an election for
a municipal office, the winner shall be determined by lot.
Where a candidate for municipal office dies before election
day, and is nevertheless elected to that office, the place of
such deceased candidates shall be filled in the same manner
as is otherwise provided for filling vacancies in the office
ice of
Village President or Village Trustee.
R. Tie -Vote in Election on Pr922sl"ti2n. In the event of a
tie -vote in an election on a proposition, the proposition
shall be deemed to have failed.
S. Expenses and Costs. The expenses of any election, court
costs and legal costs incurred by the Village of Mount
Prospect involving an election shall be borne by the Village
of Mount Prospect, but the expense incurred by any voter
contesting any election shall not be an expense of the Village."
SECTION TWO; This ordinance shall be in full force
and effect from and after its passage, approval and publication
in the manner provided by law.
