WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on
the 5th day of January, 1978, at the hour of 8: 00 p.m. , at the Public Safety Building
and did hear Case No. 3-V-78, pursuant to proper legal notice; and
WHEREAS, the Zoning Board. of Appeals of the Village of Mount Prospect did hear
certain requests to Vary the side yard and rear yard requirements on the
lot legally described hereinbelow; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the Building Committee of the Board of Trustees of the Village of Mount
Prospect the approval of the requests under Case No. 3-V-78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect did meet on January 11, 1978, and did review the recommendations of the
Zoning Board of Appeals in Case No. 3-V-78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect have recommended that the Board of Trustees of the Village of Mount
Prospect concur in the recommendations of the Zoning Board of Appeals under
said Case No. 3-V-78; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
reviewed the matter herein and have determined that the same is in the best interests
of the Village of Mount Prospect;

SECTION ONE: That subsections A, B, and C of Section One of Ordinance No. 2715
be amended in their entireties by replacing the 15 feet, 8 1/2 feet, and 19 1/2 feet
dimensions by 14.7 feet, 8.34 feet, and 19.08 feet, respectively; so that hereafter
subsections A, D, and C of Section One of Ordinance 2715 shall be and read as
follows:
A. That the side yard parallel to the west lot line of the said property be
reduced to 14.7 feet.
B . That the side yard parallel to the east lot line of the said property be
reduced to 8.34 feet.
C . That the rear yard be reduced to 19.08 feet.
SECTION TWO: That this Ordinance shall be null and void and of no force and
effect whatsoever until after its passage, approval, and publication, in the manner
provided by law.

AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR
PROPERTY COMMONLY KNOWN AS 302 WEST
NORTHWEST HIGHWAY, MOUNT PROSPECT, ILLINOIS
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet
on the 17th day of Navember, 1977, at the hour of 8: 00 p . m . , at the Public Safety
Building, 112 East Northwest Highway, and did hear Case No. 58-V-77, pursuant
to proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request to allow construction of an addition to an existing building in a rear
yard, to allow eighteen (18) off street parking spaces instead of the required
twenty-eight (28) parking spaces, and to allow no loading space as required by
ordinance.
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
recommend to the President and Board of Trustees of the Village of Mount Prospect
the approval of this request under Case No. 58-V-77; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect has reviewed the matter herein and has recommended approval thereof
to the President and Board of Trustees of the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the best
interests of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 58-V-77,
being legally described as follows:
Lots 6, 7, 8, 9, 10, 11 of Henry J. Ehard's Subdivision of that part of
the NE 1/4 of Section 11-41-1.1 lying North of the C&NW Railroad, Township
41 N, 1111E of the 3rd P.M., in Cook County, Illinois;
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as B-3 (Business -Retail and Service) District, which zoning classification shall
remain in effect subject to the variations granted herein:
(a) That no rear yard shall be required upon the subject
property;
(b) That no loading space shall be required to serve the
building located upon the subject property; and
(c) That the number of off-street parking spaces shall be
reduced to eighteen (18)

SECTION TWO: That all requirements of the Mount Prospect Building and Zoning
j5ode -shall be applicable except the variations noted in SECTION ONE heretofore
mentioned.
SECTION THREE: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby authorized to issue a building permit for construction
in accordance with the variations hereinbefore mentioned.
SECTION FOUR: That the variations granted by this Ordinance shall be null and
voidandof no force and effect whatsoever unless an application for a building
permit pursuant to such variations is made and construction commenced within
one (1) year of the date this said Ordinance becomes effective.
SECTION FIVE- That this Ordinance shall be null and void and of no force and
effect whatsoever until after its passage, approval, publication, and such time
as an accurate plat resubdividing the said parcel described in SECTION ONE
hereinabove is recorded with the Recorder of Deeds of Cook County, Illinois; a
copy of which plat of resubdivision shall be attached hereto and hereby made a
part hereof.

request for a zoning classification change B-3 (Business -Retail and Service District)
to B-4 (Business -Retail and Service District) of certain property hereinafter de-
scribed; and
WHEREAS, a notice of the aforesaid public hearing was made and published in tht

the petitioner's request under said Case No. 62-Z-77 be granted; and

Prospect has reviewed the matter herein and has recommended the approval there-
of to the President and Board of Trustees of the Village of Mount Prospect; and

SECTION ONE: That Map 42-5 of the Zoning Ordinance of the Village of Mount
Prospect, as amended, be and the same is hereby further amended by reclassifying
from B-3 (Business -Retail and Service District) to B-4 (Business -Retail and
Service District) the following described property:
That part of Plat 4 in Linneman's Division of the South 3/4 of the East 1/2
of the Northeast 1/4 and of the West 1/2 of the Northeast 1/4 of Section 23,
Township 41 North, Range 11 East of the 3rd Principal Meridian, and of the
South 477.78 feet of the West 1/2 of the Southeast 1/4 of Section 14, Town-
ship 41 North, Range 11 East of the 3rd Principal Meridian, described as
beginning at a point on the West line of Elmhurst Road (being the West line
of said Road as dedicated by Document No. 1195787 Recorded February 2,
1933, and 50 feet West of the East line of said Lot 4) said point being 190.56
feet North of the south line of said Lot 4 and 200.01 feet North of the center
line of Algonquin Road as dedicated by said Document No. 11195787 (both
distances measured along said West line of Elmhurst Road and said West

CONTROLS OVER CONFLICT OF INTEREST

SECTION ONE: That, pursuant to the authority vested in the President and
Board of Trustees of the Village of Mount Prospect under Article VII of the 1970
Constitution of the State of Illinois, the said President and Board of Trustees
hereby declare that they are enacting the hereinafter contained regulations for
the following purpose:
The continuing stability of our system of government depends in large,
part on public confidence in the system by which legislation is enacted
and justice is dispensed. Elected officials, who constitute a major
part of this system, inspire such confidence by adhering to high stan-
dards of ethical conduct. Such standards are especially important for
elected officials of local government whose highly visible position
makes them instrumental in upholding the public trust. The local
government official's responsibility to represent the public interest
also imposes special ethical considerations. Most local government,
officials, however, choose riot to make government service a career,
and enter or return to private life. This flow of officials benefits the
government by bringing seasoned businessmen and enthusiastic
laymen into public service and at the same time gives them an oppor-
tunity to acquire expertise and skills that can benefit their subsequent
private life. The obvious danger is that upon return to private life,
matters which that person handled while a government official may
present ethical conflicts. Accordingly, the development of a workable
Rule would allow the present and former elected official freedom while
promoting high ethical standards.
SECTION TWO, That, pursuant to the authority vested in the President and
Board of Trustees of the Village of Mount Prospect under Article VII of the 1970
Constitution of the State of Illinois, Section 8.111 of Chapter 8 of the Municipal
Code of Mount Prospect of 1957, as amended, be and the same is hereby
further amended in its entirety, by adding provisions to disqualify former
elected officials in matters connected with former duties or official responsibi-
lities; so that hereafter the said section 8. 111 of Chapter 8 shall be and read
as follows:
Section 8.111. Termination of Office,
A. Every officer and employee of the Village, upon the expiration of
his term for any cause whatsoever, shall deliver to his successor
all books and records which may be the property of the Village;
and if no successor has been appointed within one week after the
termination of office, such property shall be delivered to the
Village Clerk or Village Treasurer,
13. The following persons shall be deemed guilty of a misdemeanor:
Whoever, having been an elected or appointed official of the
Village of Mount Prospect, within two (2) years after his
office or employment has ceased, knowlingly acts as agent or
attorney for anyone other than the Village of Mount Prospect,
with or without compensation, in connection with any matter
in which the Village of Mount Prospect is a party or has a
direct and substantial interest or in which he participated
personally and substantially as an elected official through
decision, approval, disapproval, or otherwise, while so
elected.
SECTION THREE: That this Ordinance shall be in full force and effect from and

public employees to be covered by unemployment compensation; and
WHEREAS, Illinois legislation provides that a local public entity may protect
itself against liability under the Local Governmental and Governmental
Employees Tort Immunity Act, the Workmen's Compensation Act, and/or the
Occupational Diseases Act through insurance, through self-insurance, through
claims services, or through participation in a reciprocal insurer;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the Village of Mount Prospect does hereby and herewith

CALL TO ORDER
Mayor Krause called the meeting to order at 8:09 P.M.

APPROVAL OF MINUTES
Trustee Wattenberg, seconded by Trustee Richardson, moved
to approve the minutes of the December 20, 1977, meeting,
with correction noted.

COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD
Mr. Bauman, Chairman of the Council of St. Paul's Lutheran
Church, appeared in response to Mr. Mason's complaint to
the bells at that church at various times of the day.
Mr. Bauman reported that the 9:00 P.M. bells had been
discontinued and this compromise was satisfactory to both
parties.
Trustee Hendricks arrived at 8:16 P.M.
MANAGER'S REPORT
Village Manager Eppley announced that Mr. Semrow had been
elected President of the Des Plaines Chamber of Commerce
and requested a resolution congratulating Mr. Semrow be
drafted for the next Village Board meeting. Mayor Krause
authorized such a resolution be drafted.
MAYOR'S REPORT
Mayor Krause requested the members of the Board to review
the By -Laws for Share + 3 in order for input. A meeting
to approve the By -Laws would be held in the month of
January by Share + 3.
Mayor Krause then announced that Citizens Utilities had
filed for a rate increase, the initial hearing to take
place January 10, 1978.
Trustee Wattenberg, seconded by Trustee Richardson, moved
to authorize the attorneys (Ross; Hardies) to enter an
appearance on behalf of the Village of Mount Prospect and
keep the Village Board informed and offer recommendations.

It was announced that Mr. Ralph Laich, being a property
owner of la acres in the general area of Kenneth Drive,
had requested a pre -annexation agreement for property that
is non-contiguous to the Village. Mr. Laich would like to
acquire Village water and would be desirous of annexing to
the Village of Mount Prospect when that property becomes
contiguous.
Trustee Richardson, seconded by Trustee Hendricks, moved to
authorize the Village Attorney to prepare an ordinance,
under home rule powers, to enter into an agreement to
annex land that is not contiguous.

BUILDING COMMITTEE
Trustee Hendricks reported that the petitoner in ZBA 46-Z-77,
47-V-77 had requested the cases be continued to the
January 17, 1978 meeting of the Village Board.

Robert F. Moore, attorney for the petitioner in ZBA 54-Z-77,
55 -SU -77, 56-V-77, also requested that a continuation be
granted to January 17, 1978, for Board hearing.
Mary Stembridge, 600 Greenwood, presented a petition signed
by the residents in the area of ZBA 54-Z-77, 55 -SU -77,
56-Z-77, opposing the proposed development.
Discussion took place on the procedure of having the Village
Attorney draft an ordinance following the recommendation of
the Building Committee to grant the requests. It was
determined that an ordinance would have two readings
except when an emergency was expressed by the petitioner.
Trustee Hendricks, seconded by Trustee Wattenberg, moved
to authorize the Building Committee to direct the Village
Attorney to draft an ordinance following a recommendation
by the Building Committee, which ordinance would accompany
that Committee's report.

JUDICIARY COMMITTEE
Trustee Wattenberg presented wording to amend the Ethics
Ordinance, which amendment would prohibit former elected
officials and certain 'key' employees from representing,in
any manner,matters before commissions and board of the
Village.
Mr. Gerard Del Judis spoke in opposition to the proposed
amendment to the Ethics Ordinance relative to this matter.
Mr. Ed Miller, 131 Kenilworth, spoke in favor of the
proposed amendment.
Trustee.Wattenberg, seconded by Trustee Murauskis, moved for
concurrence with the recommendation of the Judiciary
Committee and direct the Village Attorney to draft an
amendment to the Ethics Ordinance to read "... no former
elected official or key employee will knowingly act as an
agent or attorney before any Board of Commission, with or
without compensation, following two years of such office
or employment".

PUBLIC WORKS COMMITTEE
Trustee Richardson, seconded by Trustee Hendricks, moved
to bring matters to the floor not listed on the agenda.

Motion carried.
Trustee Richardson noted that Cook County had recently
approved a 995 unit zoning case for the Rob Roy property
and requested that the Village of Mount Prospect
re -affirm action taken by the Village Board in 1975 that
the County buy the golf course.
Trustee Richardson, seconded by Trustee Floros, moved
that the Mayor and Board direct a letter to the
Commissioners re -affirming the previous policy of the
Board that all efforts be made by the County to maintain
Rob Roy as open space.

Motion carried.
Trustee Richardson stated that a recent court decision
upheld a gift requirement for developers, in the form of
land or money for schools or parks. Mayor Krause referred
that matter to the Judiciary Committee for further review.

Mayor Krause announced that the first 'Coffee with the
Mayor and Board' would be held for an informal discussion
with residents on Saturday, January 7, 1978.
